By virtue of sections 59(1) and 162 of, and paragraphs 28 and 30 of Schedule 11 to, the Government of Wales Act 2006, functions conferred on the National Assembly for Wales by this designation, are exercisable by the Welsh Ministers.</p></authorialNote> for the purposes of section 2(2) of the European Communities Act 1972<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00054" href="http://www.legislation.gov.uk/id/ukpga/1972/68">1972 c. 68</ref>.</p></authorialNote> in relation to the Common Agricultural Policy of the European Community.</p><formula name="enactingText"><p>The Welsh Ministers make these Regulations in exercise of the powers conferred on them by section 2(2) of the European Communities Act 1972.</p></formula></preamble><body><part eId="part-1"><num><b>PART 1</b></num><heading>General provisions</heading><hcontainer name="regulation" eId="regulation-1"><heading>Title, application, commencement and cessation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><intro><p>These Regulations—</p></intro><level class="para1" eId="regulation-1-1-a"><num>(a)</num><content><p>are entitled the Export and Movement Restrictions (Foot-and-Mouth Disease) (Wales) Regulations 2007;</p></content></level><level class="para1" eId="regulation-1-1-b"><num>(b)</num><content><p>apply in relation to Wales;</p></content></level><level class="para1" eId="regulation-1-1-c"><num>(c)</num><content><p>come into force at 6.25 p.m. on 20 November 2007; and</p></content></level><level class="para1" eId="regulation-1-1-d"><num>(d)</num><content><p>subject to paragraph (2), cease to have effect on 31 December 2007.</p></content></level></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>Regulations 5 to 9 and 11 to 14 cease to have effect on 15 December 2007.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“approved” means approved for the purposes of these Regulations in accordance with regulation 17;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Decision” means Commission Decision <ref eId="c00001" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> concerning certain protection measures against foot-and-mouth disease in the United Kingdom<authorialNote class="footnote" eId="f00003" marker="3"><p><abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L210, 10.8.2007, p. 36 as last amended by Commission Decision of 19 November 2007 amending Decision <ref eId="c00055" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> concerning certain protection measures against foot-and-mouth disease in the United Kingdom (not yet published in the Official Journal).</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“export” includes consigning for export;</p></content></hcontainer><hcontainer name="definition"><content><p>“inspector” means a person appointed as an inspector or a veterinary inspector for the purposes of the Animal Health Act 1981<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00056" href="http://www.legislation.gov.uk/id/ukpga/1981/22">1981 c. 22</ref>.</p></authorialNote> or the Animals and Animal Products (Import and Export) (Wales) Regulations 2006<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00057" href="http://www.legislation.gov.uk/id/wsi/2006/1536">2006/1536 (W. 153)</ref>.</p></authorialNote>, or a person authorised by the Welsh Ministers, local authority or Food Standards Agency to be an authorised officer or official veterinary surgeon for the purposes of the Products of Animal Origin (Third Country Imports) (Wales) Regulations 2007<authorialNote class="footnote" eId="f00006" marker="6"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00058" href="http://www.legislation.gov.uk/id/wsi/2007/376">2007/376 (W. 36)</ref>.</p></authorialNote> or the Products of Animal Origin (Import and Export) Regulations 1996<authorialNote class="footnote" eId="f00007" marker="7"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00059" href="http://www.legislation.gov.uk/id/uksi/1996/3124">1996/3124</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="Hazard Analysis at Critical Control Points">HACCP</abbr>” means Hazard Analysis at Critical Control Points, which is a system in which the critical points of the manufacturing process have been identified, assessments have been made of the potential risks at those points, and necessary steps have been taken to minimise those risks;</p></content></hcontainer><hcontainer name="definition"><content><p>“local authority” means in relation to an area the council or county borough council for that area;</p></content></hcontainer><hcontainer name="definition"><content><p>“official veterinarian” means a veterinarian who is qualified in accordance with Regulation <ref eId="c00002" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 854/2004</ref> of the European Parliament and of the Council laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption<authorialNote class="footnote" eId="f00008" marker="8"><p><abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L139, 30.4.2004, p.206. The revised text of Regulation <ref eId="c00060" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 854/2004</ref> is now set out in a Corrigendum (<abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L226, 25.6.2004, p.83) and that Regulation was last amended by Council Regulation <ref eId="c00061" href="http://www.legislation.gov.uk/european/regulation/2006/1791">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1791/2006</ref>.</p></authorialNote> to act in such a capacity and is appointed by the Food Standards Agency;</p></content></hcontainer><hcontainer name="definition"><content><p>“premises” includes any land, building or other place;</p></content></hcontainer><hcontainer name="definition"><content><p>“slaughter”, in relation to an animal, means causing the death of the animal by bleeding; and</p></content></hcontainer><hcontainer name="definition"><content><p>“veterinary inspector” means a veterinary inspector appointed by the Welsh Ministers for the purposes of the Animal Health Act 1981.</p></content></hcontainer></hcontainer></part><part eId="part-2"><num><b>PART 2</b></num><heading>Import and export restrictions</heading><hcontainer name="regulation" eId="regulation-3"><heading>Movement of live animals</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>No person may move any live animal of the bovine, ovine, caprine or porcine species or any other biungulate from the areas specified in Schedule 1 to the areas specified in Schedule 2 or vice versa.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>The prohibition in paragraph (1) does not apply to live animals from the areas specified in Schedule 2 that are moved to premises in the areas specified in Schedule 1 providing that the animals are moved under a licence issued in accordance with regulation 18.</p></content></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply to live animals from the areas specified in Schedule 1 that are moved to areas in Schedule 2, providing that the animals—</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><content><p>are moved under a licence issued in accordance with regulation 18; and</p></content></level><level class="para1" eId="regulation-3-3-b"><num>(b)</num><content><p>the animals show no clinical signs of foot-and-mouth disease immediately prior to loading.</p></content></level></paragraph><paragraph eId="regulation-3-4"><num>(4)</num><content><p>The prohibition in paragraph (1) does not apply to the direct transit on main roads or railway lines of live animals through the areas specified in Schedule 1 or Schedule 2 without stops, other than stops required by traffic conditions, under a licence issued in accordance with regulation 18.