<Text>In this Order “Wales” has the same meaning as in section 155(1) of the Government of Wales Act 1998<FootnoteRef Ref="f00003"/> and “Welsh waters” is to be construed accordingly.</Text>

<P1group RestrictExtent="E+W" RestrictStartDate="2019-11-01"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/2" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/2" id="article-2"><Pnumber><CommentaryRef Ref="key-eef70d36d5f1422f9e6c5b1b3dd1b502"/>2</Pnumber><P1para><Text>In this Order —</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“the Act” (“<Emphasis>y Ddeddf</Emphasis>”) means the Sea Fish (Conservation) Act 1967;</Text></Para></ListItem><ListItem><Para><Text> <Substitution ChangeId="key-deeb9750b4c585667f3f31afaa634aa2-1679398858453" CommentaryRef="key-deeb9750b4c585667f3f31afaa634aa2">“the Council Regulation (“</Substitution><Emphasis><Substitution ChangeId="key-deeb9750b4c585667f3f31afaa634aa2-1679398858453" CommentaryRef="key-deeb9750b4c585667f3f31afaa634aa2">Rheoliad y Cyngor</Substitution></Emphasis><Substitution ChangeId="key-deeb9750b4c585667f3f31afaa634aa2-1679398858453" CommentaryRef="key-deeb9750b4c585667f3f31afaa634aa2">”) means Regulation (EU) 2019/1241 of the European Parliament and of the Council of 20 June 2019 on the conservation of fisheries resources and the protection of marine ecosystems through technical measures;</Substitution> </Text></Para></ListItem><ListItem><Para><Text>“beam trawler” (“<Emphasis>treill-long drawst</Emphasis>”) means a fishing boat which, in so far as it carries or uses nets, carries or uses only nets which are designed to be towed along the sea-bed and which have their mouth extended by a beam, bar or other rigid device;</Text></Para></ListItem><ListItem><Para><Text>“equivalent Order” (“<Emphasis>Gorchymyn cyfatebol</Emphasis>”) means an Order applying to England, Northern Ireland or Scotland and made under section 5 of the Act, pursuant to Article 46 of the Council Regulation, which prohibits fishing by any trawl other than a single trawl;</Text></Para></ListItem><ListItem><Para><Text>“net” (“<Emphasis>rhwyd</Emphasis>”) means a trawl, Danish Seine or similar towed net; and</Text></Para></ListItem><ListItem><Para><Text>“single trawl” (“<Emphasis>treillrwyd unigol</Emphasis>”) means a single net towed by a two warp rig in which the net has a single bosom groundrope (the bosom being the central portion of the trawl between the lower wings), where the groundrope is attached to the towing rig at each wing-end only and does not have any further attachment, including bridles, wires or ropes, connecting it to the said towing rig;</Text></Para></ListItem></UnorderedList><Text>and any other corresponding expression used in the Council Regulation has the same meaning in this Order as in that Regulation.</Text></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2020-12-31"><Title>Prohibition of method of fishing</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/3" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/3" id="article-3"><Pnumber><CommentaryRef Ref="key-8511dc1ebd023ffeb8e088f10b41d2c6"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/3/1" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/3/1" id="article-3-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraph (2) below, fishing by any  <Substitution ChangeId="key-e4a29f0c83c11838675b28131cdaabcd-1679483728601" CommentaryRef="key-e4a29f0c83c11838675b28131cdaabcd">fishing boat</Substitution>  in Welsh waters with any trawl other than a single trawl is prohibited.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/3/2" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/3/2" id="article-3-2"><Pnumber>2</Pnumber><P2para><Text>Paragraph (1) above does not apply —</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/3/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/3/2/a" id="article-3-2-a"><Pnumber>a</Pnumber><P3para><Text>to any beam trawler;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/3/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/3/2/b" id="article-3-2-b"><Pnumber>b</Pnumber><P3para><Text>to fishing with a trawl having a mesh size of not less than 80 millimetres.</Text></P3para></P3></P2para></P2></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2020-12-31"><Title>Powers of British sea-fishery officers in relation to fishing boats</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4" id="article-4"><Pnumber><CommentaryRef Ref="key-2ebff2ea3a8c369b7d5d326da6517173"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/1" id="article-4-1"><Pnumber>1</Pnumber><P2para><Text>For the purpose of the enforcement of this Order or any equivalent Order, a British sea-fishery officer may exercise the powers conferred by paragraphs (2) to (4) of this article in relation to any  <Substitution ChangeId="key-64d5e49c81bfb82c828985784a4102c0-1679483865234" CommentaryRef="key-64d5e49c81bfb82c828985784a4102c0">fishing boat</Substitution>  in Welsh waters.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/2" id="article-4-2"><Pnumber>2</Pnumber><P2para><Text>The officer may go on board the boat, with or without persons assigned to assist in his or her duties, and may require the boat to stop and do anything else which will facilitate either the boarding of, or the disembarkation from, the boat.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/3" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/3" id="article-4-3"><Pnumber>3</Pnumber><P2para><Text>The officer may require the attendance of the master and other persons on board the boat and may make any examination and inquiry which appears to be necessary for the purpose mentioned in paragraph (1) of this article and, in particular —</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/3/a" id="article-4-3-a"><Pnumber>a</Pnumber><P3para><Text>may examine any fish on the boat and the equipment of the boat, including the fishing gear, and require persons on board the boat to do anything which appears to be necessary for facilitating the examination;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/3/b" id="article-4-3-b"><Pnumber>b</Pnumber><P3para><Text>may require any person on board the boat to produce any document relating to the boat, to its fishing operations or other operations ancillary thereto or to the persons on board which is in his or her custody or possession;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/3/c" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/3/c" id="article-4-3-c"><Pnumber>c</Pnumber><P3para><Text>for the purpose of ascertaining whether the master, owner or charterer of the boat has committed an offence under section 5(1) or (6) of the Act<FootnoteRef Ref="f00011"/> as read with this Order or any equivalent Order, may search the boat for any such document and may require any person on board the boat to do anything which appears to be necessary for facilitating the search; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/3/d" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/3/d" id="article-4-3-d"><Pnumber>d</Pnumber><P3para><Text>where the boat is one in relation to which the officer has reason to suspect that such an offence has been committed, may take copies of and seize and detain any such document produced to the officer or found on board for the purpose of enabling the document to be used as evidence in proceedings for this offence;</Text></P3para></P3><Text>but nothing in sub-paragraph (d) shall permit any document required by law to be carried on board the boat to be seized and detained except while the boat is detained in a port.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/4" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/4" id="article-4-4"><Pnumber>4</Pnumber><P2para><Text>Where it appears to a British sea-fishery officer that a contravention of this Order has at any time taken place within British fishery limits, the officer may —</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/4/a" id="article-4-4-a"><Pnumber>a</Pnumber><P3para><Text>require the master of the boat in relation to which the contravention took place to take, or the officer may take, the boat and its crew to the port which appears to him or her to be the nearest convenient port; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1855/article/4/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1855/article/4/4/b" id="article-4-4-b"><Pnumber>b</Pnumber><P3para><Text>detain or require the master to detain the boat in the port;</Text></P3para></P3><Text>and where such an officer detains or requires the detention of a boat he or she shall serve on the master a notice in writing stating that the boat will be or is required to be detained until the notice is withdrawn by the service on the master of a further notice in writing signed by a British sea-fishery officer.</Text></P2para></P2></P1para></P1></P1group>

