Arbed rhag achos cyfreithiol pan fo hysbysiad cosb benodedig wedi'i roi

26.—(1) Mae'r rheoliad hwn yn gymwys pan roddir hysbysiad cosb benodedig i berson mewn cysylltiad â thramgwydd cosb benodedig.

(2) Ni chaniateir cychwyn unrhyw achos cyfreithiol am y tramgwydd cyn diwedd y cyfnod ar gyfer talu'r gosb.

(3) Ni chaniateir i unrhyw achos cyfreithiol o'r fath gael ei gychwyn na'i barhau os telir swm y gosb cyn diwedd y cyfnod hwnnw neu os caiff ei dderbyn gan yr Awdurdod Trwyddedau ar ôl yr amser hwnnw.

(4) Ni fydd talu'r swm gostyngol yn cyfrif at ddibenion paragraff (3) ond os caiff ei wneud cyn diwedd y cyfnod ar gyfer talu'r swm gostyngol.

(5) Mewn achos cyfreithiol am y tramgwydd, bydd tystysgrif —

(a)sy'n honni ei bod wedi'i llofnodi gan neu ar ran y person sydd â chyfrifoldeb ariannol dros y cynllun trwyddedau; a

(b)sy'n datgan bod taliad o swm a bennwyd yn y dystysgrif wedi dod i law neu heb ddod i law erbyn dyddiad a bennwyd felly,

yn dystiolaeth o'r ffeithiau a ddatganwyd.

(6) Y person sydd â chyfrifoldeb ariannol dros y cynllun trwyddedau —

(a)os un awdurdod priffyrdd yw'r Awdurdod Trwyddedau, yw'r person sy'n gyfrifol am faterion ariannol yr awdurdod hwnnw; a

(b)os yw'r Awdurdod Trwyddedau'n fwy nag un awdurdod priffyrdd, yw'r person a benodwyd gan yr awdurdodau cyfranogol i fod yn gyfrifol am gyfrifyddu ariannol mewn perthynas â'r cynllun trwyddedau.
