1</b></num><heading>GENERAL</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Title, commencement, application and interpretation</heading><hcontainer name="regulation" eId="regulation-1"><num>1.</num><content><p>The title of these Regulations is the Assembly Learning Grants (European Institutions) (Wales) Regulations 2007 and they come into force on 31 August 2007.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><num>2.</num><content><p>These Regulations apply in relation to Wales.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“<abbr title="Teaching and Higher Education Act 1998 c. 30">1998 Act</abbr>” (“<i><abbr title="Deddf Addysgu ac Addysg Uwch 1998 p. 30">Deddf 1998</abbr></i>”) means the Teaching and Higher Education Act 1998;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr>” (“<i><abbr title="Rheoliadau Grantiau Dysgu y Cynulliad (Sefydliadau Ewropeaidd) (Cymru) 2006 (O.S. 2006/1794 (Cy.189))">Rheoliadau 2006</abbr></i>”) means the Assembly Learning Grant (European Institutions) (Wales) Regulations 2006<authorialNote class="footnote" eId="f00003" marker="3"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00012" href="http://www.legislation.gov.uk/id/wsi/2006/1794">2006/1794 (W.189)</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“academic authority” (“<i>awdurdod academaidd</i>”) means in, relation to an institution, the governing body or other body having the functions of a governing body and includes a person acting with the authority of that body;</p></content></hcontainer><hcontainer name="definition"><content><p>“current course” (“<i>cwrs cyfredol</i>”) means the designated course in respect of which a person is applying for support or to be recognised as an eligible student;</p></content></hcontainer><hcontainer name="definition"><content><p>“eligible student” (“<i>myfyriwr cymwys</i>”) has the meaning given by regulation 10;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="the territory comprised by the Member States of the European Community as constituted from time to time">European Community</abbr>” (“<i><abbr title="yw'r diriogaeth a ffurfir gan Aelod-wladwriaethau'r Gymuned Ewropeaidd fel y'i cyfansoddir o dro i dro">Cymuned Ewropeaidd</abbr></i>”) means the territory comprised by the Member States of the European Community as constituted from time to time;</p></content></hcontainer><hcontainer name="definition"><intro><p>“European institution” (“<i>sefydliad Ewropeaidd</i>”) means—</p></intro><level class="para1"><num>(a)</num><content><p>the Bologna Center;</p></content></level><level class="para1"><num>(b)</num><content><p>the College of Europe;</p></content></level><level class="para1"><num>(c)</num><content><p>the European University Institute;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“grants for living and other costs” (“<i>grantiau at gostau bywa chostau eraill</i>”) means the grants payable under regulations 20 or 22;</p></content></hcontainer><hcontainer name="definition"><intro><p>“person with leave to enter or remain” (“<i>person sydd â chaniatâd i ddod i mewn neu i aros</i>”) means a person—</p></intro><level class="para1"><num>(a)</num><content><p>who has been informed by a person acting under the authority of the Secretary of State for the Home Department that, although he or she is considered not to qualify for recognition as a refugee, it is thought right to allow him or her to enter or remain in the United Kingdom;</p></content></level><level class="para1"><num>(b)</num><content><p>who has been granted leave to enter or remain accordingly;</p></content></level><level class="para1"><num>(c)</num><content><p>whose period of leave to enter or remain has not expired or has been renewed and the period for which it was renewed has not expired or in respect of whose leave to enter or remain an appeal is pending (within the meaning of section 104 of the Nationality, Immigration and Asylum Act 2002<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/ukpga/2002/41">2002 c. 41</ref>.</p></authorialNote>; and</p></content></level><level class="para1"><num>(d)</num><content><p>who has been ordinarily resident in the United Kingdom and Islands throughout the period since he or she was granted leave to enter or remain;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“qualifying course” (“<i>cwrs cymwys</i>”) means a course—</p></intro><level class="para1"><num>(a)</num><content><p>which is—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>a postgraduate or comparable course; and</p></item><item><num>(ii)</num><p>of at least two academic years' duration; and</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>in respect of which the student received, for at least two academic years of the course, a statutory award other than an award intended to assist with additional expenditure that the student was obliged to incur in connection with his or her attendance on the course by reason of a disability to which he or she is or was subject;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“refugee” (“<i>ffoadur</i>”) means a person who is recognised by Her Majesty’s government as a refugee within the meaning of the United Nations Convention relating to the Status of Refugees done at Geneva on 28 July 1951<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr title="Command Paper">Cmnd.</abbr> 9171.</p></authorialNote> as extended by the Protocol theret<authorialNote class="footnote" eId="f00006" marker="6"><p><abbr title="Command Paper">Cmnd.</abbr> 3906 (out of print; photocopies are available, free of charge, from the Student Support Division, Department for Education and Skills, Mowden Hall, Staindrop Road, Darlington DL3 9BG.</p></authorialNote>);</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant date” (“<i>dyddiad perthnasol</i>”) means 1September 2007;</p></content></hcontainer><hcontainer name="definition"><content><p>“statutory award” (“<i>dyfarniad statudol</i>”) means any award bestowed, grant paid or other support provided by virtue of the <abbr title="Teaching and Higher Education Act 1998 c. 30">1998 Act</abbr> or the Education Act 1962<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00014" href="http://www.legislation.gov.uk/id/ukpga/1962/12">1962 c. 12</ref>; sections 1 to 4 and Schedule 1 were substituted by the provision sets out in Schedule 5 to the Education Act <ref eId="c00015" href="http://www.legislation.gov.uk/id/ukpga/1980/20">1980 (c. 20)</ref>. Section 1(3)(d) was amended by the Education (Grants and Awards) Act <ref eId="c00016" href="http://www.legislation.gov.uk/id/ukpga/1984/11">1984 (c. 11)</ref>, section 4. Section 4 was amended by the Education Act <ref eId="c00017" href="http://www.legislation.gov.uk/id/ukpga/1994/30">1994 (c. 30)</ref>, Schedule 2, paragraph 2. The entire Act was repealed by the Teaching and Higher Education Act <ref eId="c00018" href="http://www.legislation.gov.uk/id/ukpga/1998/30">1998 (c. 30)</ref>, section 44(2) and Schedule 4, subject to the transitional provisions and savings set out in the Teaching and Higher Education Act 1998 (Commencement <abbr title="Number">No.</abbr> 4 and Transitional Provisions) Order 1998 (<abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00019" href="http://www.legislation.gov.uk/id/uksi/1998/3237">1998/3237</ref>), article 3.</p></authorialNote>, or any comparable award, grant or other support in respect of undertaking a course which is paid out of public funds;</p></content></hcontainer><hcontainer name="definition"><content><p>“student loans legislation” (“<i>y ddeddfwriaeth ar fenthyciadau i fyfyrwyr</i>” ) means the Education (Student Loans) Act 1990, the Education (Student Loans) (Northern Ireland) Order 1990, the Education (Scotland) Act 1980 and regulations made thereunder, the Education (Student Support) (Northern Ireland) Order 1998 and regulations made thereunder or the <abbr title="Teaching and Higher Education Act 1998 c. 30">1998 Act</abbr> and regulations made thereunder;</p></content></hcontainer><hcontainer name="definition"><content><p>“supplementary grants” (“<i>grantiau atodol</i>”) means the grants payable under Chapter 4 of Part 4.</p></content></hcontainer></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Amendment of the Assembly Learning Grants (European Institutions) (Wales) Regulations 2006</heading><hcontainer name="regulation" eId="regulation-4"><num>4.</num><content><p>The <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> are amended in accordance with Schedule 1.</p></content></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Revocation and saving provisions</heading><hcontainer name="regulation" eId="regulation-5"><num>5.</num><content><p>Subject to regulations 6 and 7, the Assembly Learning Grants (European Institutions) (Wales) Regulations 2006 are revoked in relation to Wales.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-6"><num>6.</num><content><p>Regulation 5 of the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> continues to apply.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-7"><num>7.</num><content><p>The <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> are to continue to apply in relation to Wales in respect of an academic year beginning on or after 1 September 2006 but before 1 September 2007 and in respect of an academic year beginning on or after 1 September 2005 but before 1 September 2006 so far as the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> relate to an academic year beginning in that period.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-8"><num>8.</num><content><p>These Regulations apply in relation to the provision of support to students in relation to an academic year which begins on or after 1 September 2007 whether anything done under these Regulations is done before, on or after 1 September 2007.</p></content></hcontainer></hcontainer></part><part eId="part-2"><num><b>PART 2</b></num><heading>APPLYING FOR SUPPORT AND ELIGIBILITY</heading><hcontainer name="regulation" eId="regulation-9"><heading>Applications</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><content><p>Unless a person seeking support under these Regulations is already an eligible student by virtue of regulation 10(10), he or she must submit an application to be considered as an eligible student and an application for support in such form as the Welsh Ministers may require to the relevant European institution by the application deadline.</p></content></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><content><p>Where a person seeking support under these Regulations is already an eligible student by virtue of regulation 10(10), he or she must notify the Welsh Ministers in writing by the application deadline that he or she wishes to apply for support under these Regulations.</p></content></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><intro><p>The application deadline is—</p></intro><level class="para1" eId="regulation-9-3-a"><num>(a)</num><content><p>30 September 2007, in the case of the Bologna Center;</p></content></level><level class="para1" eId="regulation-9-3-b"><num>(b)</num><content><p>30 September 2007, in the case of the College of Europe; and</p></content></level><level class="para1" eId="regulation-9-3-c"><num>(c)</num><content><p>30 September 2007, in the case of the European University Institute.</p></content></level></paragraph><paragraph eId="regulation-9-4"><num>(4)</num><content><p>The Welsh Ministers may extend the application deadline if they consider that the circumstances of the case warrant it.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Eligible students</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>An eligible student qualifies for financial support in connection with his or her attendance on a designated course subject to and in accordance with these Regulations.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><intro><p>Subject to paragraphs (4) and (8), a person is an eligible student in connection with a designated course at the College of Europe or the European University Institute if—</p></intro><level class="para1" eId="regulation-10-2-a"><num>(a)</num><content><p>the academic authority of the European institution providing the designated course notifies the Welsh Ministers in writing that the person has a reasonable chance of being offered a place on that course by the academic authority; and</p></content></level><level class="para1" eId="regulation-10-2-b"><num>(b)</num><content><p>the Welsh Ministers determine in connection with an application for support under these Regulations that he or she falls within one of the categories in Part 2 of Schedule 2.</p></content></level></paragraph><paragraph eId="regulation-10-3"><num>(3)</num><intro><p>Subject to paragraphs (4) and (8), a person is an eligible student in connection with a designated course at the Bologna Center if—</p></intro><level class="para1" eId="regulation-10-3-a"><num>(a)</num><content><p>the academic authority of the Bologna Center nominates him or her for support under these Regulations by writing to the Welsh Ministers; and</p></content></level><level class="para1" eId="regulation-10-3-b"><num>(b)</num><content><p>the Welsh Ministers determine in connection with an application for support under these Regulations that he or she falls within one of the categories in Part 2 of Schedule 2.</p></content></level></paragraph><paragraph eId="regulation-10-4"><num>(4)</num><intro><p>A person is not an eligible student if—</p></intro><level class="para1" eId="regulation-10-4-a"><num>(a)</num><content><p>subject to paragraph (5), he or she has attended a qualifying course;</p></content></level><level class="para1" eId="regulation-10-4-b"><num>(b)</num><content><p>he or she is in breach of an obligation to repay any loan;</p></content></level><level class="para1" eId="regulation-10-4-c"><num>(c)</num><content><p>he or she has reached the age of 18 and not ratified any agreement for a loan made with him or her when he or she was under the age of 18; or</p></content></level><level class="para1" eId="regulation-10-4-d"><num>(d)</num><content><p>he or she has, in the opinion of the Welsh Ministers, shown himself or herself by his or her conduct to be unfitted to receive support.</p></content></level></paragraph><paragraph eId="regulation-10-5"><num>(5)</num><content><p>Paragraph (4)(a) does not apply where the person has attended a qualifying course but the Welsh Ministers have determined that having regard to the particular circumstances of that person’s case it is appropriate to pay him or her support in connection with the current course.</p></content></paragraph><paragraph eId="regulation-10-6"><num>(6)</num><content><p>For the purposes of paragraph (4)(b) and (c), “loan” means a loan made under the student loans legislation.</p></content></paragraph><paragraph eId="regulation-10-7"><num>(7)</num><intro><p>In a case where the agreement for a loan is subject to the law of Scotland, paragraph (4)(c) only applies if the agreement was made—</p></intro><level class="para1" eId="regulation-10-7-a"><num>(a)</num><content><p>before 25 September 1991; and</p></content></level><level class="para1" eId="regulation-10-7-b"><num>(b)</num><content><p>with the concurrence of the borrower’s curator or at a time when he had no curator. Paragraph (4)(c) is eligible.</p></content></level></paragraph><paragraph eId="regulation-10-8"><num>(8)</num><intro><p>Subject to paragraph (9), the number of eligible students must not exceed—</p></intro><level class="para1" eId="regulation-10-8-a"><num>(a)</num><content><p>1, in the case of the Bologna Center;</p></content></level><level class="para1" eId="regulation-10-8-b"><num>(b)</num><content><p>2, in the case of the College of Europe; and</p></content></level><level class="para1" eId="regulation-10-8-c"><num>(c)</num><content><p>1, in the case of the European University Institute.</p></content></level></paragraph><paragraph eId="regulation-10-9"><num>(9)</num><content><p>The maximum number of eligible students specified for a European Institution in sub-paragraph (8) may be exceeded if, in the Welsh Ministers' opinion, it is necessary to do so to allow a person falling within paragraph 12 of Part 2 of Schedule 2 to qualify for support for a relevant academic year.</p></content></paragraph><paragraph eId="regulation-10-10"><num>(10)</num><content><p>For the purposes of sub-paragraph (9), “relevant academic year” means an academic year beginning on or after 1 September 2007 but on or before 31 August 2008.</p></content></paragraph><paragraph eId="regulation-10-11"><num>(11)</num><content><p>An eligible student in respect of whom the first academic year of the course begins on or after 1 September 2000 shall not, at any one time, qualify for support for more than one designated course.