Mae'r Rheoliadau hyn yn darparu ar gyfer gweinyddu a gorfodi Erthygl 22 o Reoliad y Cyngor (EC) Rhif 2371/2002, “y Rheoliad CFP”, (O.J. Rhif L 358, 31.12.02, t.59) ac Erthygl 9 o Reoliad y Cyngor (EEC) Rhif 2847/93 (O.J. Rhif . L 261, 20.10.93, t.1) sy'n gorfodi gofynion o ran marchnata a phrynu pysgod gyntaf (pysgod gwerthiant cyntaf). Daw y rheoliadau i rym ar 9 Mehefin 2006 ac maent yn gymwys yng nghyswllt Cymru.
Mae'r Rheoliadau'n darparu i Gynulliad Cenedlaethol Cymru gofrestru gwerthwyr pysgod gwerthiant cyntaf (rheoliad 3), dynodi safleoedd arwerthu pysgod (rheoliad 6) a chofrestru prynwyr pysgod gwerthiant cyntaf (rheoliad 7). Yn ôl Rheoliad 5 mae'n ofynnol i werthwyr pysgod cofrestredig gadw cofnodion o'r pysgod gwerthiant cyntaf a werthir ganddynt ac yn ôl Rheoliad 9 mae'n ofynnol i brynwyr pysgod gwerthiant cyntaf gadw cofnodion o'r pysgod gwerthiant cyntaf a brynir ganddynt. Ac mae'r Rheoliadau'n darparu troseddau at ddibenion gorfodi'r cofrestriadau a'r dynodiadau hyn (rheoliadau 3(9), 3(10), 5(7), 6(8), 6(9), 7(8), 7(9) a 9(7)).
Mae'r Rheoliadau'n darparu troseddau o ran prynu a gwerthu pysgod gwerthiant cyntaf. Mae Rheoliad 4 yn ei gwneud yn drosedd i unrhyw un werthu pysgod gwerthiant cyntaf mewn safle arwerthu dynodedig oni bai ei fod wedi cofrestru'n werthwr pysgod. Yn ôl rheoliad 8 mae'n drosedd prynu pysgod gwerthiant cyntaf yn groes i Erthygl 22(2)(b) o'r Rheoliad CFP (gofyniad fod prynwyr pysgod gwerthiant cyntaf wedi'u cofrestru) o'i ddarllen gydag is-baragraff olaf Erthygl 22(2), sy'n eithrio pysgod a brynir ar gyfer treuliant preifat. Yn ôl rheoliad 10 mae'n drosedd gwerthu pysgod gwerthiant cyntaf a gaiff eu glanio mewn unrhyw ffordd ac eithrio gan gwch pysgota trwyddedig. Ac yn ôl rheoliad 11 mae'n drosedd prynu pysgod gwerthiant cyntaf oni bai fod y pysgod wedi cael eu glanio gan gwch pysgota trwyddedig.
Mae rheoliad 12 yn darparu cosbau ar gyfer y troseddau hyn: am gollfarn ddiannod, dirwy heb fod dros yr uchafswm statudol, am gollfarn o dditiad, dirwy. Pan gollfernir person am drosedd o dan reoliadau 3(9), 3(10), 5(7) 6(8), 6(9), 7(8), 7(9) neu 9(7) bydd gan lys hawl i ddirymu'r cofrestriad neu'r dynodiad dan sylw hefyd a gall orchymyn fod person a gollfernir yn cael ei anghymhwyso rhag gwneud cais i gofrestru neu am ddynodiad am gyfnod penodol.
Mae'r Rheoliadau'n cyflwyno pwerau gorfodi ar swyddogion pysgodfeydd môr Prydain at ddibenion gorfodi'r Rheoliadau hyn. Gellir arfer y pwerau hyn mewn cysylltiad â safleoedd ac unrhyw gwch pysgota o fewn Cymru (rheoliadau 13 i 15). Mae rheoliad 16 yn darparu i ddiogelu swyddogion pysgodfeydd môr Prydain ac mae rheoliad 17 yn darparu troseddau a chosbau i'w rhwystro. Mae rheoliad 18 yn darparu o ran troseddau gan gorfforaethau.
