The Avian Influenza (H5N1) (Miscellaneous Amendments) (Wales) Order 2007

The Welsh Ministers make the following Order in exercise of the powers conferred by section 8 of the Animal Health Act 19811 and now vested in them2.

Title and commencement1.

This title of this Order is the Avian Influenza (H5N1) (Miscellaneous Amendments) (Wales) Order 2007; it applies in relation to Wales and comes into force at 3.59p.m. on 28 November 2007.

Amendment2.

(1)

After article 14(2)(j) of the Avian Influenza (H5N1 in Poultry) (Wales) Order 20063) insert-

“(ja)

raw petfood, within the meaning of paragraph 48 of Annex I to Regulation (EC) No. 1774/2002, which complies with the requirements in Part B of Chapter II of Annex VIII to that Regulation;”.

(2)

After paragraph 13(2)(j) of Schedule 1 to the Avian Influenza (H5N1 in Wild Birds) (Wales) Order 20064 insert—

“(ja)

raw petfood, within the meaning of paragraph 48 of Annex I to Regulation (EC) No. 1774/2002, which complies with the requirements in Part B of Chapter II of Annex VIII to that Regulation;”.

This Order amends the Avian Influenza (H5N1 in Poultry) (Wales) Order 2006 (S.I. 2006/3309 (W.299)) and the Avian Influenza (H5N1 in Wild Birds) (Wales) Order 2006 (S.I. 2006/3310 (W.300)) to add raw petfood to the lists of by-products which can be moved under the authority of a licence issued by a veterinary inspector under each Order.

A regulatory impact assessment has not been produced for this instrument.

This Statutory Instrument has been made in consequence of a defect in S.I. 2006/3309 (W.299) & 2006/3310 (W.300) and is being issued free of charge to all known recipients of those Statutory Instruments.
