make the following Order.

Title, commencement, application and interpretation

1.(1)

The title of this Order is the Welsh Ministers and Local Health Boards (Transfer of Property, Rights and Liabilities) (Wales) Order 2012 and it comes into force on 1 June 2012.

This Order applies in relation to Wales.

(3)

In this Order:

“the transfer date” (“y dyddiad trosglwyddo”) means 1 June 2012;

“the Trust” (“yr Ymddiriedolaeth”) means Velindre National Health Service Trust established by the Velindre National Health Service Trust (Establishment) Order 1993

S.I. 1993/2838 as amended by S.I. 1999/826; S.I. 2002/442 (W.57); S.I.2002/2199 (W.219); S.I. 2009/2059 (W. 178) and S.I.2012/1262 (W.157).

Transfer of property, rights and liabilities

On the transfer date, the property listed in column 1 of Schedule 1, and any rights and liabilities arising from that property, will transfer from the Welsh Ministers to the Trust.

On the transfer date, the properties listed in column 2 of Schedule 2, and any rights and liabilities arising from those properties, will transfer from the Local Health Board listed in column 1 of that Schedule to the Trust.

The Trust must abide by the terms of any lease that has been transferred to it by virtue of articles 2 and 3.

Article 2 of this Order provides for the transfer, on 1 June 2012, of the property listed in column 1 of Schedule 1 (and rights and liabilities arising from the property), from the Welsh Ministers to Velindre National Health Service Trust (the Trust).

Article 3 provides for the transfer, on 1 June 2012, of the property listed in column 2 of Schedule 2 (and rights and liabilities arising from such property) from the Local Health Board listed in column 1 of that Schedule to the Trust.

Article 4 provides that the Trust must abide by the terms of any leases that have been transferred to the Trust by articles 2 and 3.
