eId="regulation-1"><heading>Title, commencement and application</heading><num>1.</num><content><p>These Regulations may be cited as the Common Agricultural Policy Single Payment Scheme (Set-aside) (Wales) Regulations 2005 they come into force on 15 January 2005 and apply in relation to Wales.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations —</p></intro><hcontainer name="definition"><content><p>“collector” (“<i>casglwr</i>”) has the meaning given by Article 144(b) of Commission Regulation 1973/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“Commission Regulation 795/2004” (“<i>Rheoliad y Comisiwn 795/2004</i>”) means Commission Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/2004/0795">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 795/2004</ref><authorialNote 2529/2001</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“Council Regulation 1251/1999” (“<i>Rheoliad y Cyngor 1251/1999</i>”) means Council Regulation <ref eId="c00016" href="http://www.legislation.gov.uk/european/regulation/1999/1251">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1251/1999</ref> establishing a support system for producers of certain arable crops<authorialNote class="footnote" eId="f00006" marker="6"><p>O.J. <abbr title="Number">No.</abbr> L 160, 26.6.1999, p. 1, as last amended by the Council Regulation.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Cross Compliance Regulations 2004” (“<i>Rheoliadau Trawsgydymffurfio 2004</i>”) mean the Common Agricultural Policy Single Payment and Support Schemes (Cross Compliance) (Wales) Regulations 2004<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00026" href="http://www.legislation.gov.uk/id/wsi/2004/3280"><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> 2004 / 3280 (W.284)</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“farmer” (“<i>ffermwr</i>”) has the meaning given by Article 2(a) of the Council Regulation;</p></content></hcontainer><hcontainer name="definition"><content><p>“green cover” (“<i>gorchudd glas</i>”) means a green cover established or, as the case may be, falling to be established in accordance with Schedule 1;</p></content></hcontainer><hcontainer name="definition"><content><p>“green cover season” (“<i>tymor gorchudd glas</i>”) means the period from 15 January to 14 July (inclusive) in any given year;</p></content></hcontainer><hcontainer name="definition"><content><p>“holding” (“<i>daliad</i>”) has the meaning given by Article 2(b) of the Council Regulation;</p></content></hcontainer><hcontainer name="definition"><content><p>“land set aside for non-food purposes” (“<i>tir sydd wedi'i neilltuo at ddibenion di-fwyd</i>”) means land set aside pursuant to Article 55(b) of the Council Regulation under the conditions laid down in Chapter 16 of Commission Regulation 1973/2004 for the provision of materials for the manufacture within the European Community of products not primarily intended for human or animal consumption, and any reference to a farmer setting aside land for that purpose shall be construed accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“land set aside from production” (“<i>tir sydd wedi'i neilltuo oddi wrth waith gynhyrchu</i>”) means land set aside pursuant to Article 54(3) of the Council Regulation (other than land set aside for non-food purposes), and any reference to a farmer setting aside land from production shall be construed accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“the National Assembly” (“<i>y Cynulliad Cendlaethol</i>”) means the National Assembly for Wales;</p></content></hcontainer><hcontainer name="definition"><content><p>“organic waste” (“<i>gwastraff organig</i>”) means waste material produced by or from animals or plants as a by-product of agricultural production, including animal bedding;</p></content></hcontainer><hcontainer name="definition"><content><p>“processor” (“<i>prosesydd</i>”) has the same meaning as in Commission Regulation 1973/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“set-aside period” (“<i>cyfnod neilltuo</i>”) means the period from 15 January to 31 August (inclusive) in any given year; and</p></content></hcontainer><hcontainer name="definition"><content><p>“watercourse” (“<i>cwrs dŵ r</i>”) includes a canal and field ditch.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>Any reference in these Regulations to a Community instrument is a reference to that instrument as amended on the date on which these Regulations are made.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>Other expressions used in these Regulations and in the Council Regulation, Commission Regulation 795/2004 or Commission Regulation 1973/2004 have the same meanings in these Regulations as in the Council Regulation, Commission Regulation 795/2004 or Commission Regulation 1973/2004 as the case may be.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Minimum area and dimensions of set-aside parcels</heading><num>3.</num><intro><p>For the purposes of the second sentence of Article 54(4) of the Council Regulation, land may be set aside from production if —</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>it is eligible for set-aside entitlement pursuant to Article 54(2) of the Council Regulation or counted as eligible for set-aside entitlement as a result of an application granted under regulation 5;</p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p>it is at least 6 metres (but less than 10 metres) wide;</p></content></level><level class="para1" eId="regulation-3-c"><num>(c)</num><content><p>it is at least 0.05 hectares in size; and</p></content></level><level class="para1" eId="regulation-3-d"><num>(d)</num><intro><p>it borders —</p></intro><level class="para2" eId="regulation-3-d-i"><num>(i)</num><content><p>a hedgerow;</p></content></level><level class="para2" eId="regulation-3-d-ii"><num>(ii)</num><content><p>woodland;</p></content></level><level class="para2" eId="regulation-3-d-iii"><num>(iii)</num><content><p>watercourse; or</p></content></level><level class="para2" eId="regulation-3-d-iv"><num>(iv)</num><content><p>an area of land that has been notified under section 28(1)(b) of the Wildlife and Countryside Act 1981<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00027" href="http://www.legislation.gov.uk/id/ukpga/1981/69">1981 c. 69</ref>.</p></authorialNote> as a site of special scientific interest.</p></content></level></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Additional standards of good agricultural and environmental condition in relation to set-aside land</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>Subject to paragraphs (3) to (6), the standards of good agricultural and environmental condition referred to in Article 32(2) of Commission Regulation 795/2004 that apply in relation to land set aside from production are set out in Schedule 1.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>Subject to paragraphs (3) to (6), the standards of good agricultural and environmental condition referred to in Article 32(2) of Commission Regulation 795/2004 that apply in relation to land set aside for non-food purposes are set out in Schedule 2.</p></content></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><content><p>The standards of good agricultural and environmental condition referred to in paragraphs (1) and (2) are to apply to land set aside from production and land set aside for non-food purposes respectively in addition to the standards of good agricultural and environmental condition that apply to the land by virtue of regulation 4 of the Cross Compliance Regulations 2004.