</p></content></paragraph><paragraph eId="regulation-10-12"><num>(12)</num><intro><p>Despite paragraphs (2) to (4) and subject to paragraphs (8), (13) and (14), a person is an eligible student in connection with a designated course at a European Institution if—</p></intro><level class="para1" eId="regulation-10-12-a"><num>(a)</num><intro><p>he or she qualified as an eligible student in connection with—</p></intro><level class="para2" eId="regulation-10-12-a-i"><num>(i)</num><content><p>an earlier academic year of the current course; or</p></content></level><level class="para2" eId="regulation-10-12-a-ii"><num>(ii)</num><content><p>a designated course that he or she attended at the same European institution and from which his or her status as an eligible student was transferred to the current course; and</p></content></level></level><level class="para1" eId="regulation-10-12-b"><num>(b)</num><content><p>his or her status as an eligible student has not terminated.</p></content></level></paragraph><paragraph eId="regulation-10-13"><num>(13)</num><intro><p>Where—</p></intro><level class="para1" eId="regulation-10-13-a"><num>(a)</num><content><p>the Welsh Ministers determined that, by virtue of being a refugee or the spouse, civil partner, child or step-child of a refugee, a person (“A”) was an eligible student in connection with an application for support for an earlier year of the current course or in connection with an application for support for a designated course at the same European institution from which his or her status as an eligible student has been transferred to the current course; and</p></content></level><level class="para1" eId="regulation-10-13-b"><num>(b)</num><content><p>the refugee status of A or of his or her spouse, civil partner, parent or step-parent, as the case may be, is due to expire before the first day of the academic year in respect of which A is applying for support and, as at the day before that academic year begins, no further leave to remain has been granted and no appeal is pending (within the meaning of section 104 of the Nationality, Immigration and Asylum Act 2002),</p></content></level><wrapUp><p>A’s status as an eligible student terminates on the day before the first day of the academic year in respect of which he or she is applying for support.</p></wrapUp></paragraph><paragraph eId="regulation-10-14"><num>(14)</num><intro><p>Where—</p></intro><level class="para1" eId="regulation-10-14-a"><num>(a)</num><content><p>the Welsh Ministers determined that, by virtue of being a person with leave to enter or remain or the spouse, civil partner, child or step-child of such a person, a person (“A”) was an eligible student in connection with an application for support for an earlier year of the current course or in connection with an application for support for a designated course at the same European institution from which his or her status as an eligible student has been transferred to the current course; and</p></content></level><level class="para1" eId="regulation-10-14-b"><num>(b)</num><content><p>the period for which the person with leave to enter or remain is allowed to stay in the United Kingdom is due to expire before the first day of the academic year in respect of which A is applying for support and, as at the day before that academic year begins, no further leave to remain has been granted and no appeal is pending (within the meaning of section 104 of the Nationality, Immigration and Asylum Act 2002),</p></content></level><wrapUp><p>A’s status as an eligible student terminates on the day before the first day of the academic year in respect of which he or she is applying for support.</p></wrapUp></paragraph><paragraph eId="regulation-10-15"><num>(15)</num><content><p>Paragraphs (13) and (14) do not apply where the student began the course in connection with which the Welsh Ministers determined that he or she was an eligible student before 1 September 2007.</p></content></paragraph><paragraph eId="regulation-10-16"><num>(16)</num><content><p>The Welsh Ministers may take such steps and make such inquiries as they consider necessary to determine whether a person is an eligible student.</p></content></paragraph><paragraph eId="regulation-10-17"><num>(17)</num><content><p>The Welsh Ministers must inform a person who has been notified to them under paragraph (2)(a) or nominated under paragraph (3)(a) whether he or she qualifies as an eligible student.</p></content></paragraph><paragraph eId="regulation-10-18"><num>(18)</num><content><p>A person who has received notification from the Welsh Ministers under paragraph (11) that he or she is an eligible student in connection with a course at the College of Europe or the European University Institute and a person who is an eligible student at the College of Europe or the European University Institute by virtue of paragraph (12) must, by the deadline for receipt of financial information, provide the Welsh Ministers with any information or documentation that they request in order to determine the amount of support payable under these Regulations in respect of the academic year.</p></content></paragraph><paragraph eId="regulation-10-19"><num>(19)</num><intro><p>The deadline for receipt of financial information is—</p></intro><level class="para1" eId="regulation-10-19-a"><num>(a)</num><content><p>where the eligible student falls within paragraph 12 of Part 2 of Schedule 2, 1 January 2008 or, in the case of grants payable under regulations 20(7) or 22(6), 1 August 2008;</p></content></level><level class="para1" eId="regulation-10-19-b"><num>(b)</num><content><p>in any other case, 30 September 2007 or, in the case of grants payable under regulations 20(7) or 22(6), 28 February 2008.</p></content></level></paragraph><paragraph eId="regulation-10-20"><num>(20)</num><content><p>The Welsh Ministers must notify an eligible student of the amount of support payable in respect the academic year, if any.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Designated courses</heading><num>11.</num><intro><p>A course is designated for the purposes of section 22(1) of the <abbr title="Teaching and Higher Education Act 1998 c. 30">1998 Act</abbr> and regulation 10 if it is—</p></intro><level class="para1" eId="regulation-11-a"><num>(a)</num><content><p>a postgraduate or comparable course;</p></content></level><level class="para1" eId="regulation-11-b"><num>(b)</num><content><p>a full-time course;</p></content></level><level class="para1" eId="regulation-11-c"><num>(c)</num><content><p>of at least one academic year’s duration; and</p></content></level><level class="para1" eId="regulation-11-d"><num>(d)</num><content><p>provided by a European institution.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-12"><heading>Period of eligibility</heading><num>12.</num><paragraph eId="regulation-12-1"><num>(1)</num><content><p>Subject to the following paragraphs, a student’s status as an eligible student in connection with a designated course will terminate at the end of the academic year in which the relevant European institution would ordinarily expect the student to complete the course (“period of eligibility”).</p></content></paragraph><paragraph eId="regulation-12-2"><num>(2)</num><intro><p>The student’s period of eligibility terminates when the student—</p></intro><level class="para1" eId="regulation-12-2-a"><num>(a)</num><content><p>withdraws from his or her designated course in circumstances in which the Welsh Ministers will not transfer his or her status as an eligible student in accordance with regulation 13; or</p></content></level><level class="para1" eId="regulation-12-2-b"><num>(b)</num><content><p>abandons or is expelled from his or her designated course.</p></content></level></paragraph><paragraph eId="regulation-12-3"><num>(3)</num><content><p>The Welsh Ministers may terminate the student’s period of eligibility if they are satisfied that the conduct of the student has shown that he or she is unfitted to receive support.</p></content></paragraph><paragraph eId="regulation-12-4"><num>(4)</num><content><p>Where the student’s period of eligibility will terminate before the end of the academic year in which the student will actually complete the course, the Welsh Ministers may, at any time, extend or renew the period of eligibility for such period as they determine.</p></content></paragraph><paragraph eId="regulation-12-5"><num>(5)</num><intro><p>If the Welsh Ministers are satisfied that an eligible student has failed to comply with any requirement to provide information under these Regulations or has provided information which is inaccurate in a material particular, the Welsh Ministers may do one or more of the following—</p></intro><level class="para1" eId="regulation-12-5-a"><num>(a)</num><content><p>terminate the student’s period of eligibility;</p></content></level><level class="para1" eId="regulation-12-5-b"><num>(b)</num><content><p>determine that the student no longer qualifies for any particular type of support or particular amount of support;</p></content></level><level class="para1" eId="regulation-12-5-c"><num>(c)</num><content><p>treat any support already paid to the student as an overpayment which may be recovered in accordance with regulation 39.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-13"><heading>Transfer of eligibility</heading><num>13.</num><paragraph eId="regulation-13-1"><num>(1)</num><intro><p>Where an eligible student transfers to another designated course at the same European institution, the Welsh Ministers must transfer the student’s status as an eligible student where—</p></intro><level class="para1" eId="regulation-13-1-a"><num>(a)</num><content><p>they receive a request from the eligible student to do so;</p></content></level><level class="para1" eId="regulation-13-1-b"><num>(b)</num><content><p>they are satisfied that the eligible student has begun to attend that other course on the recommendation of the academic authority; and</p></content></level><level class="para1" eId="regulation-13-1-c"><num>(c)</num><content><p>the student’s status as an eligible student has not terminated.</p></content></level></paragraph><paragraph eId="regulation-13-2"><num>(2)</num><content><p>An eligible student who transfers under paragraph (1) is to receive in connection with the academic year of the course to which he or she transfers the remainder of the support assessed by the Welsh Ministers in respect of the academic year of the course from which he or she transfers.</p></content></paragraph><paragraph eId="regulation-13-3"><num>(3)</num><content><p>An eligible student who transfers under paragraph (1) after the Welsh Ministers have assessed support in connection with the academic year of the course from which the student is transferring but before the student completes that year may not, in connection with the academic year of the course to which he or she transfers, apply for another grant of a kind that he or she has already applied for under these Regulations in connection with the academic year of the course from which he or she is transferring.</p></content></paragraph></hcontainer></part><part eId="part-3"><num><b>PART 3</b></num><heading>PROVISION OF INFORMATION</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Information</heading><hcontainer name="regulation" eId="regulation-14"><num>14.</num><content><p>Every applicant and eligible student must, as soon as reasonably practicable after he or she is requested to do so, provide the Welsh Ministers with such information as the Welsh Ministers consider they require for the purposes of these Regulations.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-15"><num>15.</num><intro><p>Every applicant and eligible student must immediately inform the Welsh Ministers and provide the Welsh Ministers with particulars if—</p></intro><level class="para1" eId="regulation-15-a"><num>(a)</num><content><p>he or she withdraws from, abandons or is expelled from the course;</p></content></level><level class="para1" eId="regulation-15-b"><num>(b)</num><content><p>he or she transfers to another course at the same European Institution;</p></content></level><level class="para1" eId="regulation-15-c"><num>(c)</num><content><p>he or she ceases to attend the course and does not intend to or is not permitted to continue it for the remainder of the academic year;</p></content></level><level class="para1" eId="regulation-15-d"><num>(d)</num><content><p>he or she is absent from the course for more than 60 days due to illness or for any period for any other reason;</p></content></level><level class="para1" eId="regulation-15-e"><num>(e)</num><content><p>the month for the start or the completion of the course changes;</p></content></level><level class="para1" eId="regulation-15-f"><num>(f)</num><content><p>his or her home or term-time address changes.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-16"><num>16.</num><content><p>Information provided to the Welsh Ministers pursuant to these Regulations must be in the format required by the Welsh Ministers and, if the Welsh Ministers require the information to be signed by the person providing it, an electronic signature in such form as they may specify satisfies this requirement.</p></content></hcontainer></hcontainer></part><part eId="part-4"><num><b>PART 4</b></num><heading>FINANCIAL SUPPORT</heading><hcontainer name="regulation" eId="regulation-17"><heading>General</heading><num>17.</num><paragraph eId="regulation-17-1"><num>(1)</num><intro><p>Subject to paragraph (2), the general rule is that—</p></intro><level class="para1" eId="regulation-17-1-a"><num>(a)</num><content><p>an eligible student who is attending a designated course provided by the Bologna Center (“Bologna Center student”) qualifies for support in connection with an academic year of that course in accordance with the provisions of Chapter 1;</p></content></level><level class="para1" eId="regulation-17-1-b"><num>(b)</num><intro><p>an eligible student who is attending a designated course provided by the College of Europe (“College of Europe student”) qualifies in connection with an academic year of that course for—</p></intro><level class="para2" eId="regulation-17-1-b-i"><num>(i)</num><content><p>a grant for fees and grants for living and other costs in accordance with Chapter 2; and</p></content></level><level class="para2" eId="regulation-17-1-b-ii"><num>(ii)</num><content><p>supplementary grants in accordance with Chapter 4; and</p></content></level></level><level class="para1" eId="regulation-17-1-c"><num>(c)</num><intro><p>an eligible student who is attending a designated course provided by the Institute (“Institute student”) qualifies in connection with an academic year for—</p></intro><level class="para2" eId="regulation-17-1-c-i"><num>(i)</num><content><p>grants for living and other in accordance with Chapter 3; and</p></content></level><level class="para2" eId="regulation-17-1-c-ii"><num>(ii)</num><content><p>supplementary grants in accordance with Chapter 4.</p></content></level></level></paragraph><paragraph eId="regulation-17-2"><num>(2)</num><intro><p>If the academic year in respect of which the eligible student has applied for support is a year of repeat study the Welsh Ministers may determine that—</p></intro><level class="para1" eId="regulation-17-2-a"><num>(a)</num><content><p>the student does not qualify for a particular type or amount of support in respect of the year of repeat study; or</p></content></level><level class="para1" eId="regulation-17-2-b"><num>(b)</num><content><p>the student does not qualify for any support in respect of the year of repeat study.</p></content></level></paragraph><paragraph eId="regulation-17-3"><num>(3)</num><content><p>In determining whether an eligible student should not qualify for some or any support in accordance with paragraph (2) the Welsh Ministers must have regard to the circumstances of the case and in particular the reasons for which the student has been required to repeat an academic year.</p></content></paragraph><paragraph eId="regulation-17-4"><num>(4)</num><content><p>For the purposes of this regulation, “year of repeat study” means an academic year which the student has previously attended but is required by the relevant European institution to attend again.</p></content></paragraph></hcontainer><chapter eId="part-4-chapter-1"><num>CHAPTER 1</num><heading>GRANTS FOR FEES FOR BOLOGNA CENTER STUDENTS</heading><hcontainer name="regulation" eId="regulation-18"><heading>Grant for fees</heading><num>18.</num><paragraph eId="regulation-18-1"><num>(1)</num><content><p>A Bologna Center student qualifies for a grant for fees in respect of an academic year of the current course calculated in accordance with paragraph (2).