Penderfyniad yr asiantaeth fabwysiadu o ran y lleoliad arfaethedig
34.—(1) Rhaid i'r asiantaeth fabwysiadu wneud y canlynol —
(a)ystyried argymhelliad y panel mabwysiadu;
(b)ystyried unrhyw gyngor a roddir gan y panel mabwysiadu yn unol â rheoliad 33(3); a
(c)rhoi sylw i'r ystyriaeth a nodir yn adran 1(2) o'r Ddeddf,
wrth benderfynu a ddylid lleoli'r plentyn ar gyfer ei fabwysiadu gyda'r darpar fabwysiadydd penodol.
(2) Nid oes unrhyw aelod o'r panel mabwysiadu i gymryd rhan yn unrhyw benderfyniad a wneir gan yr asiantaeth fabwysiadu o dan baragraff (1).
(3) Cyn gynted â phosibl ar ôl iddi benderfynu rhaid i'r asiantaeth fabwysiadu hysbysu'r darpar fabwysiadydd yn ysgrifenedig o'i phenderfyniad ynghylch y lleoliad arfaethedig, trefniadau cyswllt a chyfyngu ar gyfrifoldeb rhiant unrhyw berson.
(4) Cyn gynted â phosibl ar ôl iddi benderfynu, rhaid i'r asiantaeth hysbysu yn ysgrifenedig —
(a)y rhiant neu'r gwarcheidwad, os yw'r asiantaeth yn gwybod lle y maent; a
(b)os yw rheoliad 14(2) yn gymwys, tad y plentyn,
o'i phenderfyniad.
(5) Os yw'r asiantaeth fabwysiadu yn penderfynu y dylai'r lleoliad arfaethedig fynd rhagddo, rhaid i'r asiantaeth esbonio ei phenderfyniad i'r plentyn mewn modd priodol ac yng ngoleuni oedran a dealltwriaeth y plentyn.