</p></content></paragraph><paragraph eId="regulation-4-4"><num>(4)</num><intro><p>The provisions of paragraphs (1) and (2) do not apply to land —</p></intro><level class="para1" eId="regulation-4-4-a"><num>(a)</num><content><p>set aside or afforested pursuant to Articles 22 to 24 or Article 31 of Council Regulation <ref eId="c00017" href="http://www.legislation.gov.uk/european/regulation/1999/1257">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1257/1999</ref><authorialNote class="footnote" eId="f00009" marker="9"><p>O.J. <abbr title="Number">No.</abbr> L160, 26.6.99, p.80, as last amended by Council Regulation <ref eId="c00028" href="http://www.legislation.gov.uk/european/regulation/2003/1783">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1783/2003</ref> (O.J. <abbr title="Number">No.</abbr> L270, 21.10.2003, p.70).</p></authorialNote> on support for rural development from the European Agricultural Guidance and Guarantee Fund (<abbr title="European Agricultural Guidance and Guarantee Fund">EAGGF</abbr>) and amending and repealing certain Regulations, and</p></content></level><level class="para1" eId="regulation-4-4-b"><num>(b)</num><content><p>counting as set-aside for the purposes of Article 54 of the Council Regulation,</p></content></level><wrapUp><p>to the extent that the requirements of Schedule 1 or 2 are incompatible with the environmental or afforestation requirements laid down pursuant to those Articles.</p></wrapUp></paragraph><paragraph eId="regulation-4-5"><num>(5)</num><intro><p>A farmer is exempt from any given requirement of Schedule 1 or 2 in relation to particular set-aside land if, on an application being made to the National Assembly regarding that requirement, he or she satisfies the National Assembly that he or she should be exempted from it —</p></intro><level class="para1" eId="regulation-4-5-a"><num>(a)</num><content><p>to facilitate research into the effect of employing particular methods of managing set-aside land;</p></content></level><level class="para1" eId="regulation-4-5-b"><num>(b)</num><content><p>in the interests of environmental protection;</p></content></level><level class="para1" eId="regulation-4-5-c"><num>(c)</num><content><p>where the farmer is an educational establishment, to facilitate the fulfilment of its educational purpose;</p></content></level><level class="para1" eId="regulation-4-5-d"><num>(d)</num><intro><p>because during the set-aside period—</p></intro><level class="para2" eId="regulation-4-5-d-i"><num>(i)</num><content><p>by virtue of any power or authorisation conferred by or under any enactment, a pipeline, cable or pylon is being or will be laid through, or constructed on or across, the land, the laying or construction of which was not a proposal of which the farmer had been notified more than 5 months before the date on which the land was set aside;</p></content></level><level class="para2" eId="regulation-4-5-d-ii"><num>(ii)</num><content><p>maintenance of a pipeline, cable or pylon is being or will be carried out under statutory authority on the particular set-aside land; or</p></content></level><level class="para2" eId="regulation-4-5-d-iii"><num>(iii)</num><content><p>an archaeological excavation is being or will be carried out on the land;</p></content></level></level><level class="para1" eId="regulation-4-5-e"><num>(e)</num><content><p>in the interests of human or animal health or safety;</p></content></level><level class="para1" eId="regulation-4-5-f"><num>(f)</num><content><p>because such exemption is necessary, either to enable a serious cause of harm to plant health or serious infestation of any pest or specified weed to be treated, or to permit measures to be taken to prevent the development of any such cause of harm or infestation; or</p></content></level><level class="para1" eId="regulation-4-5-g"><num>(g)</num><content><p>in order to benefit a charity (as defined in section 96(1) of the Charities Act 1993)<authorialNote class="footnote" eId="f00010" marker="10"><p><ref eId="c00029" href="http://www.legislation.gov.uk/id/ukpga/1993/10">1993 c. 10</ref>.</p></authorialNote>.</p></content></level></paragraph><paragraph eId="regulation-4-6"><num>(6)</num><content><p>The National Assembly may specify that any exemption granted pursuant to paragraph (5) is effective only until a date, or the occurrence of a particular event, specified in the exemption.</p></content></paragraph><paragraph eId="regulation-4-7"><num>(7)</num><content><p>For the purposes of this regulation, a “specified weed” means any of the injurious weeds listed in section 1(2) of the Weeds Act 1959<authorialNote class="footnote" eId="f00011" marker="11"><p><ref eId="c00030" href="http://www.legislation.gov.uk/id/ukpga/1959/54">1959 c. 54</ref>.</p></authorialNote>, <i>Rhododendron ponticum</i>, Japanese knotweed (<i>Reynoutria japonica</i>), giant hogweed (<i>Heracleum mantegazzianum</i>) or Himalayan balsam (<i>Impatiens glandulifera</i>).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Exchange of eligible and ineligible land</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>In a situation specified in sub-paragraph (a), (b) or (c) of the first paragraph of Article 33 of Commission Regulation 795/2004, a farmer may apply to the National Assembly for land not otherwise eligible for set-aside entitlement to be counted as eligible for set-aside entitlement.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>Subject to paragraph (3), the application must be made in such form as the National Assembly may reasonably require, and, where the farmer intends to exchange the land in respect of which the application is made for other land which is eligible for set-aside entitlement (including land counted as eligible for set-aside entitlement as a result of an application granted under this regulation), he or she must give particulars of that land, as well as the land in respect of which the application is made, in his or her application.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>Where a farmer holds any of the land in respect of which his or her application is made, or any land that he or she intends to exchange for that land, as a tenant, he or she must obtain the written consent of his or her landlord to the exchange, and the application must include a declaration by the applicant that such consent has been obtained.</p></content></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><intro><p>The National Assembly may approve the application made under paragraph (1) if it is satisfied —</p></intro><level class="para1" eId="regulation-5-4-a"><num>(a)</num><content><p>that the relevant sub-paragraph of the first paragraph of Article 33 of Commission Regulation 795/2004 specified in the farmer’s application applies in relation to the land in respect of which the application has been made;</p></content></level><level class="para1" eId="regulation-5-4-b"><num>(b)</num><content><p>where the application has been made on the basis of sub-paragraph (c) of the first paragraph of Article 33 of Commission Regulation 795/2004, with the reasons given by the farmer for wanting to exchange ineligible land for eligible land on his or her holding; and</p></content></level><level class="para1" eId="regulation-5-4-c"><num>(c)</num><intro><p>that —</p></intro><level class="para2" eId="regulation-5-4-c-i"><num>(i)</num><content><p>where the land in respect of which the application is made is to be exchanged for other eligible land, the area of land in respect of which the application is made does not exceed the area of the land which is to be exchanged by more than 5%; or</p></content></level><level class="para2" eId="regulation-5-4-c-ii"><num>(ii)</num><content><p>where there is to be no exchange of land, the approval of the application will not result in a significant increase in the total area of land eligible for set-aside entitlements.