The Public Health Wales National Health Service Trust (Membership and Procedure) (Amendment) Regulations 2011

Coming into force
The Welsh Ministers make the following Regulations in exercise of the powers conferred on them by sections 18(4), 203(9) and (10) of and paragraph 4 of Schedule 3 to the National Health Service (Wales) Act 20061.

Title and commencement1.

(1)

The title of these Regulations is the Public Health Wales National Health Service Trust (Membership and Procedure) (Amendment) Regulations 2011.

(2)

These Regulations come into force on 23 June 2011.

Amendment of the Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 20092.

(1)

The Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 20092 are amended as follows.

(2)

In regulation 1(2) (interpretation), omit the definition of “trade union”.

(3)

In regulation 5(1) (non-executive directors), omit sub-paragraph (d).

(4)

In regulation 10 (termination of tenure of office of chair and non-executive directors), for regulation 10(8), substitute—

“Where the non-executive director referred to in sub-paragraph (c) of regulation 5(1) ceases to be a member or employee of a voluntary sector organisation in Wales, the Welsh Ministers will terminate his or her appointment as non-executive director.”.

In paragraph 2 of Schedule 1 (procedures for appointment of the chair and non-executive directors), for “members” substitute “directors”.

(6)

In paragraph 2(2) of Schedule 2 (rules as to meetings and proceedings of the Trust), for “members” substitute “directors”.

These Regulations amend the Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 2009 (S.I. 2009/1385 (W.141) by removing the requirement for the non-executive directors to include a person who is an officer of a trade union or other employee representative body representing staff of the Public Health Wales National Health Service Trust.

There are also minor amendments to regulation 1(2) (interpretation), paragraph 2 of Schedule 1,(procedures for appointment of the chair and non-executive directors), and paragraph 2(2) of Schedule 2 (rules as to meetings and proceedings of the Trust).