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Export of live animals</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>No person may export any live animal of the bovine, ovine, caprine or porcine species or any other biungulate from Great Britain.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>By way of derogation from paragraph (1), a person may export animals originating outside Great Britain if—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>the animals were moved in direct transit on main roads or railway lines through any area in Schedule 1 or 2 without stops, other than those required by traffic conditions; and</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>the requirements in paragraph (3)(a) and (b) are complied with.</p></content></level></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><intro><p>No person may export any biungulate to another member State from Wales without the prior authorisation of the Welsh Ministers unless—</p></intro><level class="para1" eId="regulation-4-3-a"><num>(a)</num><content><p>at least three days before export the Welsh Ministers have notified that member State; and</p></content></level><level class="para1" eId="regulation-4-3-b"><num>(b)</num><intro><p>in the case of—</p></intro><level class="para2" eId="regulation-4-3-b-i"><num>(i)</num><content><p><mod>bovine, ovine, caprine or porcine animals, the health certificate accompanying the animals bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>Animals conforming to Commission Decision <ref eId="c00003" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> of 9 August 2007 concerning certain protection measures against foot-and-mouth disease in the United Kingdom.</p></item></blockList></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para2" eId="regulation-4-3-b-ii"><num>(ii)</num><content><p><mod>other biungulates, the health certificate accompanying the animals bears the following words—<quotedStructure startQuote="“" name="appendText">.</inline></mod></p></content></level></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Export of fresh meat, minced meat, mechanically separated meat and meat preparations</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>No person may export meat from animals of the bovine, ovine, caprine or porcine species or other biungulates coming from, or obtained from animals originating in, an area specified in Schedule 1.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>In this regulation, “meat” includes fresh meat, minced meat, mechanically separated meat and meat preparations as defined in points 1.10, 1.13, 1.14 or 1.15 of Annex 1 to Regulation <ref eId="c00005" href="http://www.legislation.gov.uk/european/regulation/2004/0853">(<abbr class="acronym" title="European Community">EC</abbr>) No 853/2004</ref> of the European Parliament and of the Council laying down specific hygiene rules for food of animal origin<authorialNote class="footnote" eId="f00009" marker="9"><p><abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L139, 30.4.2004, p. 55.</p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to—</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p>meat obtained before 15 July 2007;</p></content></level><level class="para1" eId="regulation-5-3-b"><num>(b)</num><content><p>meat derived from animals reared for at least the 90 days prior to slaughter (or since birth, if less than 90 days of age) and slaughtered outside Great Britain, or in the case of meat obtained from wild game of a species susceptible to foot-and-mouth disease, killed outside Great Britain;</p></content></level><level class="para1" eId="regulation-5-3-c"><num>(c)</num><intro><p>meat from domestic ungulates of a species susceptible to foot-and-mouth disease that complies with the conditions in Schedule 4, and is derived from animals that—</p></intro><level class="para2" eId="regulation-5-3-c-i"><num>(i)</num><content><p>were kept on premises situated within the areas specified in the relevant columns of Schedule 3 where there has been no outbreak of foot-and-mouth disease for at least the 90 days prior to slaughter (or since birth, if less than 90 days of age);</p></content></level><level class="para2" eId="regulation-5-3-c-ii"><num>(ii)</num><content><p>during the 21 days prior to transport to the approved slaughterhouse, remained under the supervision of the Welsh Ministers on a premises complying with Schedule 5;</p></content></level><level class="para2" eId="regulation-5-3-c-iii"><num>(iii)</num><content><p>were transported to the approved slaughterhouse under the control of the Welsh Ministers in a means of transport that was cleansed and disinfected before loading at the premises described in sub-paragraph (c)(ii); and</p></content></level><level class="para2" eId="regulation-5-3-c-iv"><num>(iv)</num><content><p>were slaughtered less than 24 hours after arrival at the approved slaughterhouse separately from animals the meat of which is not eligible for export;</p></content></level></level><level class="para1" eId="regulation-5-3-d"><num>(d)</num><intro><p>meat from farmed game of a species susceptible to foot-and-mouth disease that complies with the conditions in Schedule 4, and is derived from animals—</p></intro><level class="para2" eId="regulation-5-3-d-i"><num>(i)</num><content><p>that were kept on premises situated within the areas specified in the relevant columns of Schedule 3 where there has been no outbreak of foot-and-mouth disease for at least the 90 days prior to slaughter (or since birth, if less than 90 days of age);</p></content></level><level class="para2" eId="regulation-5-3-d-ii"><num>(ii)</num><content><p>that, during the 21 days prior to on-farm slaughtering, remained under the supervision of the Welsh Ministers on an approved premises complying with Schedule 5; and</p></content></level><level class="para2" eId="regulation-5-3-d-iii"><num>(iii)</num><content><p>any carcase of which was transported to the approved slaughterhouse under the control of the Welsh Ministers in a means of transport that was cleansed and disinfected before loading at the premises described in sub-paragraph (d)(ii);</p></content></level></level><level class="para1" eId="regulation-5-3-e"><num>(e)</num><intro><p>fresh meat obtained from bovine, ovine, caprine or porcine species or any other biungulates reared outside the areas specified in Schedule 1 and transported, under a licence issued pursuant to regulation 18, directly and under the control of the Welsh Ministers to an approved slaughterhouse provided that—</p></intro><level class="para2" eId="regulation-5-3-e-i"><num>(i)</num><content><p>the slaughterhouse is situated in an area specified in Schedule 1;</p></content></level><level class="para2" eId="regulation-5-3-e-ii"><num>(ii)</num><content><p>the animals are slaughtered immediately, and in any event, within 24 hours of arrival at the slaughterhouse;</p></content></level><level class="para2" eId="regulation-5-3-e-iii"><num>(iii)</num><content><p>the slaughterhouse is operated under strict veterinary control; and</p></content></level><level class="para2" eId="regulation-5-3-e-iv"><num>(iv)</num><content><p>the fresh meat is clearly identified, and transported and stored separately from meat which is not eligible for export; or</p></content></level></level><level class="para1" eId="regulation-5-3-f"><num>(f)</num><intro><p>fresh meat obtained from an approved cutting plant situated in any area specified in Schedule 1 if—</p></intro><level class="para2" eId="regulation-5-3-f-i"><num>(i)</num><content><p>only fresh meat described in sub-paragraphs (a) to (e) is processed in the cutting plant in any one day;</p></content></level><level class="para2" eId="regulation-5-3-f-ii"><num>(ii)</num><content><p>cleansing and disinfection has been carried out after processing any meat not described in sub-paragraphs (a) to (e);</p></content></level><level class="para2" eId="regulation-5-3-f-iii"><num>(iii)</num><content><p>the cutting plant is operated under strict veterinary control; and</p></content></level><level class="para2" eId="regulation-5-3-f-iv"><num>(iv)</num><content><p>the fresh meat is clearly identified, and has been transported and stored separately from meat that is not eligible for export.