</p></content></level></level></paragraph><paragraph eId="regulation-5-5"><num>(5)</num><content><p>Where approval is given under paragraph (4) but any declaration included in, or information given by the farmer in connection with the application was false in any material particular, the National Assembly may revoke such approval.</p></content></paragraph><paragraph eId="regulation-5-6"><num>(6)</num><content><p>In this regulation “eligible for set-aside entitlement”, in relation to land, has the meaning given by the first paragraph of Article 54(2) of the Council Regulation.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Provisions relating to raw materials produced for non-food purposes</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>The National Assembly is designated as the competent authority for the purposes of Chapter 16 of Commission Regulation 1973/2004 (use of land set aside for the production of raw materials for non-food purposes).</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>Raw materials to which Article 146(2)(b) of Commission Regulation 1973/2004 applies must be weighed by an operator of public weighing equipment holding a certificate issued under section 18 of the Weights and Measures Act 1985<authorialNote class="footnote" eId="f00012" marker="12"><p><ref eId="c00031" href="http://www.legislation.gov.uk/id/ukpga/1985/72">1985 c. 72</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><content><p>For the purposes of Article 146(4) of Commission Regulation 1973/2004, cereals and oilseeds to which that paragraph applies must be denatured by dyeing them with a brightly coloured dye.</p></content></paragraph><paragraph eId="regulation-6-4"><num>(4)</num><content><p>For the purposes of Article 157(1) of Commission Regulation 1973/2004, the last day on which a contract to which that paragraph applies may be deposited with the National Assembly is 15 May of the year in which the relevant claim for the associated set-aside entitlement is made.</p></content></paragraph><paragraph eId="regulation-6-5"><num>(5)</num><content><p>For the purposes of Article 157(3) of Commission Regulation 1973/2004, the last day on which a collector or first processor to whom that paragraph applies may provide the National Assembly with the information specified in that paragraph is 31 January of the year following the year in which the relevant claim for the associated set-aside entitlement is made.</p></content></paragraph><paragraph eId="regulation-6-6"><num>(6)</num><intro><p>In this regulation —</p></intro><hcontainer name="definition"><content><p>“the associated set-aside entitlement” means the set-aside entitlement which is being claimed on the land which has been set aside to produce the raw materials to which the contract referred to in paragraph (4), and the information referred to in paragraph (5), relates; and</p></content></hcontainer><hcontainer name="definition"><content><p>“first processor” has the meaning given by Article 144(c) of Commission Regulation 1973/2004.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Keeping and retention of records by a collector and by a processor</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>This regulation applies where a farmer sets aside land for non-food purposes, and in paragraphs (2) to (5) references to “raw materials” are to raw materials produced on that land.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>During any month when a collector purchases or sells any raw materials, he or she must make a record of the quantity of all raw materials which he or she has purchased or sold during that month, and the names and addresses of the subsequent buyers or processors to whom he or she has sold those raw materials.</p></content></paragraph><paragraph eId="regulation-7-3"><num>(3)</num><intro><p>A collector must retain the records referred to in paragraph (2) until the earlier of —</p></intro><level class="para1" eId="regulation-7-3-a"><num>(a)</num><content><p>the end of the third calendar year following the calendar year in which he or she delivers to a processor the raw materials to which those records relate; or</p></content></level><level class="para1" eId="regulation-7-3-b"><num>(b)</num><content><p>the seventh anniversary of the date of their creation.</p></content></level></paragraph><paragraph eId="regulation-7-4"><num>(4)</num><intro><p>On any day during which a processor purchases, processes, destroys, sells or otherwise disposes of any raw materials, or sells or otherwise disposes of any products obtained from the processing of such raw materials, he or she must make a record showing —</p></intro><level class="para1" eId="regulation-7-4-a"><num>(a)</num><content><p>the quantities of the different raw materials purchased by him or her for processing;</p></content></level><level class="para1" eId="regulation-7-4-b"><num>(b)</num><content><p>the quantity of the raw materials processed by him or her together with the quantity and type of end products, co-products and by-products obtained from the processing;</p></content></level><level class="para1" eId="regulation-7-4-c"><num>(c)</num><content><p>the wastage of the raw materials during the processing;</p></content></level><level class="para1" eId="regulation-7-4-d"><num>(d)</num><content><p>the quantity of the raw materials destroyed, if any, together with the reason for such destruction;</p></content></level><level class="para1" eId="regulation-7-4-e"><num>(e)</num><content><p>the quantity and type of products sold or otherwise disposed of by him or her and the price obtained; and</p></content></level><level class="para1" eId="regulation-7-4-f"><num>(f)</num><content><p>the names and addresses of any subsequent buyers or processors to whom he or she sells such raw materials or products of processing.</p></content></level></paragraph><paragraph eId="regulation-7-5"><num>(5)</num><intro><p>A processor must retain the records referred to in paragraph (4) for two years from —</p></intro><level class="para1" eId="regulation-7-5-a"><num>(a)</num><content><p>where the records relate to the purchasing, processing, wastage, destruction, sale or other disposal of the raw materials, the date on which he or she purchases, processes, wastes, destroys, sells or otherwise disposes of the raw materials, as the case may be; and</p></content></level><level class="para1" eId="regulation-7-5-b"><num>(b)</num><content><p>where the records relate to the sale or other disposal of products obtained from the processing of such raw materials, the date on which such products STANDARDS OF GOOD AGRICULTURAL AND ENVIRONMENTAL CONDITION THAT APPLY IN RELATION TO LAND SET ASIDE FROM PRODUCTION</heading><part eId="schedule-1-part-A"><num><b>PART A</b></num><hcontainer name="crossheading" class="schGroup7"><heading>Management options for land set aside from production</heading><paragraph eId="schedule-1-paragraph-1" class="schProv1"><num>1.