by that section hereby makes the following Regulations:</p></formula></preamble><body eId="body"><hcontainer name="regulation" eId="regulation-1"><heading>Title, application and commencement</heading><num>1.</num><content><p>These Regulations are called the Registration of Establishments (Laying Hens) (Wales) Regulations 2004; they apply only to Wales and come into force on 31st May 2004.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>In these Regulations —</p></content></paragraph><hcontainer name="definition"><content><p><noteRef href="#key-6d0598d24595b667cdb3c2e58c1869a6" uk:name="commentary" ukl:Name="CommentaryRef" href="http://www.legislation.gov.uk/european/directive/1999/0074"/> </p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-establishment" eId="term-establishment">establishment</term>” (“<term refersTo="#term-sefydliad" eId="term-sefydliad"><i>sefydliad</i></term>”) means any production site at which laying hens are kept;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-laying-hens" eId="term-laying-hens">laying hens</term>” (“<term refersTo="#term-ieir-dodwy" eId="term-ieir-dodwy"><i>ieir dodwy</i></term>”) means hens of the species <i>Gallus gallus</i> which have reached maturity and are kept for the production of eggs not intended for hatching;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-local-authority" eId="term-local-authority">local authority</term>” (“<term refersTo="#term-awdurdod-lleol" eId="term-awdurdod-lleol"><i>awdurdod lleol</i></term>”) means the council of any county or county borough in Wales;</p></content></hcontainer><hcontainer name="definition"><content><p><noteRef href="#key-6d0598d24595b667cdb3c2e58c1869a6" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...<term refersTo="#term-y-cynulliad-cenedlaethol" eId="term-y-cynulliad-cenedlaethol"><i/></term></p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-register" eId="term-register">register</term>” (“<term refersTo="#term-cofrestr" eId="term-cofrestr"><i>cofrestr</i></term>”) means the register of establishments maintained by the  <ins class="substitution first last" ukl:ChangeId="key-7b6a9330bcdf452dc2fe9011755e5bf1-1679502311738" ukl:CommentaryRef="key-7b6a9330bcdf452dc2fe9011755e5bf1"><noteRef uk:name="commentary" href="#key-7b6a9330bcdf452dc2fe9011755e5bf1" class="commentary"/>Welsh Ministers</ins>  pursuant to regulation 4.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Excluded establishments</heading><num>3.</num><intro><p>These Regulations do not apply to establishments —</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>having fewer than 350 laying hens; or</p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p>rearing breeding laying hens.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Establishment of a register and provision of a distinguishing number</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>The  <ins class="substitution first last" ukl:ChangeId="key-9eecc5704e3a1d27f956dde67c673587-1679502476690" ukl:CommentaryRef="key-9eecc5704e3a1d27f956dde67c673587"><noteRef uk:name="commentary" href="#key-9eecc5704e3a1d27f956dde67c673587" class="commentary"/>Welsh Ministers
                  </ins>  shall create and maintain a register of establishments.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>The  <ins class="substitution first last" ukl:ChangeId="key-a5019003a59abcb673ab90bb72893c8a-1679502495360" ukl:CommentaryRef="key-a5019003a59abcb673ab90bb72893c8a"><noteRef uk:name="commentary" href="#key-a5019003a59abcb673ab90bb72893c8a" class="commentary"/>Welsh Ministers</ins>  must within a reasonable time after receipt of an application to note an establishment on the register allocate a distinguishing number composed in accordance with  <ins class="substitution first last" ukl:ChangeId="key-3d0b099725349e9645d3b4bcee77e31f-1679502515817" ukl:CommentaryRef="key-3d0b099725349e9645d3b4bcee77e31f"><noteRef uk:name="commentary" href="#key-3d0b099725349e9645d3b4bcee77e31f" class="commentary"/>                        paragraph (3)</ins>  to the establishment and communicate that number to the applicant.</p></content></paragraph><paragraph eId="regulation-4-3"><num><ins class="first" ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f"><noteRef uk:name="commentary" href="#key-7175b39452cbae9b93c6efcd8cec959f" class="commentary"/>(3)</ins></num><content><p><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">The distinguishing number must be composed of the appropriate farming method code determined in accordance with paragraphs (5) to (7), followed by the letters  “UK”, followed by a unique identification number allocated to the establishment by the Welsh Ministers.</ins></p></content></paragraph><paragraph eId="regulation-4-4"><num><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">(4)</ins></num><content><p><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">Where it appears appropriate to the Welsh Ministers to do so, they may add further characters to the unique identification number required by paragraph (3) in order to identify single flocks kept in separate buildings of an establishment.</ins></p></content></paragraph><paragraph eId="regulation-4-5"><num><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">(5)</ins></num><content><p><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">Except where paragraph (6) applies, when the farming method in column A is ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">(EC) No 834/2007</ins></ref><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f"> on organic production and labelling of organic products, the appropriate farming method code is  “0”.</ins></p></content></paragraph><paragraph eId="regulation-4-7"><num><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">(7)</ins></num><content><p><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">For the purposes of paragraph (5), the farming method used in an establishment is to be determined in accordance with Commission Regulation </ins><ref eId="c00002" href="http://www.legislation.gov.uk/id/eur/2008/589"><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f">(EC) No 589/2008</ins></ref><ins ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:ChangeId="key-7175b39452cbae9b93c6efcd8cec959f-1679502455642" ukl:CommentaryRef="key-7175b39452cbae9b93c6efcd8cec959f"> as regards marketing standards for eggs.</ins></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Exchange of information</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>The Food Standards Agency  <ins class="substitution first last" ukl:ChangeId="key-d696e288d284b28e490511ff2e90d078-1583319973390" ukl:CommentaryRef="key-d696e288d284b28e490511ff2e90d078"><noteRef uk:name="commentary" href="#key-d696e288d284b28e490511ff2e90d078" class="commentary"/>is</ins>  permitted to have access to the register for the purpose of tracing eggs put on the market for human consumption.