</p></content></level></level></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>Any person consigning an animal to a slaughterhouse to produce meat intended for export in accordance with sub-paragraph (c) or (d) of paragraph (3) must provide a written declaration that it complies with each of the conditions contained in that sub-paragraph and identified;</p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p>bear the health mark in accordance with Chapter <abbr class="acronym" title="3">III</abbr> of eId="regulation-8-1"><num>(1)</num><content><p>No person may export milk produced or prepared in the areas specified in Schedule 1.</p></content></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply to milk produced from animals kept in the areas specified in Schedule 1 that has been subjected to at least a treatment in accordance with—</p></intro><level class="para1" eId="regulation-8-2-a"><num>(a)</num><content><p>Part A of Annex <abbr class="acronym" title="9">IX</abbr> to Council Directive <ref Community">EC</abbr></ref>, if the milk is not intended for human consumption.</p></content></level></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply to milk prepared in an approved establishment situated in an area specified in Schedule 1 under the following conditions—</p></intro><level class="para1" eId="regulation-8-3-a"><num>(a)</num><intro><p>all milk used in the establishment has either—</p></intro><level class="para2" eId="regulation-8-3-a-i"><num>(i)</num><content><p>been treated in accordance with paragraph (2); or</p></content></level><level class="para2" eId="regulation-8-3-a-ii"><num>(ii)</num><content><p>has been obtained from animals reared and milked outside the areas specified in Schedule 1;</p></content></level></level><level class="para1" eId="regulation-8-3-b"><num>(b)</num><content><p>the establishment must be operated under strict veterinary control;</p></content></level><level class="para1" eId="regulation-8-3-c"><num>(c)</num><content><p>the milk is clearly identified and transported and stored separately from milk and dairy products not eligible for export; and</p></content></level><level class="para1" eId="regulation-8-3-d"><num>(d)</num><content><p>transport of raw milk from premises situated outside the areas specified in Schedule 1 to the establishments in the areas specified in Schedule 1 is carried out in vehicles that were cleansed and disinfected prior to operation and had no subsequent contact with premises in the areas specified in Schedule 1 keeping animals of species susceptible to foot-and-mouth disease.</p></content></level></paragraph><paragraph eId="regulation-8-4"><num>(4)</num><content><p><mod>Milk exported to another member State from Wales must be accompanied by an official certificate which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" operating <abbr title="Hazard Analysis at Critical Control Points">HACCP</abbr> and an auditable standard operating procedure which ensures that standards for treatment are met and recorded.</p></content></paragraph><paragraph eId="regulation-8-6"><num>(6)</num><content><p>Paragraph (4) does not apply to milk that conforms with the requirements of paragraph (2)(a) or (b) and that has been heat treated in hermetically sealed containers so as to ensure that it is shelf stable provided that the commercial document accompanying the consignment states the heat treatment applied.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Export of dairy products</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><content><p>No person may export dairy products produced or prepared in the areas specified in Schedule 1.</p></content></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply to dairy products—</p></intro><level class="para1" eId="regulation-9-2-a"><num>(a)</num><content><p>produced before 15 July 2007;</p></content></level><level class="para1" eId="regulation-9-2-b"><num>(b)</num><content><p>prepared from milk complying with the provisions in regulation 8(2) or (3); or</p></content></level><level class="para1" eId="regulation-9-2-c"><num>(c)</num><content><p>for export to a third country where import conditions permit such products to be subject to treatment other than laid down in regulation 8(2) which ensures the inactivation of the foot-and-mouth disease virus.</p></content></level></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply to dairy products intended for human consumption—</p></intro><level class="para1" eId="regulation-9-3-a"><num>(a)</num><content><p>that are finished products, the ingredients of which comply with the respective animal health conditions laid down in these Regulations;</p></content></level><level class="para1" eId="regulation-9-3-b"><num>(b)</num><content><p>produced from milk of a controlled pH less than 7.0 and subject to a heat treatment at a temperature of at least 72°C for at least 15 seconds; or</p></content></level><level class="para1" eId="regulation-9-3-c"><num>(c)</num><content><p>produced from raw milk of bovine, ovine or caprine animals (that have been resident for at least 30 days on a premises situated in Great Britain, and within the centre of a circle of at least 10 km radius where no outbreak of foot-and-mouth disease has occurred during the 30 days prior to the date of production of the raw milk) and which has been subject to a maturation or ripening process of at least 90 days during with the pH is lowered below 6.0 throughout the substance, and the rind of which has been treated with 0.2% citric acid immediately prior to wrapping or packaging.</p></content></level></paragraph><paragraph eId="regulation-9-4"><num>(4)</num><intro><p>The prohibition in paragraph (1) does not apply to—</p></intro><level class="para1" eId="regulation-9-4-a"><num>(a)</num><intro><p>dairy products prepared in an approved establishment situated in the areas specified in Schedule 1 if—</p></intro><level class="para2" eId="regulation-9-4-a-i"><num>(i)</num><content><p>all milk used in the establishment either conforms to the conditions of regulation 8(2) or is obtained from animals outside the areas specified in Schedule 1;</p></content></level><level class="para2" eId="regulation-9-4-a-ii"><num>(ii)</num><content><p>all dairy products used in the final product either conform to the conditions of paragraph (2)(a) or (b) or (3) of this regulation or are made from milk obtained from animals outside the areas specified in Schedule 1;</p></content></level><level class="para2" eId="regulation-9-4-a-iii"><num>(iii)</num><content><p>the establishment is operated under strict veterinary control; and</p></content></level><level class="para2" eId="regulation-9-4-a-iv"><num>(iv)</num><content><p>the dairy products are clearly identified and transported and stored separately from milk and dairy products that are not eligible for export; or</p></content></level></level><level class="para1" eId="regulation-9-4-b"><num>(b)</num><content><p>dairy products prepared outside the areas specified in Schedule 1 using milk obtained before 15 July 2007 from Great Britain provided that the milk products are clearly identified and transported and stored separately from dairy products that are not eligible for export.