name="enactingText"><p>The Welsh Ministers make these Regulations in exercise of the powers vested in them by section 2(2) of the European Communities Act 1972.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, application. commencement and cessation</heading><num>1.</num><content><p>The title of these Regulations is the Import and Export Restrictions (Foot-and-Mouth Disease) (No 2) (Wales) Regulations 2007; they apply in relation to Wales and come into force at 3.45 pm on 13 August 2007 and cease to have effect on 25 August 2007.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“approved” means approved for the purposes of these Regulations in accordance with regulation 3;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Decision” means Commission Decision <ref eId="c00001" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> concerning certain protection measures against foot-and-mouth disease in the United Kingdom and repealing Decision <ref eId="c00002" href="http://www.legislation.gov.uk/european/decision/2007/0552">2007/552/<abbr class="acronym" title="European Community">EC</abbr></ref><authorialNote class="footnote" eId="f00003" marker="3"><p><abbr class="acronym" title="Official Journal">OJ</abbr> No L. 210, 10.8.2007, p.36.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“dispatch” means dispatch from a place within the restricted area to a place outside the restricted area and includes consigning for dispatch;</p></content></hcontainer><hcontainer name="definition"><content><p>“export” means export outside Great Britain and includes consigning for export;</p></content></hcontainer><hcontainer name="definition"><content><p>“inspector” means a person appointed by the Welsh Ministers or a local authority to be an inspector (including, in the case of appointment by the Welsh Ministers, a veterinary inspector) or otherwise authorised by the Welsh Ministers for the purposes of these Regulations, the Animal Health Act 1981<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00045" href="http://www.legislation.gov.uk/id/ukpga/1981/22">1981 c. 22</ref>.</p></authorialNote>, the Animals and Animal Products (Import and Export) (Wales) Regulations 2006<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00046" href="http://www.legislation.gov.uk/id/wsi/2006/1536">2006/1536 (W153)</ref>.</p></authorialNote>, the Products of Animal Origin (Third Country Imports) (Wales)Regulations 2007<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00047" href="http://www.legislation.gov.uk/id/wsi/2007/376">SI 2007/376 (W.36)</ref></p></authorialNote> and the Products of Animal Origin (Import and Export) Regulations 1996<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00048" href="http://www.legislation.gov.uk/id/uksi/1996/3124">SI 1996/3124</ref></p></authorialNote></p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="Hazard Analysis at Critical Control Points">HACCP</abbr>” means Hazard Analysis at Critical Control Points, which is a system in which the critical points of the manufacturing process have been identified, assessments have been made of the potential risks at those points, and necessary steps have been taken to minimise those risks;</p></content></hcontainer><hcontainer name="definition"><content><p>“local authority” means in relation to an area the county council or county borough council for that area;</p></content></hcontainer><hcontainer name="definition"><content><p>“restricted area” means Great Britain.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>A notice under these Regulations must be in writing, may be subject to conditions and may be amended or revoked by further notice in writing at any time.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Approvals</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>The Welsh Ministers or a local authority may approve establishments or cutting plants for the purposes of these Regulations if they are satisfied that the occupier will comply with the conditions of these Regulations.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>Any approval must be in writing, may be made subject to conditions and may be amended, suspended or revoked by notice at any time, and in particular may be suspended or revoked if the Welsh Ministers (or in the case of an approval granted by the local authority, that local authority) are reasonably of the opinion that the provisions of these Regulations are not being complied with.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Importation of live animals</heading><num>4.</num><content><p>No person may import any live animal of species susceptible to foot-and-mouth disease into Wales from another Member State.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Dispatch of live animals</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>No person may dispatch any live animal of the bovine, ovine, caprine or porcine species or any other biungulate.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>By way of derogation from paragraph (1), the Welsh Ministers may authorise the dispatch of biungulate animals originating outside the restricted area if the animals travelled through that area on main roads and railway lines.