designated <CommentaryRef Ref="c20967661"/> for the purposes of section 2(2) of the European Communities Act 1972 <CommentaryRef Ref="c20967671"/> in relation to the common agricultural policy of the European Union.</Text></Para><Para><BlockText><Para><Text>These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Welsh Ministers that it is expedient for references in these Regulations to the following Regulations to be construed as references to those Regulations as amended from time to time—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>Part B of Annex <Acronym Expansion="14">XIV</Acronym> to Council Regulation <Citation URI="http://www.legislation.gov.uk/id/eur/2007/1234" id="c00001" Class="EuropeanUnionRegulation" Year="2007" Number="1234">(<Acronym Expansion="European Community">EC</Acronym>) No 1234/2007</Citation> <CommentaryRef Ref="c20967681"/> establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation); and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>Commission Regulation <Citation URI="http://www.legislation.gov.uk/id/eur/2008/543" id="c00002" Class="EuropeanUnionRegulation" Year="2008" Number="543">(EC) No 543/2008</Citation> <CommentaryRef Ref="c20967691"/> laying down detailed rules for the application of Council Regulation <Citation poultrymeat.</Text></Para></ListItem></OrderedList></BlockText></Para><Para><Text>Insofar as these Regulations are made in exercise of powers under the Food Safety Act 1990 <CommentaryRef Ref="c20967701"/>, the Welsh Ministers have had regard to relevant advice given by the Food Standards Agency as required by section 48(4A) <CommentaryRef Ref="c20967711"/> of the Food Safety Act 1990.</Text></Para><Para><Text>There has been open and transparent public consultation during the preparation of the following Regulations as required by Article 9 of Regulation <Citation URI="http://www.legislation.gov.uk/id/eur/2002/178" id="c00004" Class="EuropeanUnionRegulation" Year="2002" Number="178">(EC) No 178/2002</Citation> of the European Parliament and of the Council <CommentaryRef Ref="c20967721"/> laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.</Text></Para><Para><Text>The Welsh Ministers, in whom the powers conferred by sections 6(4), 16(1), 17, 26(2) and (3), 45(1) and 48(1) <CommentaryRef Ref="c20967731"/> of the Food Safety Act 1990 are now vested <CommentaryRef Ref="c20967741"/>, make these Regulations in exercise of those powers and the powers conferred by section 2(2) of, and paragraph 1A <CommentaryRef Ref="c20967751"/> ChangeId="key-dd96e5e48ea6fc6707a05b63212228bc-1541670643501" CommentaryRef="key-dd96e5e48ea6fc6707a05b63212228bc">XIV</Substitution><Substitution ChangeId="key-dd96e5e48ea6fc6707a05b63212228bc-1541670643501" CommentaryRef="key-dd96e5e48ea6fc6707a05b63212228bc"> to the Single CMO Regulation</Substitution>.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/1/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/1/4" id="regulation-1-4"><Pnumber>4</Pnumber><P2para><Text>These Regulations do not apply to the direct supply of small quantities of poultrymeat by a producer with an annual production of under 10,000 birds where the meat—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/1/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/1/4/a" id="regulation-1-4-a"><Pnumber>a</Pnumber><P3para><Text>comes from poultry slaughtered on the producer's farm; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/1/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/1/4/b" id="regulation-1-4-b"><Pnumber>b</Pnumber><P3para><Text>is supplied to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/1/4/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/1/4/b/i" id="regulation-1-4-b-i"><Pnumber>i</Pnumber><P4para><Text>the final consumer; or</Text></P4para></P4><P4 id="regulation-1-4-b-ii"><Pnumber>ii</Pnumber><P4para><Text>a local retail establishment directly supplying such meat to the final consumer as fresh meat.</Text></P4para></P4></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2024-01-01"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text></P2para></P2><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-agency">the Agency</Term>” (“<Term id="term-yr-asiantaeth"><Emphasis>yr Asiantaeth</Emphasis></Term>”) means the Food Standards Agency;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-authorised-officer">authorised officer</Term>” (“<Term id="term-swyddog-awdurdodedig"><Emphasis>swyddog awdurdodedig</Emphasis></Term>”) means any person who has written authority from an enforcement authority to act in matters arising under these Regulations;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-commission-regulation">Commission Regulation</Term>” (“<Term id="term-rheoliad-y-comisiwn"><Emphasis>Rheoliad y Comisiwn</Emphasis></Term>”) means Commission Regulation <Citation URI="http://www.legislation.gov.uk/id/eur/2008/543" id="c00005" Class="EuropeanUnionRegulation" Year="2008" Number="543">(EC) No 543/2008</Citation> laying down detailed rules for the application of Council Regulation <Citation URI="http://www.legislation.gov.uk/id/eur/2007/1234" id="c00006" Class="EuropeanUnionRegulation" Year="2007" Number="1234">(EC) No 1234/2007</Citation> as regards the marketing standards for poultrymeat, as amended from time to time;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-contravene">contravene</Term>” (“<Term id="term-torri"><Emphasis>torri</Emphasis></Term>”) includes failure to comply, and  “<Term id="term-contravention">contravention</Term>” (“<Term id="term-toriad"><Emphasis>toriad</Emphasis></Term>”) is to be construed accordingly;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-enforcement-authority">enforcement authority</Term>” (“<Term id="term-awdurdod-gorfodi"><Emphasis>awdurdod gorfodi</Emphasis></Term>”) means an authority exercising a function conferred on it by regulation 9;</Text></Para></ListItem><ListItem><Para><Text> <Substitution ChangeId="key-06cc3929f9175dd94e8a17b4949ed87c-1710416240731" CommentaryRef="key-06cc3929f9175dd94e8a17b4949ed87c">“</Substitution><Term id="term-assimilated-poultrymeat-provision"><Substitution ChangeId="key-06cc3929f9175dd94e8a17b4949ed87c-1710416240731" CommentaryRef="key-06cc3929f9175dd94e8a17b4949ed87c">assimilated poultrymeat provision</Substitution></Term><Substitution ChangeId="key-06cc3929f9175dd94e8a17b4949ed87c-1710416240731" CommentaryRef="key-06cc3929f9175dd94e8a17b4949ed87c">” (“</Substitution><Term id="term-darpariaeth-cig-dofednod-a-gymathwyd"><Substitution ChangeId="key-06cc3929f9175dd94e8a17b4949ed87c-1710416240731" CommentaryRef="key-06cc3929f9175dd94e8a17b4949ed87c">darpariaeth cig dofednod a gymathwyd</Substitution></Term><Substitution ChangeId="key-06cc3929f9175dd94e8a17b4949ed87c-1710416240731" CommentaryRef="key-06cc3929f9175dd94e8a17b4949ed87c">”)</Substitution>   means a provision of the Single CMO Regulation  <Addition ChangeId="key-90cbdbe452c47a4e29296e914085afc9-1541670928208" CommentaryRef="key-90cbdbe452c47a4e29296e914085afc9">or Regulation (</Addition><Addition