The Children and Young Persons Act 2008 (Commencement No. 2) (Wales) Order 2009
Title, interpretation and application1.

The title of this order is the Children and Young Persons Act 2008 (Commencement No. 2) (Wales) Order 2009.
(2)
In this Order “the Act” (“y deddf”) means the Children and Young Persons Act 2008.

This Order applies in relation to Wales.
Appointed day2.
1 September 2009 is the appointed day for the coming into force of the following provisions of the Act—
(a)
section 36 (entitlement of relative to apply for a residence order);
(b)
section 37 (duration of residence orders);
(c)
section 38 (entitlement of relative to apply for a special guardianship order); and
(d)
This Order brings into force on 1 September 2009 sections 36, 37, 38 and 42 of, and Schedule 4 to, the Children and Young Persons Act 2008, to the extent specified in the Order. The reference in Article 2(d) of the Order to the repeal in part of section 91(10) of the Children Act 1989, is a reference to the omission of the words “or 12(5)” from that section.
The following provisions of the Children and Young Persons Act 2008 have been brought into force in relation to Wales by Commencement Order made before the date of this Order.
