Ref="key-f115fd16a13a4539cc136ff37b562e82"/>1</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/1/1" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/1/1" id="article-1-1"><Pnumber>1</Pnumber><P2para><Text>The title of this Order is the Public Services Ombudsman (Wales) Act 2005 (Transitional Provisions and Consequential Amendments) Order 2006 and it shall come into force on 1 April 2006.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/1/2" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/1/2" id="article-1-2"><Pnumber>2</Pnumber><P2para><Text>This Order applies in relation to Wales.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/1/3" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/1/3" id="article-1-3"><Pnumber>3</Pnumber><P2para><Text>In this Order—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Abbreviation Expansion="Public Services Ombudsman (Wales) Act 2005 c. 10">the Act</Abbreviation>” (“<Emphasis><Abbreviation Expansion="Deddf Ombwdsmon Gwasanaethau Cyhoeddus (Cymru) 2005 p. 10">y Ddeddf</Abbreviation></Emphasis>”) means the Public Services Ombudsman (Wales) Act 2005;</Text></Para></ListItem><ListItem><Para><Text>“co-opted member” (“<Emphasis>aelod cyfetholedig</Emphasis>”) means, in relation to a relevant authority, a person who is not a member of the authority but who—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>is a member of any committee or sub-committee of the authority, or</Text></Para></ListItem><ListItem><Para><Text>is a member of, and represents the authority on, any joint committee or joint sub-committee of the authority,</Text></Para></ListItem></OrderedList><Text>and who is entitled to vote on any question which falls to be decided at any meeting of that committee or sub-committee; and</Text></Para></ListItem><ListItem><Para><Text>“relevant authority” (“<Emphasis>awdurdod perthnasol</Emphasis>”) means a county council, a county borough council, a National Park authority established under section 63 of the Environment Act 1995<FootnoteRef Ref="f00002"/> or a fire and rescue authority constituted by a scheme under section 2 of the Fire and Rescue Services Act 2004<FootnoteRef Ref="f00003"/> or a scheme to which section 4 of that Act applies.</Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2006-04-01"><Title>Revocation and amendment of subordinate legislation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/2" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/2" id="article-2"><Pnumber><CommentaryRef Ref="key-c11d74c81842982ab7c6f75fee5ac31d"/>2</Pnumber><P1para><Text>The subordinate legislation referred to in Schedule 1 is revoked.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/3" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/3" legislation.</Text></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2006-04-01"><Title>Transitional provisions</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4" id="article-4"><Pnumber><CommentaryRef Ref="key-408881190f6bd6ce22fdd982b5136948"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/1" id="article-4-1"><Pnumber>1</Pnumber><P2para><Text>Paragraph (2) applies if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/1/a" id="article-4-1-a"><Pnumber>a</Pnumber><P3para><Text>an allegation has been made to a Local Commissioner in Wales under section 69 of the Local Government Act 2000<FootnoteRef Ref="f00004"/> before the date on which section 38 of the Act comes into force, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/1/b" id="article-4-1-b"><Pnumber>b</Pnumber><P3para><Text>the allegation has not been determined by that Commissioner before that date.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/2" id="article-4-2"><Pnumber>2</Pnumber><P2para><Text>On and after the date on which section 38 of the Act comes into force, Part III of the Local Government Act 2000 and regulations and orders made thereunder continue to apply for the purposes of the allegation despite the provisions of the Act or this Order.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/3" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/3" id="article-4-3"><Pnumber>3</Pnumber><P2para><Text>Paragraph (4) applies if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/3/a" id="article-4-3-a"><Pnumber>a</Pnumber><P3para><Text>an allegation could (but for the provisions of the Act) have been made to a Local Commissioner in Wales, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/3/b" id="article-4-3-b"><Pnumber>b</Pnumber><P3para><Text>the allegation is an allegation that a member or co-opted member (or former member or co-opted member) of a relevant authority in Wales has failed or may have failed to comply with the authority’s code of conduct before the date on which section 38 of the Act comes into force.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/4" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/4" id="article-4-4"><Pnumber>4</Pnumber><P2para><Text>On and after the date on which section 38 of the Act comes into force, Part III of the Local Government Act 2000<FootnoteRef Ref="f00005"/> and regulations and orders made thereunder continue to apply for the purposes of enabling the allegation to be made, and for the purposes of the allegation if made, despite the provisions of the Act or this Order.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2006/362/article/4/5" IdURI="http://www.legislation.gov.uk/id/wsi/2006/362/article/4/5" The Act abolishes the offices of the Welsh Administration Ombudsman, the Health Service Commissioner for Wales and the Social Housing Ombudsman for Wales. It also abolishes the Commission for Local Administration in Wales (including the office of the Local Commissioner for Wales). Broadly speaking, the Act makes provision for the Ombudsman to investigate those matters that were within the remit of those ombudsmen and commissioners in Wales.</Text></P><P><Text>The Ombudsman will have responsibility for investigating maladministration and service failure by the National Assembly for Wales; its sponsored public bodies (the equivalent, in Wales, of non-departmental public bodies) and a number of other publicly funded bodies; Welsh health service bodies (primarily <Acronym Expansion="National Health Service">NHS</Acronym> Trusts and Local Health Boards in Wales); certain health service providers in Wales; local government bodies in Wales and social landlords in Wales.