ChangeId="key-90cbdbe452c47a4e29296e914085afc9-1541670928208" CommentaryRef="key-90cbdbe452c47a4e29296e914085afc9">EU</Addition><Addition ChangeId="key-90cbdbe452c47a4e29296e914085afc9-1541670928208" CommentaryRef="key-90cbdbe452c47a4e29296e914085afc9">) 2013</Addition> or the Commission Regulation specified in column 1 of Part 1 or 2 of Schedule 1, as read with any provision mentioned in the corresponding entry in column 2 of Part 1 or 2 of that Schedule;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-officer">officer</Term>” (“<Term id="term-swyddog"><Emphasis>swyddog</Emphasis></Term>”)—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>in relation to a body corporate, means a director, member of the committee of management, chief executive, manager, secretary or other similar officer of the body; and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in relation to an unincorporated body, means any member of its governing body or a chief executive, manager or other similar officer of the RestrictStartDate="2011-08-15"><Title>Temperature requirement for fresh poultrymeat</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/4" Regulation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/5" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/5" id="regulation-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>The Welsh Ministers are designated as the competent authority for the purpose of registration of slaughterhouses and producers as required by id="regulation-5-4-c"><Pnumber>c</Pnumber><P3para><Text>the right of appeal conferred by regulation 6 in the case of any refusal of registration.</Text></P3para></P3></P2para></P2><P2 person who is aggrieved about a decision specified in paragraph (2) may appeal against that decision to a magistrates' court.</Text></P2para></P2><P2 procedure on an appeal to a magistrates' court under paragraph (1) is by way of complaint and the Magistrates' Courts Act 1980 <CommentaryRef Ref="c20967771"/> applies to the proceedings.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/6/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/6/4" id="regulation-6-4"><Pnumber>4</Pnumber><P2para><Text>The period within which an appeal may be brought against a decision specified in paragraph (2) is 28 days, beginning with the day on which RestrictStartDate="2011-08-15"><Title>Powers of a magistrates' court on appeal</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/7" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/7" id="regulation-7"><Pnumber>7</Pnumber><P1para><Text>On an appeal against a decision by the Welsh Ministers mentioned in regulation 6(2) the magistrates' court may either overturn the decision or confirm the decision.</Text></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Water content checks</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/8" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/8" id="regulation-8"><Pnumber>8</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/8/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/8/1" id="regulation-8-1"><Pnumber>1</Pnumber><P2para><Text>Except where a water content check required by Article 16(1), (2), (3) or (4) or 20(2), (3) and (4) of the Commission Regulation is carried out by the Agency, such a check must be carried out by the food business operator of the slaughterhouse or cutting plant concerned.</Text></P2para></P2><P2 Agency must enforce the   <Substitution ChangeId="key-d7b15020a75b1cf16c90faed0f915c2b-1710761202907" CommentaryRef="key-d7b15020a75b1cf16c90faed0f915c2b">assimilated</Substitution>   poultrymeat provisions at slaughterhouses and cutting plants.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/2" id="regulation-9-2"><Pnumber>2</Pnumber><P2para><Text>Subject to paragraphs (3) and (4), a food authority must enforce—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/2/a" id="regulation-9-2-a"><Pnumber>a</Pnumber><P3para><Text>the   <Substitution ChangeId="key-d8332ecf3fd54205e8b7a21472d191bb-1710761224505" CommentaryRef="key-d8332ecf3fd54205e8b7a21472d191bb">assimilated</Substitution>   poultrymeat provisions in its area (other than at slaughterhouses and cutting plants); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/2/b" id="regulation-9-2-b"><Pnumber>b</Pnumber><P3para><Text>regulation 4.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/3" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/3" id="regulation-9-3"><Pnumber>3</Pnumber><P2para><Text>A port health authority must enforce these Regulations in its district in relation to poultrymeat imported from a third country.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/4" id="regulation-9-4"><Pnumber>4</Pnumber><P2para><Text>The record keeping requirements in Article 12(2) and (4) of the Commission Regulation must be enforced by the Welsh Ministers.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/9/5" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/9/5" id="regulation-9-5"><Pnumber>5</Pnumber><P2para><Text>In this regulation—</Text></P2para></P2><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-food-authority">food authority</Term>” (“<Term id="term-awdurdod-bwyd"><Emphasis>awdurdod bwyd</Emphasis></Term>”) has the meaning that it bears by virtue of section 5(1A) of the Food Safety Act 1990;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-port-health-authority">port health authority</Term>” (“<Term id="term-awdurdod-iechyd-porthladd"><Emphasis>awdurdod iechyd porthladd</Emphasis></Term>”) means in relation to any port health district constituted by order under section 2(3) of the Public Health (Control of Disease) Act 1984 <CommentaryRef Ref="c20967791"/>, a port health authority for that district constituted by order under section 2(4) of that Act.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Duty to give assistance and provide information</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/10" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/10" id="regulation-10"><Pnumber>10</Pnumber><P1para><Text>Each enforcement authority must give such assistance and information to any other enforcement authority as that authority may reasonably require for the purpose of helping that authority perform their duties under these Regulations.</Text></P1para></P1></P1group><P1group RestrictStartDate="2020-12-31"><Title>Powers of entry</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11" id="regulation-11"><Pnumber>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>An authorised officer may enter any premises (except premises used as a private dwelling house) at any reasonable hour for the purpose of ensuring that the provisions of these Regulations are being complied with.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>The authorised officer may be accompanied by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/2/a" id="regulation-11-2-a"><Pnumber>a</Pnumber><P3para><Text>such other persons as the authorised officer considers necessary; <CommentaryRef . . . . . . . . . . . . . . . . . . . . . . . . . .