The Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008
Title, commencement and application1.
(1)
The title of this Order is the Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008 and, subject to articles 4(1), 5(1), 6(1), 7(1), 8(1), 9(1), 10(1), 11(1), 12(1), 13(1), 14(1) and 15(1) and (2) below, it comes into force on 1 August 2008.
(2)
This Order applies in relation to Wales.
Interpretation2.
(1)
In this Order—
references to the first, second, third and fourth key stages are to be interpreted in accordance with section 103 of the Education Act 2002.
Revocation and transitional provisions3.
(1)
The Orders listed in the Schedule are revoked on 1 August 2008.
(2)
Despite paragraph (1) the provisions of the Orders listed in the Schedule continue to apply to pupils in the second, third and fourth key stages until such time as the provisions of this Order apply to them.
Art and design4.
(1)
The provisions of this Order insofar as they relate to the art and design document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.
(2)
The provisions relating to the attainment target and programmes of study set out in the art and design document have effect for the purpose of specifying the attainment target and programmes of study in relation to art and design.
(3)
The examples printed in italics in the art and design document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
Design and technology5.
(1)
The provisions of this Order insofar as they relate to the design and technology document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.
(2)
The provisions relating to the attainment target and programmes of study set out in the design and technology document shall have effect for the purpose of specifying the attainment target and programmes of study in relation to design and technology.
(3)
The examples printed in italics in the design and technology document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
English6.
(1)
The provisions of this Order insofar as they relate to the English document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;
(c)
1 August 2010 in respect of pupils in the first year of the fourth key stage; and
(d)
1 August 2011 in respect of pupils in the second year of the fourth key stage.
(2)
The provisions relating to attainment targets and programmes of study set out in the English document have effect for the purpose of specifying the attainment targets and programmes of study in relation to English.
(3)
The examples printed in italics in the English document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
Geography7.
(1)
The provisions of this Order insofar as they relate to the geography document will come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.
(2)
The provisions relating to the attainment target and programmes of study set out in the geography document have effect for the purpose of specifying the attainment target and programmes of study in relation to geography.
(3)
The examples printed in italics in the geography document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
History8.
(1)
The provisions of this Order insofar as they relate to the history document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.
(2)
The provisions relating to the attainment target and programmes of study set out in the history document have effect for the purpose of specifying the attainment target and programmes of study in relation to history.

Information and communication technology9.
(1)
The provisions of this Order insofar as they relate to the information and communication technology document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.
(2)
The provisions relating to the attainment target and programmes of study set out in the information and communication technology document have effect for the purpose of specifying the attainment target and programmes of study in relation to information and communication technology.
(3)
The examples printed in italics in the information and communication technology document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
Mathematics10.
(1)
The provisions of this Order insofar as they relate to the mathematics document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;
(c)
1 August 2010 in respect of pupils in the first year of the fourth key stage; and
(d)
1 August 2011 in respect of pupils in the second year of the fourth key stage.

Modern foreign languages11.
(1)
The provisions of this Order insofar as they relate to the modern foreign languages document come into force on—
(a)
1 August 2008 in respect of pupils in the first two years of the third key stage; and
(b)
1 August 2009 in respect of pupils in the third year of the third key stage.
(2)
The provisions relating to attainment targets and programmes of study set out in the modern foreign languages document have effect for the purpose of specifying the attainment targets and programmes of study in relation to modern foreign languages.
(3)

Music12.
(1)
The provisions of this Order insofar as they relate to the music document come into force on—
(a)

1 August 2009 in respect of pupils in the fourth year of the second key stage, the third year of the third key stage and the first year of the fourth key stage; and
(c)
1 August 2010 in respect of pupils in the second year of the fourth key stage.

The provisions relating to the attainment target and programmes of study set out in the physical education document have effect for the purpose of specifying the attainment target and programmes of study in relation to physical education.

Science14.
(1)
The provisions of this Order insofar as they relate to the science document come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage, the first two years of the third key stage and in the fourth key stage; and
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

The provisions relating to the attainment target and programmes of study set out in the science document have effect for the purpose of specifying the attainment target and programmes of study in relation to science.

Welsh15.
(1)
The provisions of this Order insofar as they relate to that part of the Welsh document entitled “Welsh” comes into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;
(c)
1 August 2010 in respect of pupils in the first year of the fourth key stage; and
(d)
1 August 2011 in respect of pupils in the second year of the fourth key stage.
(2)
The provisions of this Order insofar as they relate to that part of the Welsh document entitled “Welsh second language” will come into force on—
(a)
1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;
(b)
1 August 2009 in respect of pupils in the fourth year of the second key stage, the third year of the third key stage and the first year of the fourth key stage; and
(c)
1 August 2010 in respect of pupils in the second year of the fourth key stage.
(3)
The provisions relating to attainment targets and programmes of study set out in the Welsh document have effect for the purpose of specifying the attainment targets and programmes of study in relation to Welsh.

The National Curriculum for Wales will be revised from 1 August 2008. This Order gives legal effect to the programmes of study, which set out what pupils should be taught and attainment targets for them. Details of these are set out in twelve documents called:
“Art and design in the National Curriculum for Wales”;
“Design and technology in the National Curriculum for Wales”;
“English in the National Curriculum for Wales”;
“Geography in the National Curriculum for Wales”;
“History in the National Curriculum for Wales”;
“Information and communication technology in the National Curriculum for Wales”;
“Mathematics in the National Curriculum for Wales”;
“Modern foreign languages in the National Curriculum for Wales”;
“Music in the National Curriculum for Wales”;
“Physical education in the National Curriculum for Wales”;
“Science in the National Curriculum for Wales”; and
“Welsh in the National Curriculum for Wales”.
This Order also sets out arrangements for phasing in the revised National Curriculum.