</p></content></paragraph><paragraph eId="regulation-18-2"><num>(2)</num><content><p>Subject to paragraph (3), the amount of grant for fees payable in respect of an academic year is the aggregate amount of fees payable by the student in respect of, or otherwise in connection with, his or her attendance on the course during that academic year.</p></content></paragraph><paragraph eId="regulation-18-3"><num>(3)</num><content><p>Despite paragraph (2), the grant for fees payable under this regulation is not to exceed 25,580 euro.</p></content></paragraph></hcontainer></chapter><chapter eId="part-4-chapter-2"><num>CHAPTER 2</num><heading>GRANTS FOR COLLEGE OF EUROPE STUDENTS</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Grant for fees</heading><hcontainer name="regulation" eId="regulation-19"><num>19.</num><paragraph eId="regulation-19-1"><num>(1)</num><content><p>A College of Europe student qualifies for a grant for fees in respect of an academic year of the current course calculated in accordance with paragraph (2).</p></content></paragraph><paragraph eId="regulation-19-2"><num>(2)</num><content><p>Subject to paragraph (3), the amount of grant for fees payable in respect of an academic year is the aggregate amount of fees payable by the student in respect of, or otherwise in connection with, his or her attendance on the current course during that academic year.</p></content></paragraph><paragraph eId="regulation-19-3"><num>(3)</num><content><p>The maximum amount of grant for fees is 10,800 euro.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Grants for living and other costs</heading><hcontainer name="regulation" eId="regulation-20"><num>20.</num><paragraph eId="regulation-20-1"><num>(1)</num><content><p>Subject to paragraph (2), a College of Europe student qualifies in respect of an academic year for the grants for living and other costs specified in and calculated in accordance with paragraphs (3) to (7).</p></content></paragraph><paragraph eId="regulation-20-2"><num>(2)</num><content><p>A College of Europe student does not qualify for any of the grants payable under this regulation if paragraph 9 of Part 2 of Schedule 2 is the only paragraph of Part 2 of that Schedule into which the student falls.</p></content></paragraph><paragraph eId="regulation-20-3"><num>(3)</num><intro><p>A College of Europe student qualifies for a grant for living costs of an amount equal to the sum of (<b>A + B</b>) where—</p></intro><level class="para1" eId="regulation-20-3-a"><num>(a)</num><content><p><b>A</b> is £2,344; and</p></content></level><level class="para1" eId="regulation-20-3-b"><num>(b)</num><content><p><b>B</b> is £48 for each week, including a week during which the student is required to attend the College of Europe for less than 5 days, that the student is required to attend the College of Europe in excess of 30 weeks and 3 days.</p></content></level></paragraph><paragraph eId="regulation-20-4"><num>(4)</num><content><p>A College of Europe student qualifies for a grant for board and lodging of 6,000 euro.</p></content></paragraph><paragraph eId="regulation-20-5"><num>(5)</num><content><p>A College of Europe student qualifies for a grant for travel home of an amount equal to (<b>A − B</b>) where—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p><b>A</b> is the amount determined by the Welsh Ministers to be the cost of three return journeys from the student’s home address to the College of Europe; and</p></item><item><p><b>B</b> is £97.</p></item></blockList></content></paragraph><paragraph eId="regulation-20-6"><num>(6)</num><content><p>A College of Europe student qualifies for a grant for college travel of such amount as the Welsh Ministers determine to be the reasonable cost of travel from the student’s residence whilst attending the College of Europe to the College of Europe.</p></content></paragraph><paragraph eId="regulation-20-7"><num>(7)</num><content><p>Subject to the prior agreement of the Welsh Ministers before costs are incurred, a College of Europe student qualifies for a grant for research travel of such amount as the Welsh Ministers determine to be the reasonable cost of travel incurred for the purposes of completing periods of research authorised by the College of Europe during the academic year in respect of which support is being applied for.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-21"><num>21.</num><content><p>A deduction may be made in accordance with Part 5 from the amount payable in respect of any of the grants calculated in accordance with regulation 20.</p></content></hcontainer></hcontainer></chapter><chapter eId="part-4-chapter-3"><num>CHAPTER 3</num><heading>GRANTS FOR EUROPEAN UNIVERSITY INSTITUTE STUDENTS</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Grants for living and other costs</heading><hcontainer name="regulation" eId="regulation-22"><num>22.</num><paragraph eId="regulation-22-1"><num>(1)</num><content><p>Subject to paragraphs (2) and (3), a European University Institute student qualifies in respect of an academic year for the grants for living and other costs specified in and calculated in accordance with paragraphs (3) to (7).</p></content></paragraph><paragraph eId="regulation-22-2"><num>(2)</num><content><p>A European University Institute student does not qualify for any of the grants payable under this regulation if paragraph 9 of Part 2 of Schedule 2 is the only paragraph of Part 2 of that Schedule into which the student falls.</p></content></paragraph><paragraph eId="regulation-22-3"><num>(3)</num><content><p>A European University Institute student qualifies for a grant for living costs of 13,000 euro.</p></content></paragraph><paragraph eId="regulation-22-4"><num>(4)</num><content><p>A European University Institute student qualifies for a grant for travel home of the amount determined by the Welsh Ministers to be the reasonable cost of one return journey from the student’s home address to the European University Institute;</p></content></paragraph><paragraph eId="regulation-22-5"><num>(5)</num><content><p>A European University Institute student qualifies for a grant for college travel of the amount determined by the Welsh Ministers to be the reasonable cost of travel from the student’s residence whilst attending the European University Institute to the European University Institute.</p></content></paragraph><paragraph eId="regulation-22-6"><num>(6)</num><content><p>Subject to the prior agreement of the Welsh Ministers before costs are incurred, a European University Institute student qualifies for a grant for research travel of the amount determined by the Welsh Ministers to be the reasonable cost of travel incurred for the purposes of completing periods of research authorised by the European University Institute during the academic year in respect of which support is being applied for.</p></content></paragraph><paragraph eId="regulation-22-7"><num>(7)</num><content><p>A European University Institute student qualifies for a grant for medical insurance of the amount determined by the Welsh Ministers to be the reasonable cost of insuring the student against liability for the cost of medical treatment provided outside the United Kingdom where the ordinary duration of the course is more than one academic year.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-23"><num>23.</num><content><p>A deduction may be made in accordance with Part 5 from the amount payable in respect of any of the grants calculated under paragraphs (4) to (6) of regulation 22.</p></content></hcontainer></hcontainer></chapter><chapter eId="part-4-chapter-4"><num>CHAPTER 4</num><heading>SUPPLEMENTARY GRANTS</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Disabled students' allowance</heading><hcontainer name="regulation" eId="regulation-24"><num>24.</num><paragraph eId="regulation-24-1"><num>(1)</num><content><p>Subject to paragraph (2), a College of Europe student or a European University Institute student qualifies for a disabled students' allowance to assist with the additional expenditure which the Welsh Ministers are satisfied that the student is obliged to incur by reason of a disability to which he or she is subject in respect of his or her attendance at a designated course.</p></content></paragraph><paragraph eId="regulation-24-2"><num>(2)</num><content><p>A College of Europe student or a European University Institute student does not qualify for a disabled students' allowance if paragraph 9 of Part 2 of Schedule 2 is the only paragraph of Part 2 of that Schedule into which the student falls.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Amount of disabled students' allowance</heading><hcontainer name="regulation" eId="regulation-25"><num>25.</num><paragraph eId="regulation-25-1"><num>(1)</num><content><p>Subject to paragraph (2), the amount of the disabled student’s allowance is the amount that the Welsh Ministers consider appropriate in accordance with the student’s circumstances to assist with one or more types of eligible expenditure.</p></content></paragraph><paragraph eId="regulation-25-2"><num>(2)</num><content><p>The amount of disabled students' allowance must not exceed £5,915 in respect of an academic year.</p></content></paragraph><paragraph eId="regulation-25-3"><num>(3)</num><intro><p>The “types of eligible expenditure” are—</p></intro><level class="para1" eId="regulation-25-3-a"><num>(a)</num><content><p>expenditure on a non-medical personal helper;</p></content></level><level class="para1" eId="regulation-25-3-b"><num>(b)</num><content><p>expenditure on major items of specialist equipment;</p></content></level><level class="para1" eId="regulation-25-3-c"><num>(c)</num><intro><p>any additional expenditure incurred—</p></intro><level class="para2" eId="regulation-25-3-c-i"><num>(i)</num><content><p>in the country where the relevant institution is located for the purpose of attending the institution; and</p></content></level><level class="para2" eId="regulation-25-3-c-ii"><num>(ii)</num><content><p>within or outside the United Kingdom for the purpose of travelling to the relevant institution in order to attend the relevant course;</p></content></level></level></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Grant for dependants</heading><hcontainer name="regulation" eId="regulation-26"><num>26.</num><paragraph eId="regulation-26-1"><num>(1)</num><intro><p>The grant for dependants consists of the following elements—</p></intro><level class="para1" eId="regulation-26-1-a"><num>(a)</num><content><p>adult dependants' grant; and</p></content></level><level class="para1" eId="regulation-26-1-b"><num>(b)</num><content><p>parents learning allowance.</p></content></level></paragraph><paragraph eId="regulation-26-2"><num>(2)</num><content><p>The qualifying conditions for each element and the amounts payable are set out in regulations 27 to 31.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Adult dependants' grant</heading><hcontainer name="regulation" eId="regulation-27"><num>27.</num><paragraph eId="regulation-27-1"><num>(1)</num><content><p>Subject to paragraph (3), a College of Europe Student or a European University Institute student qualifies for an adult dependants' grant in connection with his or her attendance on a designated course in accordance with this regulation.</p></content></paragraph><paragraph eId="regulation-27-2"><num>(2)</num><intro><p>The adult dependants' grant is available in respect of a dependant of an eligible student who is either—</p></intro><level class="para1" eId="regulation-27-2-a"><num>(a)</num><content><p>the student’s partner; or</p></content></level><level class="para1" eId="regulation-27-2-b"><num>(b)</num><content><p>an adult dependant of the student whose net income does not exceed, £3,615.</p></content></level></paragraph><paragraph eId="regulation-27-3"><num>(3)</num><content><p>A College of Europe student or a European University Institute student does not qualify for the grant payable under this regulation if paragraph 9 of Part 2 of Schedule 2 is the only paragraph of Part 2 of that Schedule into which the student falls.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-28"><num>28.</num><intro><p>The amount of adult dependants' grant payable in respect of an academic year is calculated in accordance with regulation 30, the basic amount being—</p></intro><level class="para1" eId="regulation-28-a"><num>(a)</num><content><p>in respect of the current academic year, £2,515; or</p></content></level><level class="para1" eId="regulation-28-b"><num>(b)</num><content><p>where the person in respect of whom the student is applying for adult dependants' grant is ordinarily resident outside of the United Kingdom, such amount not exceeding £2,515 as the Welsh Ministers consider reasonable in the circumstances.</p></content></level></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Parents' learning allowance</heading><hcontainer name="regulation" eId="regulation-29"><num>29.</num><paragraph eId="regulation-29-1"><num>(1)</num><content><p>Subject to paragraph (2), a College of Europe student or a European University Institute student qualifies in connection with his or her attendance on a designated course for the parents' learning allowance if he or she has one or more dependent children.</p></content></paragraph><paragraph eId="regulation-29-2"><num>(2)</num><content><p>A College of Europe student or a European University Institute student does not qualify for the grant payable under this regulation if paragraph 9 of Part 2 of Schedule 2 is the only paragraph of Part 2 of that Schedule into which the student falls.</p></content></paragraph><paragraph eId="regulation-29-3"><num>(3)</num><content><p>The amount of parents' learning allowance payable in respect of an academic year is calculated in accordance with regulation 30, the basic amount being, £1,435.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Calculations</heading><hcontainer name="regulation" eId="regulation-30"><num>30.</num><paragraph eId="regulation-30-1"><num>(1)</num><intro><p>Subject to the following paragraphs, the amount payable in respect of a particular element of the grant for dependants for which the College of Europe student or European University Institute student qualifies under regulations 27 to 29 is the amount of that element remaining after applying, until it is extinguished or no element remains payable under regulations 27 to 29, an amount equal to (<b>A − B</b>) as follows and in the following order—</p></intro><level class="para1" eId="regulation-30-1-a"><num>(a)</num><content><p>to reduce the basic amount of the adult dependants' grant where the student qualifies for that element under regulation 27; and</p></content></level><level class="para1" eId="regulation-30-1-b"><num>(b)</num><content><p>to reduce the basic amount of parents' learning allowance where the student qualifies for that element under regulation 29.</p></content></level></paragraph><paragraph eId="regulation-30-2"><num>(2)</num><content><p>Subject to paragraphs (4) and (5), where <b>B</b> is greater than or equal to <b>A</b>, the basic amount of each element of the grant for dependants for which the student qualifies is payable.</p></content></paragraph><paragraph eId="regulation-30-3"><num>(3)</num><content><p>Where (<b>A − B</b>) is equal to or exceeds the aggregate of the basic amounts of the elements of the grant for dependants for which the eligible student qualifies, the amount payable in respect of each element is nil.</p></content></paragraph><paragraph eId="regulation-30-4"><num>(4)</num><intro><p>The amount of adult dependants' grant calculated under paragraph (1) is reduced by one half where—</p></intro><level class="para1" eId="regulation-30-4-a"><num>(a)</num><intro><p>the student’s partner—</p></intro><level class="para2" eId="regulation-30-4-a-i"><num>(i)</num><content><p>is an eligible student; or</p></content></level><level class="para2" eId="regulation-30-4-a-ii"><num>(ii)</num><content><p>holds a statutory award; and</p></content></level></level><level class="para1" eId="regulation-30-4-b"><num>(b)</num><content><p>account is taken of that partner’s dependants in calculating the amount of support for which that partner qualifies or the payment to which he or she is entitled under the statutory award.</p></content></level></paragraph><paragraph eId="regulation-30-5"><num>(5)</num><content><p>Where the amount of the parents' learning allowance calculated under paragraph (1) is £0.01 or more but less than £50, the amount of parents' learning allowance payable is £50.