</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/3" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/3" id="regulation-11-3"><Pnumber>3</Pnumber><P2para><Text>An authorised officer must not exercise the powers under paragraph (1) or (2) except on the production, if so required, of a duly authenticated document showing the officer's authority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/4" id="regulation-11-4"><Pnumber>4</Pnumber><P2para><Text>Admission to any premises used as a private dwelling house may not be demanded as of right unless entry is in accordance with a warrant granted under this regulation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/5" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/5" id="regulation-11-5"><Pnumber>5</Pnumber><P2para><Text>If a justice of the peace, on sworn information in writing, is satisfied of the matters mentioned in paragraph (6), the justice may sign a warrant permitting an authorised officer to enter any premises, if need be by reasonable force.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/6" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/6" id="regulation-11-6"><Pnumber>6</Pnumber><P2para><Text>The matters are that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/6/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/6/a" id="regulation-11-6-a"><Pnumber>a</Pnumber><P3para><Text>there are reasonable grounds for believing that Condition A or B is met; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/6/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/6/b" id="regulation-11-6-b"><Pnumber>b</Pnumber><P3para><Text>Condition C, D, E or F is met.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/7" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/7" id="regulation-11-7"><Pnumber>7</Pnumber><P2para><Text>Condition A is that on the premises there are items of the type mentioned in regulation 12(1)(a) or documents or records of the type mentioned in regulation 12(1)(d) and that their inspection is likely to disclose evidence of a contravention of these Regulations.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/8" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/8" id="regulation-11-8"><Pnumber>8</Pnumber><P2para><Text>Condition B is that a contravention of these Regulations has occurred, is occurring or is about to occur on those premises.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/9" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/9" id="regulation-11-9"><Pnumber>9</Pnumber><P2para><Text>Condition C is that admission to the premises has been, or is likely to be, refused, and that the occupier has been informed (whether orally or in writing) that a warrant may be applied for.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/10" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/10" id="regulation-11-10"><Pnumber>10</Pnumber><P2para><Text>Condition D is that admission to the premises has been, or is likely to be, refused, and informing the occupier that a warrant under this regulation may be applied for may defeat the object of the entry.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/11" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/11" id="regulation-11-11"><Pnumber>11</Pnumber><P2para><Text>Condition E is that the premises are unoccupied or that the occupier is temporarily absent and it may defeat the object of the entry to await the occupier's return.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/12" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/12" id="regulation-11-12"><Pnumber>12</Pnumber><P2para><Text>Condition F is that the premises are used as a private dwelling house.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/13" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/13" id="regulation-11-13"><Pnumber>13</Pnumber><P2para><Text>A warrant granted under paragraph (5)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/13/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/13/a" id="regulation-11-13-a"><Pnumber>a</Pnumber><P3para><Text>is valid for one month, beginning with the day on which it is granted; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/13/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/13/b" id="regulation-11-13-b"><Pnumber>b</Pnumber><P3para><Text>must be produced for inspection to the person (if there is one) who appears to the officer to be the occupier, or the person in charge of the premises.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/11/14" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/11/14" id="regulation-11-14"><Pnumber>14</Pnumber><P2para><Text>An authorised officer who enters any premises that are unoccupied or where the occupier is temporarily absent must leave the premises as effectively secured against unauthorised entry as when the officer found them.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2020-12-31"><Title>Powers of an authorised officer</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12" id="regulation-12"><Pnumber>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1" id="regulation-12-1"><Pnumber>1</Pnumber><P2para><Text>An authorised officer (“O”) entering premises under regulation 11 may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a" id="regulation-12-1-a"><Pnumber>a</Pnumber><P3para><Text>inspect the premises, and any plant, machinery or equipment on those premises, and any of the following found on those premises—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a/i" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a/i" id="regulation-12-1-a-i"><Pnumber>i</Pnumber><P4para><Text>any meat that O has reasonable grounds for believing is poultrymeat (including giblets and any packaging in which the meat is found);</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a/ii" id="regulation-12-1-a-ii"><Pnumber>ii</Pnumber><P4para><Text>any empty container;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a/iii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a/iii" id="regulation-12-1-a-iii"><Pnumber>iii</Pnumber><P4para><Text>any label;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a/iv" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a/iv" id="regulation-12-1-a-iv"><Pnumber>iv</Pnumber><P4para><Text>any packaging; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/a/v" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/a/v" id="regulation-12-1-a-v"><Pnumber>v</Pnumber><P4para><Text>any live poultry;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/b" id="regulation-12-1-b"><Pnumber>b</Pnumber><P3para><Text>search the premises;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/c" id="regulation-12-1-c"><Pnumber>c</Pnumber><P3para><Text>carry out any inquiries, examinations or tests;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/d" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/d" id="regulation-12-1-d"><Pnumber>d</Pnumber><P3para><Text>have access to, and inspect and copy, any documents or records (in whatever form they are held) relating to matters covered by these Regulations, and remove them