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>The Welsh Ministers may only authorise the dispatch of the biungulate animals originating outside the restricted area to another Member State if at least three days before dispatch they have notified the destination Member State, and—</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p><mod>in the case of bovine, porcine, ovine and caprine animals, the health certificate accompanying the animals bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>Animals conforming to Commission Decision <ref eId="c00003" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> of 9 August 2007 concerning certain protection measures against foot-and-mouth disease in the United Kingdom</p></item></blockList></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para1" name="regulation" eId="regulation-6"><heading>Dispatch of fresh meat, minced meat, mechanically separated meat and meat preparations</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>No person may dispatch any meat of animals of the bovine, ovine, caprine or porcine species or other biungulate coming from the restricted area or obtained from animals originating in that area.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>In this regulation, the reference to “meat” includes fresh meat, minced meat, mechanically separated meat and meat preparations as defined in points 1.10, 1.13, 1.14 and 1.15 of Annex 1 to Regulation <ref eId="c00005" href="http://www.legislation.gov.uk/european/regulation/2004/0853">(<abbr class="acronym" title="European Community">EC</abbr>) No 853/2004</ref> of the European Parliament and of the Council laying down specific hygiene rules for food of animal origin<authorialNote class="footnote" eId="f00008" marker="8"><p><abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L139, 30.4.2004, p. 55.</p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to meat bearing a health mark in accordance with Chapter <abbr class="acronym" title="3">III</abbr> of Section I of Annex I to Regulation <ref eId="c00006" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) No 854/2004</ref> of the European Parliament and of the Council laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption<authorialNote class="footnote" eId="f00009" marker="9"><p><abbr class="acronym" title="Official Journal">OJ</abbr> No L139, 30.4.2004, p.206 as last amended by Regulation <ref eId="c00049" href="http://www.legislation.gov.uk/european/regulation/2006/1791">(<abbr class="acronym" title="European Community">EC</abbr>) No 1791/2006</ref></p></authorialNote>, provided that—</p></intro><level class="para1" eId="regulation-6-3-a"><num>(a)</num><content><p>the meat is clearly identified and has been transported and stored since the date of production separately from meat not eligible, in accordance with the Decision, for dispatch outside the areas listed in Annex 1; and</p></content></level><level class="para1" eId="regulation-6-3-b"><num>(b)</num><intro><p>the meat complies with either of the following conditions—</p></intro><level class="para2" eId="regulation-6-3-b-i"><num>(i)</num><content><p>it was obtained before 15 July 2007, or</p></content></level><level class="para2" eId="regulation-6-3-b-ii"><num>(ii)</num><content><p>it is derived from animals reared for at least 90 days prior to slaughter outside the restricted area and slaughtered outside the restricted area or, in the case of meat obtained from wild game of species susceptible to foot and mouth disease, killed, outside the restricted area.</p></content></level></level></paragraph><paragraph eId="regulation-6-4"><num>(4)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to fresh meat obtained from an approved cutting plant situated in the restricted area if—</p></intro><level class="para1" eId="regulation-6-4-a"><num>(a)</num><content><p>Only fresh meat as described in paragraph (3)(b) is processed in the cutting plant in any one day</p></content></level><level class="para1" eId="regulation-6-4-b"><num>(b)</num><content><p>Cleansing and disinfection is carried out after processing any meat not meeting the requirement in sub-paragraph (a);</p></content></level><level class="para1" eId="regulation-6-4-c"><num>(c)</num><content><p>All meat bears the health mark in accordance with Chapter <abbr class="acronym" title="3">III</abbr> of Section 1 to Annex 1 of Regulation<ref eId="c00007" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) No 854/2004</ref>;</p></content></level><level class="para1" eId="regulation-6-4-d"><num>(d)</num><content><p>The cutting plant is operated under strict veterinary control; and</p></content></level><level class="para1" eId="regulation-6-4-e"><num>(e)</num><content><p>The fresh meat is clearly identified, transported and stored separately from meat which is not eligible for dispatch</p></content></level></paragraph><paragraph eId="regulation-6-5"><num>(5)</num><content><p><mod>Meat consigned to another member State must be accompanied by an official certificate from an official veterinarian which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>Meat conforming to Commission Decision <ref eId="c00008" href="http://www.legislation.gov.uk/european/decision/2007/0554">2007/554/<abbr class="acronym" title="European Community">EC</abbr></ref> of 9 August 2007 concerning certain protection measures against foot-and-mouth disease in the United Kingdom</p></item></blockList></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Dispatch of meat products</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>No person may dispatch meat products, including treated stomachs, bladders and intestines, of animals of the bovine, ovine, caprine or porcine species and other biungulates coming from the restricted area or prepared using meat obtained from such animals originating in that area.