<Text>The Welsh Ministers make the following Regulations in exercise of the powers conferred on the Secretary of State by article 24 of the Regulatory Reform (Fire Safety) Order 2005<FootnoteRef Ref="f00001"/> and now vested in them<FootnoteRef Ref="f00002"/>.</Text>

<Text>In accordance with article 24(4) of that Order the Welsh Ministers have consulted such persons or bodies of persons as appeared to the Welsh Ministers to be appropriate.</Text>

<Title>Employer to take employees' capabilities into consideration</Title>

<Text>Every employer must, in entrusting tasks to employees, take into account their capabilities as regards health and safety, so far as those capabilities relate to fire.</Text>

<Text>The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.</Text>