</p></content></paragraph><paragraph eId="regulation-30-6"><num>(6)</num><content><p>For the purposes of this regulation—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p><b>A</b> is the aggregate of the net income of each of the eligible student’s dependants; and</p></item><item><p><b>B</b> is—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>£1,100 where the student has no dependent children;</p></item><item><num>(b)</num><p>£3,300 where the student is not a lone parent and has one dependent child;</p></item><item><num>(c)</num><p>£4,405 where the student is not a lone parent and has more than one dependent child;</p></item><item><num>(d)</num><p>£4,405 where the student is a lone parent and has one dependent child;</p></item><item><num>(e)</num><p>£5,510 where the student is a lone parent and has more than one dependent child;</p></item></blockList></item></blockList></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-31"><num>31.</num><content><p>A deduction may be made in accordance with Part 5 from the amount payable in respect of a particular element of the grant for dependants calculated in accordance with regulations 27 to 30.</p></content></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Interpretation</heading><hcontainer name="regulation" eId="regulation-32"><num>32.</num><paragraph eId="regulation-32-1"><num>(1)</num><intro><p>For the purposes of regulations 27 to 31—</p></intro><level class="para1" eId="regulation-32-1-a"><num>(a)</num><content><p>“adult dependant” (“<i>dibynnydd mewn oed</i>”) means, in relation to a student, an adult person dependent on the student other than his or her child, his or her partner (including a spouse or civil partner from whom the Welsh Ministers consider the student is separated) or his or her former partner;</p></content></level><level class="para1" eId="regulation-32-1-b"><num>(b)</num><content><p>“child” (“<i>plentyn</i>”) in relation to a student includes any child of the student’s partner who is dependent on the student and any child for whom the student has parental responsibility who is dependent on him or her;</p></content></level><level class="para1" eId="regulation-32-1-c"><num>(c)</num><content><p>“dependant” (“<i>dibynnydd</i>”) means, in relation to a student, the student’s partner, his or her dependent child or an adult dependant, who in each case is not an eligible student and does not hold a statutory award;</p></content></level><level class="para1" eId="regulation-32-1-d"><num>(d)</num><content><p>“dependent” (“<i>dibynnol</i>”) means wholly or mainly financially dependent;</p></content></level><level class="para1" eId="regulation-32-1-e"><num>(e)</num><content><p>“lone parent” (“<i>rhiant unigol</i>”) means a student who does not have a partner and who has a dependent child or dependent children;</p></content></level><level class="para1" eId="regulation-32-1-f"><num>(f)</num><content><p>“net income” (“<i>incwm net</i>”) has the meaning given in paragraph (2);</p></content></level><level class="para1" eId="regulation-32-1-g"><num>(g)</num><intro><p>subject to sub-paragraphs (h), (i) and (j), “partner” (“<i>partner</i>”) means any of the following—</p></intro><level class="para2" eId="regulation-32-1-g-i"><num>(i)</num><content><p>the spouse of a student;</p></content></level><level class="para2" eId="regulation-32-1-g-ii"><num>(ii)</num><content><p>the civil partner of a student;</p></content></level><level class="para2" eId="regulation-32-1-g-iii"><num>(iii)</num><intro><p>a person ordinarily living with a student as if that person were his or her spouse where that student—</p></intro><level class="para3" eId="regulation-32-1-g-iii-aa"><num>(aa)</num><content><p>was aged 25 or over at the start of the academic year in respect of which the student’s contribution falls to be assessed; and</p></content></level><level class="para3" eId="regulation-32-1-g-iii-bb"><num>(bb)</num><content><p>started the designated course on or after 1 September 2000;</p></content></level></level><level class="para2" eId="regulation-32-1-g-iv"><num>(iv)</num><intro><p>a person ordinarily living with a student as if that person were his or her civil partner where that student—</p></intro><level class="para3" eId="regulation-32-1-g-iv-aa"><num>(aa)</num><content><p>was aged 25 or over at the start of the academic year in respect of which the student’s contribution falls to be assessed; and</p></content></level><level class="para3" eId="regulation-32-1-g-iv-bb"><num>(bb)</num><content><p>started the designated course on or after 1 September 2005;</p></content></level></level></level><level class="para1" eId="regulation-32-1-h"><num>(h)</num><intro><p>unless otherwise indicated, a person who would otherwise be a partner under sub-paragraph (g) is not to be treated as a partner if—</p></intro><level class="para2" eId="regulation-32-1-h-i"><num>(i)</num><content><p>in the opinion of the Welsh Ministers, that person and the student are separated; or</p></content></level><level class="para2" eId="regulation-32-1-h-ii"><num>(ii)</num><content><p>the person is ordinarily living outside the United Kingdom and is not maintained by the student;</p></content></level></level><level class="para1" eId="regulation-32-1-i"><num>(i)</num><content><p>for the purposes of the definition of “adult dependant”, a person is to be treated as a partner if the person would be a partner under sub-paragraph (g) but for the fact that the student with whom he or she is living was not aged 25 or over at the start of the academic year in respect of which the student’s contribution falls to be assessed;</p></content></level><level class="para1" eId="regulation-32-1-j"><num>(j)</num><content><p>for the purposes of the definitions of “child” and “lone parent”, a person is to be treated as a partner if the person would be a partner under sub-paragraph (g) but for the date on which the student began the designated course or the fact that the student with whom he or she is ordinarily resident was not aged 25 or over at the start of the academic year in respect of which the student’s contribution falls to be assessed.</p></content></level></paragraph><paragraph eId="regulation-32-2"><num>(2)</num><intro><p>Subject to paragraph (3), a dependant’s net income is his or her income from all sources for the academic year in question reduced by the amount of income tax and social security contributions payable in respect of it but disregarding—</p></intro><level class="para1" eId="regulation-32-2-a"><num>(a)</num><content><p>any pension, allowance or other benefit paid by reason of a disability or incapacity to which the dependant is subject;</p></content></level><level class="para1" eId="regulation-32-2-b"><num>(b)</num><content><p>child benefit payable under Part IX of the Social Security Contributions and Benefits Act 1992<authorialNote class="footnote" 38</ref>.</p></authorialNote>;</p></content></level><level class="para1" eId="regulation-32-2-d"><num>(d)</num><content><p>any guardian’s allowance to which the dependant is entitled under section 77 and</p></content></level><level class="para1" eId="regulation-32-2-g"><num>(g)</num><content><p>any child tax credit to which the dependant is entitled under Part 1 of the Tax Credits Act 2002.</p></content></level></paragraph><paragraph eId="regulation-32-3"><num>(3)</num><intro><p>Where a student or his or her partner makes any recurrent payments which were previously made by the student in pursuance of an obligation incurred before the first academic year of the student’s course, the partner’s net income is net income calculated in accordance with paragraph (2) reduced by—</p></intro><level class="para1" eId="regulation-32-3-a"><num>(a)</num><content><p>an amount equal to the payments in question for the academic year, if in the opinion of the Welsh Ministers the obligation has been reasonably incurred; or</p></content></level><level class="para1" eId="regulation-32-3-b"><num>(b)</num><content><p>such lesser amount, if any, as the Welsh Ministers consider appropriate if, in their opinion, a lesser obligation could reasonably have been incurred.</p></content></level></paragraph><paragraph eId="regulation-32-4"><num>(4)</num><intro><p>For the purposes of paragraph (2), where—</p></intro><level class="para1" eId="regulation-32-4-a"><num>(a)</num><content><p>the dependant is a dependent child;</p></content></level><level class="para1" eId="regulation-32-4-b"><num>(b)</num><content><p>the relevant academic year is a new academic year; and</p></content></level><level class="para1" eId="regulation-32-4-c"><num>(c)</num><content><p>payments are made to the student towards the child’s maintenance;</p></content></level><wrapUp><p>those payments are to be treated as the child’s income.</p></wrapUp></paragraph></hcontainer></hcontainer></chapter></part><part eId="part-5"><num><b>PART 5</b></num><heading>CONTRIBUTIONS</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Student’s contribution</heading><hcontainer name="regulation" eId="regulation-33"><num>33.</num><paragraph eId="regulation-33-1"><num>(1)</num><content><p>A College of Europe student or a European University Institute student’s contribution in respect of an academic year is the amount, if any, calculated under Schedule 3.</p></content></paragraph><paragraph eId="regulation-33-2"><num>(2)</num><content><p>For the purposes of the exercise of the Welsh Ministers' functions under these Regulations the Welsh Ministers may require a student to provide from time to time such information as they require in order to assess the student’s contribution.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Application of the student’s contribution</heading><hcontainer name="regulation" eId="regulation-34"><num>34.</num><paragraph eId="regulation-34-1"><num>(1)</num><intro><p>The contribution calculated in accordance with regulation 33 must be applied—</p></intro><level class="para1" eId="regulation-34-1-a"><num>(a)</num><content><p>in the case of a College of Europe student in accordance with regulation 35; and</p></content></level><level class="para1" eId="regulation-34-1-b"><num>(b)</num><content><p>in the case of a European University Institute student in accordance with regulation 36.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-35"><num>35.</num><paragraph eId="regulation-35-1"><num>(1)</num><intro><p>In the case of a College of Europe student, the Welsh Ministers must apply the student’s contribution—</p></intro><level class="para1" eId="regulation-35-1-a"><num>(a)</num><content><p>first, to reduce the amount of grant for living costs calculated under regulation 20(3);</p></content></level><level class="para1" eId="regulation-35-1-b"><num>(b)</num><intro><p>second—</p></intro><level class="para2" eId="regulation-35-1-b-i"><num>(i)</num><intro><p>in the case of a student who is eligible for the grant for dependants, to reduce in the following order—</p></intro><level class="para3" eId="regulation-35-1-b-i-aa"><num>(aa)</num><content><p>the amount of any adult dependants' grant calculated in accordance with regulation 30</p></content></level><level class="para3" eId="regulation-35-1-b-i-bb"><num>(bb)</num><content><p>the amount of any parents' learning allowance calculated in accordance with regulation 30; and</p></content></level><level class="para3" eId="regulation-35-1-b-i-cc"><num>(cc)</num><content><p>the amount of any grant for board and lodging calculated in accordance with regulation 20(4);</p></content></level></level><level class="para2" eId="regulation-35-1-b-ii"><num>(ii)</num><content><p>in any other case, to reduce the amount of grant for board and lodging calculated under regulation 20(4);</p></content></level></level><level class="para1" eId="regulation-35-1-c"><num>(c)</num><content><p>third, to reduce the amount of grant for travel home calculated in accordance with regulation 20(5);</p></content></level><level class="para1" eId="regulation-35-1-d"><num>(d)</num><content><p>fourth, to reduce the amount of grant for college travel calculated in accordance with regulation 20(6);</p></content></level><level class="para1" eId="regulation-35-1-e"><num>(e)</num><content><p>fifth, subject to paragraph (2), to reduce the amount of grant for research travel calculated in accordance with regulation 20(7).</p></content></level></paragraph><paragraph eId="regulation-35-2"><num>(2)</num><content><p>Where the contribution available to reduce the amount of grant for research travel in accordance with paragraph (1)(e) exceeds the amount of that grant calculated under regulation 20(7), the amount of that grant payable to the student is nil.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-36"><num>36.</num><paragraph eId="regulation-36-1"><num>(1)</num><intro><p>In the case of a European University Institute student, the Welsh Ministers must apply the student’s contribution—</p></intro><level class="para1" eId="regulation-36-1-a"><num>(a)</num><content><p>first, to reduce the amount of grant for living costs calculated in accordance with regulation 22(3);</p></content></level><level class="para1" eId="regulation-36-1-b"><num>(b)</num><intro><p>second—</p></intro><level class="para2" eId="regulation-36-1-b-i"><num>(i)</num><intro><p>in the case of a student who is eligible for the grant for dependants, to reduce in the following order—</p></intro><level class="para3" eId="regulation-36-1-b-i-aa"><num>(aa)</num><content><p>the amount of any adult dependants' grant calculated in accordance with regulation 30;</p></content></level><level class="para3" eId="regulation-36-1-b-i-bb"><num>(bb)</num><content><p>the amount of any parents' learning allowance calculated in accordance with regulation 30; and</p></content></level><level class="para3" eId="regulation-36-1-b-i-cc"><num>(cc)</num><content><p>the amount of any grant for travel home calculated in accordance with regulation 22(4);</p></content></level></level><level class="para2" eId="regulation-36-1-b-ii"><num>(ii)</num><content><p>in any other case, to reduce the amount of grant for travel home calculated in accordance with regulation 22(4);</p></content></level></level><level class="para1" eId="regulation-36-1-c"><num>(c)</num><content><p>third, to reduce the amount of grant for college travel calculated in accordance with regulation 22(5).</p></content></level><level class="para1" eId="regulation-36-1-d"><num>(d)</num><content><p>fourth, subject to paragraph (2), to reduce the amount of grant for research travel calculated in accordance with regulation 22(6).</p></content></level></paragraph><paragraph eId="regulation-36-2"><num>(2)</num><content><p>Where the contribution available to reduce the amount of grant for research travel in accordance with paragraph (1)(d) exceeds the amount of that grant calculated under regulation 22(6), the amount of that grant payable to the student is nil.</p></content></paragraph></hcontainer></hcontainer></part><part eId="part-6"><num><b>PART 6</b></num><heading>PAYMENTS</heading><hcontainer name="regulation" eId="regulation-37"><heading>Payment of grant for fees</heading><num>37.</num><paragraph eId="regulation-37-1"><num>(1)</num><content><p>The Welsh Ministers must not pay the grant for fees for which a student qualifies until they have received a valid request for payment from the academic authority.</p></content></paragraph><paragraph eId="regulation-37-2"><num>(2)</num><content><p>The Welsh Ministers may make the payments of the grant for fees to the academic authority in such instalments and at such times as they consider to be appropriate.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-38"><heading>Payment of grants for living and other costs and supplementary grants</heading><num>38.</num><paragraph eId="regulation-38-1"><num>(1)</num><content><p>The Welsh Ministers may pay the grants for living and other costs and the supplementary grants for which a student qualifies in such instalments and at such times as they consider appropriate.</p></content></paragraph><paragraph eId="regulation-38-2"><num>(2)</num><content><p>The Welsh Ministers may, if they consider it appropriate to do so, pay the grant payable under regulation 20(4) or regulation 22(3) to the relevant academic authority for the authority to pay the relevant grant on their behalf.</p></content></paragraph><paragraph eId="regulation-38-3"><num>(3)</num><content><p>Where a final assessment of the amount of grants for living and other costs or supplementary grants payable to a student cannot be made on the basis of the information provided by the student, the Welsh Ministers may make provisional payments of those grants pending the final assessment.</p></content></paragraph><paragraph eId="regulation-38-4"><num>(4)</num><content><p>The Welsh Ministers may, if they consider it appropriate to do so, make a payment of disabled students' allowance before the start of the academic year in respect of which that payment is due.