They apply in relation to Wales and come into force on 28 March 2007.</Text></P1para></P1></P1group><P1group RestrictStartDate="2010-11-10"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/2" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-act">the Act</Term>” (“<Term id="term-y-ddeddf"><Emphasis>y Ddeddf</Emphasis></Term>”) means the Animal Welfare Act 2006;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-cattle">cattle</Term>” (“<Term id="term-gwartheg"><Emphasis>gwartheg</Emphasis></Term>”) means all animals of the bovine species including bison and buffalo;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">“conventionally reared meat chicken” (“</Addition><Emphasis><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">iâr fwyta a fegir yn gonfensiynol</Addition></Emphasis><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">”) means an animal of the species </Addition><Emphasis><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">Gallus gallus</Addition></Emphasis><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c"> that is kept for meat production, other than one—</Addition></Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">that is on a holding with fewer than 500 such animals or with only breeding stocks of such animals;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">in relation to which the term “Extensive indoor (barn reared)”, “Free range”, “Traditional free range” or “Free range – total freedom” can be used within the meaning of point (b), (c), (d) or (e) of Annex V to Commission Regulation (EC) No 543/2008 laying down detailed rules for the application of Regulation (EC) No 1234/2007 as regards the marketing standards for poultry meat);</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-b1256815cc825f256cdf25bc52378f4c-1670428267868" CommentaryRef="key-b1256815cc825f256cdf25bc52378f4c">that is organically reared in accordance with Council Regulation (EC) No 834/2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2092/91;</Addition> </Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-desnooding">desnooding</Term>” (“<Term id="term-torri-crogrib"><Emphasis>torri crogrib</Emphasis></Term>”) means removal of a turkey's snood;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-disbudding">disbudding</Term>” (“<Term id="term-dadimpio"><Emphasis>dadimpio</Emphasis></Term>”) means removal of the horn bud of cattle, goats or sheep;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-domestic-fowl">domestic fowl</Term>” (“<Term id="term-ffowlyn-domestig"><Emphasis>ffowlyn domestig</Emphasis></Term>”) means a domesticated member of the species gallus gallus;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-dubbing">dubbing</Term>” (“<Term id="term-torri-crib"><Emphasis>torri crib</Emphasis></Term>”) means removal of the comb of a domestic fowl;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-farmed">farmed</Term>” (“<Term id="term-a-ffermir"><Emphasis>a ffermir</Emphasis></Term>”) means an animal bred or kept for the production of food, wool or skin or for other farming purposes;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-horses">horses</Term>” (“<Term id="term-ceffylau"><Emphasis>ceffylau</Emphasis></Term>”) includes ponies, asses, donkeys, jennets and mules;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-in-velvet">in velvet</Term>” (“<Term id="term-yn-bwrw-eu-melfed"><Emphasis>yn bwrw eu melfed</Emphasis></Term>”) means, in relation to the antlers of a deer, until the velvet is frayed and the greater part of it has been shed;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-laying-hen">laying hen</Term>” (“<Term id="term-iâr-ddodwy"><Emphasis>iâr ddodwy</Emphasis></Term>”) means a hen of the species <Emphasis>Gallus gallus</Emphasis> which has reached laying maturity and is kept for production of eggs not intended for hatching;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-poultry">poultry</Term>” (“<Term id="term-dofednod"><Emphasis>dofednod</Emphasis></Term>”) means domestic fowl, turkeys, geese, ducks, guinea fowl, quails, pheasants and partridges;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-prohibited-procedure">prohibited procedure</Term>” (“<Term id="term-triniaeth-waharddedig"><Emphasis>triniaeth waharddedig</Emphasis></Term>”) means a procedure which involves interference with the sensitive tissues or bone structure of an animal, otherwise than for the purpose of its medical treatment;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-suitable-instrument">suitable instrument</Term>” (“<Term id="term-offeryn-addas"><Emphasis>offeryn addas</Emphasis></Term>”) means in relation to any procedure, an instrument that is in a fit state of repair and has been designed, or is of a kind commonly used, for the purpose of performing that procedure.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2008-12-03"><Title>Exceptions to the prohibition on mutilations</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><Text>Section 5(1) and (2) of the Act does not apply to a procedure listed in Schedule 1, providing that the procedure is carried out—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3/a" id="regulation-3-a"><Pnumber>a</Pnumber><P3para><Text>in accordance with any relevant requirement in Schedules 2 to 9;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3/b" id="regulation-3-b"><Pnumber>b</Pnumber><P3para><Text>in such a way as to minimise the pain and suffering it causes to the animal;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3/c" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3/c" id="regulation-3-c"><Pnumber><Substitution ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877664238" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">c</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877664238" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">in hygienic