<Text>The title of these Regulations is the Town and Country Planning (Compensation) (Wales) (No. 2) Regulations 2012 and they come into force on 5 October 2012.</Text>

<Text>In these Regulations—</Text>

<Text>“the <Abbreviation Expansion="Town and Country Planning (General Permitted Development) Order 1995 (S.I. 1995/418)">1995 Order</Abbreviation>” (“<Emphasis><Abbreviation Expansion="Gorchymyn Cynllunio Gwlad a Thref (Datblygu Cyffredinol a Ganiateir) 1995 (O.S. 1995/418)">Gorchymyn 1995</Abbreviation></Emphasis>”) means the Town and Country Planning (General Permitted Development) Order 1995<FootnoteRef Ref="f00003"/>; and</Text>

<Text>“Schedule 2” (“<Emphasis>Atodlen 2</Emphasis>”) means Schedule 2 to the 1995 Order.</Text>

<Title>Prescribed development</Title>

<Pnumber>2</Pnumber>
<P1para>
<Text>For the purposes of paragraphs (2A)(a) and (3C)(a) of section 108 of the Act (compensation where development order or local development order withdrawn), development of the following description is prescribed—</Text>

<Pnumber>a</Pnumber>

<Text>development permitted by Part 1 of Schedule 2 (development within the curtilage of a dwellinghouse);</Text>
</P3para>
</P3>

<Text>development permitted by Class A of Part 8 of Schedule 2 (extension or alteration of an industrial building or a warehouse);</Text>
</P3para>
</P3>

<Text>development permitted by Part 32 of Schedule 2 (schools, colleges, universities and hospitals);</Text>

<Text>development permitted by Part 43 of Schedule 2 (installation of non-domestic microgeneration equipment).</Text>

<Title>Prescribed manner in which planning permission to be withdrawn</Title>

<Pnumber>3</Pnumber>
<P1para>
<Text>For the purposes of section 108(3C)(b) of the Act, the prescribed manner for withdrawing planning permission is by direction in accordance with articles 4, 5 and (as appropriate) 6 of the 1995 Order.</Text>

<P1group>
<Title>Notice of withdrawal-prescribed manner and period</Title>

<Pnumber>4</Pnumber>

<Text>For the purposes of section 108(3C)(c) of the Act—</Text>

<Text>For the purposes of section 108(3D)(c) of the Act—</Text>

<Title>Transitional provision</Title>

<Pnumber>6</Pnumber>
<P1para>
<Text>These Regulations do not apply in relation to any withdrawal of planning permission for development of a description prescribed in regulation 2(d) where, before 18 June 2012, either—</Text>

<Pnumber>a</Pnumber>

<Text>notice of the direction withdrawing that permission has been given in accordance with article 5 of the 1995 Order; or</Text>
</P3para>
</P3>

<Text>the direction is one to which article 6 of the 1995 Order (notice and confirmation of article 4(2) directions) applies and the direction has come into force.</Text>

<Title>Revocation</Title>

<Text>These Regulations prescribe various matters for the purposes of section 108 of the Town and Country Planning Act 1990.</Text>
</P>
<P>
<Text>Section 108 provides for the payment of compensation in certain cases where planning permission for development granted by a development order or a local development order is withdrawn and where on an application for planning permission for that development, the application is refused or permission is granted subject to conditions.</Text>
</P>
<P>
<Text>Section 108(2A) and (3B) to (3D) (as amended by the Planning Permission (Withdrawal of Development Order or Local Development Order) (Compensation) (Wales) Order 2012 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/wsi/2012/210" id="c00001" Year="2012" Number="0210" Class="WelshStatutoryInstrument" AlternativeNumber="W.36">2012/210 (W.36)</Citation>) limits the circumstances in which compensation is payable. These Regulations prescribe types of development for the purposes of section 108(2A) and (3C) (regulation 2), prescribe the manner in which planning permission is to be withdrawn (regulation 3) and prescribe the manner, and maximum period, in which notice of withdrawal, revocation, amendment or directions is to be given (regulations 4 and 5). The prescribed development now includes the installation of non-domestic microgeneration equipment.</Text>

<Text>Regulation 6 is a transitional provision.</Text>
</P>
<P>
<Text>These Regulations replace the Town and Country Planning (Compensation) (Wales) Regulations 2012 (S.I. <Citation URI="http://www.legislation.gov.uk/id/wsi/2012/789" id="c00002" Year="2012" Number="0789" Class="WelshStatutoryInstrument" AlternativeNumber="W.105">2012/789 (W.105)</Citation>) which are revoked by regulation 7.</Text>
