Datganiadau statudol ac ymrwymiadau
16.—(1) Rhaid i bob penodai y bydd yr Awdurdod yn rhoi caniatâd iddo olygu, copïo neu dynnu data o'r storfeydd data electronig roi datganiad statudol yn y ffurf yn Atodlen 5, yn unol â'r trefniadau a wneir gan yr Awdurdod, cyn gynted ag y bo'n ymarferol ar ôl cael ei benodi gan yr Awdurdod neu ar ôl i'r Rheoliadau hyn ddod i rym, p'un bynnag fydd olaf.
(2) Yn ddarostyngedig i baragraff (3), rhaid i bob penodai nad yw'n ofynnol iddo gwblhau datganiad statudol o dan baragraff (1) lenwi ffurflen yr ymrwymiad a nodir yn Atodlen 6, yn unol â'r trefniadau a wneir gan yr Awdurdod, cyn gynted ag y bo'n ymarferol ar ôl cael ei benodi neu ar ôl i'r Rheoliadau hyn ddod i rym, p'un bynnag fydd olaf.
(3) Ni fydd yn ofynnol i unrhyw benodai a benodwyd cyn i'r Rheoliadau hyn ddod i rym, a lenwodd ffurflen ymrwymiad sydd yr un fath neu sydd i'r un perwyl â'r ymrwymiad yn Atodlen 6, lenwi ymrwymiad arall yn rhinwedd y rheoliad hwn.
(4) At ddibenion paragraff (1), ystyr “storfeydd data electronig” (“electronic data repositories”) yw unrhyw rai o'r systemau electronig a ddefnyddir er mwyn storio'r manylion a gofnodir yn yr holl holiaduron a fydd yn dod i law'r Awdurdod a ddynodir gan yr Awdurdod.
