Mae adran 101(1) o Ddeddf Addysg 2002 (y Ddeddf) yn ei gwneud yn ofynnol i'r cwricwlwm ar gyfer pob ysgol a gynhelir yng Nghymru gynnwys cwricwlwm sylfaenol sy'n cwmpasu addysg grefyddol, y Cwricwlwm Cenedlaethol ar gyfer Cymru ac addysg rhyw. Mae is-adran (3) yn galluogi i Gynulliad Cenedlaethol Cymru wneud Gorchymyn sy'n diwygio is-adran (1) drwy ychwanegu gofynion pellach.

Mae'r Gorchymyn hwn, sydd wedi'i wneud o dan is-adran (3), yn ychwanegu dau ofyniad newydd at y cwricwlwm sylfaenol. Mae'r cyntaf, sydd i fod yn gymwys o 1 Medi 2003, yn ei gwneud yn ofynnol i'r cwricwlwm sylfaenol gynnwys darpariaeth ar gyfer addysg bersonol a chymdeithasol i ddisgyblion cofrestredig o oedran ysgol gorfodol. Mae'r ail, sydd i fod yn gymwys o 1 Medi 2004, yn ei gwneud yn ofynnol i'r cwricwlwm gynnwys darpariaeth ar gyfer addysg gysylltiedig â gwaith i ddisgyblion sydd yng nghyfnod allweddol pedwar (disgyblion 14—16 oed yn fras).

Wrth addysgu plant mewn addysg bersonol a chymdeithasol ac addysg gysylltiedig â gwaith mae'n rhaid rhoi sylw i unrhyw ganllawiau a gyhoeddwyd gan y Cynulliad Cenedlaethol — gweler adran 100(8) o'r Ddeddf. Bydd y Cynulliad yn cyhoeddi canllawiau yng Nghylchlythyr cccc 13/2003, Cynulliad Cenedlaethol Cymru “Addysg Bersonal a Chymdeithasol ac Addysg Gysylltiedig â Gwaith yn y Cyricwlwm Sylfaenol”. Gellir cael copïau o Is-adran Safonau a Pherfformiad y Cynulliad a gellir eu gweld ar dysgu.cymru.gov.uk.
