The Welsh Ministers in exercise of the powers conferred on the Secretary of State, by sections 69(3) and (4) and 138(7) and (8) of the School Standards and Framework Act 1998(1), as applied in relation to independent schools by section 124B(1)(2) of that Act and now vested in them(3), make the following Order.

In making this Order the Welsh Ministers have followed the procedure specified in the Independent Schools (Religious Character of Schools) (Designation Procedure) (Wales) Regulations 2003(4).

Title and commencement

1.  The title of this Order is the Designation of Schools Having a Religious Character (Independent Schools) (Wales) Order 2009, and it comes into force on 1 June 2009.

Interpretation

2.  In this Order “the relevant religion or religious denomination” (“y grefydd berthnasol neu'r enwad crefyddol perthnasol ”) means the religion or religious denomination in accordance with whose tenets education is provided at the school or the school is conducted (or, as the case may be, each such religious denomination).

Designation of schools

3.—(1) The Schools listed in column (1) of the Schedule are designated as schools having a religious character.

(2) The relevant religion or religious denomination in relation to a school listed in column (1) of the Schedule is specified in relation to that school in column (2).

Explanatory Note

(This note is not part of the Order)

This Order designates the independent schools named as having a religious character.

Under section 124A of the School Standards and Framework Act 1998, independent schools which are so designated are permitted to take account of certain religious considerations in making specified employment decisions which relate to teaching staff.

Designation by this Order is not of itself a means of acquiring a religious character or of changing religious character. Designation is the recognition of certain existing attributes of the school or its governing body as described in the Independent Schools (Religious Character of Schools) (Wales) Regulations 2003.

The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and then to the Welsh Ministers by paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