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply to meat products that have been transported and stored since the date of production separately from other meat products not eligible for dispatch, provided that the meat products—</p></intro><level class="para1" eId="regulation-7-2-a"><num>(a)</num><content><p>are clearly identified;</p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p>bear the health mark in accordance with Chapter <abbr class="acronym" title="3">III</abbr> of Section 1 of Annex I to Regulation <ref eId="c00009" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) No 854/2004</ref>/<abbr class="acronym" title="European Community">EC</abbr>; and</p></content></level><level class="para1" eId="regulation-7-2-c"><num>(c)</num><intro><p>are either—</p></intro><level class="para2" eId="regulation-7-2-c-i"><num>(i)</num><content><p>made from meats described in regulation 6(3)(b); or</p></content></level><level class="para2" eId="regulation-7-2-c-ii"><num>(ii)</num><content><p>have undergone at least one of the relevant treatments laid down for foot-and-mouth disease in Part 1 of Annex <abbr class="acronym" title="3">III</abbr> to Directive <ref eId="c00010" href="http://www.legislation.gov.uk/european/directive/2002/0099">2002/99/<abbr class="acronym" title="European Community">EC</abbr></ref> laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption<authorialNote class="footnote" eId="f00010" marker="10"><p><abbr class="acronym" title="Official Journal">OJ</abbr> No L18, 23.1.2003,p11</p></authorialNote>.</p></content></level></level></paragraph><paragraph eId="regulation-7-3"><num>(3)</num><content><p><mod>Meat products consigned to another Member State must be accompanied by a certificate from an official veterinarian which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="regulation-7-4"><num>(4)</num><content><p>Paragraph (3) does not apply to meat products which comply with paragraph (2), and which have been processed in an establishment operating <abbr title="Hazard Analysis at Critical Control Points">HACCP</abbr> and an auditable standard operating procedure that ensures that standards for treatment are met and recorded, if compliance with paragraph (2)(c)(ii) is stated in the commercial document accompanying the consignment, endorsed in accordance with regulation 14.</p></content></paragraph><paragraph eId="regulation-7-5"><num>(5)</num><content><p>Paragraph (3) does not apply to meat products heat treated in accordance with paragraph (2) (c ) (ii) stored in hermetically sealed containers so as to ensure that they are shelf stable if the heat treatment applied is stated in the commercial document accompanying the consignment.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Dispatch of milk</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><content><p>No person may dispatch milk.</p></content></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply to milk produced from animals kept in the restricted area which has been subjected to at least a treatment in accordance with—</p></intro><level class="para1" eId="regulation-8-2-a"><num>(a)</num><content><p>Part A of Annex <abbr class="acronym" title="9">IX</abbr> to Council Directive <ref eId="c00012" Directive <ref eId="c00013" href="http://www.legislation.gov.uk/european/directive/2003/0085">2003/85/<abbr class="acronym" title="European Community">EC</abbr></ref>, if the milk is not intended for human consumption or is intended for feeding to animals of species susceptible to foot-and-mouth disease.</p></content></level></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply to milk prepared in an approved establishment situated in the restricted area under the following conditions—</p></intro><level class="para1" eId="regulation-8-3-a"><num>(a)</num><intro><p>all milk used in the establishment has either—</p></intro><level class="para2" eId="regulation-8-3-a-i"><num>(i)</num><content><p>been treated in accordance with paragraph (2); or</p></content></level><level class="para2" eId="regulation-8-3-a-ii"><num>(ii)</num><content><p>has been obtained from animals reared and milked outside the restricted area</p></content></level></level><level class="para1" eId="regulation-8-3-b"><num>(b)</num><content><p>the establishment must be operated under strict veterinary control;</p></content></level><level class="para1" eId="regulation-8-3-c"><num>(c)</num><content><p>the milk is clearly identified and transported and stored separately from milk and dairy products which are not eligible for dispatch; and</p></content></level><level class="para1" eId="regulation-8-3-d"><num>(d)</num><content><p>transport of raw milk from holdings situated outside the restricted area to the establishment is carried out in vehicles which were cleansed and disinfected prior to operation and had no subsequent contact with holdings in the restricted area keeping animals of species susceptible to foot-and-mouth disease.