</p></content></level></paragraph><paragraph eId="regulation-9-5"><num>(5)</num><content><p><mod>Dairy products exported to another member State from Wales must be accompanied by an official certificate which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" are met and recorded.</p></content></paragraph><paragraph eId="regulation-9-7"><num>(7)</num><content><p>Paragraph (5) does not apply to dairy products that conform to the requirements of paragraph (2)(a) or (b), (3) or (4), which have been treated in hermetically sealed containers so as to ensure that they are shelf stable if the heat treatment applied is stated in the commercial document accompanying the consignment.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Export of semen, ova and embryos</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>No person may export semen, ova or embryos of animals of the bovine, ovine, caprine or porcine species or other biungulates produced in or brought into Great Britain.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to—</p></intro><level class="para1" eId="regulation-10-2-a"><num>(a)</num><content><p>semen, ova or embryos produced before 15 July 2007;</p></content></level><level class="para1" eId="regulation-10-2-b"><num>(b)</num><content><p>frozen bovine semen imported into the United Kingdom in accordance with the conditions laid down in Council Directive <ref eId="c00017" href="http://www.legislation.gov.uk/european/directive/1988/0407">88/407/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> laying down the animal health requirements applicable to intra-Community trade in and imports of deep-frozen semen of domestic animals of the bovine species<authorialNote class="footnote" eId="f00014" marker="14"><p><abbr class="acronym" 1.</p></content></level></paragraph><paragraph eId="regulation-12-2"><num>(2)</num><content><p>No person may export dung or manure from animals of the bovine, ovine, caprine or porcine species or other biungulates from the areas specified in Schedule 1.</p></content></paragraph><paragraph eId="regulation-12-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to—</p></intro><level class="para1" eId="regulation-12-3-a"><num>(a)</num><intro><p>animal products that—</p></intro><level class="para2" eId="regulation-12-3-a-i"><num>(i)</num><content><p>have been subject to a heat treatment in a hermetically sealed container with a Fo value of 3,00 or more;</p></content></level><level class="para2" eId="regulation-12-3-a-ii"><num>(ii)</num><content><p>have been subject to a heat treatment in which the centre temperature is raised to at least 70oC;</p></content></level><level class="para2" eId="regulation-12-3-a-iii"><num>(iii)</num><content><p>were produced outside the areas specified in Schedule 1 in accordance with the conditions laid down in Regulation <ref eId="c00031" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref>, and which since introduction into the areas specified in Schedule 1 have been stored and transported separately from animal products not eligible for export; or</p></content></level><level class="para2" eId="regulation-12-3-a-iv"><num>(iv)</num><content><p>were produced from animals slaughtered in a slaughterhouse, or in the case of farmed game slaughtered on premises, or in the case of wild game killed, for the production of meat in accordance with regulation 5(3), and comply with the requirements of Part A(1) of Chapter <abbr class="acronym" title="2">II</abbr> of Annex <abbr class="acronym" title="8">VIII</abbr> to Regulation <ref eId="c00032" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref>, and have been stored and transported separately from animal products not eligible for export;</p></content></level></level><level class="para1" eId="regulation-12-3-b"><num>(b)</num><intro><p>blood or blood products—</p></intro><level class="para2" eId="regulation-12-3-b-i"><num>(i)</num><content><p>as defined in points 4 and 5 of Annex I to Regulation <ref eId="c00033" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref> which have been subjected to at least one of the treatments provided for in paragraph 3(a)(ii) of Part A of Chapter <abbr eId="regulation-13"><heading>Exemptions</heading><num>13.</num><intro><p>The prohibitions in regulations 7, 8, 9 and 12 do not apply in relation to—</p></intro><level class="para1" eId="regulation-13-a"><num>(a)</num><content><p>products not produced in the United Kingdom and which remain in their original packaging indicating the country of origin of the products; and</p></content></level><level class="para1" eId="regulation-13-b"><num>(b)</num><intro><p>products that are—</p></intro><level class="para2" eId="regulation-13-b-i"><num>(i)</num><content><p>produced in an approved establishment in Great Britain from pre-processed products originating outside Great Britain which, since introduction into the United Kingdom have been transported, stored and processed separately from products from Great Britain not eligible for export; and</p></content></level><level class="para2" eId="regulation-13-b-ii"><num>(ii)</num><content><p>accompanied by a commercial document or official certificate as required by these Regulations.</p></content></level></level></hcontainer><hcontainer name="regulation" eId="regulation-14"><heading>Endorsement of commercial documents</heading><num>14.</num><paragraph eId="regulation-14-1"><num>(1)</num><intro><p>Where reference is made to a commercial document being endorsed in accordance with this regulation, the document must have attached to it an official certificate stating that—</p></intro><level class="para1" eId="regulation-14-1-a"><num>(a)</num><intro><p>the products concerned have been produced—</p></intro><level class="para2" eId="regulation-14-1-a-i"><num>(i)</num><content><p>in a production process that has been audited and found to be in compliance with the appropriate requirements in Community animal health legislation and suitable to destroy the foot-and-mouth disease virus; or</p></content></level><level class="para2" eId="regulation-14-1-a-ii"><num>(ii)</num><content><p>from pre-processed materials that have been certified accordingly; and</p></content></level></level><level class="para1" eId="regulation-14-1-b"><num>(b)</num><content><p>provisions are in place to avoid possible recontamination with the foot-and-mouth disease virus after treatment.</p></content></level></paragraph><paragraph eId="regulation-14-2"><num>(2)</num><content><p>The certificate must bear a reference to the Decision, is valid for 30 days, must state the expiry date and is renewable after inspection of the establishment.