and 52(2) of the Mental Health (Wales) Measure 2010<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/mwa/2010/7">2010 nawm 7</ref>.</p></authorialNote>.</p><formula name="enactingText"><p>A draft of this instrument has been laid before the National Assembly for Wales in accordance with section 52(5)(b) of the Measure, and approved by resolution of the National Assembly for Wales.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Mental Health (Assessment of Former Users of Secondary Mental Health Services) (Wales) Regulations 2011 and they come into force on 6 June 2012.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply in relation to Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“adult” (“<i>oedolyn</i>”) means a person aged eighteen years or above who is entitled to a mental health assessment under section 22 (entitlement to assessment) of the Measure;</p></content></hcontainer><hcontainer name="definition"><content><p>“assessment report” (“<i>adroddiad o'r asesia</i>d”) means a single report in writing which records whether a mental health assessment has identified any services which might improve or prevent a deterioration in the mental health of an adult in accordance with section 25 (purpose of assessment) of the Measure;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Measure” (“<i>y Mesur</i>”) means the Mental Health (Wales) Measure 2010;</p></content></hcontainer><hcontainer name="definition"><content><p>“mental health assessment” (“<i>asesiad iechyd meddwl</i>”) means an analysis of an adult’s mental health for the purposes provided in section 25 of the Measure;</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant discharge period” (“<i>cyfnod rhyddhau perthnasol</i>”) means the period within which an adult may request that a mental health assessment is carried out following discharge from secondary mental health services; and</p></content></hcontainer><hcontainer name="definition"><content><p>“working day” (“<i>diwrnod gwaith</i>”) means any day except Saturday, Sunday, Christmas Day, Good Friday or a bank holiday in England and Wales under the Banking and Financial Dealings Act 1971<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1971/80">1971 c. 80</ref>.</p></authorialNote>.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Relevant discharge period</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>The relevant discharge period begins on the date on which an adult is discharged from secondary mental health services and ends upon the expiry of a period of three years from that date.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>But if an adult was discharged from secondary mental health services prior to the date of the coming into force of these Regulations, the relevant discharge period for that adult is as provided in regulation 6.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Provision of assessment report</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>A copy of an assessment report is to be provided to an adult who has had a mental health assessment no later than ten working days following the completion of the assessment.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>For the purposes of this regulation, the copy of the assessment report is provided on the day when it is—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>delivered by hand to an adult; or</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>sent by prepaid post addressed to an adult at that adult’s usual or last known residence.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Determination of usual residence</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>Where for the purposes of Part 3 (assessments of former users of secondary mental health services) of the Measure there is a question as to whether an adult’s usual residence lies within a local authority area (“local authority area A”), then the local authority for local authority area A (“local authority A”) is responsible for determining within which local authority area that adult usually resides in accordance with paragraph (2).</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>For the purposes of making a determination as provided in paragraph (1)—</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>an adult is to be deemed as usually resident at the address given by that adult to local authority A as being the address at which he or she usually resides;</p></content></level><level class="para1" eId="regulation-5-2-b"><num>(b)</num><content><p>where an adult gives no such address that adult is to be deemed as usually resident at the address which he or she gives to local authority A as being his or her most recent address;</p></content></level><level class="para1" eId="regulation-5-2-c"><num>(c)</num><content><p>where an adult’s usual residence cannot be determined under sub-paragraphs (a) or (b) above, that adult is to be deemed as usually resident in the area in which he or she is present.</p></content></level></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>Until such time as a determination of an adult’s usual residence is made under paragraph (1), that adult is deemed to be usually resident within local authority area A.</p></content></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>But where the local mental health partners for another local authority area (“local authority area B”) agree to act as the local mental health partners for an adult, then that adult is deemed to be usually resident within local authority area B.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Transitional provisions relating to the relevant discharge period</heading><num>6.</num><content><p>Where an adult has been discharged from secondary mental health services within two years prior to the date of the coming into force of these Regulations the relevant discharge period for that adult is the period of time beginning on the coming into force date of these Regulations and ending on the expiry of three years from that adult’s date of ukl:Name="P1" class="prov1"><num>1.</num><p>These Regulations contain provisions about mental health assessments for former users of secondary mental health services.</p></blockContainer><blockContainer ukl:Name="P1" class="prov1"><num>2.</num><p>Regulation 3 provides that the term of the relevant discharge period during which an adult is eligible for a mental health assessment following discharge from secondary mental health services is three years. Where an adult was discharged from secondary mental health services before the coming into force date of these Regulations, the term of any relevant discharge period for that adult is as provided in regulation 6.</p></blockContainer><blockContainer ukl:Name="P1" class="prov1"><num>3.</num><p>Regulation 4 provides for a copy of the assessment report to be provided no later than ten working days following the completion of an adult’s mental health assessment.</p></blockContainer><blockContainer ukl:Name="P1" class="prov1"><num>4.</num><p>Regulation 5 provides for the determination of an adult’s usual residence for the purposes of Part 3 (assessments of former users of secondary mental health services) of the Mental Health (Wales) Measure 2010, where there is a question about whether an adult’s usual residence is situated within a particular local authority area.</p></blockContainer><blockContainer ukl:Name="P1" class="prov1"><num>5.</num><p>Regulation 6 makes transitional provision relating to the relevant discharge period for an adult who has been discharged from secondary mental health services within two years prior to the coming into force date of these Regulations.</p></blockContainer><blockContainer ukl:Name="P1" class="prov1"><num>6.</num><p>A regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