</p></content></level></paragraph><paragraph eId="regulation-8-4"><num>(4)</num><content><p><mod>Milk consigned to another Member State must be accompanied by an official certificate which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>Milk conforming to Commission Decision <ref eId="c00014" eId="regulation-8-5"><num>(5)</num><content><p>Paragraph (4) does not apply to milk which complies with the requirements of paragraph 2(a) or (b) if such compliance is stated in the commercial document accompanying the consignment, endorsed in accordance with regulation 14, and has been processed in an establishment operating <abbr title="Hazard Analysis at Critical Control Points">HACCP</abbr> and an auditable standard operating procedure which ensures that standards for treatment are met and recorded.</p></content></paragraph><paragraph eId="regulation-8-6"><num>(6)</num><content><p>Paragraph (4) does not apply to milk which conforms with the requirements of paragraph (2)(a) or (b) and which has been heat treated in hermetically sealed containers so as to ensure that it is shelf stable provided that the commercial document accompanying the consignment states the heat treatment applied.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Dispatch of dairy products</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><content><p>No person may dispatch dairy products.</p></content></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply to dairy products—</p></intro><level class="para1" eId="regulation-9-2-a"><num>(a)</num><content><p>produced before 15 July 2007;</p></content></level><level class="para1" eId="regulation-9-2-b"><num>(b)</num><content><p>prepared from milk complying with the provisions in regulation 8(2) or (3); or</p></content></level><level class="para1" eId="regulation-9-2-c"><num>(c)</num><content><p>for export to a third country where import conditions permit such products to be subject to treatment other than laid down in regulation 8(2) which ensures the inactivation of the foot-and-mouth disease virus.</p></content></level></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply to dairy products intended for human consumption—</p></intro><level class="para1" eId="regulation-9-3-a"><num>(a)</num><content><p>produced from milk of a controlled pH less than 7.0 and subject to a heat treatment at a temperature of at least 72°C for at least 15 seconds, on the understanding that such treatment is not necessary for finished products, the ingredients of which comply with the respective animal health conditions laid down in these Regulations; or</p></content></level><level class="para1" eId="regulation-9-3-b"><num>(b)</num><content><p>produced from raw milk of bovine, ovine or caprine animals which have been resident for at least 30 days on a holding situated, within the restricted area, in the centre of a circle of at least 10 km radius where no outbreak of foot-and-mouth disease has occurred during the 30 days prior to the date of production of the raw milk, and which are subject to a maturation or ripening process of at least 90 days during which the pH is lowered below 6.0 throughout the substance, and the rind of which has been treated with 0.2% citric acid immediately prior to wrapping or packaging.</p></content></level></paragraph><paragraph eId="regulation-9-4"><num>(4)</num><intro><p>The prohibition in paragraph (1) does not apply to—</p></intro><level class="para1" eId="regulation-9-4-a"><num>(a)</num><intro><p>dairy products prepared in an approved establishment situated in the restricted area provided that—</p></intro><level class="para2" eId="regulation-9-4-a-i"><num>(i)</num><content><p>all milk used in the establishment either conforms to the conditions of regulation 8(2) or is obtained from animals outside the restricted area;</p></content></level><level class="para2" eId="regulation-9-4-a-ii"><num>(ii)</num><content><p>all dairy products used in the final product must either conform to the conditions of paragraph (2)(a) or (b) or (3) of this regulation or are made from milk obtained from animals outside the restricted area;</p></content></level><level class="para2" eId="regulation-9-4-a-iii"><num>(iii)</num><content><p>the establishment must be under strict veterinary control; and</p></content></level><level class="para2" eId="regulation-9-4-a-iv"><num>(iv)</num><content><p>the dairy products are clearly identified and transported and stored separately from milk and dairy products which are not eligible for dispatch; or</p></content></level></level><level class="para1" eId="regulation-9-4-b"><num>(b)</num><content><p>dairy products prepared in parts of the United Kingdom outside the restricted area using milk obtained before 15 July 2007 from the restricted area provided that the milk products are clearly identified and transported and stored separately from dairy products not eligible for dispatch.