</p></content></paragraph><paragraph eId="regulation-14-3"><num>(3)</num><intro><p>In the case of products for retail sale to the final consumer, a consolidated consignment of animal products, each of which is eligible for export in accordance with these Regulations, may be exported from an approved establishment accompanied by a commercial document endorsed by the attachment of a copy of an official veterinary certificate that—</p></intro><level class="para1" eId="regulation-14-3-a"><num>(a)</num><content><p>confirms that the establishment of export has in place a system to ensure that goods can only be exported if they are traceable to documentary evidence of compliance with these Regulations;</p></content></level><level class="para1" eId="regulation-14-3-b"><num>(b)</num><content><p>confirms that this system has been audited and found satisfactory;</p></content></level><level class="para1" eId="regulation-14-3-c"><num>(c)</num><content><p>refers to the Decision;</p></content></level><level class="para1" eId="regulation-14-3-d"><num>(d)</num><content><p>is valid for 30 days;</p></content></level><level class="para1" eId="regulation-14-3-e"><num>(e)</num><content><p>states the expiry date; and</p></content></level><level class="para1" eId="regulation-14-3-f"><num>(f)</num><content><p>is renewable only after the establishment had been audited with satisfactory results.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-15"><heading>Duties of slaughterhouses and other establishments</heading><num>15.</num><paragraph eId="regulation-15-1"><num>(1)</num><intro><p>If foot-and-mouth disease is suspected in:</p></intro><level class="para1" eId="regulation-15-1-a"><num>(a)</num><content><p>a slaughterhouse;</p></content></level><level class="para1" eId="regulation-15-1-b"><num>(b)</num><content><p>premises on which farmed game are slaughtered; or</p></content></level><level class="para1" eId="regulation-15-1-c"><num>(c)</num><content><p>a game-handling establishment,</p></content></level><wrapUp><p>which handles meat controlled under these Regulations, the occupier must comply with paragraph (2).</p></wrapUp></paragraph><paragraph eId="regulation-15-2"><num>(2)</num><intro><p>The occupier must, under the supervision of the Welsh Ministers, ensure that:</p></intro><level class="para1" eId="regulation-15-2-a"><num>(a)</num><content><p>all animals present are slaughtered;</p></content></level><level class="para1" eId="regulation-15-2-b"><num>(b)</num><content><p>all meat and all dead animals are removed and disposed of in accordance with article 25(2) of the Foot-and-Mouth Disease (Wales) Order 2006<authorialNote class="footnote" eId="f00025" marker="25"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00067" href="http://www.legislation.gov.uk/id/wsi/2006/179">2006/179 (W. 30)</ref>.</p></authorialNote>;</p></content></level><level class="para1" eId="regulation-15-2-c"><num>(c)</num><content><p>the establishment is cleansed and disinfected; and</p></content></level><level class="para1" eId="regulation-15-2-d"><num>(d)</num><content><p>no meat is prepared for consigning outside the areas listed in Schedule 1 for 24 hours following the completion of the cleansing and disinfection required by sub-paragraph (c).</p></content></level></paragraph><paragraph eId="regulation-15-3"><num>(3)</num><intro><p>If an animal susceptible to foot-and-mouth disease and from premises situated in any area specified in Schedule 1 is slaughtered in any of the establishments referred to in paragraph (1), the occupier must ensure that:</p></intro><level class="para1" eId="regulation-15-3-a"><num>(a)</num><content><p>all animals present are slaughtered;</p></content></level><level class="para1" eId="regulation-15-3-b"><num>(b)</num><content><p>the establishment is cleansed and disinfected; and</p></content></level><level class="para1" eId="regulation-15-3-c"><num>(c)</num><content><p>no meat is prepared for consigning outside the areas listed in Schedule 1 until the completion of the cleansing and disinfection required by sub-paragraph (b).</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-16"><heading>Offers to dispatch or export</heading><num>16.</num><content><p>No person may offer to dispatch or export, or accept orders for the dispatch or export of, anything prohibited from being dispatched or exported by these Regulations, whether on the internet or otherwise.</p></content></hcontainer></part><part eId="part-3"><num><b>PART 3</b></num><heading>Administration and enforcement</heading><hcontainer name="regulation" eId="regulation-17"><heading>Approvals</heading><num>17.</num><paragraph eId="regulation-17-1"><num>(1)</num><content><p>The Welsh Ministers or a local authority may approve establishments, slaughterhouses or cutting plants for the purposes of these Regulations if satisfied that the occupier will comply with the conditions of these Regulations.</p></content></paragraph><paragraph eId="regulation-17-2"><num>(2)</num><content><p>Any approval must be in writing, may be made subject to conditions and may be amended, suspended or revoked by notice at any time, and in particular may be suspended or revoked if the Welsh Ministers (or in the case of an approval granted by the local authority, that local authority) are reasonably of the opinion that the provisions of these Regulations or any conditions of approval are not being complied with.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-18"><heading>Licences</heading><num>18.</num><paragraph eId="regulation-18-1"><num>(1)</num><intro><p>A veterinary inspector, or inspector acting under the direction of a veterinary inspector, may—</p></intro><level class="para1" eId="regulation-18-1-a"><num>(a)</num><content><p>grant a licence; and</p></content></level><level class="para1" eId="regulation-18-1-b"><num>(b)</num><content><p>amend, suspend or revoke a licence in writing at any time.</p></content></level></paragraph><paragraph eId="regulation-18-2"><num>(2)</num><intro><p>The licence—</p></intro><level class="para1" eId="regulation-18-2-a"><num>(a)</num><content><p>must be in writing;</p></content></level><level class="para1" eId="regulation-18-2-b"><num>(b)</num><content><p>may be general or specific; and</p></content></level><level class="para1" eId="regulation-18-2-c"><num>(c)</num><content><p>may be made subject to such conditions as the veterinary inspector considers necessary to prevent the spread of foot-and-mouth disease.</p></content></level></paragraph><paragraph eId="regulation-18-3"><num>(3)</num><intro><p>A person moving any animal under a specific licence granted under these Regulations must—</p></intro><level class="para1" eId="regulation-18-3-a"><num>(a)</num><content><p>keep the licence or a copy of it with them at all times during the licensed movement;</p></content></level><level class="para1" eId="regulation-18-3-b"><num>(b)</num><intro><p>on demand by an inspector or veterinary inspector:</p></intro><level class="para2" eId="regulation-18-3-b-i"><num>(i)</num><content><p>produce the licence, or copy;</p></content></level><level class="para2" eId="regulation-18-3-b-ii"><num>(ii)</num><content><p>allow a copy or extract of the licence to be taken; or</p></content></level><level class="para2" eId="regulation-18-3-b-iii"><num>(iii)</num><content><p>provide their name or address.