Swyddogaeth y panel mabwysiadu o ran plentyn a atgyfeirir gan yr asiantaeth fabwysiadu

18.—(1) Rhaid i'r panel mabwysiadu ystyried achos pob plentyn a gaiff ei atgyfeirio ato gan yr asiantaeth fabwysiadu a gwneud argymhelliad i'r asiantaeth honno ynghylch a ddylid lleoli'r plentyn ar gyfer ei fabwysiadu.

(2) Wrth ystyried pa argymhelliad i'w wneud, rhaid i'r panel mabwysiadu roi sylw i'r dyletswyddau a osodwyd ar yr asiantaeth fabwysiadu o dan adran 1(2), (4), (5) a (6) o'r Ddeddf (ystyriaethau sy'n gymwys wrth arfer pwerau o ran mabwysiadu plentyn) a —

(a)rhaid iddo bwyso a mesur a chymryd i ystyriaeth yr holl wybodaeth a'r adroddiadau a ddaeth iddo yn unol â rheoliad 17;

(b)caiff ofyn i'r asiantaeth gael gafael ar unrhyw wybodaeth berthnasol arall y mae'r panel yn ystyried ei bod yn angenrheidiol;

(c)rhaid iddo gael cyngor cyfreithiol yr ystyria sy'n angenrheidiol o ran yr achos.

(3) Pan fo'r panel mabwysiadu yn gwneud argymhelliad i'r asiantaeth fabwysiadu y dylid lleoli'r plentyn ar gyfer ei fabwysiadu rhaid iddo ystyried a chaiff ar yr un pryd roi cyngor i'r asiantaeth ynghylch —

(a)y trefniadau y mae'r asiantaeth yn bwriadu eu gwneud er mwyn caniatáu cyswllt â'r plentyn i unrhyw berson;

(b)os yw'r asiantaeth fabwysiadu yn awdurdod lleol, a ddylid gwneud cais am orchymyn lleoliad ynglyn â'r plentyn.
