powers conferred on it by section 128(4)(b) and (c) of the Learning and Skills Act 2000<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/2000/21">2000 c. 21</ref>.</p></authorialNote>.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Name, commencement, application and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations are called The Inspection of Youth Support Services in Wales Regulations 2004 and shall come into force on 1st August 2004.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply to Wales.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><intro><p>In these Regulations —</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Learning and Skills Act 2000 c. 21">2000 Act</abbr>” (“<i><abbr title="Deddf Dysgu a Medrau 2000 p. 21">Deddf 2000</abbr></i>”) means the Learning and Skills Act 2000;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Her Majesty’s Chief Inspector of Education and Training in Wales">Chief Inspector</abbr>” (“<i>y <abbr title="Prif Arolygydd Ei Mawrhydi dros Addysg a Hyfforddiant yng Nghymru">Prif Arolygydd</abbr></i>”) means Her Majesty’s Chief Inspector of Education and Training in Wales<authorialNote class="footnote" eId="f00002" marker="2"><p><i>See</i> section 4 of the School Inspections Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1996/57">1996 (c. 57)</ref>. The current title, Her Majesty’s Chief Inspector of Education and Training in Wales, was substituted by section 73(1) of the Learning and Skills Act 2000.</p></authorialNote>; and</p></content></hcontainer><hcontainer name="definition"><content><p>“working day” (“<i>diwrnod gwaith</i>”) means a day which is not a Saturday, a Sunday or a bank holiday.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Action plan</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>A statement under section 128 of the <abbr title="Learning and Skills Act 2000 c. 21">2000 Act</abbr> (“an action plan”) must be published within the period of 50 working days (whether or not there is a requirement that it be translated), from the date on which the report of the inspection concerned was published under arrangements made by the <abbr title="Her Majesty’s Chief Inspector of Education and Training in Wales">Chief Inspector</abbr>.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>The action plan must be published by making it available at the offices of the person who provided the inspected service, for inspection by members of the public at all reasonable times, and on any internet web-site of that person which is associated with the service.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>A copy of the action plan must be sent free of charge to each of the following —</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>the <abbr title="Her Majesty’s Chief Inspector of Education and Training in Wales">Chief Inspector</abbr>;</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>the National Assembly for Wales;</p></content></level><level class="para1" eId="regulation-2-3-c"><num>(c)</num><content><p>the National Council for Education and Training in Wales;</p></content></level><level class="para1" eId="regulation-2-3-d"><num>(d)</num><content><p>any other organisations which contribute to the provision of the youth support services who were not included within the original report from the <abbr title="Her Majesty’s Chief Inspector of Education and Training in Wales">Chief Inspector</abbr>;</p></content></level><level class="para1" eId="regulation-2-3-e"><num>(e)</num><content><p>young people’s representatives groups within the area for which the local authority is responsible;</p></content></level><level class="para1" eId="regulation-2-3-f"><num>(f)</num><content><p>all school councils within the area for which the local authority is responsible; and</p></content></level><level class="para1" eId="regulation-2-3-g"><num>(g)</num><intro><p>any partnership established by the local authority to encourage, enable or assist young persons (directly or indirectly) —</p></intro><level class="para2" eId="regulation-2-3-g-i"><num>(i)</num><content><p>to participate in education or training,</p></content></level><level class="para2" eId="regulation-2-3-g-ii"><num>(ii)</num><content><p>to take advantage of opportunities for employment, or</p></content></level><level class="para2" eId="regulation-2-3-g-iii"><num>(iii)</num><content><p>to participate effectively and responsibly in the life of their communities.</p></content></level></level></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><content><p>A copy of the action plan must also be sent (free of charge) to any member of the public who request a copy.</p></content></paragraph></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><p>Signed on behalf of the National Assembly for Wales under section 66(1) of the Government of Wales Act 1998<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1998/38">1998 c. 38</ref>.</p></authorialNote></p><block name="signature"><signature refersTo="#">John Marek</signature></block><block name="role"><role refersTo="#">The Deputy Presiding Officer of the National Assembly</role></block><block name="date"><date date="2004-03-09">9th March 2004</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations state the time-scale within which statements under section 128 of the Learning and Skills Act 2000 are to be published and who should be sent a copy.</p></blockContainer><blockContainer ukl:Name="P"><p>A statement under section 128 is a statement of the action which is proposed by the party whose services have been inspected, in light of a report following an inspection of Her Majesty’s Chief Inspector of Education and Training in Wales.
