The Special Educational Needs Tribunal for Wales (Amendment) Regulations 2012

The Welsh Ministers, in exercise of the powers conferred on them by sections 336(1) and (2) and 569(4) and (5) of the Education Act 19961 and after consulting the Administrative Justice and Tribunals Council in accordance with paragraph 24(1) of Schedule 7 to the Tribunals, Courts and Enforcement Act 20072, make the following Regulations.

Title, commencement and application1.

(1)

The title of these Regulations is the Special Educational Needs Tribunal for Wales (Amendment) Regulations 2012 and they come into force on 21 June 2012.

(2)

These Regulations apply in relation to Wales.

Amendments to the Special Educational Needs Tribunal for Wales Regulations 20122.

(1)

The Special Educational Needs Tribunal for Wales Regulations 20123 are amended as follows.

(2)

In regulation 13(4) (appeal application), in the Welsh text—

(a)

for sub-paragraph (c)(ii) substitute—

“(ii)

ysgol annibynnol, drwy gadarnhad ysgrifenedig bod y person sy'n gwneud yr apêl wedi hysbysu perchennog yr ysgol am fwriad y person i ofyn am enwi'r ysgol annibynnol yn y datganiad;”; and

(b)

after sub-paragraph (c)(ii) insert—

“(iii)

ysgol annibynnol, drwy gadarnhad ysgrifenedig gan berchennog yr ysgol bod lle ar gael yn yr ysgol i'r plentyn.”.

These Regulations amend the Special Educational Needs Tribunal for Wales Regulations 2012.

Regulation 2 of these Regulations makes amendments to correct errors in the Welsh text of the Special Educational Needs Tribunal for Wales Regulations 2012.