</p></content></level></level></paragraph><paragraph eId="regulation-18-4"><num>(4)</num><intro><p>A person moving any animal under a general licence granted under these Regulations must—</p></intro><level class="para1" eId="regulation-18-4-a"><num>(a)</num><intro><p>keep with them at all times during the licensed movement, a consignment note that contains details of—</p></intro><level class="para2" eId="regulation-18-4-a-i"><num>(i)</num><content><p>the type, and numbers, of animals being moved;</p></content></level><level class="para2" eId="regulation-18-4-a-ii"><num>(ii)</num><content><p>the date of the movement;</p></content></level><level class="para2" eId="regulation-18-4-a-iii"><num>(iii)</num><content><p>the name of the consignor;</p></content></level><level class="para2" eId="regulation-18-4-a-iv"><num>(iv)</num><content><p>the address of the premises from which the movement started;</p></content></level><level class="para2" eId="regulation-18-4-a-v"><num>(v)</num><content><p>the name of the consignee; and</p></content></level><level class="para2" eId="regulation-18-4-a-vi"><num>(vi)</num><content><p>the address of the premises of destination; and</p></content></level></level><level class="para1" eId="regulation-18-4-b"><num>(b)</num><intro><p>on demand by an inspector or veterinary inspector—</p></intro><level class="para2" eId="regulation-18-4-b-i"><num>(i)</num><content><p>produce the consignment note and allow a copy or extract to be taken; and</p></content></level><level class="para2" eId="regulation-18-4-b-ii"><num>(ii)</num><content><p>provide their name and address.</p></content></level></level></paragraph><paragraph eId="regulation-18-5"><num>(5)</num><content><p>Licences granted in England or Scotland for activities that can be licensed in Wales under these Regulations have effect in Wales as if they were licences granted under these Regulations, but an inspector acting under the direction of the Welsh Ministers may serve a notice on any person moving any animal under such a licence, directing him or her to move it to or keep it on premises specified in the notice or move it out of Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-19"><heading>Notices</heading><num>19.</num><paragraph eId="regulation-19-1"><num>(1)</num><intro><p>A veterinary inspector, or inspector, may serve any notice issued under the Regulations on—</p></intro><level class="para1" eId="regulation-19-1-a"><num>(a)</num><content><p>the owner or keeper of an animal; or</p></content></level><level class="para1" eId="regulation-19-1-b"><num>(b)</num><content><p>the person in control of an animal, carcase or any part of an animal.</p></content></level></paragraph><paragraph eId="regulation-19-2"><num>(2)</num><intro><p>The notice must:</p></intro><level class="para1" eId="regulation-19-2-a"><num>(a)</num><content><p>be in writing and may be amended or revoked, by further notice at any time; and</p></content></level><level class="para1" eId="regulation-19-2-b"><num>(b)</num><content><p>specify how it must be complied with.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-20"><heading>Powers of inspectors</heading><num>20.</num><paragraph eId="regulation-20-1"><num>(1)</num><content><p>An inspector may, at all reasonable hours enter any place, land, installation, vehicle (including any container, trailer, semi-trailer, caravan or other thing which is designed or adapted to be towed by another vehicle), train, ship, vessel, boat, craft, hovercraft or aircraft.</p></content></paragraph><paragraph eId="regulation-20-2"><num>(2)</num><content><p>Where an inspector enters any of the places specified in paragraph (1), that inspector must produce a duly authenticated document showing the inspector’s authority, if required to do so.</p></content></paragraph><paragraph eId="regulation-20-3"><num>(3)</num><content><p>An inspector may by notice, or as a condition of a licence, require the cleansing and disinfection of premises, vehicles, equipment, or any other thing that may spread foot-and-mouth disease.</p></content></paragraph><paragraph eId="regulation-20-4"><num>(4)</num><intro><p>An inspector may—</p></intro><level class="para1" eId="regulation-20-4-a"><num>(a)</num><content><p>require the detention or isolation in a specified place of any animal by serving a notice requiring such action on the occupier of the premises where it is present, or its keeper; and</p></content></level><level class="para1" eId="regulation-20-4-b"><num>(b)</num><content><p>mark, or cause to be marked, for identification purposes any animal, carcase or thing.</p></content></level></paragraph><paragraph eId="regulation-20-5"><num>(5)</num><content><p>A veterinary inspector may inspect, or take samples from, any animal, carcase or thing.</p></content></paragraph><paragraph eId="regulation-20-6"><num>(6)</num><intro><p>An inspector may carry out all checks and examinations necessary for the enforcement of these Regulations, and in particular may—</p></intro><level class="para1" eId="regulation-20-6-a"><num>(a)</num><content><p>by notice on the person they consider to be appropriate, detain any vehicle, vessel, container or anything which they reasonably suspect to contain animals or products controlled by these Regulations and intended for export for as long as is reasonably necessary to determine whether the consignment complies with the conditions for export;</p></content></level><level class="para1" eId="regulation-20-6-b"><num>(b)</num><content><p>search any premises;</p></content></level><level class="para1" eId="regulation-20-6-c"><num>(c)</num><content><p>carry out inspections of any processes used for the marking of any animal, carcase or thing;</p></content></level><level class="para1" eId="regulation-20-6-d"><num>(d)</num><content><p>examine documentary or data-processing material relevant to the checks carried out under these Regulations, including any import or export manifest; and</p></content></level><level class="para1" eId="regulation-20-6-e"><num>(e)</num><content><p>take with them a representative of the European Commission acting for the purposes of the Decision.</p></content></level></paragraph><paragraph eId="regulation-20-7"><num>(7)</num><content><p>If any person fails to comply with a requirement in these Regulations, or a notice, approval or licence issued or granted under these Regulations, an inspector may take such steps as they consider necessary to ensure the requirement is met at the expense of that person, including the power to require, by notice, any person to take or refrain from a specified action in respect of any place, animal, vehicle or other thing.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-21"><heading>Powers of officers of Revenue and Customs</heading><num>21.</num><content><p>An Officer of Revenue and Customs may detain any vehicle, vessel, container or anything which the officer reasonably suspects to contain animals or products controlled by these Regulations for as long as is reasonably necessary to enable an inspector to exercise a power under these Regulations.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-22"><heading>Illegal consignments of products</heading><num>22.</num><paragraph eId="regulation-22-1"><num>(1)</num><content><p>This regulation has effect when an inspector, on reasonable grounds, suspects that anything other than live animals is intended to be exported in contravention of these Regulations.</p></content></paragraph><paragraph eId="regulation-22-2"><num>(2)</num><content><p>The inspector may seize it and remove it in order to have it dealt with by a justice of the peace.</p></content></paragraph><paragraph eId="regulation-22-3"><num>(3)</num><intro><p>If anything other than live animals is seized under this regulation, the inspector must inform the person appearing to the inspector to be in charge of the consignment of the inspector’s intention to have it dealt with by a justice of the peace, and—</p></intro><level class="para1" eId="regulation-22-3-a"><num>(a)</num><content><p>any person who might be liable for prosecution under these Regulations in relation to the export must, if they attend before the justice of the peace by whom the matter falls to be dealt with, be entitled to be heard and to call witnesses; and</p></content></level><level class="para1" eId="regulation-22-3-b"><num>(b)</num><content><p>the justice of the peace may, but need not, be a member of the court before which any person is charged with an offence under these Regulations in relation to that consignment.