</p></content></level></paragraph><paragraph eId="regulation-9-5"><num>(5)</num><content><p><mod>Dairy products consigned to another Member State must be accompanied by an official certificate which bears the following words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" document accompanying the consignment.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Dispatch of semen, ova and embryos</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>No person may dispatch semen, ova or embryos of animals of the bovine, ovine, caprine and porcine species and other biungulates.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to—</p></intro><level class="para1" eId="regulation-10-2-a"><num>(a)</num><content><p>Semen, ova and embryos produced before 15 July 2007; and</p></content></level><level class="para1" eId="regulation-10-2-b"><num>(b)</num><intro><p>frozen bovine and porcine semen and bovine embryos imported into the United Kingdom in accordance with the conditions laid down in—</p></intro><level class="para2" eId="regulation-10-2-b-i"><num>(i)</num><content><p>Council Directive <ref eId="c00016" href="http://www.legislation.gov.uk/european/directive/1988/0407">88/407/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> (laying down the animal health requirements applicable to intra-Community trade in and imports of deep-frozen semen of domestic animals of the products</heading><num>12.</num><paragraph eId="regulation-12-1"><num>(1)</num><intro><p>No person may dispatch animal products of the bovine, ovine, caprine and porcine species and other biungulates not otherwise mentioned in these Regulations,—</p></intro><level class="para1" eId="regulation-12-1-a"><num>(a)</num><content><p>produced after 15 July 2007 coming from the restricted area; or</p></content></level><level class="para1" eId="regulation-12-1-b"><num>(b)</num><content><p>Obtained from animals originating from the restricted area.</p></content></level></paragraph><paragraph eId="regulation-12-2"><num>(2)</num><content><p>No person may dispatch dung or manure from animals of the bovine, ovine, caprine and porcine species and other biungulates from the restricted area.</p></content></paragraph><paragraph eId="regulation-12-3"><num>(3)</num><intro><p>The prohibition in paragraph (1) does not apply in relation to—</p></intro><level class="para1" eId="regulation-12-3-a"><num>(a)</num><intro><p>animal products that—</p></intro><level class="para2" eId="regulation-12-3-a-i"><num>(i)</num><content><p>have been subject to a heat treatment in a hermetically sealed container with a Fo value of 3,00 or more; or</p></content></level><level class="para2" eId="regulation-12-3-a-ii"><num>(ii)</num><content><p>have been subject to a heat treatment in which the centre temperature is raised to at least 70<sup>o</sup>C; or</p></content></level><level class="para2" eId="regulation-12-3-a-iii"><num>(iii)</num><content><p>were produced outside the restricted area in accordance with the conditions laid down in Regulation <ref eId="c00027" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref>, and which since introduction into the United Kingdom have been stored and transported separately from animal products not eligible for dispatch;</p></content></level></level><level class="para1" eId="regulation-12-3-b"><num>(b)</num><intro><p>blood and blood products—</p></intro><level class="para2" eId="regulation-12-3-b-i"><num>(i)</num><content><p>as defined in points 4 and 5 of Annex I to Regulation <ref eId="c00028" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref> which have been subjected to at least one of the treatments provided for in paragraph 3(a)(ii) of Part A of Chapter <abbr class="acronym" title="4">IV</abbr> of Annex <abbr class="acronym" title="8">VIII</abbr> to Regulation <ref eId="c00029" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr title="8">VIII</abbr> to Regulation (<abbr class="acronym" title="European Community">EC</abbr>)No 1774/2002;</p></content></level></level><level class="para1" eId="regulation-12-3-c"><num>(c)</num><content><p>lard and rendered fats which have been subjected to the heat treatment prescribed in paragraph 2(d)(iv) of Part B of Chapter <abbr class="acronym" title="4">IV</abbr> of Annex <abbr class="acronym" title="7">VII</abbr> to Regulation <ref eId="c00030" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr></ref> laying down animal health and public requirements governing trade in and imports into the Community of certain products<authorialNote class="footnote" eId="f00016" marker="16"><p><abbr class="acronym" title="Official Journal">OJ</abbr> No L162, 15.3.1993, p49</p></authorialNote>which have been cleaned, scraped and then either salted, bleached or dried, and where subsequently effective steps were taken to prevent the recontamination of the casings;</p></content></level><level class="para1" eId="regulation-12-3-e"><num>(e)</num><content><p>sheep wool, ruminant hair and pigs' bristles which have undergone factory washing or have been obtained from tanning and unprocessed sheep wool, ruminant hair and pigs' bristles which are securely enclosed in packaging and dry;</p></content></level><level class="para1" eId="regulation-12-3-f"><num>(f)</num><content><p>petfood conforming to the requirements of points 2 to 4 of Part B of Chapter <abbr class="acronym" title="2">II</abbr> of Annex <abbr class="acronym" title="8">VIII</abbr> to Regulation <ref eId="c00032" href="http://www.legislation.gov.uk/european/regulation/2002/1774">(<abbr class="acronym" title="European Community">EC</abbr>) No 1774/2002</ref>;</p></content></level><level class="para1" eId="regulation-12-3-g"><num>(g)</num><content><p>composite products which are not subjected to further treatment containing products of animal origin on the understanding that the treatment was not necessary for finished products the ingredients of which comply with the respective animal health conditions laid down in these Regulations;</p></content></level><level class="para1" eId="regulation-13"><heading>Exemptions</heading><num>13.