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The local authority is permitted to have access to the register for the purpose of enforcement of these Regulations.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Prohibition on operation or bringing into service of establishments</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>After 30th June 2004 no person may continue to operate an establishment in operation on that date unless an application has been made to note that establishment on the register.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>No person may bring an establishment into operation after 30th June 2004 unless an application has been made to note that establishment on the register and a distinguishing number communicated to the applicant by the  <ins class="substitution first last" ukl:ChangeId="key-0a7d3be70de65393277414f47d831ca3-1679502693177" ukl:CommentaryRef="key-0a7d3be70de65393277414f47d831ca3"><noteRef uk:name="commentary" href="#key-0a7d3be70de65393277414f47d831ca3" class="commentary"/>Welsh Ministers</ins>.</p></content></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><content><p>Applications must contain the information set out in the Schedule and be in the form that the  <ins class="substitution first last" ukl:ChangeId="key-5765bf575a9485015750c37322b7ff01-1679502727367" ukl:CommentaryRef="key-5765bf575a9485015750c37322b7ff01"><noteRef uk:name="commentary" href="#key-5765bf575a9485015750c37322b7ff01" class="commentary"/>Welsh Ministers require</ins>.</p></content></paragraph><paragraph eId="regulation-6-4"><num>(4)</num><content><p>Any change to the information supplied to the <ins class="substitution first last" ukl:ChangeId="key-e692978922bf8dfce9ae8d1a83356c69-1679502707837" ukl:CommentaryRef="key-e692978922bf8dfce9ae8d1a83356c69"><noteRef uk:name="commentary" href="#key-e692978922bf8dfce9ae8d1a83356c69" class="commentary"/>Welsh Ministers</ins>  must be notified within 28 days.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Powers of authorised officers</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>An officer authorised by the  <ins class="substitution first last" ukl:ChangeId="key-a8e77980b8d5d07ede9b3ddfb90776e9-1679502833241" ukl:CommentaryRef="key-a8e77980b8d5d07ede9b3ddfb90776e9"><noteRef uk:name="commentary" href="#key-a8e77980b8d5d07ede9b3ddfb90776e9" class="commentary"/>Welsh Ministers</ins>  or the local authority will, on producing if required to do so some duly authenticated document showing his or her authority, have the right at all reasonable hours to enter any land or premises for the purposes of ascertaining whether there is or has been on or in respect of the premises any contravention of these Regulations.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>Such an officer will have powers to carry out all checks and examinations necessary for the enforcement of these Regulations, and in particular may examine documentary or data processing material.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Obstruction</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><intro><p>No person may —</p></intro><level class="para1" eId="regulation-8-1-a"><num>(a)</num><content><p>obstruct any person acting in the execution of these Regulations;</p></content></level><level class="para1" eId="regulation-8-1-b"><num>(b)</num><content><p>without reasonable cause, fail to give any person acting in the execution of these Regulations any assistance or information which that person may reasonably require for the purposes of his or her functions under these Regulations; or</p></content></level><level class="para1" eId="regulation-8-1-c"><num>(c)</num><content><p>furnish to any person acting in the execution of these Regulations any information which he or she knows to be false.</p></content></level></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><content><p>Nothing in paragraph (1)(b) above is to be construed as requiring any person to answer any question or give any information if to do so might incriminate that person.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Offences by body corporate</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><intro><p>When a body corporate is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or connivance of, or to have been attributable to any neglect on the part of —</p></intro><level class="para1" eId="regulation-9-1-a"><num>(a)</num><content><p>any director, manager, secretary or other similar officer of the body corporate, or</p></content></level><level class="para1" eId="regulation-9-1-b"><num>(b)</num><content><p>any person who was purporting to act in any such capacity,</p></content></level><wrapUp><p>that person as well as the body corporate will be guilty of an offence and be liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><content><p>For the purposes of paragraph (1) above,  “<term refersTo="#term-director" eId="term-director">director</term>” in relation to a body corporate whose affairs are managed by its members, means a member of the body corporate.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Penalties</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>A person contravening any provision of these Regulations is guilty of an offence.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>A person guilty of an offence under these Regulations is liable on summary conviction to The National Assembly for Wales is required to create and maintain a register of such establishments recording the details listed in the Schedule and to allocate a distinguishing number to each establishment (regulation 4).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>The information in the register will be made available to the Food Standards Agency and the Health Protection Agency where this is necessary to trace eggs put on the market for human consumption (regulation 5).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Establishments may not continue in operation after 30th June 2004 if the information in the Schedule has not been supplied and new establishments may not be brought into operation after that date until a distinguishing number has been communicated (regulation 6).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Regulations 7—11 create offences and provide for enforcement.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>A Regulatory Appraisal has been prepared.