</p></content></paragraph><paragraph eId="regulation-38-5"><num>(5)</num><content><p>Where the circumstances in regulation 15(a) or regulation 15(c) apply, the Welsh Ministers must not make any payments of support to a student after the date on which he or she stops attending his or her course unless they consider it appropriate to do so taking into account the circumstances of the student’s case.</p></content></paragraph><paragraph eId="regulation-38-6"><num>(6)</num><intro><p>The Welsh Ministers must not make any payments of support to a student who is absent from the course—</p></intro><level class="para1" eId="regulation-38-6-a"><num>(a)</num><content><p>for more than 60 days due to illness; or</p></content></level><level class="para1" eId="regulation-38-6-b"><num>(b)</num><content><p>for any period for any other reason,</p></content></level><wrapUp><p>unless they consider that it is appropriate to do so taking into account the circumstances of the student’s case.</p></wrapUp></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-39"><heading>Overpayments</heading><num>39.</num><paragraph eId="regulation-39-1"><num>(1)</num><content><p>The Welsh Ministers may recover any overpayment of grant for fees from the academic authority.</p></content></paragraph><paragraph eId="regulation-39-2"><num>(2)</num><content><p>An eligible student must, if required to do so by the Welsh Ministers, repay any amount paid to that student under Part 4 which for whatever reason exceeds the amount of support to which he or she is entitled under Part 4.</p></content></paragraph></hcontainer></part><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">Jane E. (5);</p></content></hcontainer><hcontainer name="definition"><content><p>“Swiss self-employed person” (“<i>person hunangyflogedig Swisaidd</i>”) means a Swiss national who is or, in the case of a person who applies for support after the moving date, was a self-employed person, other than a Swiss frontier self-employed person, in the United Kingdom;</p></content></hcontainer><hcontainer name="definition"><intro><p>“Turkish worker” (“<i>gweithiwr Twrcaidd</i>”) means a Turkish national who on the relevant date—</p></intro><level class="para1"><num>(a)</num><content><p>was ordinarily resident in the United Kingdom and Islands; and</p></content></level><level class="para1"><num>(b)</num><content><p>was, or had been, lawfully employed in the United Kingdom.</p></content></level></hcontainer><hcontainer name="definition"><content><p>“United Kingdom national” (“<i>gwladolyn y Deyrnas Unedig</i>”) means a person who falls to be treated as a national of the United Kingdom for the purposes of the Community Treaties;</p></content></hcontainer><hcontainer name="definition"><content><p>“worker” (“<i>gweithiwr</i>”) means a worker within the meaning of Article 7 of Directive 2004/38 or the <abbr class="acronym" title="European Economic Area">EEA</abbr> Agreement, as the case may be.</p></content></hcontainer></subparagraph><subparagraph eId="schedule-2-paragraph-1-2"><num>(2)</num><intro><p>“<abbr class="acronym" title="European Economic Area">EEA</abbr> frontier self-employed person” (“<i>person hunangyflogedig y ffin o'r AEE</i>”) means an <abbr class="acronym" title="European Economic Area">EEA</abbr> national who—</p></intro><level class="para1" eId="schedule-2-paragraph-1-2-a"><num>(a)</num><content><p>is a self-employed person in Wales; and</p></content></level><level class="para1" eId="schedule-2-paragraph-1-2-b"><num>(b)</num><content><p>resides in Switzerland or in the territory of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State other than the United Kingdom and returns to his or her residence in Switzerland or that <abbr class="acronym" title="European Economic Area">EEA</abbr> State, as the case may be, daily or at least once a week.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-1-3"><num>(3)</num><intro><p>“<abbr class="acronym" title="European Economic Area">EEA</abbr> frontier worker” (“<i>gweithiwr y ffin o'r AEE</i>” ) means an <abbr class="acronym" title="European Economic Area">EEA</abbr> national who—</p></intro><level class="para1" eId="schedule-2-paragraph-1-3-a"><num>(a)</num><content><p>is a worker in Wales; and</p></content></level><level class="para1" eId="schedule-2-paragraph-1-3-b"><num>(b)</num><content><p>resides in Switzerland or in the territory of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State other than the United Kingdom and returns to his or her residence in Switzerland or that <abbr class="acronym" title="European Economic Area">EEA</abbr> State, as the case may be, daily or at least once a week.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-1-4"><num>(4)</num><intro><p>“Swiss frontier employed person” (“<i>person cyflogedig Swisaidd y ffin</i>” ) means a Swiss national who—</p></intro><level class="para1" eId="schedule-2-paragraph-1-4-a"><num>(a)</num><content><p>is an employed person in Wales; and</p></content></level><level class="para1" eId="schedule-2-paragraph-1-4-b"><num>(b)</num><content><p>resides in Switzerland or in the territory of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State other than the United Kingdom and returns to his or her residence in Switzerland or that <abbr class="acronym" title="European Economic Area">EEA</abbr> State, as the case may be, daily or at least once a week.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-1-5"><num>(5)</num><intro><p>“Swiss frontier self-employed person” (“<i>person hunangyflogedig Swisaidd y ffin</i>”) means a Swiss national who—</p></intro><level class="para1" eId="schedule-2-paragraph-1-5-a"><num>(a)</num><content><p>is a self-employed person in Wales; and</p></content></level><level class="para1" eId="schedule-2-paragraph-1-5-b"><num>(b)</num><content><p>resides in Switzerland or in the territory of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State other than the United Kingdom and returns to his or her residence in Switzerland or that <abbr class="acronym" title="European Economic Area">EEA</abbr> State, as the case may be, daily or at least once a week.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-1-6"><num>(6)</num><content><p>For the purposes of this Schedule, “parent” includes a guardian, any other person having parental responsibility for a child and any person having care of a child and “child” is to be construed accordingly.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-1-7"><num>(7)</num><intro><p>For the purposes of this Schedule, a person is to be treated as ordinarily resident in Wales, the United Kingdom and Islands, the territory comprising the European Economic Area and Switzerland or the territory comprising the European Economic Area, Switzerland and Turkey if he or she would have been so resident but for the fact that-—</p></intro><level class="para1" eId="schedule-2-paragraph-1-7-a"><num>(a)</num><content><p>he or she;</p></content></level><level class="para1" eId="schedule-2-paragraph-1-7-b"><num>(b)</num><content><p>his or her spouse or civil partner;</p></content></level><level class="para1" eId="schedule-2-paragraph-1-7-c"><num>(c)</num><content><p>his or her parent; or</p></content></level><level class="para1" eId="schedule-2-paragraph-1-7-d"><num>(d)</num><content><p>in the case of a dependent direct relative in the ascending line, his or her child or child’s spouse or civil partner,</p></content></level><wrapUp><p>is or was temporarily employed outside the area in question.</p></wrapUp></subparagraph><subparagraph eId="schedule-2-paragraph-1-8"><num>(8)</num><intro><p>For the purposes of sub-paragraph (7), temporary employment outside of Wales, the United Kingdom and Islands, the territory comprising the European Economic Area and Switzerland or the territory comprising the European Economic Area, Switzerland and Turkey includes—</p></intro><level class="para1" eId="schedule-2-paragraph-1-8-a"><num>(a)</num><content><p>in the case of members of the regular naval, military or air forces of the Crown, any period which they serve outside the United Kingdom as members of such forces;</p></content></level><level class="para1" eId="schedule-2-paragraph-1-8-b"><num>(b)</num><content><p>in the case of members of the regular armed forces of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, any period which they serve outside the territory comprising the European Economic Area and Switzerland as members of such forces; and</p></content></level><level class="para1" eId="schedule-2-paragraph-1-8-c"><num>(c)</num><content><p>in the case of members of the regular armed forces of Turkey, any period which they serve outside of the territory comprising the European Economic Area, Switzerland and Turkey as members of such forces.</p></content></level></subparagraph></paragraph></hcontainer></part><part eId="schedule-2-part-2"><num><b>PART 2</b></num><heading>Categories</heading><hcontainer name="crossheading" class="schGroup7"><heading>Persons who are settled in the United Kingdom</heading><paragraph eId="schedule-2-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-2-paragraph-2-1"><num>(1)</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-2-1-a"><num>(a)</num><content><p>is settled in the United Kingdom on the relevant date other than by reason of having acquired a right of permanent residence;</p></content></level><level class="para1" eId="schedule-2-paragraph-2-1-b"><num>(b)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-2-1-c"><num>(c)</num><content><p>had been ordinarily resident throughout the three-year period preceding the relevant date in the United Kingdom and Islands; and</p></content></level><level class="para1" eId="schedule-2-paragraph-2-1-d"><num>(d)</num><content><p>had not during any part of the period referred to in paragraph (c) been ordinarily resident in the United Kingdom and Islands wholly or mainly for the purpose of receiving full-time education.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-2-2"><num>(2)</num><content><p>Paragraph (d) of sub-paragraph (1) does not apply to a person who is treated as being ordinarily resident in the United Kingdom and Islands in accordance with paragraph 1(7).</p></content></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-3" class="schProv1"><num>3.</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-3-a"><num>(a)</num><content><p>who is settled in the United Kingdom on the relevant date by reason of having acquired the right of permanent residence;</p></content></level><level class="para1" eId="schedule-2-paragraph-3-b"><num>(b)</num><content><p>who is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-3-c"><num>(c)</num><content><p>who had been ordinarily resident in the United Kingdom throughout the three-year period preceding the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-3-d"><num>(d)</num><content><p>who, in a case where his or her ordinary residence referred to in paragraph (c) was wholly or mainly for the purpose of receiving full-time education, was ordinarily resident in the territory comprising the European Economic Area and Switzerland immediately before the period of ordinary residence referred to in paragraph (c).</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Refugees and persons with leave to enter or remain</heading><paragraph eId="schedule-2-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-2-paragraph-4-1"><num>(1)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-4-1-a"><num>(a)</num><content><p>who is a refugee;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-1-b"><num>(b)</num><content><p>who is ordinarily resident in the United Kingdom and Islands and has not ceased to be so resident since he or she was recognised as a refugee; and</p></content></level><level class="para1" eId="schedule-2-paragraph-4-1-c"><num>(c)</num><content><p>who is ordinarily resident in Wales on the relevant date.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-4-2"><num>(2)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-4-2-a"><num>(a)</num><content><p>who is the spouse or civil partner of a refugee;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-2-b"><num>(b)</num><content><p>who was the spouse or civil partner of the refugee on the date on which the refugee made his or her application for asylum;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-2-c"><num>(c)</num><content><p>who is ordinarily resident in the United Kingdom and Islands and has not ceased to be so resident since he or she was given leave to remain in the United Kingdom; and</p></content></level><level class="para1" eId="schedule-2-paragraph-4-2-d"><num>(d)</num><content><p>who is ordinarily resident in Wales on the relevant date.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-4-3"><num>(3)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-4-3-a"><num>(a)</num><content><p>who is the child of a refugee or the child of the spouse or civil partner of a refugee;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-3-b"><num>(b)</num><content><p>who, on the date on which the refugee made his or her application for asylum, was the child of the refugee or the child of a person who was the spouse or civil partner of the refugee on that date;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-3-c"><num>(c)</num><content><p>who was under 18 on the date on which the refugee made his or her application for asylum;</p></content></level><level class="para1" eId="schedule-2-paragraph-4-3-d"><num>(d)</num><content><p>who is ordinarily resident in the United Kingdom and Islands and has not ceased to be so resident since he or she was given leave to remain in the United Kingdom; and</p></content></level><level class="para1" eId="schedule-2-paragraph-4-3-e"><num>(e)</num><content><p>who is ordinarily resident in Wales on the relevant date.</p></content></level></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-5" class="schProv1"><num>5.</num><subparagraph eId="schedule-2-paragraph-5-1"><num>(1)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-5-1-a"><num>(a)</num><content><p>with leave to enter or remain;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-1-b"><num>(b)</num><content><p>who is ordinarily resident in Wales on the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-5-1-c"><num>(c)</num><content><p>who has been ordinarily resident in the United Kingdom and Islands throughout the three-year period preceding the relevant date.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-5-2"><num>(2)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-5-2-a"><num>(a)</num><content><p>who is the spouse or civil partner of a person with leave to enter or remain;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-2-b"><num>(b)</num><content><p>who was the spouse or civil partner of the person with leave to enter or remain on the date on which that person made his or her application for asylum;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-2-c"><num>(c)</num><content><p>who is ordinarily resident in Wales on the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-5-2-d"><num>(d)</num><content><p>who has been ordinarily resident in the United Kingdom and Islands throughout the three-year period preceding the relevant date.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-5-3"><num>(3)</num><intro><p>A person—</p></intro><level class="para1" eId="schedule-2-paragraph-5-3-a"><num>(a)</num><content><p>who is the child of a person with leave to enter or remain or the child of the spouse or civil partner of a person with leave to enter or remain;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-3-b"><num>(b)</num><content><p>who, on the date on which the person with leave to enter or remain made his or her application for asylum, was the child of that person or the child of a person who was the spouse or civil partner of the person with leave to enter or remain on that date;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-3-c"><num>(c)</num><content><p>who was under 18 on the date on which the person with leave to enter or remain made his or her application for asylum;</p></content></level><level class="para1" eId="schedule-2-paragraph-5-3-d"><num>(d)</num><content><p>who is ordinarily resident in Wales on the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-5-3-e"><num>(e)</num><content><p>who has been ordinarily resident in the United Kingdom and Islands throughout the three-year period preceding the relevant date.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Workers, employed persons, self-employed persons and their family members</heading><paragraph eId="schedule-2-paragraph-6" class="schProv1"><num>6.