<Title>Interpretation</Title>

<Text>In these Regulations—</Text>
<UnorderedList Decoration="none">
<ListItem>
<Para>
<Text>“the Act” (“ <Emphasis>y Ddeddf</Emphasis>”) means the Marine and Coastal Access Act 2009;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the appointed person” (“<Emphasis>y person penodedig</Emphasis>”) means the person appointed under regulation 5(1);</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“document” (“<Emphasis>dogfen</Emphasis>”) includes a map, photograph or report;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the Licensing Authority” (“<Emphasis>yr Awdurdod Trwyddedu</Emphasis>”) means the Welsh Ministers acting in their capacity as the appropriate licensing authority under section 113(4)(b) of the Marine and Coastal Access Act 2009;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“marine licence” (“<Emphasis>trwydded morol</Emphasis>” ) means a licence granted under Part 4 of the Act;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“relevant time limits” (“<Emphasis>terfynau amser perthnasol</Emphasis>”) means—</Text>

<Text>the time limits specified in these Regulations or in any direction given or requirement made by the appointed person by virtue of these Regulations;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>but sub-paragraph (a) is subject to regulation 25(1).</Text>
</Para>
</ListItem>

<Para>
<Text>“start date” (“<Emphasis>dyddiad dechrau</Emphasis>”) has the meaning given by regulation 8(3);</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“valid notice of appeal” (“<Emphasis>hysbysiad apêl dilys</Emphasis>”) means a notice of appeal that—</Text>

<Title>Appeal against marine licensing decisions</Title>

<Text>A person who has applied for a marine licence may by notice appeal to the Welsh Ministers against a decision taken under section 71 of the Act (refusal of licence or grant subject to conditions <Abbreviation Expansion="Et cetera" xml:lang="la">etc</Abbreviation>).</Text>

<Title>Determination by appointed person</Title>

<Text>The Welsh Ministers must appoint a person (“the appointed person”) to —</Text>

<Text>determine, upon receipt of a notice of appeal pursuant to regulation 4(1), whether the notice received is a valid notice of appeal and if so;</Text>

<Text>Appeals must be determined in accordance with these Regulations.</Text>

<Text>An appointment under paragraph (1)—</Text>

<Pnumber>a</Pnumber>

<Text>must be in writing;</Text>

<Text>may relate to any particular appeal specified in the appointment or to appeals of a class or description so specified;</Text>
</P3para>
</P3>

<Text>may be subject to such conditions as may be specified in the appointment;</Text>

<Text>may provide for payment to be made to the appointed person.</Text>

<Text>In respect of any appeal that has not been determined the Welsh Ministers may revoke an appointment under paragraph (1) if they are—</Text>

<Pnumber>a</Pnumber>

<Text>notified in writing by the appointed person; or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/925/regulation/5/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/925/regulation/5/4/b" id="regulation-5-4-b">
<Pnumber>b</Pnumber>

<Text>are otherwise satisfied;</Text>
</P3para>
</P3>
<Text>that the appointed person is unable to carry out the requirements of paragraph (1).</Text>

<Pnumber>5</Pnumber>

<Text>Where an appointment is so revoked in respect of any appeal, the Welsh Ministers must, as soon as practicable, appoint another person under paragraph (1) to determine the appeal.</Text>
</P2para>

<Pnumber>6</Pnumber>
<P2para>
<Text>Where a new appointment is made, the consideration of the appeal, or any hearing or inquiry in connection with it, must be begun afresh.</Text>
</P2para>
</P2>

<Text>But nothing in paragraph (6) requires any person to be given an opportunity to make fresh representations or comments or to modify or withdraw any representations or comments already made.</Text>

<Title>Establishing the hearing or inquiry</Title>

<Text>The appointed person must set a date for the hearing or inquiry (“the relevant date”).</Text>

<Text>The appointed person must, at least 6 weeks before the relevant date, give notice of the relevant date to the appellant, the Licensing Authority and any person who has made representations concerning the appeal.</Text>

<Title>Proofs of evidence — inquiries</Title>

<Text>This regulation applies where a person entitled to appear at an inquiry intends to give, or to call a witness to give, evidence at the inquiry.</Text>

<Text>Where a person gives evidence at an inquiry by reading a summary of a proof of evidence—</Text>

<Text>the proof of evidence is treated as tendered in evidence, unless the person required to provide the summary notifies the appointed person that the person now wishes to rely on the contents of that summary alone; and</Text>

<Text>The appointed person may allow any person to alter or add to that person’s proof of evidence or summary so far as may be necessary for the purposes of the inquiry.</Text>

<Text>Cross-examination is not permitted at a hearing unless the appointed person considers that it is required to ensure a thorough examination of the main issues.</Text>

<Text>If the appointed person considers that cross-examination is required, the appointed person must consider, after consulting the appellant and the Licensing Authority, whether to close the hearing and start an inquiry instead.</Text>

<Text>A person entitled to appear at an inquiry may cross-examine persons giving evidence, but the cross-examination of persons giving evidence at an inquiry is otherwise at the appointed person’s discretion.</Text>

<Text>The appointed person may take into account any written representation, evidence or any other document received from any person before or during a hearing or inquiry, provided that the appointed person discloses it at the hearing or inquiry.</Text>

<Title>Powers to exclude persons, evidence etc</Title>

<Text>These Regulations establish an appeals procedure in relation to decisions taken under section 71 of the Marine and Coastal Access Act 2009. They apply in relation to any licensable marine activity for which the Welsh Ministers are the appropriate licensing authority under section 113 of that Act.</Text>
</P>

<Text>Part 1 (regulations 1 to 3) deals with introductory matters.</Text>
</P>
<P>
<Text>Part 2 (regulations 4 and 5) contains provisions setting out a right of appeal to the Welsh Ministers against marine licensing decisions and requiring the Welsh Ministers to appoint a person to determine such appeals.</Text>
</P>
<P>
<Text>Part 3 (regulations 6 to 8) contains provisions relating to time limits for, and contents of, notices of appeal, and decisions as to appeal procedure.</Text>
</P>
<P>
<Text>Part 4 (regulations 9 and 10) contains provisions relating to notices, representations and comments.</Text>
</P>
<P>
<Text>Part 5 (regulations 11 to 20) contains provisions relating to hearings and inquiries.</Text>