to enable them to be copied;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/e" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/e" id="regulation-12-1-e"><Pnumber>e</Pnumber><P3para><Text>have access to, and inspect and check the data on, and operation of, any computer, and any associated electronic storage device or apparatus (“computer equipment”) that is, or has been in use in connection with, the documents or records mentioned in sub-paragraph (d), including data relating to deleted files and activity logs; and for this purpose O may require any person having charge of, or otherwise concerned with the operation of, the computer equipment to afford to O such assistance (including the provision of passwords) as O may reasonably require, and, during the course of the checks, O may recover data held on the computer equipment; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/1/f" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/1/f" id="regulation-12-1-f"><Pnumber>f</Pnumber><P3para><Text>where a document or record mentioned in sub-paragraph (d) is kept by means of a computer, require the record to be produced in a form in which it may be taken away.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/2" id="regulation-12-2"><Pnumber>2</Pnumber><P2para><Text>O may direct a person appearing to O to be in charge of the items or premises mentioned below that the following must be left undisturbed for as long as is reasonably necessary for the purpose of any examination or investigation—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/2/a" id="regulation-12-2-a"><Pnumber>a</Pnumber><P3para><Text>any one or more of the items mentioned in paragraph (1)(a)(i) to (v); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/2/b" id="regulation-12-2-b"><Pnumber>b</Pnumber><P3para><Text>any premises on or in which any of those items are found.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/3" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/3" id="regulation-12-3"><Pnumber>3</Pnumber><P2para><Text>Where O gives a person a direction under paragraph (2) those items which are the subject of the direction must be kept on the premises at that person's expense.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/4" id="regulation-12-4"><Pnumber>4</Pnumber><P2para><Text>O may seize and detain any item of the type mentioned in paragraph (1)(a)(i) to (iv) or document or record mentioned in paragraph (1)(d) that O has reason to believe may be required as evidence in proceedings under these Regulations.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/5" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/5" id="regulation-12-5"><Pnumber>5</Pnumber><P2para><Text>O may seize as liable to destruction any item of the type mentioned in paragraph (1)(a)(i) to (iv) that O reasonably believes contravenes any provision of these Regulations.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/6" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/6" id="regulation-12-6"><Pnumber>6</Pnumber><P2para><Text>O may seize any computer equipment for the purpose of copying documents or records of the type mentioned in paragraph (1)(d), and for checking the data on, and operation of, any computer equipment that is, or has been, in use in connection with those documents or records (and in doing so may recover data), provided the equipment is returned as soon as practicable and, in any event, within 14 days, beginning with the day on which the equipment is seized.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7" id="regulation-12-7"><Pnumber>7</Pnumber><P2para><Text>If O is not able to remove an item or computer equipment seized under paragraph (4), (5) or (6) immediately, O may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7/a" id="regulation-12-7-a"><Pnumber>a</Pnumber><P3para><Text>mark it in any way that O sees fit; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7/b" id="regulation-12-7-b"><Pnumber>b</Pnumber><P3para><Text>give the person appearing to O to be in charge of the item or computer equipment a notice (“a regulation 12(7) notice”)—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7/b/i" id="regulation-12-7-b-i"><Pnumber>i</Pnumber><P4para><Text>identifying it;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7/b/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7/b/ii" id="regulation-12-7-b-ii"><Pnumber>ii</Pnumber><P4para><Text>requiring the item or computer equipment to be left undisturbed until it is collected by O; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/7/b/iii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/7/b/iii" id="regulation-12-7-b-iii"><Pnumber>iii</Pnumber><P4para><Text>prohibiting the removal of the item or computer equipment from the premises on which it was found until it is collected by O.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/8" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/8" id="regulation-12-8"><Pnumber>8</Pnumber><P2para><Text>Where, in accordance with Article 8 of the Commission Regulation, O has checked a batch of poultrymeat and is satisfied that it does not comply with the requirements of Article 1 or 7 of the Commission Regulation, O may direct any person appearing to O to be in charge of the batch or premises not to market or import that batch until such time as proof has been produced to the enforcement authority that it has been made to comply with those requirements.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/9" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/9" id="regulation-12-9"><Pnumber>9</Pnumber><P2para><Text>O may give such directions as O thinks appropriate in relation to a batch of poultrymeat to which paragraph (10) applies—</Text><P3 16(6) of the Commission Regulation; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/9/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/9/b" id="regulation-12-9-b"><Pnumber>b</Pnumber><P3para><Text>to ensure that it is exported to a third country.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/10" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/10" id="regulation-12-10"><Pnumber>10</Pnumber><P2para><Text>This paragraph applies to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/10/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/10/a" id="regulation-12-10-a"><Pnumber>a</Pnumber><P3para><Text>a batch of frozen or quick-frozen chickens that is deemed, after counter-analysis, not to comply with Article 15(1) of the Commission Regulation;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/12/10/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/12/10/b" id="regulation-12-10-b"><Pnumber>b</Pnumber><P3para><Text>an imported batch of frozen or quick-frozen chickens that is found 2013</Substitution>.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Procedure on seizure</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13" id="regulation-13"><Pnumber>13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/1" id="regulation-13-1"><Pnumber>1</Pnumber><P2para><Text>An authorised officer (“O”) must follow the procedures set out in this regulation if O seizes anything under regulation 12(4), (5) or (6).