conditions;</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3/d" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3/d" id="regulation-3-d"><Pnumber><Substitution ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877679042" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">d</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877679042" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">in accordance with good practice; and</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/3/e" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/3/e" id="regulation-3-e"><Pnumber><Addition ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877695374" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">e</Addition></Pnumber><P3para><Text><Addition ChangeId="key-3ecff09da633b6f0cf82e8e0abe3005d-1563877695374" CommentaryRef="key-3ecff09da633b6f0cf82e8e0abe3005d">in accordance with regulation 5, where applicable.</Addition></Text></P3para></P3></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2008-12-03"><Title>Performance of prohibited procedures in an emergency</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/4" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>Section 5(1) and (2) of the Act does not apply where a prohibited procedure is carried out in an emergency for the purpose of saving the life or relieving the pain of the <CommentaryRef Ref="key-4c9f6656387144f3709c9991dce65181"/>... animal <CommentaryRef Ref="c18579221"/>.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>Any procedure carried out under paragraph (1) must be carried out in accordance with regulation 3, so far as this is practicable in all of the circumstances.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2008-12-03"><Title>Persons who may carry out permitted procedures</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/5" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/5" id="regulation-5"><Pnumber><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8">5</Substitution></Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/5/1" id="regulation-5-1"><Pnumber><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8">1</Substitution></Pnumber><P2para><Text><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8">Any procedure permitted under regulation 3 to which the Veterinary Surgeons Act 1966</Substitution><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8"> or the Veterinary Surgeons (Exemptions) Order 1962</Substitution><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8"> applies, with the exception of the procedures referred to in paragraph (2), may only be carried out by a person permitted to carry it out under that legislation.</Substitution></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2007/1029/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/wsi/2007/1029/regulation/5/2" id="regulation-5-2"><Pnumber><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8">2</Substitution></Pnumber><P2para><Text><Substitution ChangeId="key-4a6a63e28febdd971fb4a6a60b7d84b8-1563878196451" CommentaryRef="key-4a6a63e28febdd971fb4a6a60b7d84b8">Tail docking, or castration, of pigs may only be carried out by a veterinary surgeon or, where the animal is aged not more than 7 days, by a person experienced in performing the techniques involved and who is either a person responsible for the animal or a person employed or engaged protected by that Act:</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>carry out a prohibited procedure;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>cause the carrying out of a prohibited procedure; or</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>in specified circumstances, permit another person to carry out a prohibited procedure .</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>A prohibited procedure is one which involves interference with the sensitive tissues (e.g. skin) or bone structure of the animal, otherwise than for the purpose of its medical treatment (see section 5(3) of the Act).</Text></Para></BlockText></P><P><BlockText><Para><Text>These Regulations specify the procedures to which the offences in section 5(1) and 5(2) do not apply. Depending upon the animals to which they are to be applied, such procedures may include those for the purposes of:</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>identification (such as ear tagging);</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>the control of reproduction (such as castration and vasectomy); and</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>other purposes (such as laparoscopy) (Schedule 1).</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>For certain of these procedures, and again depending upon the animals in respect of which they are permitted, Schedules 2 to 9 apply restrictions to the carrying out of the procedure (such as specifying a required age for the animal, or requiring the administration of an anaesthetic).</Text></Para></BlockText></P><P><BlockText><Para><Text>In respect of certain procedures permitted to be applied to pigs, these Regulations implement paragraph 8 of Chapter I of the Annex to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0630" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="630">91/630/EEC</Citation> laying down minimum standards for the protection of pigs (OJ No. L340, 11.12.1991, p.33), as amended by Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0088" id="c00002" Class="EuropeanUnionDirective" Year="2001" Number="88">2001/88/EC</Citation> (OJ No. L316, 1.12.2001, p.1), Commission Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0093" id="c00003" Class="EuropeanUnionDirective" Year="2001" Number="93">2001/93/EC</Citation> (OJ No. L316, 1.12.2001, p.36) and Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/0806" id="c00004" Class="EuropeanUnionRegulation" Year="2003" Number="806">(EC) No. 806/2003</Citation> (OJ No. L122, 16.5.2003, p.1).