</num><subparagraph eId="schedule-1-paragraph-1-1"><num>(1)</num><intro><p>Subject to sub-paragraphs (2) to (4), in respect of each field or part of a field which is set aside from production in a particular calendar year, a farmer must, during that year, comply with the conditions applicable to one of the following management options (as set out in paragraphs 2, 3 and 4 respectively) —</p></intro><level class="para1" eId="schedule-1-paragraph-1-1-a"><num>(a)</num><content><p>the sown green cover option;</p></content></level><level class="para1" eId="schedule-1-paragraph-1-1-b"><num>(b)</num><content><p>the natural regeneration option; or</p></content></level><level class="para1" eId="schedule-1-paragraph-1-1-c"><num>(c)</num><content><p>the wild bird cover option.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-1-2"><num>(2)</num><content><p>In 2005, in respect of each part of a field to which regulation 3 applies and which is set aside from production in that year, a farmer may instead comply with the conditions applicable to the under 10 metre strips option (as set out in paragraph 5).</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-3"><num>(3)</num><content><p>Where in 2006 or any year thereafter a farmer sets aside from production land to which regulation 3 applies, he or she must comply with the conditions applicable to the sown green cover option set out in paragraph 2 during that year.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-4"><num>(4)</num><intro><p>Where a farmer —</p></intro><level class="para1" eId="schedule-1-paragraph-1-4-a"><num>(a)</num><content><p>has applied in writing to the National Assembly for permission to manage land set aside from production in accordance with a management plan set out in his or her application, and</p></content></level><level class="para1" eId="schedule-1-paragraph-1-4-b"><num>(b)</num><content><p>has obtained the written consent of the National Assembly to the plan,</p></content></level><wrapUp><p>the farmer must manage the land in accordance with that management plan instead of complying with the conditions set out in the following paragraphs of this Schedule that would otherwise be applicable.</p></wrapUp></subparagraph><subparagraph eId="schedule-1-paragraph-1-5"><num>(5)</num><intro><p>For the purposes of this Schedule —</p></intro><hcontainer name="definition"><content><p>“the current green cover season” (“<i>y tymor gorchudd glas cyfredol</i>”) means the green cover season during the current year;</p></content></hcontainer><hcontainer name="definition"><content><p>“the current year” (“<i>y flwyddyn gyfredol</i>”) means the year referred to in sub-paragraph (1);</p></content></hcontainer><hcontainer name="definition"><content><p>“the current set-aside period” (“<i>y cyfnod neilltuo cyfredol</i>”) means the set-aside period during the current year;</p></content></hcontainer><hcontainer name="definition"><content><p>“the following year” (“<i>y flwyddyn ganlynol</i>”) means the calendar year immediately following the current year;</p></content></hcontainer><hcontainer name="definition"><content><p>“the previous year” (“<i>y flwyddyn flaenorol</i>”) means the calendar year immediately preceding the current year;</p></content></hcontainer><hcontainer name="definition"><intro><p>“a relevant mixture of seed” (“<i>cymysgedd perthnasol o hadau</i>”) means a mixture of seed of crops of different types —</p></intro><level class="para1"><num>(a)</num><content><p>which is not a mixture only of different types of cereal seed or of different types of Brassica seed;</p></content></level><level class="para1"><num>(b)</num><content><p>which is not a mixture only of one type of crop and legumes seed, a mixture only of cereals and legumes seed, or a mixture only of brassicas and legumes seed; and</p></content></level><level class="para1"><num>(c)</num><content><p>the crops from which it would not be practicable to harvest separately; and</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“seed of a relevant kind” (“<i>hadau o fath perthnasol</i>”) means —</p></intro><level class="para1"><num>(a)</num><content><p>grass seed;</p></content></level><level class="para1"><num>(b)</num><content><p>a mixture of grass seed and the seed of native broad-leaved plants not commonly used for agricultural production (where such mixture does not contain more than 50 per cent by weight of legume seed);</p></content></level><level class="para1"><num>(c)</num><content><p>mustard seed; or</p></content></level><level class="para1"><num>(d)</num><content><p>phacelia seed.</p></content></level></hcontainer></subparagraph><subparagraph eId="schedule-1-paragraph-1-6"><num>(6)</num><intro><p>In paragraphs 2(1)(b), 3(1)(b), 4(1)(c) and 5(1)(b), “the relevant period” (“y cyfnod perthnasol”) in relation to a field or part of a field (as the case may be) set aside from production means —</p></intro><level class="para1" eId="schedule-1-paragraph-1-6-a"><num>(a)</num><content><p>where the farmer does not intend to set aside the field or part of a field (as the case may be) from production in the following year or intends to set it aside for a non-food purpose in the following year, the current green cover season; and</p></content></level><level class="para1" eId="schedule-1-paragraph-1-6-b"><num>(b)</num><content><p>where the farmer intends to set aside the field or part of a field (as the case may be) from production in the following year (but does not intend to set it aside for a non-food purpose), the current set-aside period.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>The sown green cover option</heading><paragraph eId="schedule-1-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-1-paragraph-2-1"><num>(1)</num><intro><p>In respect of each field or part of a field to be managed in accordance with the sown green cover option, a farmer must —</p></intro><level class="para1" eId="schedule-1-paragraph-2-1-a"><num>(a)</num><content><p>subject to sub-paragraph (2) and paragraph 7, establish a green cover by the start of the current green cover season by sowing seed of a relevant kind;</p></content></level><level class="para1" eId="schedule-1-paragraph-2-1-b"><num>(b)</num><content><p>subject to paragraphs 8, 12 and 13, maintain the green cover thereafter until the end of the relevant period; and</p></content></level><level class="para1" eId="schedule-1-paragraph-2-1-c"><num>(c)</num><content><p>cut or destroy the green cover in accordance with paragraph 6.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-2-2"><num>(2)</num><intro><p>The requirement to establish a green cover in accordance with paragraph (1)(a) does not apply —</p></intro><level class="para1" eId="schedule-1-paragraph-2-2-a"><num>(a)</num><intro><p>in 2005, where —</p></intro><level class="para2" eId="schedule-1-paragraph-2-2-a-i"><num>(i)</num><content><p>the field or part of a field was set aside in 2004 pursuant to Article 6 of Council Regulation 1251/1999 and was managed during that year in accordance with the grassland option set out in paragraph 2 of Schedule 2 to the Arable Area Payments Regulations 1996<authorialNote class="footnote" eId="f00014" marker="14"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00033" href="http://www.legislation.gov.uk/id/uksi/1996/3142">1996/3142</ref>, to which there are amendments not relevant to these Regulations.