<Text>The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by sections 198(8) and 333(1) of the Town and Country Planning Act 1990<FootnoteRef Ref="f00001"/> and now exercisable by them<FootnoteRef Ref="f00002"/>, make the following Regulations.</Text>

<Text>Functions under those sections, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (<Citation URI="http://www.legislation.gov.uk/id/uksi/1999/672" id="c00004" Class="UnitedKingdomStatutoryInstrument" Year="1999" Number="0672">S.I. 1999/672</Citation>). By virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/2006/32" id="c00005" Year="2006" Number="0032" Class="UnitedKingdomPublicGeneralAct">2006 (c. 32)</Citation>, those functions are now exercisable by the Welsh Ministers.</Text>