</num><intro><p>The prohibitions in regulations 7, 8, 9 and 12 do not apply in relation to—</p></intro><level class="para1" eId="regulation-13-a"><num>(a)</num><content><p>products not produced in the United Kingdom and which remain in their original packaging indicating the country of origin of the products; and</p></content></level><level class="para1" eId="regulation-13-b"><num>(b)</num><intro><p>products that are—</p></intro><level class="para2" eId="regulation-13-b-i"><num>(i)</num><content><p>produced in an approved establishment in the restricted area from pre-processed products originating outside that area which, since introduction into the United Kingdom have been transported, stored and processed separately from products not eligible for dispatch; and</p></content></level><level class="para2" eId="regulation-13-b-ii"><num>(ii)</num><content><p>accompanied by a commercial document or official certificate as required by these Regulations.</p></content></level></level></hcontainer><hcontainer name="regulation" eId="regulation-14"><heading>Endorsement of commercial documents</heading><num>14.</num><paragraph eId="regulation-14-1"><num>(1)</num><intro><p>Where reference is made to a commercial document being endorsed in accordance with this regulation, the document must have attached to it an official certificate stating that—</p></intro><level class="para1" eId="regulation-14-1-a"><num>(a)</num><intro><p>the products concerned have been produced—</p></intro><level class="para2" eId="regulation-14-1-a-i"><num>(i)</num><content><p>In a production process that has been audited and found to be in compliance with the appropriate requirements in Community animal health legislation and suitable to destroy the foot-and-mouth disease virus; or</p></content></level><level class="para2" eId="regulation-14-1-a-ii"><num>(ii)</num><content><p>From pre processed materials that have been certified accordingly; and</p></content></level></level><level class="para1" eId="regulation-14-1-b"><num>(b)</num><content><p>Provisions are in place to avoid possible recontamination with the foot-and-mouth disease virus after treatment.</p></content></level></paragraph><paragraph eId="regulation-14-2"><num>(2)</num><content><p>The certificate must bear a reference to the Decision, is valid for 30 days, must state the expiry date and is renewable after inspection of the establishment.</p></content></paragraph><paragraph eId="regulation-14-3"><num>(3)</num><intro><p>In the case of products for retail sale to the final consumer, a consolidated consignment other than fresh meat, minced meat, mechanically separated meat and meat preparations, each of which is eligible for dispatch in accordance with these Regulations, may be dispatched from an approved establishment accompanied by a commercial document endorsed by the attachment of a copy of an official veterinary certificate which—</p></intro><level class="para1" eId="regulation-14-3-a"><num>(a)</num><content><p>confirms that the establishment of dispatch has in place a system to ensure that goods can only be dispatched if they are traceable to documentary evidence of compliance with these Regulations;</p></content></level><level class="para1" eId="regulation-14-3-b"><num>(b)</num><content><p>confirms that this system has been audited and found satisfactory;</p></content></level><level class="para1" eId="regulation-14-3-c"><num>(c)</num><content><p>refers to the Decision;</p></content></level><level class="para1" eId="regulation-14-3-d"><num>(d)</num><content><p>is valid for 30 days;</p></content></level><level class="para1" eId="regulation-14-3-e"><num>(e)</num><content><p>states the expiry date; and</p></content></level><level class="para1" eId="regulation-14-3-f"><num>(f)</num><content><p>is renewable only after the establishment had been audited with satisfactory results.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-15"><heading>Dispatch of equidae</heading><num>15.</num><paragraph eId="regulation-15-1"><num>(1)</num><content><p>Any person dispatching equidae must ensure that they are accompanied by a health certificate in accordance with the model in Annex C of Directive <ref eId="c00040" href="http://www.legislation.gov.uk/european/directive/1990/0426">90/426/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> on animal health conditions governing the movement and import from third countries of equidae <authorialNote class="footnote" eId="f00021" marker="21"><p><abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L224, 18.8.90, p. 42.