</num><subparagraph eId="schedule-2-paragraph-6-1"><num>(1)</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-6-1-a"><num>(a)</num><intro><p>on the relevant date, is—</p></intro><level class="para2" eId="schedule-2-paragraph-6-1-a-i"><num>(i)</num><content><p>an <abbr class="acronym" title="European Economic Area">EEA</abbr> migrant worker or an <abbr class="acronym" title="European Economic Area">EEA</abbr> self-employed person;</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-ii"><num>(ii)</num><content><p>a Swiss employed person or a Swiss self-employed person;</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-iii"><num>(iii)</num><content><p>a family member of a person mentioned in paragraph (i) or (ii);</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-iv"><num>(iv)</num><content><p>an <abbr class="acronym" title="European Economic Area">EEA</abbr> frontier worker or an <abbr class="acronym" title="European Economic Area">EEA</abbr> frontier self-employed person;</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-v"><num>(v)</num><content><p>a Swiss frontier employed person or a Swiss frontier self-employed person; or</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-vi"><num>(vi)</num><content><p>a family member of a person in (iv) or (v);</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-vii"><num>(vii)</num><content><p>subject to sub-paragraph (2), is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para2" eId="schedule-2-paragraph-6-1-a-viii"><num>(viii)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area and Switzerland throughout the three-year period preceding the relevant date.</p></content></level></level></subparagraph><subparagraph eId="schedule-2-paragraph-6-2"><num>(2)</num><content><p>Paragraph (b) of sub-paragraph (1) does not apply where the person applying for support falls within paragraph (a)(iv), (v) or (vi) of sub-paragraph (1).</p></content></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-7" class="schProv1"><num>7.</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-7-a"><num>(a)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-7-b"><num>(b)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area and Switzerland throughout the three-year period preceding the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-7-c"><num>(c)</num><content><p>is entitled to support by virtue of article 12 of Council Regulation <ref eId="c00002" href="http://www.legislation.gov.uk/european/regulation/1968/1612">(<abbr class="acronym" title="European Economic Community">EEC</abbr>) <abbr title="Number">No.</abbr> 1612/68</ref> on the freedom of movement of workers<authorialNote class="footnote" eId="f00015" marker="15"><p><abbr class="acronym" title="Official Journal">OJ</abbr> No L257, 19.10.1968, p.2 (<abbr class="acronym" title="Official Journal">OJ</abbr>/SE 1968 (ii) p.475).</p></authorialNote>,as extended by the <abbr class="acronym" title="European Economic Area">EEA</abbr> Agreement.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Persons who are settled in the United Kingdom and have exercised a right of residence elsewhere</heading><paragraph eId="schedule-2-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-2-paragraph-8-1"><num>(1)</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-8-1-a"><num>(a)</num><content><p>is settled in the United Kingdom;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-1-b"><num>(b)</num><content><p>left the United Kingdom and exercised a right of residence after having been settled in the United Kingdom;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-1-c"><num>(c)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-1-d"><num>(d)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area and Switzerland throughout the three-year period preceding the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-8-1-e"><num>(e)</num><content><p>in a case where his or her ordinary residence referred to in paragraph (b) was wholly or mainly for the purposes of receiving full-time education, was ordinarily resident in the territory comprising the European Economic Area and Switzerland immediately before the period of ordinary residence referred to in paragraph (d).</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-8-2"><num>(2)</num><content><p>For the purposes of this paragraph, a person has exercised a right of residence if he or she is a United Kingdom national, a family member of a United Kingdom national for the purposes of Article 7 of Directive 2004/38 (or corresponding purposes under the <abbr class="acronym" title="European Economic Area">EEA</abbr> Agreement or Swiss Agreement) or a person who has the right of permanent residence who in each case has exercised a right under Article 7 of Directive 2004/38 or any equivalent right under the <abbr class="acronym" title="European Economic Area">EEA</abbr> Agreement or Swiss Agreement in a state other than the United Kingdom or, in the case of a person who is settled in the United Kingdom and has a right of permanent residence, if he or she goes to the state within the territory comprising the European Economic Area and Switzerland of which he or she is a national or of which the person in relation to whom he or she is a family member is a national.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading><abbr class="acronym" title="European Community">EC</abbr> nationals</heading><paragraph eId="schedule-2-paragraph-9" class="schProv1"><num>9.</num><subparagraph eId="schedule-2-paragraph-9-1"><num>(1)</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-9-1-a"><num>(a)</num><intro><p>on the relevant date, is either—</p></intro><level class="para2" eId="schedule-2-paragraph-9-1-a-i"><num>(i)</num><content><p>an <abbr class="acronym" title="European Community">EC</abbr> national; or</p></content></level><level class="para2" eId="schedule-2-paragraph-9-1-a-ii"><num>(ii)</num><content><p>a family member of such a person;</p></content></level></level><level class="para1" eId="schedule-2-paragraph-9-1-b"><num>(b)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-9-1-c"><num>(c)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area and Switzerland throughout the three-year period preceding the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-9-1-d"><num>(d)</num><content><p>subject of sub-paragraph (2), whose ordinary residence in the territory comprising the European Economic Area and Switzerland has not during any part of the period referred to in paragraph (c) been wholly or mainly for the purpose of receiving full-time education.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-9-2"><num>(2)</num><content><p>Paragraph (d) of sub-paragraph (1) does not apply to a person who is treated as being ordinarily resident in the territory comprising the European Economic Area and Switzerland in accordance with paragraph 1(7).</p></content></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-10" class="schProv1"><num>10.</num><subparagraph eId="schedule-2-paragraph-10-1"><num>(1)</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-10-1-a"><num>(a)</num><content><p>on the relevant date, is an <abbr class="acronym" title="European Community">EC</abbr> national other than a United Kingdom national;</p></content></level><level class="para1" eId="schedule-2-paragraph-10-1-b"><num>(b)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-10-1-c"><num>(c)</num><content><p>has been ordinarily resident in the United Kingdom and Islands throughout the three-year period immediately preceding the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-10-1-d"><num>(d)</num><content><p>in a case where his or her ordinary residence referred to in paragraph (c) was wholly or mainly for the purpose of receiving full-time education, was ordinarily resident in the territory comprising the European Economic Area and Switzerland immediately before the period of ordinary residence referred to in paragraph (c).</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Children of Swiss nationals</heading><paragraph eId="schedule-2-paragraph-11" class="schProv1"><num>11.</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-11-a"><num>(a)</num><content><p>on the relevant date, is the child of a Swiss national who is entitled to support from the Secretary of State by virtue of article 3(6) of Annex 1 to the Swiss Agreement;</p></content></level><level class="para1" eId="schedule-2-paragraph-11-b"><num>(b)</num><content><p>is ordinarily resident in Wales on the relevant date;</p></content></level><level class="para1" eId="schedule-2-paragraph-11-c"><num>(c)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area and Switzerland throughout the three-year period preceding the first day of the first academic year of the course; and</p></content></level><level class="para1" eId="schedule-2-paragraph-11-d"><num>(d)</num><content><p>in a case where his or her ordinary residence referred to in paragraph (c) was wholly or mainly for the purpose of receiving full-time education, was ordinarily resident in the territory comprising the European Economic Area and Switzerland immediately before the period of ordinary residence referred to in paragraph (c).</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Children of Turkish workers</heading><paragraph eId="schedule-2-paragraph-12" class="schProv1"><num>12.</num><intro><p>A person who—</p></intro><level class="para1" eId="schedule-2-paragraph-12-a"><num>(a)</num><content><p>on the relevant date, was the child of a Turkish worker;</p></content></level><level class="para1" eId="schedule-2-paragraph-12-b"><num>(b)</num><content><p>was ordinarily resident in Wales on the relevant date; and</p></content></level><level class="para1" eId="schedule-2-paragraph-12-c"><num>(c)</num><content><p>has been ordinarily resident in the territory comprising the European Economic Area, Switzerland and Turkey throughout the three-year period preceding the first day of the first academic year of the course.</p></content></level></paragraph></hcontainer></part></hcontainer><hcontainer name="schedule" eId="schedule-3"><num>SCHEDULE 3<authorialNote class="referenceNote"><p>Regulation 33</p></authorialNote></num><heading>STUDENT'S CONTRIBUTION</heading><part eId="schedule-3-part-1"><num><b>PART 1</b></num><hcontainer name="crossheading" class="schGroup7"><heading>Interpretation</heading><paragraph eId="schedule-3-paragraph-1" class="schProv1"><num>1.</num><subparagraph eId="schedule-3-paragraph-1-1"><num>(1)</num><intro><p>In this Schedule—</p></intro><hcontainer name="definition"><content><p>“<abbr class="acronym" title="European Economic Area">EEA</abbr> State” (“<i>Gwladwriaeth yr AEE</i>”) has the meaning given by paragraph 1 of Part 1 of Schedule 2;</p></content></hcontainer><hcontainer name="definition"><content><p>“existing student” (“<i>myfyriwr presennol</i>” ) means a College of Europe student who is not a new student;</p></content></hcontainer><hcontainer name="definition"><content><p>“financial year” (“<i>blwyddyn ariannol</i>”) means the period of twelve months in respect of which the income of a person whose residual income is calculated under the provisions of Part 2 of this Schedule is computed for the purposes of the income tax legislation which applies to it;</p></content></hcontainer><hcontainer name="definition"><content><p>“household income” (“<i>incwm yr aelwyd</i>”) has the meaning given in paragraph 2;</p></content></hcontainer><hcontainer name="definition"><content><p>“independent eligible student” (“<i>myfyriwr cymwys annibynnol</i>”) has the meaning given in sub-paragraph (2);</p></content></hcontainer><hcontainer name="definition"><content><p>“Member State” (“<i>Aelod-wladwriaeth</i>”) means a Member State of the <abbr title="the territory comprised by the Member States of the European Community as constituted from time to time">European Community</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“new student” (“<i>myfyriwr newydd</i>”) means a College of Europe student who begins a designated course on or after 1 September 2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“parent” (“<i>rhiant</i>”) means a natural or adoptive parent and “child” (“<i>plentyn</i>”), “mother” (“<i>mam</i>”) and “father” (“<i>tad</i>”) are to be construed accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“parent student” (“<i>myfyriwr sy'n rhiant</i>” ) means a College of Europe student who is the parent of a College of Europe student;</p></content></hcontainer><hcontainer name="definition"><content><p>“partner” (“<i>partner</i>” ) in relation to a student means any of the following—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>the spouse of the student;</p></item><item><num>(ii)</num><p>the civil partner of the student;</p></item><item><num>(iii)</num><p>a person ordinarily living with the student as if he or she were the spouse of the student where the student falls within sub-paragraph (2)(a) and begins the designated course on or after 1 September 2000;</p></item><item><num>(iv)</num><p>a person ordinarily living with the student as if that person were the student’s civil partner where the student falls within sub-paragraph (2)(a) and begins the designated course on or after 1 September 2005;</p></item></blockList></content></hcontainer><hcontainer name="definition"><intro><p>“partner” (“<i>partner</i>” ) in relation to the parent of a College of Europe student means any of the following other than another parent of the College of Europe student—</p></intro><level class="para1"><num>(a)</num><content><p>the spouse of the College of Europe student’s parent;</p></content></level><level class="para1"><num>(b)</num><content><p>the civil partner of the College of Europe student’s parent;</p></content></level><level class="para1"><num>(c)</num><content><p>a person ordinarily living with the parent of the College of Europe student as if he or she were the parent’s spouse;</p></content></level><level class="para1"><num>(d)</num><content><p>a person ordinarily living with the parent of the College of Europe student as if he or she were the parent’s civil partner;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“preceding financial year” (“<i>blwyddyn ariannol flaenorol</i>”) means the financial year immediately preceding the relevant year;</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant year” (“<i>blwyddyn berthnasol</i>”) means the academic year in respect of which the household income falls to be assessed;</p></content></hcontainer><hcontainer name="definition"><content><p>“residual income” (“<i>incwm gweddilliol</i>”) means taxable income after the application of paragraph 3 (in the case of a student), paragraph 4 (in the case of a College of Europe student’s parent), paragraph 5 (in the case of a student’s partner) and paragraph 6 (in the case of the partner of a College of Europe Student’s parent);</p></content></hcontainer><hcontainer name="definition"><content><p>“student” (“<i>myfyriwr</i>”) means a College of Europe student or a European University Institute student as the case may be.