<Title>Interpretation</Title>

<Text>In this Order—</Text>

<Text>“the <Abbreviation Expansion="Local Government Finance Act 1988 c. 41">1988 Act</Abbreviation>” (“<Emphasis><Abbreviation Expansion="Deddf Cyllid Llywodraeth Leol 1988 p. 41">Deddf 1988</Abbreviation></Emphasis>”) means the Local Government Finance Act 1988;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“electronic communications apparatus” (“<Emphasis>cyfarpar cyfathrebu electronig</Emphasis>”) includes —</Text>

<Text>apparatus within the meaning given by paragraph 1(1) of the electronic communications code;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>structures in the nature of huts or other buildings (including structures forming part only of a building) used, or designed for use, solely to house apparatus falling within the description in paragraph (a); and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>any ancillary equipment occupied exclusively for the purposes of a person who is licensed under section 1 of the Wireless Telegraphy Act 1949<FootnoteRef Ref="f00002"/> or who has a grant of recognised spectrum access under section 159 of the Communications Act 2003<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>

</ListItem>
<ListItem>
<Para>
<Text>“electronic communications code” (“<Emphasis>cod cyfathrebu electronig</Emphasis>”) has the same meaning as in section 106(1) of the Communications Act 2003;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“excepted hereditament” (“<Emphasis>hereditament a eithrir</Emphasis>”) means a hereditament—</Text>

<ListItem>
<Para>
<Text>which is used exclusively for the display of advertisements, the parking of motor vehicles, sewage works or electronic communications apparatus,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>which is a beach hut or a post office,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>to which one or more of paragraphs (a) to (c) of section 47(2) of the 1988 Act applies,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>which is an excepted hereditament as defined in section 47(9) of the 1988 Act,</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text> which is a Crown hereditament as defined in section 65A(4) of the 1988 Act, or</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>which comprises, or part of which comprises, a building or self-contained part of a building as described in paragraphs (a) and (b) of section 66(2B) of the 1988 Act;</Text>
</Para>
</ListItem>

<Text>“post office” (“s<Emphasis>wyddfa bost</Emphasis>”) means a public post office within the meaning given by section 42(3) of the Postal Services Act 2000<FootnoteRef Ref="f00004"/>.</Text>

<Title>Maximum rateable value for rate relief</Title>

<Text>For the purposes of section 43(4B)(b)(i) of the 1988 Act, the amount prescribed for a hereditament is £12,000.</Text>
</P1para>

<Title>Conditions for relief</Title>

<Text>For the purposes of section 43(4B)(b)(ii) of the 1988 Act, in respect of hereditaments whose rateable value is £5,000 or less, the conditions to be satisfied are that—</Text>

<Text>For the purposes of section 43(4B)(b)(ii) of the 1988 Act, in respect of hereditaments whose rateable value is £12,000 or less, the condition to be satisfied is that the hereditament, or part of a hereditament, is used as a post office.</Text>

<Title>Amount of E</Title>

<Text>The amount of E prescribed for the purposes of section 44(9) of the 1988 Act —</Text>

<Text>Article 6 prescribes the amount of E in the formula contained in section 43(4A)(b) of the 1988 Act. That formula provides the mechanism for calculating the amount of rates payable in respect of particular hereditaments.</Text>

<Text>Articles 4 and 6 have the effect of granting (a) 50% mandatory rate relief to hereditaments which have a rateable value of £2,000 or less, which are not excepted hereditaments as defined in Article 2 and are wholly occupied; and of granting (b) 25% mandatory rate relief to hereditaments which have a rateable value of more than £2,000 but not more than £5,000, which are not excepted hereditaments as defined in Article 2 and are wholly occupied.</Text>

<Text>Articles 5 and 6 have the effect of granting 100% mandatory relief to post offices which have a rateable value of £9,000 or less, and of granting 50% mandatory relief to post offices which have a rateable value of more than £9,000 but not more than £12,000.</Text>