</p></authorialNote>; and</p></content></level><level class="para2" eId="schedule-1-paragraph-2-2-a-ii"><num>(ii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season; and</p></content></level></level><level class="para1" eId="schedule-1-paragraph-2-2-b"><num>(b)</num><intro><p>in 2006 and in each year thereafter, where —</p></intro><level class="para2" eId="schedule-1-paragraph-2-2-b-i"><num>(i)</num><content><p>the field or part of a field was set aside in the previous year and was managed during that year in accordance with the sown green cover option; and</p></content></level><level class="para2" eId="schedule-1-paragraph-2-2-b-ii"><num>(ii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season in the year in question.</p></content></level></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>The natural regeneration option</heading><paragraph eId="schedule-1-paragraph-3" class="schProv1"><num>3.</num><subparagraph eId="schedule-1-paragraph-3-1"><num>(1)</num><intro><p>In each field or part of a field to be managed in accordance with the natural regeneration option, a farmer must —</p></intro><level class="para1" eId="schedule-1-paragraph-3-1-a"><num>(a)</num><content><p>subject to sub-paragraph (2) and paragraph 7, establish a green cover by the start of the current green cover season by allowing natural regeneration following the last crop produced in that field or part of a field in the previous year;</p></content></level><level class="para1" eId="schedule-1-paragraph-3-1-b"><num>(b)</num><content><p>subject to paragraphs 8, 12 and 13, maintain the green cover thereafter until the end of the relevant period; and</p></content></level><level class="para1" eId="schedule-1-paragraph-3-1-c"><num>(c)</num><content><p>cut or destroy the green cover in accordance with paragraph 6.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-3-2"><num>(2)</num><intro><p>The requirement to establish a green cover in accordance with paragraph (1)(a) does not apply —</p></intro><level class="para1" eId="schedule-1-paragraph-3-2-a"><num>(a)</num><intro><p>in 2005, where —</p></intro><level class="para2" eId="schedule-1-paragraph-3-2-a-i"><num>(i)</num><content><p>the field or part of a field was set aside in 2004 pursuant to Article 6 of Council Regulation 1251/1999 and was managed during that year in accordance with the natural regeneration option set out in paragraph 3 of Schedule 2 to the Arable Area Payments Regulations 1996<authorialNote class="footnote" eId="f00015" marker="15"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00034" href="http://www.legislation.gov.uk/id/uksi/1996/3142">1996/3142</ref>, to which there are amendments not relevant to these Regulations.</p></authorialNote>; and</p></content></level><level class="para2" eId="schedule-1-paragraph-3-2-a-ii"><num>(ii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season; and</p></content></level></level><level class="para1" eId="schedule-1-paragraph-3-2-b"><num>(b)</num><intro><p>in 2006 and in each year thereafter, where —</p></intro><level class="para2" eId="schedule-1-paragraph-3-2-b-i"><num>(i)</num><content><p>the field or part of a field was set aside in the previous year and was managed during that year in accordance with the natural regeneration option; and</p></content></level><level class="para2" eId="schedule-1-paragraph-3-2-b-ii"><num>(ii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season in the year in question.</p></content></level></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>The wild bird cover option</heading><paragraph eId="schedule-1-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-1-paragraph-4-1"><num>(1)</num><intro><p>In each field or part of a field to be managed in accordance with the wild bird cover option, a farmer must —</p></intro><level class="para1" eId="schedule-1-paragraph-4-1-a"><num>(a)</num><intro><p> subject to sub-paragraph (2) and paragraph 7, either —</p></intro><level class="para2" eId="schedule-1-paragraph-4-1-a-i"><num>(i)</num><content><p>establish a green cover by the start of the current green cover season by allowing natural regeneration following the last crop produced in that field or part of a field in the previous year; or</p></content></level><level class="para2" eId="schedule-1-paragraph-4-1-a-ii"><num>(ii)</num><content><p>establish a green cover by the start of the current green cover season by sowing a relevant mixture of seed.</p></content></level></level><level class="para1" eId="schedule-1-paragraph-4-1-b"><num>(b)</num><intro><p>where a green cover was established by the start of the current green cover season in accordance with sub-paragraph (a)(i) —</p></intro><level class="para2" eId="schedule-1-paragraph-4-1-b-i"><num>(i)</num><content><p>maintain that green cover until it is replaced in accordance with sub-paragraph (ii); and</p></content></level><level class="para2" eId="schedule-1-paragraph-4-1-b-ii"><num>(ii)</num><content><p>replace that green cover by sowing a new green cover comprising a relevant mixture of seed as early as is practicable after the start of the current green cover season and the destruction of the green cover that is to be replaced;</p></content></level></level><level class="para1" eId="schedule-1-paragraph-4-1-c"><num>(c)</num><content><p>subject to paragraph 8, 12 and 13, maintain the green cover established under paragraph (a)(ii) or (b)(ii) until the end of the relevant period; and</p></content></level><level class="para1" eId="schedule-1-paragraph-4-1-d"><num>(d)</num><intro><p>cut or destroy the cover in accordance with paragraph 6, unless —</p></intro><level class="para2" eId="schedule-1-paragraph-4-1-d-i"><num>(i)</num><content><p>the field is to be set aside from production in the following year; and</p></content></level><level class="para2" eId="schedule-1-paragraph-4-1-d-ii"><num>(ii)</num><content><p>the farmer has not harvested any of the green cover, or permitted any of it to be harvested or grazed, in the current year.</p></content></level></level></subparagraph><subparagraph eId="schedule-1-paragraph-4-2"><num>(2)</num><intro><p>The requirement to establish a green cover in accordance with sub-paragraph (1)(a) does not apply —</p></intro><level class="para1" eId="schedule-1-paragraph-4-2-a"><num>(a)</num><intro><p>in 2005, where —</p></intro><level class="para2" eId="schedule-1-paragraph-4-2-a-i"><num>(i)</num><content><p>the field or part of a field was set aside in 2004 pursuant to Article 6 of Council Regulation 1251/1999 and was managed during that year in accordance with the wild bird cover option set out in paragraph 4 of Schedule 2 to the Arable Area Payments Regulations 1996; and</p></content></level><level class="para2" eId="schedule-1-paragraph-4-2-a-ii"><num>(ii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season; and</p></content></level></level><level class="para1" eId="schedule-1-paragraph-4-2-b"><num>(b)</num><intro><p>in 2006 and in each year thereafter, where —</p></intro><level class="para2" eId="schedule-1-paragraph-4-2-b-i"><num>(i)</num><content><p>the field or part of a field was set aside in the previous year;</p></content></level><level class="para2" eId="schedule-1-paragraph-4-2-b-ii"><num>(ii)</num><content><p>the field or part of a field was managed during that year in accordance with the wild bird cover option; and</p></content></level><level class="para2" eId="schedule-1-paragraph-4-2-b-iii"><num>(iii)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season in the year in question.</p></content></level></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>The under 10 metre strips option</heading><paragraph eId="schedule-1-paragraph-5" class="schProv1"><num>5.