</p></content></hcontainer><hcontainer name="definition"><intro><p>“taxable income” (“<i>incwm trethadwy</i>” ) means, in relation to paragraph 3, in respect of an academic year for which support is sought and, in relation to paragraph 4, in respect (subject to sub-paragraphs (3), (4) and (5) of paragraph 4) of the preceding financial year, a person’s taxable income from all sources computed as for the purposes of—</p></intro><level class="para1"><num>(a)</num><content><p>the Income Tax Acts;</p></content></level><level class="para1"><num>(b)</num><content><p>the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland which applies to the person’s income;</p></content></level><level class="para1"><num>(c)</num><content><p>where the legislation of more than one <abbr class="acronym" title="European Economic Area">EEA</abbr> State or of an <abbr class="acronym" title="European Economic Area">EEA</abbr> State and Switzerland applies to the period, the legislation under which the Welsh Ministers consider the person will pay the largest amount of tax in that period (except as otherwise provided in paragraph 4);</p></content></level></hcontainer></subparagraph><subparagraph eId="schedule-3-paragraph-1-2"><num>(2)</num><intro><p>An “independent eligible student” (“<i>myfyriwr cymwys annibynnol</i>” ) is a College of Europe student where—</p></intro><level class="para1" eId="schedule-3-paragraph-1-2-a"><num>(a)</num><content><p>he or she is aged 25 or over on the first day of the relevant year;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-b"><num>(b)</num><content><p>he or she is married or in a civil partnership before the beginning of the relevant year, whether or not the marriage or civil partnership is still subsisting;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-c"><num>(c)</num><content><p>he or she has no parent living;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-d"><num>(d)</num><content><p>the Welsh Ministers are satisfied that neither his or her parents can be found or that it is not reasonably practicable to get in touch with either of them;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-e"><num>(e)</num><content><p>he or she has communicated with neither of his or her parents for the period of one year before the beginning of the relevant year or, in the opinion of the Welsh Ministers, he or she can demonstrate on other grounds that he or she is irreconcilably estranged from his or her parents;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-f"><num>(f)</num><content><p>he or she has been provided with accommodation by, or he or she has, pursuant to an order of a competent court been in the custody or care of, any legal person who is not the student’s parent throughout any three-month period ending on or after the date on which he or she attains the age of 16 and before the first day of his or her course (“the relevant period”) (provided that he or she has not in fact at any time during the relevant period been under the charge or control of his or her parents);</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-g"><num>(g)</num><intro><p>his or her parents are residing outside of the <abbr title="the territory comprised by the Member States of the European Community as constituted from time to time">European Community</abbr> and the Welsh Ministers are satisfied that either—</p></intro><level class="para2" eId="schedule-3-paragraph-1-2-g-i"><num>(i)</num><content><p>the assessment of the household income by reference to their residual income would place those parents in jeopardy; or</p></content></level><level class="para2" eId="schedule-3-paragraph-1-2-g-ii"><num>(ii)</num><content><p>it would not be reasonably practicable for those parents as a result of the calculation of any contribution under paragraph 7 to send any relevant funds to the United Kingdom;</p></content></level></level><level class="para1" eId="schedule-3-paragraph-1-2-h"><num>(h)</num><content><p>where paragraph 4(9) applies and the parent whom the Welsh Ministers considered the more appropriate for the purposes of that paragraph has died (irrespective of whether the parent in question has a partner);</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-i"><num>(i)</num><content><p>he or she is a member of a religious order who resides in a house of that order;</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-j"><num>(j)</num><content><p>as at the first day of the relevant year, he or she has the care of a person under the age of 18; or</p></content></level><level class="para1" eId="schedule-3-paragraph-1-2-k"><num>(k)</num><intro><p>he or she has supported himself or herself out of his or her earnings for any period or periods ending before the first academic year of the course which periods together aggregate not less than three years, and for the purposes of this paragraph he or she is to be treated as supporting himself or herself out of his or her earnings during any period in which—</p></intro><level class="para2" eId="schedule-3-paragraph-1-2-k-i"><num>(i)</num><content><p>he or she was participating in arrangements for training for the unemployed under any scheme operated by, sponsored or funded by any state authority or agency, whether national, regional or local (“relevant authority”);</p></content></level><level class="para2" eId="schedule-3-paragraph-1-2-k-ii"><num>(ii)</num><content><p>he or she was in receipt of benefit payable by any relevant authority in respect of a person who is available for employment but who is unemployed;</p></content></level><level class="para2" eId="schedule-3-paragraph-1-2-k-iii"><num>(iii)</num><content><p>he or she was available for employment and complied with any requirement of registration imposed by a relevant authority as a condition of entitlement for participation in arrangements for training or receipt of benefits;</p></content></level><level class="para2" eId="schedule-3-paragraph-1-2-k-iv"><num>(iv)</num><content><p>he or she held a State Studentship or other comparable award; or</p></content></level><level class="para2" eId="schedule-3-paragraph-1-2-k-v"><num>(v)</num><content><p>he or she received any pension, allowance or other benefit paid by any person by reason of a disability to which he or she is subject, or by reason of confinement, injury or sickness.</p></content></level></level></subparagraph><subparagraph eId="schedule-3-paragraph-1-3"><num>(3)</num><content><p>Any College of Europe student who qualifies as an independent eligible student under sub-paragraph (2)(j) in respect of an academic year of a designated course retains that status for the duration of the period of eligibility.</p></content></subparagraph></paragraph></hcontainer></part><part eId="schedule-3-part-2"><num><b>PART 2</b></num><heading>Calculation of contribution</heading><hcontainer name="crossheading" class="schGroup7"><heading>Household income</heading><paragraph eId="schedule-3-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-3-paragraph-2-1"><num>(1)</num><content><p>The amount of a College of Europe student or an Institute student’s contribution depends on the household income.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-2-2"><num>(2)</num><intro><p>The household income is—</p></intro><level class="para1" eId="schedule-3-paragraph-2-2-a"><num>(a)</num><intro><p>in the case of a College of Europe student who is not an independent eligible student, the residual income of the eligible student aggregated with the residual income of the College of Europe student’s parents (subject to paragraph 4(9)) and—</p></intro><level class="para2" eId="schedule-3-paragraph-2-2-a-i"><num>(i)</num><content><p>in the case of a new student who began the course before 1 September 2005, the residual income of the partner of the student’s parent (other than a person ordinarily living with the parent of an eligible student as if he or she were the parent’s civil partner) provided that the Welsh Ministers have selected that parent under paragraph 4(9); or</p></content></level><level class="para2" eId="schedule-3-paragraph-2-2-a-ii"><num>(ii)</num><content><p>in the case of a new student who began the course on or after 1 September 2005, the residual income of the partner of the student’s parent (provided that the Welsh Ministers have selected that parent under paragraph 4(9));</p></content></level></level><level class="para1" eId="schedule-3-paragraph-2-2-b"><num>(b)</num><intro><p>in the case of—</p></intro><level class="para2" eId="schedule-3-paragraph-2-2-b-i"><num>(i)</num><content><p>an independent eligible student who has a partner: or</p></content></level><level class="para2" eId="schedule-3-paragraph-2-2-b-ii"><num>(ii)</num><content><p>a European University Institute student who has a partner,</p></content></level><wrapUp><p>the residual income of the student aggregated with the residual income of that student’s partner (subject to sub-paragraph (5)); or</p></wrapUp></level><level class="para1" eId="schedule-3-paragraph-2-2-c"><num>(c)</num><intro><p>in the case of—</p></intro><level class="para2" eId="schedule-3-paragraph-2-2-c-i"><num>(i)</num><content><p>an independent eligible student who does not have a partner; or</p></content></level><level class="para2" eId="schedule-3-paragraph-2-2-c-ii"><num>(ii)</num><content><p>a European University Institute student who does not have a partner,</p></content></level><wrapUp><p>the residual income of that student.</p></wrapUp></level></subparagraph><subparagraph eId="schedule-3-paragraph-2-3"><num>(3)</num><intro><p>In determining the household income an amount calculated in accordance with sub-paragraph (4) there is to be deducted—</p></intro><level class="para1" eId="schedule-3-paragraph-2-3-a"><num>(a)</num><intro><p>in the case of a College of Europe student—</p></intro><level class="para2" eId="schedule-3-paragraph-2-3-a-i"><num>(i)</num><content><p>for each child wholly or mainly financially dependent on the student or his or her partner; or</p></content></level><level class="para2" eId="schedule-3-paragraph-2-3-a-ii"><num>(ii)</num><content><p>for each child other than the College of Europe student wholly or mainly financially dependent on the College of Europe student’s parent or the student’s parent’s partner whose residual income is being taking into account; and</p></content></level></level><level class="para1" eId="schedule-3-paragraph-2-3-b"><num>(b)</num><content><p>in the case of a European University Institute student, for each child wholly or mainly financially dependent on the student or his or her partner.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-2-4"><num>(4)</num><content><p>The amount referred to in sub-paragraph (3) is, £1,075.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-2-5"><num>(5)</num><content><p>For the purpose of calculating the contribution payable in respect of a parent student, the residual income of the parent student’s partner is not to be aggregated under sub-paragraph (2)(b) in the case of a parent student whose child or whose partner’s child holds an award in respect of which the household income is calculated with reference to the residual income of the parent student or of the parent student’s partner or of both.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Calculation of the student’s residual income</heading><paragraph eId="schedule-3-paragraph-3" class="schProv1"><num>3.</num><subparagraph eId="schedule-3-paragraph-3-1"><num>(1)</num><intro><p>For the purpose of determining the residual income of a student, there is to be deducted from his or her taxable income (unless already deducted in determining taxable income) the aggregate of any amounts falling within any of the following sub-paragraphs—</p></intro><level class="para1" eId="schedule-3-paragraph-3-1-a"><num>(a)</num><content><p>any remuneration for work done during any academic year of the student’s course, provided that such remuneration does not include any sums paid in respect of any period for which he or she has leave of absence or is relieved of normal duties for the purpose of attending that course;</p></content></level><level class="para1" eId="schedule-3-paragraph-3-1-b"><num>(b)</num><content><p>the gross amount of any premium or other sum paid by the student in relation to a pension (not being a pension payable under a policy of life assurance) in respect of which relief is given under section 273, 619 or 639 of the Income and Corporation Taxes Act 1988<authorialNote class="footnote" eId="f00016" marker="16"><p><ref eId="c00026" href="http://www.legislation.gov.uk/id/ukpga/1988/1">1988 c. 1</ref>.</p></authorialNote> or under section 188 of the Finance Act 2004<authorialNote class="footnote" eId="f00017" marker="17"><p><ref eId="c00027" href="http://www.legislation.gov.uk/id/ukpga/2004/12">2004 c. 12</ref>.</p></authorialNote>, or where the student’s income is computed for the purpose of the income tax legislation of another Member State, the gross amount of any such premium or sum in respect of which relief would be given if that legislation made provision equivalent to the Income Tax Acts.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-3-2"><num>(2)</num><intro><p>Where the student receives income in a currency other than sterling, the value of that income for the purpose of this paragraph is—</p></intro><level class="para1" eId="schedule-3-paragraph-3-2-a"><num>(a)</num><content><p>if the student purchases sterling with the income, the amount of sterling the student so receives; or</p></content></level><level class="para1" eId="schedule-3-paragraph-3-2-b"><num>(b)</num><content><p>otherwise, the value of the sterling the income would purchase using the rate for the month in which it is received published by the Office for National Statistics<authorialNote class="footnote" eId="f00018" marker="18"><p>“Financial Statistics” (<abbr class="acronym" title="International Standard Serial Number">ISSN</abbr> 0015-203X).</p></authorialNote>.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Calculation of parent’s residual income</heading><paragraph eId="schedule-3-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-3-paragraph-4-1"><num>(1)</num><intro><p>For the purposes of determining the taxable income of a student’s parent, any deductions which fall to be made or exemptions which are permitted—</p></intro><level class="para1" eId="schedule-3-paragraph-4-1-a"><num>(a)</num><content><p>by way of personal reliefs provided for in Chapter 1 of Part VII of the Income and Corporation Taxes Act 1988, or where the income is computed for the purposes of the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, the gross amount of any such premium in respect of which relief would be given if that legislation made provision equivalent to the Income Tax Acts;</p></content></level><level class="para1" eId="schedule-3-paragraph-4-1-b"><num>(b)</num><content><p>pursuant to any enactment or rule of law under which payments which would otherwise under United Kingdom law form part of a person’s income are not treated as such; or</p></content></level><level class="para1" eId="schedule-3-paragraph-4-1-c"><num>(c)</num><content><p>under sub-paragraph (2)</p></content></level><wrapUp><p>are not to be made or permitted.</p></wrapUp></subparagraph><subparagraph eId="schedule-3-paragraph-4-2"><num>(2)</num><intro><p>For the purpose of determining the residual income of a parent, there is to be deducted from the taxable income determined under sub-paragraph (1) the aggregate of any amounts falling within any of the following sub-paragraphs—</p></intro><level class="para1" eId="schedule-3-paragraph-4-2-a"><num>(a)</num><content><p>the gross amount of any premium or other sum paid by the student in relation to a pension (not being a pension payable under a policy of life assurance) in respect of which relief is given under section 273, 619 or 639 of the Income and Corporation Taxes Act 1988 or under section 188 of the Finance Act 2004, or where the student’s income is computed for the purpose of the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, the gross amount of any such premium or sum in respect of which relief would be given if that legislation made provision equivalent to the Income Tax Acts;</p></content></level><level class="para1" eId="schedule-3-paragraph-4-2-b"><num>(b)</num><content><p>in any case where income is computed in accordance with sub-paragraph (6) any sums equivalent to the deduction mentioned in paragraph (a), provided that any sums so deducted are not to exceed the deductions which would be made if the whole of the student’s parent’s income were in fact income for the purposes of the Income Tax Acts; and</p></content></level><level class="para1" eId="schedule-3-paragraph-4-2-c"><num>(c)</num><content><p>in the case of a parent student or a student’s parent who holds a statutory award, £1,075.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-4-3"><num>(3)</num><content><p>Where the Welsh Ministers are satisfied that the income of the parent in the financial year beginning immediately before the relevant year (“current financial year”) is, as a result of some event beyond the parent’s control, likely to be not more than 85 per cent, of the sterling value of his or her income in the preceding financial year the Welsh Ministers may, for the purpose of enabling the student to attend the course without hardship, ascertain the household income for the current financial year.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-4-4"><num>(4)</num><content><p>Where the Welsh Minsters are satisfied that the income of the parent in any financial year is, as a result of some event beyond the parent’s control, likely to be and to continue after that year to be not more than 85 per cent. of the sterling value of his or her income in the previous financial year the Welsh Ministers may, for the purpose of enabling the student to attend the course without hardship, ascertain the household income for the academic year of the student’s course in which that event occurred by taking as the residual income of the parent the average of his or her residual income for each of the financial years in which that academic year falls.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-4-5"><num>(5)</num><content><p>Where the student’s parent satisfies the Welsh Ministers that his or her income is wholly or mainly derived from the profits of a business or profession carried on by him or her, then any reference in this Part of the Schedule to a preceding financial year is to be read as a reference to the earliest period of twelve months which ends after the start of the preceding financial year and in respect of which accounts are kept relating to that business or profession.