</p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-15-2"><num>(2)</num><content><p>The certificate may only be issued for equidae coming from a holding that is not subject to official prohibition under the Foot-and-Mouth Disease (Wales) Order 2006<authorialNote class="footnote" eId="f00022" marker="22"><p><ref eId="c00053" href="http://www.legislation.gov.uk/id/wsi/2006/179">S.I 2006/179 (W.30)</ref></p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-15-3"><num>(3)</num><content><p><mod>The certificate accompanying equidae dispatched to another Member State in accordance with paragraph (1) of this regulation, must bear the following words—<quotedStructure startQuote="“" endQuote="”" Kingdom.</p></item></blockList></quotedStructure></mod></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-16"><heading>Personal exports</heading><num>16.</num><content><p>No person travelling out of the British Islands may take with them in their personal luggage or on any other non-commercial basis any product to which these Regulations apply.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-17"><heading>Offers to dispatch or export</heading><num>17.</num><content><p>No person may offer to dispatch or export, or accept orders for the dispatch or export of, anything prohibited from being dispatched or exported by these Regulations, whether on the internet or otherwise.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-18"><heading>Powers of inspectors</heading><num>18.</num><paragraph eId="regulation-18-1"><num>(1)</num><content><p>An inspector has, on producing, if required to do so, some duly authenticated document showing his or her authority, the right at all reasonable hours to enter any land or premises for the purposes of ascertaining whether there is or has been on the premises any contravention of these Regulations; and in this regulation “premises” includes any place, installation, vehicle (including any container, trailer, semi-trailer, caravan or other thing which is designed or adapted to be towed by another vehicle), train, ship, vessel, boat, craft, hovercraft or aircraft.</p></content></paragraph><paragraph eId="regulation-18-2"><num>(2)</num><intro><p>An inspector has powers to carry out all checks and examinations necessary for the enforcement of these Regulations, and in particular may—</p></intro><level class="para1" eId="regulation-18-2-a"><num>(a)</num><content><p>detain any vehicle, vessel, container or anything which he or she reasonably suspects to contain animals or products controlled by these Regulations and intended for export for as long as is reasonably necessary to determine whether the consignment complies with the conditions for export;</p></content></level><level class="para1" eId="regulation-18-2-b"><num>(b)</num><content><p>search any premises;</p></content></level><level class="para1" eId="regulation-18-2-c"><num>(c)</num><content><p>carry out inspections of any processes used for the marking and identification of animals, any premises and any installation;</p></content></level><level class="para1" eId="regulation-18-2-d"><num>(d)</num><content><p>examine documentary or data processing material relevant to the checks carried out under these Regulations including any import or export manifest; and</p></content></level><level class="para1" eId="regulation-18-2-e"><num>(e)</num><content><p>take with him or her a representative of the European Commission acting for the purposes of the Decision.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-19"><heading>Powers of officers of Revenue and Customs</heading><num>19.</num><content><p>An officer of Revenue and Customs may detain any vehicle, vessel, container or anything which he or she reasonably suspects to contain animals or products controlled by these Regulations for as long as is reasonably necessary to enable an inspector to exercise a power under these Regulations.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-20"><heading>Illegal consignments of products</heading><num>20.</num><paragraph eId="regulation-20-1"><num>(1)</num><content><p>This regulation has effect when an inspector, on reasonable grounds, suspects that anything other than live animals is intended to be dispatched in contravention of these Regulations.</p></content></paragraph><paragraph eId="regulation-20-2"><num>(2)</num><content><p>The inspector may seize it and remove it in order to have it dealt with by a justice of the peace.</p></content></paragraph><paragraph eId="regulation-20-3"><num>(3)</num><intro><p>If he or she seizes it he or she must inform the person appearing to him or her to be in charge of the consignment of his or her intention to have it dealt with by a justice of the peace, and—</p></intro><level class="para1" eId="regulation-20-3-a"><num>(a)</num><content><p>any person who might be liable for prosecution under these Regulations in relation to the dispatch is, if he or she attends before the justices of the peace by whom the consignment falls to be dealt with, entitled to be heard and to call witnesses; and</p></content></level><level class="para1" eId="regulation-20-3-b"><num>(b)</num><content><p>the justice of the peace may, but need not, be a member of the court before which any person is charged with an offence under these Regulations in relation to that consignment.