</num><subparagraph eId="schedule-1-paragraph-5-1"><num>(1)</num><intro><p>In each part of a field to be managed in accordance with the under 10 metre strips option, a farmer must —</p></intro><level class="para1" eId="schedule-1-paragraph-5-1-a"><num>(a)</num><intro><p>subject to sub-paragraph (2) and paragraph 7, establish a green cover by the start of the current green cover season —</p></intro><level class="para2" eId="schedule-1-paragraph-5-1-a-i"><num>(i)</num><content><p>by sowing seed of a relevant kind; or</p></content></level><level class="para2" eId="schedule-1-paragraph-5-1-a-ii"><num>(ii)</num><content><p>by allowing natural regeneration following the last crop which was produced on that part of the field in question in the previous year;</p></content></level></level><level class="para1" eId="schedule-1-paragraph-5-1-b"><num>(b)</num><content><p>subject to paragraphs 8, 12 and 13, maintain the green cover until the end of the relevant period; and</p></content></level><level class="para1" eId="schedule-1-paragraph-5-1-c"><num>(c)</num><content><p>cut the green cover at least once during the current year.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-5-2"><num>(2)</num><intro><p>The requirement to establish a green cover in accordance with sub-paragraph (1)(a) does not apply in 2005 where—</p></intro><level class="para1" eId="schedule-1-paragraph-5-2-a"><num>(a)</num><content><p>the field or part of a field was set aside in 2004 pursuant to Article 6 of Council Regulation 1251/1999 and was managed during that year in accordance with the field margins option set out in paragraph 5 of Schedule 2 to the Arable Area Payments Regulations 1996; and</p></content></level><level class="para1" eId="schedule-1-paragraph-5-2-b"><num>(b)</num><content><p>the green cover established in accordance with the requirements of that option has been maintained until the beginning of the current green cover season.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Cutting or destruction of the green cover</heading><paragraph eId="schedule-1-paragraph-6" class="schProv1"><num>6.</num><subparagraph eId="schedule-1-paragraph-6-1"><num>(1)</num><intro><p>In each field or part of a field to which one of the options mentioned in paragraph 1(1) is applied, a farmer must either —</p></intro><level class="para1" eId="schedule-1-paragraph-6-1-a"><num>(a)</num><content><p>subject to sub-paragraph (2), cut the green cover between 15 July and 15 August (inclusive) during the current set-aside period; or</p></content></level><level class="para1" eId="schedule-1-paragraph-6-1-b"><num>(b)</num><content><p>destroy the green cover between 15 July and 31 August (inclusive) during the current set-aside period.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-6-2"><num>(2)</num><content><p>A farmer may (where he cuts the green cover in a field or part of a field in accordance with sub-paragraph (1)(a)) in the case of a field which is to be set aside in the following year, leave uncut 25% of the area set aside in that field, provided that any area left uncut in accordance with this paragraph which has also been left uncut in the previous two years in accordance with this paragraph (or paragraph 7(2)(b) of Schedule 2 to the Arable Area Payments Regulations 1996) is cut in accordance with sub-paragraph (1) in the following year.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Exemptions from the requirement to establish a green cover on set-aside land</heading><paragraph eId="schedule-1-paragraph-7" class="schProv1"><num>7.</num><subparagraph eId="schedule-1-paragraph-7-1"><num>(1)</num><content><p>In each field or part of a field to which any of the options mentioned in paragraph 1(1) or (2) is applied, a farmer will by virtue of this provision be treated as exempt from a requirement to establish a green cover by the start of the current green cover season, where he or she satisfies the National Assembly that for climatic reasons it was not practicable for a green cover to be established by that time, and, where he or she is treated as exempt, he or she must establish a green cover as soon as reasonably possible after the start of the green cover season.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-7-2"><num>(2)</num><intro><p>In each field or part of a field to which any of the options mentioned in paragraph 1(1) or (2) is applied, a farmer need not establish a green cover on a strip of land forming part of the land set aside and bordering its edge, of a width up to —</p></intro><level class="para1" eId="schedule-1-paragraph-7-2-a"><num>(a)</num><content><p>1 metre, where the strip of land set aside borders land planted with a crop other than a seed crop;</p></content></level><level class="para1" eId="schedule-1-paragraph-7-2-b"><num>(b)</num><content><p>2 metres, where the strip of land set aside borders land planted with a seed crop; or</p></content></level><level class="para1" eId="schedule-1-paragraph-7-2-c"><num>(c)</num><content><p>5 metres, in any place where vehicular access to that land from a road or track adjacent to that land may be possible, provided that the strip is ploughed and left as bare fallow.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-7-3"><num>(3)</num><content><p>In sub-paragraph (2), “seed crop” means a crop grown so that the seed of the crop may be harvested and sown to establish a further crop.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Exemptions from the requirement to maintain a green cover on the land set aside from production</heading><paragraph eId="schedule-1-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-1-paragraph-8-1"><num>(1)</num><content><p>In each field or part of a field to which any of the options mentioned in paragraph 1(1) or (2) is applied, a farmer is not required to maintain a green cover on the land set aside from production where that green cover is destroyed following the application of herbicide to the land on or after 15 April in the current year.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-8-2"><num>(2)</num><content><p>In respect of each field or part of a field to which any of the options mentioned in paragraph 1(1) or (2) is applied, a farmer will by virtue of this provision be treated as exempt from a requirement to maintain a green cover where he or she satisfies the National Assembly that the green cover which he or she established failed and he or she could not reasonably have prevented such failure.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-8-3"><num>(3)</num><intro><p>The exemptions mentioned in sub-paragraphs (1) and (2) will apply until —</p></intro><level class="para1" eId="schedule-1-paragraph-8-3-a"><num>(a)</num><content><p>in the case of the exemption in sub-paragraph (1), the commencement of the following green cover season; and</p></content></level><level class="para1" eId="schedule-1-paragraph-8-3-b"><num>(b)</num><content><p>in the case of the exemption in sub-paragraph (2), the end of the current year.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-8-4"><num>(4)</num><content><p>In each field or part of a field to which any of the options mentioned in paragraph 1(1) or (2) is applied, and in which a farmer has chosen not to establish a green cover on a strip of land pursuant to paragraph 7(2), he or she need not maintain any green cover which nevertheless subsequently becomes established on that strip.