</p></content></level></paragraph><paragraph eId="regulation-22-4"><num>(4)</num><content><p>If it appears to a justice of the peace that there was an intention to export the consignment in contravention of these Regulations the justice of the peace must, unless satisfied that the consignment can be returned to the owner without risk of a further attempt to export it in contravention of these Regulations, order that the consignment be destroyed or otherwise disposed of so as to prevent it from being despatched.</p></content></paragraph><paragraph eId="regulation-22-5"><num>(5)</num><content><p>When under the preceding paragraph a justice of the peace is satisfied that there was an intention to export a consignment in breach of these Regulations, the owner, the consignor and the consignee are jointly and severally liable for the costs reasonably incurred in its removal to storage, its storage and its destruction or disposal.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-23"><heading>Obstruction</heading><num>23.</num><intro><p>No person must—</p></intro><level class="para1" eId="regulation-23-a"><num>(a)</num><content><p>intentionally obstruct any person acting in the execution of these Regulations;</p></content></level><level class="para1" eId="regulation-23-b"><num>(b)</num><content><p>without reasonable cause, fail to give to any person acting in the execution of these Regulations any assistance or information which that person may reasonably require for the purposes of his or her functions under these Regulations;</p></content></level><level class="para1" eId="regulation-23-c"><num>(c)</num><content><p>furnish to any person acting in the execution of these Regulations any information which they know to be false or misleading; or</p></content></level><level class="para1" eId="regulation-23-d"><num>(d)</num><content><p>deface, obliterate or remove any mark made by an inspector under these Regulations.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-24"><heading>Offences by bodies corporate</heading><num>24.</num><paragraph eId="regulation-24-1"><num>(1)</num><intro><p>Where a body corporate is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or connivance of, or to have been attributable to any neglect on the part of—</p></intro><level class="para1" eId="regulation-24-1-a"><num>(a)</num><content><p>any director, manager, secretary or other similar officer of the body corporate, or</p></content></level><level class="para1" eId="regulation-24-1-b"><num>(b)</num><content><p>any person who was purporting to act in any such capacity,</p></content></level><wrapUp><p>that person as well as the body corporate, is guilty of the offence and is liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="regulation-24-2"><num>(2)</num><content><p>For the purposes of this regulation, “director” in relation to a body corporate whose affairs are managed by its members, means a member of the body corporate.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-25"><heading>Penalties</heading><num>25.</num><paragraph eId="regulation-25-1"><num>(1)</num><intro><p>A person contravening any provision of these Regulations, or any conditions of an approval or licence granted, or a notice served, under these Regulations, is guilty of an offence and liable—</p></intro><level class="para1" eId="regulation-25-1-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment not exceeding three months or to both; or</p></content></level><level class="para1" eId="regulation-25-1-b"><num>(b)</num><content><p>on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-26"><heading>Authorisations, certificates, <abbr title="et cetera" xml:lang="la">etc.</abbr> issued in another part of the United Kingdom</heading><num>26.</num><paragraph eId="regulation-26-1"><num>(1)</num><content><p>Where these Regulations require any authorisation, certificate or approval to be issued or granted by the Welsh Ministers, a veterinary inspector or inspector, an equivalent document issued in another part of the United Kingdom by the relevant competent authority is valid.</p></content></paragraph><paragraph eId="regulation-26-2"><num>(2)</num><content><p>Where these Regulations require anything to be done in approved establishments or cutting plants in Wales, anything done in premises approved for those purposes in another part of the United Kingdom must be treated as if it had been processed in approved premises in Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-27"><heading>Sharing information</heading><num>27.</num><paragraph eId="regulation-27-1"><num>(1)</num><content><p>The Welsh Ministers, the Commissioners and any local authority may exchange information for the purposes of these Regulations, and may divulge information to the enforcement authorities in another part of the British Islands.</p></content></paragraph><paragraph eId="regulation-27-2"><num>(2)</num><content><p>Paragraph (1) is without prejudice to any other power of the Welsh Ministers, the Commissioners or any local authority to disclose information.</p></content></paragraph><paragraph eId="regulation-27-3"><num>(3)</num><intro><p>No person, including a servant of the Crown, may disclose any information received from the Commissioners under paragraph (1) if—</p></intro><level class="para1" eId="regulation-27-3-a"><num>(a)</num><intro><p>the information relates to a person whose identity—</p></intro><level class="para2" eId="regulation-27-3-a-i"><num>(i)</num><content><p>is specified in the disclosure; or</p></content></level><level class="para2" eId="regulation-27-3-a-ii"><num>(ii)</num><content><p>can be deduced from the disclosure;</p></content></level></level><level class="para1" eId="regulation-27-3-b"><num>(b)</num><content><p>the disclosure is for a purpose other than the purposes of these Regulations; and</p></content></level><level class="para1" eId="regulation-27-3-c"><num>(c)</num><content><p>the Commissioners have not given their prior consent to the disclosure.</p></content></level></paragraph><paragraph eId="regulation-27-4"><num>(4)</num><content><p>In this regulation, “the Commissioners” means the Commissioners for Her Majesty’s Revenue and Customs.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-28"><heading>Enforcement</heading><num>28.</num><content><p>These Regulations must be enforced by the Welsh Ministers or the local authority.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-29"><heading>Revocations</heading><num>29.</num><content><p>The Import and Export Restrictions (Foot-And-Mouth Disease) (No.6) (Wales) Regulations 2007<authorialNote class="footnote" eId="f00026" marker="26"><p><ref eId="c00068" href="http://www.legislation.gov.uk/id/wsi/2007/3140">S. 4<authorialNote class="referenceNote"><p>Regulation 5</p></authorialNote></num><heading>Additional requirements for meat</heading><paragraph eId="schedule-4-paragraph-1" class="schProv1"><num>1.</num><content><p>Where the meat is from bovine, ovine, caprine or porcine animals or farmed game it must have been transported to the approved slaughterhouse without any contact with any premises situated in the areas not specified in Schedule 3.</p></content></paragraph><paragraph eId="schedule-4-paragraph-2" class="schProv1"><num>2.</num><content><p>The meat must at all times be clearly identified, handled, stored and transported separately from meat not eligible for export.