Trosglwyddo cofnodion achos

44.—(1) Yn ddarostyngedig i baragraff (4), caiff yr asiantaeth fabwysiadu drosglwyddo copi o gofnod achos (neu ran ohono) i asiantaeth fabwysiadu arall pan fydd o'r farn fod hyn er lles plentyn neu ddarpar fabwysiadydd y mae'r cofnod yn ymwneud ag ef, a rhaid cadw cofnod ysgrifenedig o unrhyw drosglwyddiad o'r fath.

(2) Yn ddarostyngedig i baragraff (4), rhaid i gymdeithas fabwysiadu gofrestredig sy'n bwriadu peidio â gweithredu neu beidio â bod yn gymdeithas fabwysiadu gofrestredig drosglwyddo ar unwaith naill ai ei chofnodion achos i asiantaeth fabwysiadu arall ar ôl cael cymeradwyaeth yr awdurdod cofrestru ar gyfer trosglwyddiad o'r fath neu drosglwyddo ei chofnodion achos —

(a)i'r awdurdod lleol y lleolir prif swyddfa'r gymdeithas yn ei ardal; neu

(b)yn achos cymdeithas sy'n cyfuno â chymdeithas fabwysiadu gofrestredig arall i ffurfio cymdeithas fabwysiadu gofrestredig newydd, i'r corff newydd hwnnw.

(3) Os yw cymdeithas fabwysiadu gofrestredig yn bwriadu peidio â darparu ar gyfer mabwysiadu plant ond ei bod wedi'i chofrestru i ddarparu gwasanaethau cymorth mabwysiadu caiff gadw ei holl gofnodion achos ar ôl cael yn gyntaf gymeradwyaeth yr awdurdod cofrestru yn ysgrifenedig ar gyfer eu cadw.

(4) Rhaid i'r asiantaeth fabwysiadu y trosglwyddir cofnodion achos iddi yn rhinwedd paragraff (2)(a) neu (b) hysbysu'r awdurdod cofrestru yn ysgrifenedig o'r cyfryw drosglwyddiad.