<Text>This Order revokes and re-enacts with amendments the Norway Lobsters (Prohibition of Method of Fishing) Order 1993 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/uksi/1993/1887" id="c00007" Class="UnitedKingdomStatutoryInstrument" Year="1993" Number="1887">1993/1887</Citation>) in relation to Wales.</Text>
</P>

<Text>The Order prohibits fishing with any trawl other than a single trawl, save in specified circumstances. The prohibition in the 1993 Order related only to fishing for Norway lobsters. The prohibition in this Order is not so confined. The prohibition applies to a British fishing boat in Welsh waters (article 3(1)). The Order introduces a definition of “single trawl” (article 2(1)). The prohibition does not apply to beam trawlers or to fishing with a trawl having a specified mesh size of not less than 80 millimetres (article 3(2)).</Text>

<Text>British Sea fishery officers are given certain powers for the purpose of the enforcement of the Order (article 4).</Text>

<Text>Offences are prescribed by sections 5(1) and (6) of the Sea Fish (Conservation) Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1967/84" id="c00008" Class="UnitedKingdomPublicGeneralAct" Year="1967" Number="0084">1967 (c. 84)</Citation> and penalties by section 11 of that Act, as amended by section 24(1) of the Fisheries Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1981/29" id="c00009" Class="UnitedKingdomPublicGeneralAct" Year="1981" Number="0029">1981 (c. 29)</Citation>.</Text>

<Text>This Order is made in reliance on Article 46 of the Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/1998/0850" id="c00010" Class="EuropeanUnionRegulation" Year="1998" Number="850">(<Acronym Expansion="European Community">EC</Acronym>) 850/98</Citation> for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms (O.J. <Abbreviation Expansion="Number">No.</Abbreviation> L125, 27.4.98, p.1.), which authorises a Member State to take certain national measures for the conservation and management of stocks, provided such measures apply solely to the fishermen of that Member State.</Text>