</p></content></paragraph><paragraph eId="schedule-4-paragraph-3" class="schProv1"><num>3.</num><intro><p>The meat must be inspected, along with the animal from which it derived, post-mortem by an official veterinarian—</p></intro><level class="para1" eId="schedule-4-paragraph-3-a"><num>(a)</num><content><p>in the slaughterhouse;</p></content></level><level class="para1" eId="schedule-4-paragraph-3-b"><num>(b)</num><content><p>in the case of on-farm slaughtering of farmed game, on the premises; or</p></content></level><level class="para1" eId="schedule-4-paragraph-3-c"><num>(c)</num><content><p>in the case of wild game, at the game-handling establishment,</p></content></level><wrapUp><p>with no clinical signs or evidence of foot-and-mouth disease identified.</p></wrapUp></paragraph><paragraph eId="schedule-4-paragraph-4" class="schProv1"><num>4.</num><content><p>The meat must remain in the slaughterhouse, premises or game-handling establishment for at least 24 hours after the post-mortem inspection described in paragraph 3.</p></content></paragraph></hcontainer><hcontainer name="schedule" eId="schedule-5"><num>SCHEDULE 5<authorialNote class="referenceNote"><p>Regulation 5</p></authorialNote></num><heading>Premises from which an animal may be transported for slaughter</heading><paragraph eId="schedule-5-paragraph-1" class="schProv1"><num>1.</num><content><p>The premises must be situated in the centre of a circle of at least 10 km radius in which there was no outbreak of foot-and-mouth disease during at least the 30 days prior to transport.</p></content></paragraph><paragraph eId="schedule-5-paragraph-2" class="schProv1"><num>2.</num><intro><p>The premises must have had no animal of a species susceptible to foot-and-mouth disease introduced into it during the 21 days prior to transport to slaughter of any animal in the premises susceptible to foot-and-mouth disease (except in the case of pigs, in which case the period of 21 days is reduced to 7 days), unless—</p></intro><level class="para1" eId="schedule-5-paragraph-2-a"><num>(a)</num><intro><p>such animal complies with the conditions in regulation 5(3)(c)(i) or 5(3)(d)(i) and was under the supervision of the Welsh Ministers on a single premises—</p></intro><level class="para2" eId="schedule-5-paragraph-2-a-i"><num>(i)</num><content><p>complying with paragraph 1 during the 21 days prior to its transport; and</p></content></level><level class="para2" eId="schedule-5-paragraph-2-a-ii"><num>(ii)</num><content><p>into which no animal of a species susceptible to foot-and-mouth disease was introduced during the 21 days prior to the transport of the animal (except in the case of a pig, in which case the period of 21 days is reduced to 7 days);</p></content></level></level><level class="para1" eId="schedule-5-paragraph-2-b"><num>(b)</num><content><p>a test for antibodies against the foot-and-mouth disease virus was carried out on a blood sample taken from the animal at least 10 days prior to the date of transport to the premises and produced a negative result; or</p></content></level><level class="para1" eId="schedule-5-paragraph-2-c"><num>(c)</num><content><p>the animal comes from a premises on which a serological survey pursuant to a sampling protocol suitable to detect 5% prevalence of foot-and-mouth disease with at least 95% level of confidence was conducted and produced negative results.</p></content></level></paragraph></hcontainer><hcontainer name="schedule" eId="schedule-6"><num>SCHEDULE 6<authorialNote class="referenceNote"><p>Regulation 10</p></authorialNote></num><heading>Semen and Embryos</heading><part eId="schedule-6-part-1"><num><b>PART 1</b></num><heading>Centres or premises from which semen or embryos may be collected</heading><paragraph eId="schedule-6-paragraph-1" class="schProv1"><num>1.</num><content><p>The centre or premises must have been free from foot-and mouth disease for at least three months prior to the date of collection of the semen or embryos.</p></content></paragraph><paragraph eId="schedule-6-paragraph-2" class="schProv1"><num>2.</num><content><p>It must be situated in the centre of an area of 10 km radius in which there has been no case of foot-and-mouth disease for at least the 30 days prior to the date of collection.</p></content></paragraph></part><part eId="schedule-6-part-2"><num><b>PART 2</b></num><heading>Storage conditions for frozen semen and embryos</heading><paragraph eId="schedule-6-paragraph-1" class="schProv1"><num>1.</num><content><p>Frozen bovine embryos must have been stored in accordance with the Bovine Embryo (Collection, Production and Transfer) Regulations 1995<authorialNote class="footnote" eId="f00028" marker="28"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00069" href="http://www.legislation.gov.uk/id/uksi/1995/2478">1995/2478</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="schedule-6-paragraph-2" class="schProv1"><num>2.</num><content><p>Frozen porcine semen must have been stored in accordance with Chapters I and <abbr class="acronym" title="2">II</abbr> of Annex A of Council Directive <ref eId="c00048" href="http://www.legislation.gov.uk/european/directive/1990/0429">90/429/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> laying down the animal health class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations revoke the Import and Export Restrictions (Foot-and-Mouth Disease) (No.6) (Wales) Regulations 2007. The Regulations implement the Commission Decision of 19 November 2007 amending Decision <ref eId="c00052" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> concerning certain protection measures against foot-and-mouth disease in the United Kingdom (not yet published in the Official Journal). The Commission Decision of 19 November 2007 extends the categories of, and areas from which, products derived from animals may exported.</p></blockContainer><blockContainer ukl:Name="P"><p>They regulate—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>the movement and export of live animals (regulations 3 and 4);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>the export of meat from bovine, ovine caprine and porcine animals and other biungulates, (regulation 5);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>the marking of meat not eligible for export (regulation 6);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>the export of meat products, milk and dairy products (regulations 7,8 and 9); and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(e)</num><p>the export of semen, ova or embryos of animals of the bovine, ovine, caprine or porcine species or other biungulates (regulation 10), hides and skins (regulation 11) and various animal products (regulation 12).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>They create an offence of offering to export anything which it is prohibited to export under the Regulations (regulation 16).</p></blockContainer><blockContainer ukl:Name="P"><p>They provide powers for enforcement, and powers for officers of Revenue and Customs (regulations 20 to 22) and create an offence of obstruction (regulation 23).</p></blockContainer><blockContainer ukl:Name="P"><p>Breach of the Regulations is an offence, punishable with up to two years imprisonment.</p></blockContainer><blockContainer ukl:Name="P"><p>The Regulations are enforced by the Welsh Ministers or the local authority (regulation 28).</p></blockContainer><blockContainer ukl:Name="P"><p>A regulatory impact assessment has not been prepared for these Regulations.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