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>O must give to the person appearing to O to be in charge of the premises from which the item or computer equipment was seized (“<Term id="term-the-premises">the premises</Term>”) a notice that must state—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/2/a" id="regulation-13-2-a"><Pnumber>a</Pnumber><P3para><Text>what O has seized;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/2/b" id="regulation-13-2-b"><Pnumber>b</Pnumber><P3para><Text>when O seized it;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/2/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/2/c" id="regulation-13-2-c"><Pnumber>c</Pnumber><P3para><Text>the grounds for the seizure of the item or equipment; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/2/d" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/2/d" id="regulation-13-2-d"><Pnumber>d</Pnumber><P3para><Text>the address to which, and the period during which, a claim may be made for the return of the item or equipment.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/3" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/3" id="regulation-13-3"><Pnumber>3</Pnumber><P2para><Text>But where the premises are unoccupied, or no-one appears to O to be in charge of the premises, O must attach a notice to a conspicuous part of the premises containing the information mentioned in sub-paragraphs (a) to (d) of paragraph (2).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/4" id="regulation-13-4"><Pnumber>4</Pnumber><P2para><Text>A person having a proprietary interest in the seized item or computer equipment (including a creditor who has a debt secured on the item or equipment) may notify O of any claim that the seized item, document or record, or equipment was not liable to seizure, setting out the grounds for the claim in full.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/5" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/5" id="regulation-13-5"><Pnumber>5</Pnumber><P2para><Text>The claim must be made within 14 days of the seizure, beginning on the day on which the item or computer equipment was seized, to the address specified in the seizure notice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/6" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/6" id="regulation-13-6"><Pnumber>6</Pnumber><P2para><Text>If a notification of a claim is not received within 14 days in respect of an item seized under regulation 12(4), the enforcement authority may retain the seized item for as long as necessary while it is being held for the purpose of any criminal investigation or proceedings or for use as evidence at a trial.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/7" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/7" id="regulation-13-7"><Pnumber>7</Pnumber><P2para><Text>If a notification of a claim is received within 14 days in respect of an item seized under regulation 12(4), the enforcement authority must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/7/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/7/a" id="regulation-13-7-a"><Pnumber>a</Pnumber><P3para><Text>return the seized item within 7 days, beginning with the day on which the claim is received; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/7/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/7/b" id="regulation-13-7-b"><Pnumber>b</Pnumber><P3para><Text>retain the seized item for as long as necessary while it is being held for the purpose of any criminal investigation or proceedings, or for use as evidence at a trial, but it must notify the claimant that the seized item is being retained, and of the reason why it is being retained within 28 days, beginning with the day on which the claim is received.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8" id="regulation-13-8"><Pnumber>8</Pnumber><P2para><Text>If a notification of a claim is not received within 14 days in respect of an item seized under regulation 12(5), the enforcement authority may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/a" id="regulation-13-8-a"><Pnumber>a</Pnumber><P3para><Text>if a decision is taken by the enforcement authority not to destroy the seized item but to retain it for the purpose of any criminal investigation or proceedings, or for use as evidence at a trial, retain the seized item for as long as necessary for one of those purposes, but the enforcement authority must—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/a/i" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/a/i" id="regulation-13-8-a-i"><Pnumber>i</Pnumber><P4para><Text>notify the relevant person that the seized item is being retained, and of the reason why it is being retained, within 14 days of the expiry of the claim period, beginning with the day after the claim period expires; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/a/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/a/ii" id="regulation-13-8-a-ii"><Pnumber>ii</Pnumber><P4para><Text>where the enforcement authority does not know who the relevant person is, and this cannot be ascertained after reasonable enquiries have been made by the enforcement authority, attach a notice to a conspicuous part of the premises, or a conspicuous object on those premises, within 14 days of the expiry of the claim period, beginning with the day after the claim period expires, stating that the seized item is being retained, and the reason why it is being retained; or</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/b" id="regulation-13-8-b"><Pnumber>b</Pnumber><P3para><Text>destroy the seized item within 14 days, beginning with the day after the 14 day claim period expires, but the enforcement authority must—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/b/i" id="regulation-13-8-b-i"><Pnumber>i</Pnumber><P4para><Text>notify the relevant person that the seized item has been destroyed within 14 days of its destruction, beginning with the day on which the item is destroyed (or the last day of destruction where the destruction of the item takes place on more than one day); or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/8/b/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/8/b/ii" id="regulation-13-8-b-ii"><Pnumber>ii</Pnumber><P4para><Text>where the enforcement authority does not know who the relevant person is, and this cannot be ascertained after reasonable enquiries have been made by the enforcement authority, attach a notice to a conspicuous part of the premises, or to a conspicuous object on those premises, within 14 days of the destruction of the item, beginning with the day on which the item is destroyed (or the last day of destruction where the destruction of the item takes place on more than one day) stating that the seized item has been destroyed.