Mae'r Gorchymyn hwn yn diddymu ac yn ailddeddfu gyda diwygiadau Orchymyn Cimychiaid Norwy (Gwahardd Dull Pysgota) 1993 (O.S. 1993/1887) mewn perthynas â Chymru.

Mae'r Gorchymyn yn gwahardd pysgota ag unrhyw dreillrwyd heblaw treillrwyd unigol, ac eithrio o dan amgylchiadau penodedig. Yr oedd y gwaharddiad yng Ngorchymyn 1993 yn ymwneud â physgota am gimychiaid Norwy yn unig. Nid yw'r gwaharddiad yn y Gorchymyn hwn wedi'i gyfyngu felly. Mae'r gwaharddiad yn gymwys i gwch pysgota Prydeinig yn nyfroedd Cymru (erthygl 3(1)). Mae'r Gorchymyn yn cyflwyno diffiniad o “dreillrwyd unigol” (erthygl 2(1)). Nid yw'r gwaharddiad yn gymwys i dreill-longau trawst nac i bysgota â threillrwyd nad yw maint penodedig eu masgl yn llai nag 80 milimetr (erthygl 3(2)).

Rhoddir pwerau penodol i swyddogion pysgodfeydd môr Prydain er mwyn gorfodi'r Gorchymyn (erthygl 4).

Rhagnodir tramgwyddau gan adrannau 5(1) a (6) o Ddeddf Pysgod Môr (Cadwraeth) 1967 (p.84) a chosbau gan adran 11 o'r Ddeddf honno, fel y'i diwygiwyd gan adran 24(1) o Ddeddf Pysgodfeydd 1981 (p.29).

Mae'r Gorchymyn hwn yn cael ei wneud drwy ddibynnu ar Erthygl 46 o Reoliad y Cyngor (EC) 850/98 ar gyfer cadw adnoddau pysgodfeydd drwy gyfrwng mesurau technegol i amddiffyn organeddau morol ifanc (OJ Rhif L125, 27.4.98, t.1), sy'n awdurdodi Aelod-wladwriaeth i gymryd mesurau cenedlaethol penodol i gadw a rheoli stociau, ar yr amod bod mesurau o'r fath yn gymwys i bysgotwyr o'r Aelod-wladwriaeth honno yn unig.

Mae Arfarniad Rheoliadol wedi'i baratoi ac wedi'i adneuo yn llyfrgell y Cynulliad Cenedlaethol. Gellir cael copïau oddi wrth y Gangen Bysgodfeydd, Cynulliad Cenedlaethol Cymru, Parc Cathays, Caerdydd CF10 3NQ.