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-4-6"><num>(6)</num><intro><p>Where a student’s parent is in receipt of any income which does not form part of that parent’s income for the purposes of the Income Tax Acts or the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland by reason only that—</p></intro><level class="para1" eId="schedule-3-paragraph-4-6-a"><num>(a)</num><content><p>the parent is not resident, ordinarily resident or domiciled in the United Kingdom, or where his or her income is computed as for the purposes of the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, not so resident, ordinarily resident or domiciled in that <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland;</p></content></level><level class="para1" eId="schedule-3-paragraph-4-6-b"><num>(b)</num><content><p>the income does not arise in the United Kingdom, or where the parent’s income is computed for the purposes of the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, does not arise in that <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland; or</p></content></level><level class="para1" eId="schedule-3-paragraph-4-6-c"><num>(c)</num><content><p>the income arises from an office, service or employment, income from which is exempt from tax in pursuance of any legislation,</p></content></level><wrapUp><p>his or her taxable income for the purpose of this Schedule is to be computed as though the income under this sub-paragraph were part of his or her income for the purpose of the Income Tax Acts or the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, as the case may be.</p></wrapUp></subparagraph><subparagraph eId="schedule-3-paragraph-4-7"><num>(7)</num><content><p>Where the income of the student’s parent is computed as for the purposes of the income tax legislation of another <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland, it is to be computed under the provisions of this Schedule in the currency of that <abbr class="acronym" title="European Economic Area">EEA</abbr> State or Switzerland and the income of the student’s parent for the purposes of this Schedule is the sterling value of that income determined in accordance with the rate for the month in which the last day of the financial year in question falls, as published by the Office for National Statistics.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-4-8"><num>(8)</num><intro><p>Where one of the student’s parents dies either before or during the relevant year and that parent’s income has been or would be taken into account for the purpose of determining the household income, then</p></intro><level class="para1" eId="schedule-3-paragraph-4-8-a"><num>(a)</num><content><p>where the parent dies before the relevant year, the household income is to be determined by reference to the income of the surviving parent; or</p></content></level><level class="para1" eId="schedule-3-paragraph-4-8-b"><num>(b)</num><intro><p>where the parent dies during the relevant year, the household income is to be taken to be the aggregate of—</p></intro><level class="para2" eId="schedule-3-paragraph-4-8-b-i"><num>(i)</num><content><p>the appropriate proportion of the household income determined by reference to the income of both parents, being the proportion in respect of that part of the relevant year during which both parents were alive; and</p></content></level><level class="para2" eId="schedule-3-paragraph-4-8-b-ii"><num>(ii)</num><content><p>the appropriate proportion of the household income determined by reference to the income of the surviving parent, being the proportion in respect of that part of the relevant year remaining after the death of the other parent.</p></content></level></level></subparagraph><subparagraph eId="schedule-3-paragraph-4-9"><num>(9)</num><content><p>Where the Welsh Ministers determine that the parents were separated for the duration of the relevant year, the household income is to be determined by reference to the income of whichever parent the Welsh Ministers consider most appropriate under the circumstances.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-4-10"><num>(10)</num><intro><p>Where the Welsh Ministers determine that the parents separated in the course of the relevant year, the household income is determined by reference to the aggregate of—</p></intro><level class="para1" eId="schedule-3-paragraph-4-10-a"><num>(a)</num><content><p>the appropriate proportion of the household income determined in accordance with sub-paragraph (9), being the proportion in respect of that part of the relevant year for which the parents are separated; and</p></content></level><level class="para1" eId="schedule-3-paragraph-4-10-b"><num>(b)</num><content><p>the appropriate proportion of the household income determined otherwise in respect of the remainder of the relevant year.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Calculation of the student’s partner’s residual income</heading><paragraph eId="schedule-3-paragraph-5" class="schProv1"><num>5.</num><subparagraph eId="schedule-3-paragraph-5-1"><num>(1)</num><content><p>Subject to sub-paragraphs (2), (3) and (4) of this paragraph and with the exception of sub-paragraphs (8), (9) and (10) of paragraph 4, a student’s partner’s income is to be determined in accordance with paragraph 4, reference to the parent being construed as references to the student’s partner.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-5-2"><num>(2)</num><content><p>Where the Welsh Ministers determine that the student and his or her partner were separated for the duration of the relevant year, the partner’s income is not taken into account in determining the household income.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-5-3"><num>(3)</num><content><p>Where the Welsh Ministers determine that the student and his or her partner separated in the course of the relevant year, the partner’s income is determined by reference to his or her income under sub-paragraph (1) divided by fifty-two and multiplied by the number of complete weeks in the relevant year for which the Welsh Ministers determine that the student and his or her partner were not separated.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-5-4"><num>(4)</num><content><p>Where a student has more than one partner in any one academic year, the provisions of this paragraph apply in relation to each.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Calculation of parent’s partner’s residual income</heading><paragraph eId="schedule-3-paragraph-6" class="schProv1"><num>6.</num><content><p>The income of a new student’s parent’s partner whose income is part of the household income by virtue of paragraph 2(2)(a) is to be determined in accordance with paragraph 5, references to the student’s partner being construed as references to the new student’s parent’s partner, and references to the student being construed as references to the student’s parent.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Calculation of contribution</heading><paragraph eId="schedule-3-paragraph-7" class="schProv1"><num>7.</num><subparagraph eId="schedule-3-paragraph-7-1"><num>(1)</num><content><p>A student’s contribution is to be calculated in accordance with this regulation.</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-7-2"><num>(2)</num><intro><p>In relation to a College of Europe student who is not an independent eligible student, a College of Europe student who is an independent eligible student who has a partner and a European University Institute student who has a partner, the contribution is—</p></intro><level class="para1" eId="schedule-3-paragraph-7-2-a"><num>(a)</num><content><p>where the household income is £23,100 or more, £45 with the addition of £1 for every complete £9.50 by which the household income exceeds £23,100; and</p></content></level><level class="para1" eId="schedule-3-paragraph-7-2-b"><num>(b)</num><content><p>in any case where the household income is less than £23,100, nil.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-7-3"><num>(3)</num><intro><p>In relation to a College of Europe student who is an independent eligible student who does not have a partner and a European University Institute student who does not have a partner, the contribution is—</p></intro><level class="para1" eId="schedule-3-paragraph-7-3-a"><num>(a)</num><content><p>where the household income is £10,755 or more, £45 with the addition of £1 for every complete £9.50 by which the household income exceeds £10,755; and</p></content></level><level class="para1" eId="schedule-3-paragraph-7-3-b"><num>(b)</num><content><p>where the household income is less than £10,755, nil.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-7-4"><num>(4)</num><content><p>The amount of contribution is not to exceed £7,610 where the contribution is calculated under sub-paragraph (2) or (3).</p></content></subparagraph><subparagraph eId="schedule-3-paragraph-7-5"><num>(5)</num><intro><p>Where sub-paragraph (6) applies, the aggregate of the contributions calculated under sub-paragraph (2) or (3), is not to exceed—</p></intro><level class="para2" eId="schedule-3-paragraph-7-5-i"><num>(i)</num><content><p>£7,610; or</p></content></level><level class="para2" eId="schedule-3-paragraph-7-5-ii"><num>(ii)</num><content><p>the contribution which would be payable if only one student held an award.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-7-6"><num>(6)</num><intro><p>This sub-paragraph applies where the household income consists of the residual income of—</p></intro><level class="para1" eId="schedule-3-paragraph-7-6-a"><num>(a)</num><content><p>two or more College of Europe students in respect of the same income under paragraph 4 or, where the relevant parent’s partner’s residual income is taken into account, under paragraphs 4 and 6; or</p></content></level><level class="para1" eId="schedule-3-paragraph-7-6-b"><num>(b)</num><content><p>an independent eligible student and his or her partner where both hold a statutory award.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Split contributions</heading><paragraph eId="schedule-3-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-3-paragraph-8-1"><num>(1)</num><intro><p>Where a contribution is payable under paragraph 7 above and one or more of the conditions in sub-paragraph (2) is satisfied, the amount of contribution payable in respect of the College of Europe student is to be the amount that the Welsh Ministers consider just taking into account—</p></intro><level class="para1" eId="schedule-3-paragraph-8-1-a"><num>(a)</num><content><p>the application of paragraph 7 to new College of Europe students and existing students respectively; and</p></content></level><level class="para1" eId="schedule-3-paragraph-8-1-b"><num>(b)</num><content><p>the particular circumstances of the College of Europe student.</p></content></level></subparagraph><subparagraph eId="schedule-3-paragraph-8-2"><num>(2)</num><intro><p>The conditions referred to in sub-paragraph (1) above are—</p></intro><level class="para1" eId="schedule-3-paragraph-8-2-a"><num>(a)</num><content><p>more than one child of the College of Europe student’s parents holds a statutory award;</p></content></level><level class="para1" eId="schedule-3-paragraph-8-2-b"><num>(b)</num><content><p>the College of Europe student’s parent holds a statutory award;</p></content></level><level class="para1" eId="schedule-3-paragraph-8-2-c"><num>(c)</num><content><p>the College of Europe student’s parent’s partner holds a statutory award;</p></content></level><level class="para1" eId="schedule-3-paragraph-8-2-d"><num>(d)</num><content><p>the College of Europe student’s partner holds a statutory award.</p></content></level></subparagraph></paragraph></hcontainer></part></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations amend the Assembly Learning Grants (European Institutions) (Wales) Regulations 2006 (the “<abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr>”).</p></blockContainer><blockContainer ukl:Name="P"><p>The <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> provide for support for students taking designated higher education courses at the Bologna Center, the College of Europe or the European University Institute in respect of an academic year beginning on or after 1 September 2006. The <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> also make provision for support for certain students taking courses at these institutions in respect of the academic year beginning on or after 1 September 2005 but before 1 September 2006.</p></blockContainer><blockContainer ukl:Name="P"><p>The <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> apply in relation to Wales.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 amends regulation 21 of the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> so as to increase the maximum amount of the grant for fees payable to students attending designated courses at the Bologna Center from 22,700 euro to 24,100 euro. Regulation 6 amends regulation 25(4)(b) of the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> so as to increase the amount of the grant for living costs payable to students attending designated courses at the European University Institute from 12,840 euro to 13,000 euro.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 3, 4 and 7 correct typographical and drafting errors in the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations also provide for support for eligible students taking designated higher education courses at the Bologna Center, the College of Europe or the European University Institute in respect of an academic year beginning on or after 1 September 2007.</p></blockContainer><blockContainer ukl:Name="P"><p>A grant for fees is available for one eligible student at the Bologna Center.</p></blockContainer><blockContainer ukl:Name="P"><p>A grant for fees, grants for living and other costs, a disabled students' allowance and a grant for dependants are available for up to two eligible students at the College of Europe.</p></blockContainer><blockContainer ukl:Name="P"><p>Grants for living and other costs, a disabled students' allowance and a grant for dependants are available for one eligible student at the European University Institute.</p></blockContainer><blockContainer ukl:Name="P"><p>The Regulations set out the eligibility criteria for the grants, the application procedure and the method for calculating the amount of grant payable. The Regulations also set out the arrangements for payment of the grants and recovery of any overpayments.</p></blockContainer><blockContainer ukl:Name="P"><p>Provision is also made in these Regulations to comply with article 9 of Decision No 1/80 of the Association Council of 19 September 1980 on the development of the Association between the <abbr title="the territory comprised by the Member States of the European Community as constituted from time to time">European Community</abbr> and Turkey.</p></blockContainer><blockContainer ukl:Name="P"><p>The Association Council was created by the agreement establishing an association between the <abbr title="the territory comprised by the Member States of the European Community as constituted from time to time">European Community</abbr> and Turkey which was signed in Ankara on 12 September 1963 by the Republic of Turkey on the one hand and the Member States of the <abbr class="acronym" title="European Economic Community">EEC</abbr> and the Community on the other. The agreement was concluded, approved and confirmed on behalf of the Community by Council Decision <ref eId="c00003" href="http://www.legislation.gov.uk/european/decision/1964/0732">64/732/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> of 23 December 1963 (<abbr class="acronym" title="Official Journal">OJ</abbr> <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1973/113">1973 c. 113</ref> p. 1).</p></blockContainer><blockContainer ukl:Name="P"><p>Article 9 of Decision No 1/80 of the Association Council of 19th September 1980 on the development of the association provides: “Turkish children residing legally in a Member State of the Community with their parents who are or have been legally employed in that member State, shall be admitted to courses of general education, apprenticeship and vocational training under the same educational entry qualifications as the children of nationals of that member State. They may in that Member State be eligible to benefit from the advantages provided for under the national legislation in this area.”.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations revoke the <abbr title="Assembly Learning Grant (European Institutions) (Wales) Regulations 2006 (S.I. 2006/1794 (W.189))">2006 Regulations</abbr> to the extent set out in regulations 4 to 6.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
