1.—(1) The title of these Regulations is the Paying Agency (National Assembly for Wales) (Amendment) Regulations 2006.
(2) These Regulations come into force on 16 October 2006.
(3) These Regulations apply in relation to Wales.
2.—(1) The Paying Agency (National Assembly for Wales) Regulations 1999(3) are amended in accordance with this regulation.
(2) For paragraphs (c), (e) and (g) of regulation 2 (Interpretation), substitute the following paragraphs—
“(c)“Commission Regulation” means Commission Regulation (EC) No 885/2006(4) laying down detailed rules for the application of the Council Regulation in relation to the accreditation of paying agencies”;
“(e)“the Council Regulation” means Council Regulation (EC) No 1290/2005(5) on the financing of the common agricultural policy, as last amended by Council Regulation (EC) No 320/2006(6);”;
“(g)“paying agency” has the meaning it has in Article 6 of the Council Regulation;”.

These Regulations amend the Paying Agency (National Assembly for Wales) Regulations 1999 (“the 1999 Regulations”).
These Regulations apply in relation to Wales and to cross border agricultural holdings for which the National Assembly for Wales (“the Assembly”) is the responsible paying agency.
The 1999 Regulations enable the Assembly, if duly accredited for the purpose, to act as a UK paying agency in relation to the financing of the common agricultural policy.
These Regulations update the references made to European legislation in the 1999 Regulations.
By virtue of the European Communities (Designation) (No. 3) Order 2005 (S.I. 2005/2766) (“the Order”). Article 4 and Schedule 3 to the Order enable the National Assembly for Wales to make regulations, in relation to the Common Agricultural Policy of the European Community, which extend to holdings which include land situated within the United Kingdom but outside of Wales.
