The Diseases of Animals (Approved Disinfectants) (Amendment) (Wales) Order 2005

The National Assembly for Wales, in exercise of its powers under sections 1, 7 and 23(f) and (g) of the Animal Health Act 1981(1), which are now vested in it makes the following Order:

Title, commencement and application

1.—(1) This Order may be cited as the Diseases of Animals (Approved Disinfectants) (Amendment) (Wales) Order 2005 and comes into force on 1 April 2005.

(2) This Order applies to Wales only.

Amendments to the Diseases of Animals (Approved Disinfectants) Order 1978

2.—(1) The Diseases of Animals (Approved Disinfectants) Order 1978(2) (“the 1978 Order”) is amended in relation to Wales in accordance with 'the following provisions of this article.

(2) In paragraph (2) of article 6 of the 1978 Order (which specifies the date until which disinfectants subject to transitional provisions remain approved), for “31st August 2003” there is substituted “30 June 2005”.

(3) For Schedule 1 to the 1978 Order (which lists approved disinfectants) there is substituted Schedule 1 to this Order.

(4) For Schedule 2 to the 1978 Order (which lists disinfectants subject to transitional provisions) there is substituted Schedule 2 to this Order.

Revocations

3.  The following are revoked —

(a) Diseases of Animals (Approved Disinfectants) (Amendment) (Wales) Order 2001(3);

(b) The Diseases of Animals (Approved Disinfectants) (Amendment)Order 1999 (4) to the extent that it relates to Wales.

Explanatory Note

(This note is not part of the Order)

This Order amends the Diseases of Animals (Approved Disinfectants) Order 1978 (“the 1978 Order”), S.I. 1978/32 and revokes earlier amendment Orders. It substitutes for Schedules 1 and 2 to the 1978 Order the Schedules set out in this Order. Schedule 1 lists disinfectants approved by the National Assembly for Wales and Schedule 2 lists disinfectants which, although no longer approved, can continue to be used as approved disinfectants until 30 June 2005.

This Order was notified in draft to the European Commission in accordance with Directive 98/34/EC, as amended by Directive 98/48/EC.

A Regulatory Appraisal has been prepared. Copies may be obtained from the Animal and Plant Health Division of the Welsh Assembly Government, Cathays Park, Cardiff CF10 3NQ.
