<Text>These Regulations may be cited as the Bus Service Operators Grant (Wales) (Amendment) Regulations 2004 and come into force on 31 July 2004.</Text>

<Title>Amendment of principal Regulations</Title>

<Text>The Bus Service Operators Grant (Wales) Regulations 2002<FootnoteRef Ref="f00002"/> (“the principal Regulations”) are amended as provided in regulations 3 and 4.</Text>

<Title>Amendment of interpretation provisions</Title>

<Pnumber>3</Pnumber>

<Text>In Regulation 2 of the principal Regulations, insert in the appropriate place in alphabetical order—</Text>

<Text>“fixed stopping place” (“<Emphasis>man aros gosodedig</Emphasis>”) means a stopping place at a fixed location”; and</Text>

<Text>“flexible service” (“<Emphasis>gwasanaeth hyblyg</Emphasis>”) means a service:</Text>

<Para>
<Text>which serves one or more local communities or neighbourhoods within a specific geographical area,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="ii">
<Para>
<Text>which, while it may have fixed sections of route, is in the entirety of its operation so flexible that it is not practicable to identify in advance all the roads to be traversed at any given time,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="iii">
<Para>
<Text>which is provided primarily for the purpose of carrying passengers who have booked in advance of the journey and whose collective requirements determine the route of each journey notwithstanding that other persons may also be travelling,</Text>
</Para>
</ListItem>
<ListItem NumberOverride="iv">
<Para>
<Text>all the seats of which are available for use by members of the general public, and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>which is provided in consideration of the payment of individual passenger fares which are not subject to variation according to the number of passengers carried on the journey.</Text>

<Text>Regulation 3 of the principal Regulations (eligibility for grant) is amended as follows—</Text>