</p></content></level></paragraph><paragraph eId="regulation-20-4"><num>(4)</num><content><p>If it appears to a justice of the peace that there was an intention to dispatch the consignment in contravention of these Regulations he or she must, unless he or she is satisfied that the consignment can be returned to the owner without risk of a further attempt to dispatch it in contravention of these Regulations, order that the consignment must be destroyed or otherwise disposed of so as to prevent it from being despatched.</p></content></paragraph><paragraph eId="regulation-20-5"><num>(5)</num><content><p>When under the preceding paragraph a justice of the peace is satisfied that there was an intention to dispatch a consignment in breach of these Regulations, the owner, the consignor and the consignee are jointly and severally liable for the costs reasonably incurred in its removal to storage, its storage and its destruction or disposal.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-21"><heading>Obstruction</heading><num>21.</num><intro><p>No person is to—</p></intro><level class="para1" eId="regulation-21-a"><num>(a)</num><content><p>intentionally obstruct any person acting in the execution of these Regulations;</p></content></level><level class="para1" eId="regulation-21-b"><num>(b)</num><content><p>without reasonable cause, fail to give to any person acting in the execution of these Regulations any assistance or information which that person may reasonably require for the purposes of his or her functions under these Regulations; or</p></content></level><level class="para1" eId="regulation-21-c"><num>(c)</num><content><p>furnish to any person acting in the execution of these Regulations any information which he or she knows to be false or misleading.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-22"><heading>Furnishing false information</heading><num>22.</num><content><p>No person is to furnish to any person acting in the execution of these Regulations any information which he or she knows to be false or misleading.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-23"><heading>Offences by bodies corporate</heading><num>23.</num><paragraph eId="regulation-23-1"><num>(1)</num><intro><p>Where a body corporate is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or connivance of, or to have been attributable to any neglect on the part of—</p></intro><level class="para1" eId="regulation-23-1-a"><num>(a)</num><content><p>any director, manager, secretary or other similar officer of the body corporate, or</p></content></level><level class="para1" eId="regulation-23-1-b"><num>(b)</num><content><p>any person who was purporting to act in any such capacity,</p></content></level><wrapUp><p>he or she as well as the body corporate, is guilty of the offence and is liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="regulation-23-2"><num>(2)</num><content><p>For the purposes of this regulation, “director” in relation to a body corporate whose affairs are managed by its members, means a member of the body corporate.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-24"><heading>Penalties</heading><num>24.</num><intro><p>A person contravening any provision of these Regulations is guilty of an offence and liable—</p></intro><level class="para1" eId="regulation-24-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment not exceeding three months or to both;</p></content></level><level class="para1" eId="regulation-24-b"><num>(b)</num><content><p>on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-25"><heading>Authorisations, certificates, <abbr title="et cetera" xml:lang="la">etc.</abbr> issued in another part of the British Islands</heading><num>25.</num><paragraph eId="regulation-25-1"><num>(1)</num><content><p>Where these Regulations require any authorisation, certificate or approval to be issued or granted by the Welsh Ministers in relation to Wales, an equivalent document issued in another part of the British Islands by the relevant competent authority is valid.</p></content></paragraph><paragraph eId="regulation-25-2"><num>(2)</num><content><p>Where these Regulations require anything to be done in approved establishments or cutting plants in Wales, anything done in premises approved for those purposes in another part of the British Islands must be treated as if it had been processed in approved premises in Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-26"><heading>Sharing information</heading><num>26.</num><content><p>The Welsh Ministers, the Commissioners for Her Majesty’s Revenue and Customs and any local authority may exchange information for the purposes of these Regulations and may divulge information to the enforcement authorities in another part of the British Islands.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-27"><heading>Enforcement</heading><num>27.</num><content><p>These Regulations must be enforced by the Welsh Ministers or the local authority.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-28"><heading>Revocations</heading><num>28.</num><content><p>The Import and Export
