Mynediad at gofnodion achos a datgelu gwybodaeth

43.—(1) Yn ddarostyngedig i baragraff (3), rhaid i'r asiantaeth fabwysiadu ddarparu'r mynediad hwnnw at ei chofnodion achos a datgelu'r wybodaeth honno sydd yn ei meddiant, y gallai fod ei hangen —

(a)i'r sawl sy'n cynnal ymchwiliad o dan adran 81 o Ddeddf 1989 (ymchwiliadau) neu adran 17 o'r Ddeddf (ymchwiliadau) at ddibenion ymchwiliad o'r fath;

(b)i Gynulliad Cenedlaethol Cymru;

(c)yn ddarostyngedig i ddarpariaethau adran 74(5) o Ddeddf Safonau Gofal 2000 (datgeliad), i Gomisiynydd Plant Cymru at ddibenion unrhyw archwiliad a gynhelir yn unol â Rhan V o'r Ddeddf honno;

(ch)yn ddarostyngedig i ddarpariaethau adrannau 29(7) a 32(3) o Ddeddf Llywodraeth Leol 1974 (ymchwiliadau a datgeliad), i Gomisiynydd Gweinyddiaeth Leol yng Nghymru, at ddibenion unrhyw ymchwiliad a gynhelir yn unol â Rhan III o'r Ddeddf honno;

(d)i unrhyw berson a benodwyd gan yr asiantaeth fabwysiadu at ddibenion ystyriaeth gan yr asiantaeth o unrhyw sylwadau (gan gynnwys cwynion);

(dd)i'r personau a'r awdurdodau gan y Rheoliadau hyn ac i'r graddau a bennir yn y Rheoliadau hyn;

(e)i swyddog achosion teuluol ar gyfer Cymru neu swyddog o CAFCASS at ddibenion cyflawni dyletswyddau'r swyddog o dan y Ddeddf;

(f)i lys y mae ganddo bŵer i wneud gorchymyn o dan y Ddeddf neu o dan Ddeddf 1989.

(2) Yn ddarostyngedig i baragraff (3), caiff yr asiantaeth fabwysiadu ddarparu'r mynediad hwnnw a datgelu'r wybodaeth honno sydd yn ei meddiant, fel y gwêl yn dda at ddibenion cyflawni ei swyddogaethau fel asiantaeth fabwysiadu.

(3) Rhaid i'r asiantaeth fabwysiadu gadw cofnod ysgrifenedig o unrhyw fynediad a ddarperir neu ddatgeliad a roir yn rhinwedd y rheoliad hwn.