</p></content></subparagraph></paragraph></hcontainer></part><part eId="schedule-1-part-B"><num><b>PART B</b></num><heading>General standards applying to all land set aside from production</heading><hcontainer name="crossheading" class="schGroup7"><heading>Application of conditions to all land set aside from production</heading><paragraph eId="schedule-1-paragraph-9" class="schProv1"><num>9.</num><content><p>The provisions of paragraphs 10 to 15 of this Schedule apply to all land set aside from production that is managed by a farmer in accordance with any of the provisions of paragraphs 1 to 8.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Prohibition on sowing and preparation for sowing a crop on, and the cultivation of, the land set aside from production</heading><paragraph eId="schedule-1-paragraph-10" class="schProv1"><num>10.</num><subparagraph eId="schedule-1-paragraph-10-1"><num>(1)</num><content><p>Subject to paragraphs 11 and 12, during the current set-aside period, a farmer must not sow or carry out any preparation for sowing a crop on the land set aside from production or otherwise cultivate that land.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-10-2"><num>(2)</num><content><p>Any reference to a date in paragraph 11 or 12 is to that date falling within the current set-aside period.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Exemptions from the prohibition on sowing and preparation for sowing a crop on the land set aside from production</heading><paragraph eId="schedule-1-paragraph-11" class="schProv1"><num>11.</num><subparagraph eId="schedule-1-paragraph-11-1"><num>(1)</num><content><p>A farmer may make preparations for sowing on or after 15 July.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-11-2"><num>(2)</num><content><p>Subject to paragraph (3), a farmer may sow any seed on or after 15 July where the seed sown is sown in order to produce a crop for harvesting in the following year.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-11-3"><num>(3)</num><content><p>Where a farmer sows a grass ley on land set-aside from production pursuant to the exemption in sub-paragraph (2), he or she must not graze any animals on that land during the remainder of the current year.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Cultivation of land set aside from production for the purpose of weed control</heading><paragraph eId="schedule-1-paragraph-12" class="schProv1"><num>12.</num><content><p>A farmer may at any time on or after 1 July cultivate the land set aside from production for the purposes of controlling weeds.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Replacement of the green cover and changing management options</heading><paragraph eId="schedule-1-paragraph-13" class="schProv1"><num>13.</num><subparagraph eId="schedule-1-paragraph-13-1"><num>(1)</num><content><p>Subject to sub-paragraphs (2) and (3), in any period during which a farmer is required to maintain a green cover in a field or part of a field, he or she may nevertheless replace that green cover with another provided that the seed is sown as soon as is practicable after the destruction of the existing green cover.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-13-2"><num>(2)</num><intro><p>The seed to be sown to establish a replacement green cover must —</p></intro><level class="para1" eId="schedule-1-paragraph-13-2-a"><num>(a)</num><content><p>where the cover is to be replaced in part only of a field managed in accordance with the under 10 metre strips option, be seed of a relevant kind; and</p></content></level><level class="para1" eId="schedule-1-paragraph-13-2-b"><num>(b)</num><intro><p>in other cases be —</p></intro><level class="para2" eId="schedule-1-paragraph-13-2-b-i"><num>(i)</num><content><p>seed of a relevant kind; or</p></content></level><level class="para2" eId="schedule-1-paragraph-13-2-b-ii"><num>(ii)</num><content><p>a relevant mixture of seed.</p></content></level></level></subparagraph><subparagraph eId="schedule-1-paragraph-13-3"><num>(3)</num><intro><p>A farmer must, in respect of the field or part of a field where the green cover has been replaced, comply with such of the conditions set out in Part A of this Schedule as relate to one of the following management options —</p></intro><level class="para1" eId="schedule-1-paragraph-13-3-a"><num>(a)</num><content><p>where the seed sown is seed of a relevant kind, the sown green cover option; or</p></content></level><level class="para1" eId="schedule-1-paragraph-13-3-b"><num>(b)</num><content><p>where the seed sown is a relevant mixture of seed, the wild bird cover option.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-13-4"><num>(4)</num><content><p>Where a farmer replaces a green cover in accordance with sub-paragraph (1), he or she must not graze any animals on that land, or harvest any crops produced on that land, during the remainder of the current year.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Use of the green cover</heading><paragraph eId="schedule-1-paragraph-14" class="schProv1"><num>14.</num><subparagraph eId="schedule-1-paragraph-14-1"><num>(1)</num><content><p>A farmer must ensure that, subject to sub-paragraph (2), no green cover or cuttings from any green cover are used for seed production or any other commercial or agricultural purpose in the current year.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-14-2"><num>(2)</num><intro><p>A farmer may —</p></intro><level class="para1" eId="schedule-1-paragraph-14-2-a"><num>(a)</num><content><p>subject to paragraphs 11(3) and 13(4), use any such green cover or cuttings for any agricultural purposes after 31 August; and</p></content></level><level class="para1" eId="schedule-1-paragraph-14-2-b"><num>(b)</num><content><p>place on the market any cuttings, or crops, that are harvested from the green cover on or after 15 January in the following year.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-14-3"><num>(3)</num><content><p>A farmer must ensure that no cuttings from the green cover are removed from the set-aside land concerned except in accordance with sub-paragraph (2) or with the prior consent of the National Assembly.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Application of fertiliser, waste, lime and gypsum to the land set-aside from production</heading><paragraph eId="schedule-1-paragraph-15" class="schProv1"><num>15.</num><subparagraph eId="schedule-1-paragraph-15-1"><num>(1)</num><content><p>A farmer must not apply any fertiliser, waste, lime or gypsum to the land set aside from production except in accordance with the following sub-paragraphs.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-2"><num>(2)</num><content><p>A farmer may apply fertilisers to the land set-aside from production if prior to such application he or she satisfies the National Assembly that the land is situated in an area known to be used as a feeding area by geese in winter and is to be managed as such an area.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-3"><num>(3)</num><intro><p>Throughout the set-aside period a farmer may apply organic waste to the land set aside from production provided that it —</p></intro><level class="para1" eId="schedule-1-paragraph-15-3-a"><num>(a)</num><content><p>is applied only where there is an existing green cover on the set-aside land;</p></content></level><level class="para1" eId="schedule-1-paragraph-15-3-b"><num>(b)</num><content><p>is applied in amounts which will not destroy that green cover; and</p></content></level><level class="para1" eId="schedule-1-paragraph-15-3-c"><num>(c)</num><intro><p>in the case of manure and slurry, is not applied —</p></intro><level class="para2" eId="schedule-1-paragraph-15-3-c-i"><num>(i)</num><content><p>within 10 metres of any watercourse; or</p></content></level><level class="para2" eId="schedule-1-paragraph-15-3-c-ii"><num>(ii)</num><content><p>within 50 metres of any boreholes.