<Text>Section 329 of the Planning Act<FootnoteRef Ref="f00006"/> (service of notices) is amended as follows.</Text>

<Text>In subsection (1), after paragraph (c), insert—</Text>

<Text>After subsection (3), insert—</Text>

<Text>The condition mentioned in subsection (1)(cc) is that the notice or other document shall be—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>capable of being accessed by the person mentioned in that provision;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>legible in all material respects; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>in a form sufficiently permanent to be used for subsequent reference,</Text>
</P3para>
</P3>
<Text>and for this purpose “legible in all material respects” means that the information contained in the notice or document is available to that person to no lesser extent than it would be if served or given by means of a notice or document in printed form.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3B</Pnumber>
<P2para>
<Text>Subsection (1)(cc) shall not apply to—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>service of a planning contravention notice;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>service of a copy of an enforcement notice by a local planning authority;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>giving of notice under section 173A of the exercise of powers conferred by subsection (1) of that section;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>service under section 181(4) of notice of a local planning authority’s intention to take steps required by an enforcement notice;</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>service of an enforcement notice issued by the Secretary of State;</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>service of a stop notice, or of notice of withdrawal of a stop notice, by a local planning authority;</Text>
</P3para>
</P3>
<P3>
<Pnumber>g</Pnumber>
<P3para>
<Text>service of a stop notice by the Secretary of State;</Text>
</P3para>
</P3>
<P3>
<Pnumber>h</Pnumber>
<P3para>
<Text>service of a breach of condition notice or of notice of withdrawal of a breach of condition notice;</Text>
</P3para>
</P3>
<P3>
<Pnumber>i</Pnumber>
<P3para>
<Text>giving of notice of the making of a tree preservation order, or service of a copy of such an order, in accordance with regulations under section 199;</Text>
</P3para>
</P3>
<P3>
<Pnumber>j</Pnumber>
<P3para>
<Text>service of a notice under section 215 requiring steps to be taken to remedy the condition of any land;</Text>
</P3para>
</P3>
<P3>
<Pnumber>k</Pnumber>
<P3para>
<Text>service of a notice under section 330 requiring information as to interests in land.</Text>