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/9" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/9" id="regulation-13-9"><Pnumber>9</Pnumber><P2para><Text>In paragraph (8) the  “<Term id="term-relevant-person">relevant person</Term>” (“<Term id="term-person-perthnasol"><Emphasis>person perthnasol</Emphasis></Term>”) means—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/9/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/9/a" id="regulation-13-9-a"><Pnumber>a</Pnumber><P3para><Text>if the enforcement authority knows the identity of a person with a proprietary interest in the seized item, that person or (where the enforcement authority knows the identity of more than one person with a proprietary interest in the seized item) each of those persons; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/9/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/9/b" id="regulation-13-9-b"><Pnumber>b</Pnumber><P3para><Text>if the enforcement authority does not know the identity of a person with a proprietary interest in the seized item, the person appearing to the enforcement authority to be in charge of the premises.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10" id="regulation-13-10"><Pnumber>10</Pnumber><P2para><Text>In the case of any item destroyed under paragraph (8)(b), the enforcement authority may recover the following costs as a debt from any person who had a proprietary interest in the item immediately before its destruction (apart from a creditor who has a debt secured on the item)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10/a" id="regulation-13-10-a"><Pnumber>a</Pnumber><P3para><Text>the costs of the removal and transport of the item from the premises to the place at which it is stored;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10/b" id="regulation-13-10-b"><Pnumber>b</Pnumber><P3para><Text>the costs of the storage of the item for up to 14 days;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10/c" id="regulation-13-10-c"><Pnumber>c</Pnumber><P3para><Text>any costs for the removal and transport of the item if it is moved from one place of storage to another place of storage;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10/d" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10/d" id="regulation-13-10-d"><Pnumber>d</Pnumber><P3para><Text>the costs of the transport of the item from the place of storage to the place of destruction; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/10/e" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/10/e" id="regulation-13-10-e"><Pnumber>e</Pnumber><P3para><Text>the costs of the destruction of the item.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/11" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/11" id="regulation-13-11"><Pnumber>11</Pnumber><P2para><Text>If a notification of a claim is received within 14 days in respect of an item seized under regulation 12(5), the enforcement authority must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/11/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/11/a" id="regulation-13-11-a"><Pnumber>a</Pnumber><P3para><Text>return the seized item within seven days, beginning with the day on which the claim is received;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/11/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/11/b" id="regulation-13-11-b"><Pnumber>b</Pnumber><P3para><Text>if a decision is taken by the enforcement authority not to destroy the seized item but to retain it for the purpose of any criminal investigation or proceedings or for use as evidence at a trial, retain the item for as long as necessary for one of those purposes but the enforcement authority must notify the claimant that the seized item is being retained, and of the reason why it is being retained, within seven days of the claim, beginning with the day on which the claim is received; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/11/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/11/c" id="regulation-13-11-c"><Pnumber>c</Pnumber><P3para><Text>within 14 days of the claim, beginning with the day on which the claim is received, take proceedings (“regulation 13(11)(c) proceedings”) in a magistrates' court for an order giving authority to destroy the item.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/12" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/12" id="regulation-13-12"><Pnumber>12</Pnumber><P2para><Text>In regulation 13(11)(c) proceedings the magistrates' court may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/12/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/12/a" id="regulation-13-12-a"><Pnumber>a</Pnumber><P3para><Text>authorise the enforcement authority to destroy the seized item;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/12/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/12/b" id="regulation-13-12-b"><Pnumber>b</Pnumber><P3para><Text>authorise the enforcement authority to retain the item for the purpose of any criminal investigation or proceedings, or for use as evidence at a trial, for as long as necessary for one of those purposes; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/12/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/12/c" id="regulation-13-12-c"><Pnumber>c</Pnumber><P3para><Text>require the enforcement authority to return the item to the claimant and impose a deadline by which this must be done.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/13" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/13" id="regulation-13-13"><Pnumber>13</Pnumber><P2para><Text>If, in regulation 13(11)(c) proceedings, the magistrates' court authorises the enforcement authority to destroy the seized item, it may also make an order requiring the claimant (but not a claimant who is a creditor with a debt secured on the item) to pay such of the costs listed in paragraph (10) as the court may specify.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/14" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/14" id="regulation-13-14"><Pnumber>14</Pnumber><P2para><Text>Where a person with a proprietary interest in an item seized under regulation 12(5) does not intend to make a claim under paragraph (4), that person may notify the enforcement authority of this in writing, and the enforcement authority may (but does not have to) proceed in one of the ways specified in paragraph (8) without waiting for the 14 day claim period to expire upon receiving—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/14/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/14/a" id="regulation-13-14-a"><Pnumber>a</Pnumber><P3para><Text>written confirmation from that person that no-one else has a proprietary interest in that item (or that all those with a proprietary interest in the item are content for the enforcement authority to proceed without waiting for the 14 day claim period to expire); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/14/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/14/b" id="regulation-13-14-b"><Pnumber>b</Pnumber><P3para><Text>a written indemnity from that person against any claim made by another person with a proprietary interest in the item arising as a consequence of the enforcement authority proceeding without waiting for the 14 day claim period to expire.