Tynnu cydsyniad yn ôl
39.—(1) Mae'r paragraff hwn yn gymwys pan dynnir cydsyniad yn ôl o dan adran 19, neu adran 19 a 20 o'r Ddeddf o ran plentyn yn unol ag adran 52(8) o'r Ddeddf.
(2) Os yw paragraff (1) yn gymwys ac os yw'r asiantaeth fabwysiadu yn awdurdod lleol, pan dderbynnir y ffurflen neu'r hysbysiad a roddir yn unol ag adran 52(8) o'r Ddeddf rhaid i'r awdurdod ar unwaith adolygu ei benderfyniad i leoli'r plentyn i'w fabwysiadu ac os bydd yr awdurdod, yn unol ag adran 22(1) neu (2) o'r Ddeddf yn penderfynu gwneud cais am orchymyn lleoliad o ran y plentyn, rhaid iddo ar unwaith hysbysu —
(a)y rhiant neu'r gwarcheidwad;
(b)os yw rheoliad 14(2) yn gymwys, tad y plentyn, ac
(c)os lleolir y plentyn ar gyfer ei fabwysiadu, y darpar fabwysiadydd y lleolir y plentyn gydag ef.
(3) Os bydd paragraff (1) yn gymwys a bod yr asiantaeth fabwysiadu yn gymdeithas fabwysiadu gofrestredig, rhaid i'r asiantaeth ar unwaith ystyried a yw'n briodol i hysbysu'r awdurdod lleol y mae'r plentyn yn byw yn ei ardal.
