The Education (Recognised Bodies) (Wales) Order 2012

The Welsh Ministers, in exercise of the powers conferred upon the Secretary of State by section 216(1) of the Education Reform Act 19881 and now vested in them2, make the following Order:

Title, commencement and application1.

(1)

The title of this Order is the Education (Recognised Bodies) (Wales) Order 2012 and it comes into force on 4 June 2012.

(2)

This Order applies in relation to Wales.

Recognised Bodies2.

The bodies that are specified in the Schedule to this Order are designated as bodies that appear to the Welsh Ministers to be recognised bodies.

Revocations3.

The following are revoked—

(This note is not part of the Order)

This Order lists all the bodies appearing to the Welsh Ministers to be recognised bodies within section 214 (2)(a) or (b) of the Education Reform Act 1988. Such bodies are either:

(a)

universities, colleges or bodies authorised by Royal Charter or by or under an Act of Parliament to grant degrees; or

(b)

bodies which are for the time being permitted by any body falling within paragraph (a) to act on its behalf in the granting of degrees.

The Order updates and replaces the list of bodies contained in the Education (Recognised Bodies) (Wales) Order 2007 ('the 2007 Order') which was amended by the Education (Recognised Bodies) (Wales) (Amendment) Order 2009 ('the 2009 Order'). This Order revokes the 2007 Order and the 2009 Order. A number of bodies are omitted from the Order as they no longer have degree awarding powers or have merged with other bodies. A number of new bodies have been inserted as these bodies now appear to the Welsh Ministers to fall within either (a) or (b) above. A number of minor amendments have also been made to take account of name changes since the 2007 Order was amended.

The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
