The Rating Lists (Valuation Date) (Wales) Order 2007

The Welsh Ministers make the following Order in exercise of the powers conferred on the Secretary of State by paragraph 2(3)(b) of Schedule 6 to the Local Government Finance Act 19881 and now vested in the Welsh Ministers:

Title, commencement and application1.

The title of this Order is the Rating Lists (Valuation Date) (Wales) Order 2007 and it comes into force on 1 December 2007.

This Order applies in relation to Wales.

Valuation date2.

1 April 2008 is specified under paragraph 2(3)(b) of Schedule 6 (Valuation for non-domestic rating) to the Local Government Finance Act 1988 as the day by reference to which the rateable values of non-domestic hereditaments are to be determined for the purposes of the local and central non-domestic rating lists which are to be compiled for Wales on 1 April 2010.

Revocation3.

The Rating Lists (Valuation Date) (Wales) Order 20022 is revoked in so far as it relates to Wales.

By virtue of sections 41(2) and 52(2) of the Local Government Finance Act 1988 Part III, non-domestic rating lists must be compiled on 1 April in every fifth year after 1990.

For the purposes of compiling such a list the rateable value of a non-domestic hereditament is to be determined on the day on which the list must be compiled or on such day preceding that day as may be specified by order.

This Order specifies 1 April 2008 as the day by reference to which the rateable value of a non-domestic hereditament is to be determined for the purposes of the local and central non-domestic rating lists which are to be compiled on 1 April 2010.

Article 3 revokes the Rating Lists (Valuation Date) (Wales) Order 2002.