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/15" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/15" id="regulation-13-15"><Pnumber>15</Pnumber><P2para><Text>If a notification of a claim is received within 14 days in the case of any computer equipment seized under regulation 12(6), the enforcement id="regulation-13-15-a"><Pnumber>a</Pnumber><P3para><Text>return the seized computer equipment within seven days of the claim, beginning with the day on which the claim is received, or, if shorter, within the remainder of the maximum 14 day period provided for in regulation 12(6); or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/13/15/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/13/15/b" id="regulation-13-15-b"><Pnumber>b</Pnumber><P3para><Text>take proceedings in a magistrates' court within seven days of the claim, beginning with the day on which the claim is received unless there are seven days or less remaining before the expiry of the maximum 14 day period provided for in regulation 12(6), for an order authorising the enforcement authority to retain the seized computer equipment for longer than the 14 day period specified in regulation 12(6).</Text></P3para></P3></P2para></P2><P2 id="regulation-13-16"><Pnumber>16</Pnumber><P2para><Text>If, in the case of any computer equipment seized under regulation 12(6), the magistrates' court authorises the enforcement authority to retain the seized computer equipment, the court may impose conditions as to the basis on which the equipment may continue to be retained, including the imposition of a deadline by which the equipment must be Ref="c20967801"/> applies to the proceedings.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2024-01-01"><Title>Compliance notices</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/14" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/14" id="regulation-14"><Pnumber>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/14/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/14/1" id="regulation-14-1"><Pnumber>1</Pnumber><P2para><Text>If an authorised officer has reasonable grounds for believing that any person is contravening, or has contravened—</Text><P3 notice is 28 days, beginning with the day on which the compliance notice is served.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/15/4" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/15/4" id="regulation-15-4"><Pnumber>4</Pnumber><P2para><Text>A magistrates' court may suspend a compliance notice pending an appeal.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Powers of a magistrates' court on appeal</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/16" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/16" id="regulation-16"><Pnumber>16</Pnumber><P1para><Text>On an appeal against a compliance notice, the magistrates' court may either cancel the compliance notice or confirm the notice with or without modification.</Text></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Publicity</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/17" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/17" id="regulation-17"><Pnumber>17</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/17/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/17/1" id="regulation-17-1"><Pnumber>1</Pnumber><P2para><Text>An enforcement authority may publicise the cases in which items seized under regulation 12(5) have been destroyed, in such manner as it sees fit.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/17/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/17/2" id="regulation-17-3"><Pnumber>3</Pnumber><P2para><Text>But an enforcement authority must not publicise a compliance notice given by it—</Text><P3 RestrictStartDate="2011-08-15"><Title>Obstruction</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/18" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/18" id="regulation-18"><Pnumber>18</Pnumber><P1para><Text>A person is guilty of an offence if that person—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/18/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/18/a" id="regulation-18-a"><Pnumber>a</Pnumber><P3para><Text>intentionally obstructs an authorised officer acting in the execution of these Regulations;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/18/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/18/b" id="regulation-18-b"><Pnumber>b</Pnumber><P3para><Text>fails without reasonable excuse to give to an authorised officer any assistance or information the officer may reasonably require for the officer.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Criminal offences: penalty</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/19" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/19" id="regulation-19"><Pnumber>19</Pnumber><P1para><Text>A person guilty of an offence under regulation 3, 14(3) or 18 is liable on summary conviction to a fine not exceeding level 5 on the standard scale.</Text></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Extended period for bringing prosecutions</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/20" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/20" id="regulation-20"><Pnumber>20</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/20/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/20/1" id="regulation-20-1"><Pnumber>1</Pnumber><P2para><Text>Proceedings for an offence under these Regulations may be commenced within the period of one year from the date on which evidence sufficient in the opinion of the prosecutor to warrant the proceedings came to the prosecutor's knowledge.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/20/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/20/2" id="regulation-20-2"><Pnumber>2</Pnumber><P2para><Text>But no such proceedings may be commenced by virtue of paragraph (1) more than three years after the commission of the date on which evidence sufficient in the prosecutor's opinion to warrant the proceedings came to the prosecutor's knowledge is conclusive evidence of that fact; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/20/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/20/3/b" id="regulation-20-3-b"><Pnumber>b</Pnumber><P3para><Text>a certificate stating that matter and purporting to be so signed is deemed to be so signed unless the contrary is proved.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Offences by bodies corporate <Abbreviation Expansion="et cetera" xml:lang="la">etc.</Abbreviation></Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/21" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/21" id="regulation-21"><Pnumber>21</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/21/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/21/1" id="regulation-21-1"><Pnumber>1</Pnumber><P2para><Text>Where an offence committed by a body corporate (other than a limited liability partnership or a Scottish partnership) is proved to have been committed with the consent or connivance of, or is attributable to any neglect on the part of, an officer of the body corporate, or a person purporting to act in such a capacity, that officer or person (as well as the body corporate) is guilty of the offence and is liable to be proceeded against and punished accordingly.