Section 3A was inserted by the Health Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/2009/21">2009 (c. 21)</ref>, section 22. <i>See</i> section 3A(8) for the definition of “the appropriate national authority”.</p></authorialNote>.</p><formula name="enactingText"><p>A draft of these Regulations was laid before, and approved by resolution of, the National Assembly for Wales in accordance with section 3A(7)(b) of that Act.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement, and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Protection from Tobacco (Sales from Vending Machines) (Wales) Regulations 2011 and they come into force on 1 February 2012.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply in relation to Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Prohibition of the sale of tobacco from vending machines</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The sale of tobacco<authorialNote class="footnote" eId="f00002" marker="2"><p>“Tobacco” has the same meaning as in section 7 of the Children and Young Persons Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1933/12">1933 (c. 12)</ref>.</p></authorialNote> from an automatic machine is prohibited.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>The person who controls, or is concerned with the management of, the premises where the automatic machine is located will be liable for a breach of paragraph (1)<authorialNote class="footnote" eId="f00003" marker="3"><p>In accordance with section 3A(3) of the Children and Young Persons (Protection from Tobacco) Act 1991, such person will be guilty of an offence if the prohibition in regulation 2(1) is breached. Pursuant to section 3A(4) of that Act a person guilty of an offence under section 3A(3) is liable on summary conviction to a fine not exceeding level 4 on the standard scale.</p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>In this regulation “premises” (“<i>mangre</i>”) includes any place and any vehicle, vessel, hovercraft, stall or moveable structure.</p></content></paragraph></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">Lesley Griffiths</signature></block><block name="role"><role refersTo="#">Minister for Health and Social Services, one of the Welsh Ministers</role></block><block name="date"><date date="2011-10-18">18 October 2011</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations prohibit the sale of tobacco from an automatic machine.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2 prohibits the sale of tobacco from an automatic machine. Liability for a breach of this prohibition will fall on the person who controls or manages the premises in which the automatic machine is located.</p></blockContainer><blockContainer ukl:Name="P"><p>A draft of these Regulations has been notified to the European Commission as a technical standard pursuant to Directive <ref eId="c00001" href="http://www.legislation.gov.uk/european/directive/1998/0034">98/34/<abbr class="acronym" title="European Community">EC</abbr></ref> of the European Parliament and the Council (<abbr class="acronym" title="Official Journal">OJ</abbr> No L204, 21.7.1998, p.37), laying down a procedure for the provision of information in the field of technical standards and regulations, as amended.</p></blockContainer><blockContainer ukl:Name="P"><p>A full regulatory impact assessment of the effect that this instrument will have on the costs of business has been prepared and has been placed in the library of the National Assembly for Wales.