</p></content></level></level></subparagraph><subparagraph eId="schedule-1-paragraph-15-4"><num>(4)</num><content><p>A farmer must not store, dump or otherwise dispose of any waste on the land set aside from production, save that he or she may store organic waste in a field which comprises or forms part of the set-aside land where that organic waste is to be applied by him or her to that field in accordance with sub-paragraph (3).</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-5"><num>(5)</num><content><p>A farmer may apply fertiliser during the current year to any agricultural parcel of land managed in accordance with paragraph 4 where a new green cover is being established in that year, provided that the total nitrogen content of that fertiliser is not more than 30 kilograms per hectare of the land to which it is applied.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-6"><num>(6)</num><content><p>A farmer may apply lime or gypsum to the land set aside from production where that land is to be cropped in the following year.</p></content></subparagraph></paragraph></hcontainer></part></hcontainer><hcontainer name="schedule" eId="schedule-2"><num>SCHEDULE 2<authorialNote class="referenceNote"><p>Regulation 4(2) and (4)</p></authorialNote></num><heading>ADDITIONAL STANDARDS OF GOOD AGRICULTURAL AND ENVIRONMENTAL CONDITION THAT APPLY IN RELATION TO LAND SET ASIDE FOR THE PROVISION OF NON-FOOD CROPS</heading><hcontainer name="crossheading" class="schGroup7"><heading>Application of fertilisers and waste to land set aside for the provision of non-food crops</heading><intro><p>A farmer may only apply fertiliser or waste to land set aside for the provision of non-food crops so far as —</p></intro><level class="para1" eId="schedule-2-paragraph-a"><num>(a)</num><content><p>it is necessary to do so in order to ensure the proper growth of the crops; and</p></content></level><level class="para1" eId="schedule-2-paragraph-b"><num>(b)</num><content><p>the manner of application is consistent with the Code of Good Agricultural Practice for the Protection of Water approved by the Water (Prevention of Pollution) (Code of Practice) Order 1998<authorialNote class="footnote" eId="f00016" marker="16"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00035" href="http://www.legislation.gov.uk/id/uksi/1998/3084">1998/3084</ref>.</p></authorialNote>.</p></content></level></hcontainer></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations come into force on 15 January 2005. They make provision in Wales for the administration of Council Regulation <ref eId="c00018" href="http://www.legislation.gov.uk/european/regulation/2003/1782">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1782/2003</ref> (O.J. <abbr title="Number">No.</abbr> L 270, 21.10.2003, p. 1) (“the Council Regulation”), Commission Regulation <ref eId="c00019" href="http://www.legislation.gov.uk/european/regulation/2004/0795">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 795/2004</ref> (O.J. <abbr title="Number">No.</abbr> L 141, 30.4.2004, p. 1) and Commission Regulation <ref eId="c00020" href="http://www.legislation.gov.uk/european/regulation/2004/1973">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1973/2004</ref> (O.J. <abbr title="Number">No.</abbr> L 345, 20.11.2004, p. 1) (“ Commission Regulation 1973/2004”) in relation to the obligation to set aside land under the new Single Payment Scheme for farmers (“the Scheme”). The Scheme itself came into force on 1 January 2005.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 3 lays down the minimum size and width of land that may be set aside in specific situations as permitted by Article 54(4) of the Council Regulation. In doing so, it derogates from the provision of Article 54(4) that otherwise lays down the minimum size and width of land that may be set aside.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4, as read with Schedules 1 and 2, lays down the good agricultural and environmental conditions that apply to land set aside under the Scheme. These apply in addition to the good agricultural and environmental conditions that apply by virtue of the Common Agricultural Policy Single Payment and Support Schemes (Cross Compliance) (Wales) Regulations 2004 (<ref eId="c00021" href="http://www.legislation.gov.uk/id/wsi/2004/3280"><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> 2004 / 3280 (W.284)</ref>).</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 allows farmers to apply for land that cannot be set aside under the Scheme to be counted as land that may be set aside under the Scheme. Article 33 of Commission Regulation 795/2004 lays down the cases in which this may be permitted. In some cases, this may involve an exchange of land.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 6 lays down provisions relating to raw materials grown on land which is set aside for the provision of materials for the manufacture within the European Community of products not primarily intended for human or animal consumption (“raw materials produced for non-food purposes”) as follows —</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>it designates the National Assembly as the competent authority for the purposes of Chapter 16 of Commission Regulation 1973/2004 (use of land set aside for the production of raw materials for non-food purposes) (paragraph (1));</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>it lays down provisions relating to the weighing of certain raw materials produced for non-food purposes where they are to be used for any of the purposes specified in Article 146(1) of Commission Regulation 1973/2004 (paragraph (2));</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>it lays down the method of denaturing to be applied to cereals and oilseeds where they are to be used for any of the purposes specified in Article 146(1)(a) of Commission Regulation 1973/2004 (paragraph (3)); and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>it lays down the date of 15 May of the year of application as the last day by which contracts made between farmers and collectors or processors in respect of raw materials produced for non-food purposes must be deposited with the National Assembly (paragraph (4)) and the date of 31 January of the following year as the last day by which certain information relating to those materials must be deposited with the National Assembly (paragraph (5)).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>Regulation 7 lays down the records that must be kept by collectors and first processors in respect of any raw materials produced for non-food purposes purchased by them and the period for which such records should be kept.</p></blockContainer><blockContainer ukl:Name="P"><p>A regulatory appraisal in respect of these Regulations has been prepared and is available from the Department for Environment, Planning and Countryside, National Assembly for Wales, Cathays Park, Cardiff CF10 3NQ.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