</Text></P2para></P2><P2 under these Regulations.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Act or default of third person</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/22" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/22" id="regulation-22"><Pnumber>22</Pnumber><P1para><Text>Where the commission by one person (“A”) of an offence under these Regulations is due to the act or default of another (“B”), B also commits the offence, and B may be charged with and convicted of the offence by virtue of this regulation whether or not proceedings are taken against A.</Text></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Defences</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/23" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/23" id="regulation-23"><Pnumber>23</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/23/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/23/1" id="regulation-23-1"><Pnumber>1</Pnumber><P2para><Text>It is a defence for a person charged with an offence under these Regulations to prove that that person took all reasonable steps and exercised all due diligence to avoid committing the offence.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/23/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/23/2" id="regulation-23-2"><Pnumber>2</Pnumber><P2para><Text>A may not rely on a defence that involves an allegation that the commission of the offence was due to the act or default of B unless—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/23/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/23/2/a" id="regulation-23-2-a"><Pnumber>a</Pnumber><P3para><Text>at least seven days before the hearing A has given to the prosecutor a notice in writing giving such information identifying or assisting in the identification of B as was then in A's possession; or</Text></P3para></P3><P3 id="regulation-23-2-b"><Pnumber>b</Pnumber><P3para><Text>the court grants A leave.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2011-08-15"><Title>Giving of notices</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/24" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/24" id="regulation-24"><Pnumber>24</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/24/1" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/24/1" id="regulation-24-1"><Pnumber>1</Pnumber><P2para><Text>Any notice required to be given under these Regulations to any person must be given to that person by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/24/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/24/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/24/1/b" id="regulation-24-1-b"><Pnumber>b</Pnumber><P3para><Text>leaving it at that person's proper address;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/24/1/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/24/1/c" id="regulation-25-1"><Pnumber>1</Pnumber><P2para><Text>The following provisions of the Food Safety Act 1990 <CommentaryRef Ref="c20967831"/> apply for the purposes of these Regulations with the id="regulation-25-1-a"><Pnumber>a</Pnumber><P3para><Text>section 3 (presumptions that food intended for human consumption);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/1/b" id="regulation-25-1-b"><Pnumber>b</Pnumber><P3para><Text>section 29 (procurement of samples);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/1/c" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/1/c" id="regulation-25-1-c"><Pnumber>c</Pnumber><P3para><Text>section 30(8) (documentary evidence);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/1/d" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/1/d" id="regulation-25-1-d"><Pnumber>d</Pnumber><P3para><Text>section 44 (protection of officers acting in good faith); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/1/e" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/1/e" id="regulation-25-1-e"><Pnumber>e</Pnumber><P3para><Text>section 46(1) (expenses of authorised officers).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/2" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/2" id="regulation-25-2"><Pnumber>2</Pnumber><P2para><Text>The modifications are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/2/a" id="regulation-25-2-a"><Pnumber>a</Pnumber><P3para><Text>construe any reference in the provisions specified in paragraph (1) to the Food Safety Act 1990 (or a Part of that Act) as a reference to these Regulations;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2011/1719/regulation/25/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2011/1719/regulation/25/2/b" id="regulation-25-2-b"><Pnumber>b</Pnumber><P3para><Text>construe any reference in the provisions specified in paragraph (1) to an authorised officer, or an officer of an enforcement authority or food authority, as a reference to an authorised officer as defined in regulation 2(1) of these Regulations;</Text></P3para></P3><P3 Journal">OJ</Acronym> No L 157, 17.6.2008, p. 46) mentioned in Schedule 2 (provisions relating to the marketing of poultrymeat) an offence (regulation 3 and Schedule 2),</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>make provision in relation to the registration of slaughterhouses and producers as required by Article 12 of Commission Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0543" id="c00010" Class="EuropeanUnionRegulation" Year="2008" Number="543">(EC) No 543/2008</Citation> (regulation 5) and provide for appeals against a decision to refuse such a registration and a decision to cancel such a registration (regulations 6 and 7),</Text></Para></ListItem><ListItem NumberOverride="d"><Para><Text>provide for the payment of fees in relation to water content checks carried out by the Food Standards Agency (regulation 8 and Schedule 3),</Text></Para></ListItem><ListItem NumberOverride="e"><Para><Text>provide for enforcement (regulations 9 and 10),</Text></Para></ListItem><ListItem NumberOverride="f"><Para><Text>confer powers of entry (regulation 11) and other powers (regulation 12), including seizure and destruction powers,</Text></Para></ListItem><ListItem NumberOverride="g"><Para><Text>make the failure to comply with the provisions of Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2007/1234" id="c00011" Class="EuropeanUnionRegulation" Year="2007" Number="1234">(EC) No 1234/2007</Citation> establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (OJ No L 299, 16.11.2007, p. 1) and Commission Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0543" id="c00012" Class="EuropeanUnionRegulation" Year="2008" Number="543">(EC) No 543/2008</Citation> mentioned in Schedule 1 a matter for which a compliance notice may be issued (regulation 14) and provide for appeals against compliance notices (regulations 15 and 16).
