Act 1990 <CommentaryRef Ref="c5185391"/> having had regard in accordance with section 48(4A) of that Act to relevant advice given by the Food Standards Agency and after consultation in accordance with application</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/article/1" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/article/1" id="article-1"><Pnumber>1</Pnumber><P1para><Text>This Order which may be cited as the Food Safety (Ships and Aircraft) (Wales) Order 2003; shall come into force on 31st July 2003 and applies to Wales only.</Text></P1para></P1></P1group><P1group RestrictExtent="E+W" RestrictStartDate="2006-01-01"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/article/2" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/article/2" id="article-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/article/2/1" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/article/2/1" id="article-2-1"><Pnumber>1</Pnumber><P2para><Text>In this Order —</Text></P2para></P2><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-act">the Act</Term>” (“<Term id="term-y-ddeddf"><Emphasis>y Ddeddf</Emphasis></Term>”) means the Food Safety Act 1990;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-exempt-ship-or-aircraft">exempt ship or aircraft</Term>” (“<Term id="term-llong-neu-awyren-esempt"><Emphasis>llong neu awyren esempt</Emphasis></Term>”) means any sovereign immune ship or aircraft or any ship of a State other than the United Kingdom which is exercising the right of innocent passage through that part of the territorial sea within to Wales;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-home-going-ship">home-going ship</Term>” (“<Term id="term-llong-syn-mynd-tuag-adref"><Emphasis>llong sy'n mynd tuag adref</Emphasis></Term>”) means a ship which is engaged exclusively in —</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>plying in internal waters, or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>excursions which last not more than one day, start and end in Great Britain and do not involve calling at any place outside Great Britain;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-innocent-passage">innocent passage</Term>” (“<Term id="term-tramwyon-ddiniwed"><Emphasis>tramwyo'n ddiniwed</Emphasis></Term>”) has the same meaning as it has for the purposes of Part II Section 3A of the United Nations Convention on the Law of the Sea;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-internal-waters">internal waters</Term>” (“<Term id="term-dyfroedd-mewnol"><Emphasis>dyfroedd mewnol</Emphasis></Term>”) has the same meaning as it has for the purposes of Article 8(1) of the United Nations Convention on the Law of the Sea;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-principal-hygiene-and-temperature-control-provisions">the principal Hygiene and Temperature Control provisions</Term>” (“<Term id="term-y-prif-ddarpariaeth-rheoli-hylendid-a-thymheredd"><Emphasis>y prif ddarpariaeth Rheoli Hylendid a Thymheredd</Emphasis></Term>”) means —</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text><CommentaryRef Ref="key-20c47e50b4f32207319ac8e6bcc26765"/>...</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>the Food Safety (Temperature Control) Regulations 1995 <CommentaryRef Ref="c5185411"/> except regulations 4 — 9 and 12 and Part III of those Regulations.</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-sovereign-immune-ship-or-aircraft">sovereign immune ship or aircraft</Term>” (“<Term id="term-llong-neu-awyren-freintrydd-sofran"><Emphasis>llong neu awyren freintrydd sofran</Emphasis></Term>”) means a ship or aircraft belonging to a State other than the United Kingdom and which is not in use for commercial purposes;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-territorial-sea">territorial sea</Term>” (“<Term id="term-môr-tiriogaethol"><Emphasis>môr tiriogaethol</Emphasis></Term>”) has the same meaning as it has for the purposes of the Territorial Sea Act 1987 <CommentaryRef Ref="c5185421"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-wales">Wales</Term>” (“<Term id="term-cymru">Cymru</Term>”) has the same meaning as provided by section 155 of the Government of Wales Act 1998 <CommentaryRef Ref="c5185431"/>.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2003-07-31"><Title>Ships and aircraft as premises for specified purposes</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/article/3" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/article/3" id="article-3"><Pnumber>3</Pnumber><P1para><Text>“Premises” shall include any ship or aircraft of a description specified in the Schedule to this Order for any purpose specified in relation to that ship or aircraft in that         </Number><TitleBlock><Title><Strong>Ships and aircraft which are premises for specified purposes</Strong></Title></TitleBlock><Reference>Article 3</Reference><ScheduleBody><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/schedule/paragraph/1" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/schedule/paragraph/1" RestrictStartDate="2003-07-31" id="schedule-paragraph-1"><Pnumber>1</Pnumber><P1para><Text>Any home-going ship for the purpose of applying the Act and any regulations made under it.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/schedule/paragraph/2" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/schedule/paragraph/2" RestrictStartDate="2006-01-01" id="schedule-paragraph-2" RestrictExtent="E+W"><Pnumber>2</Pnumber><P1para><Text>Any other ship or any aircraft, which is not an exempt ship or aircraft —</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/schedule/paragraph/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/schedule/paragraph/2/a" id="schedule-paragraph-2-a"><Pnumber>a</Pnumber><P3para><Text>for the purpose of ascertaining whether there is in the ship or aircraft any food imported as part of the cargo in contravention of the provisions of regulations made under Part II of the Act;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/schedule/paragraph/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/schedule/paragraph/2/b" id="schedule-paragraph-2-b"><Pnumber>b</Pnumber><P3para><Text><CommentaryRef Ref="key-2c1b6049438066f6dac232e1868d95b4"/>... and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/schedule/paragraph/2/c" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/schedule/paragraph/2/c" id="schedule-paragraph-2-c"><Pnumber>c</Pnumber><P3para><Text>for the purpose of applying sections 11 and 12 of the Act:</Text></P3para></P3><Text>and references to  “premises” in sections 2, 3, 29, 32 and 50 of the Act shall include any ship or aircraft of a description specified in this paragraph both in relation to any purposes specified in this paragraph and in relation to sections 8 to 10 of the Act.</Text></P1para></P1></ScheduleBody></Schedule></Schedules><ExplanatoryNotes DocumentURI="http://www.legislation.gov.uk/wsi/2003/1774/note" IdURI="http://www.legislation.gov.uk/id/wsi/2003/1774/note"><P><Text><Emphasis>(This note is not part of the Order)</Emphasis></Text></P><P><BlockText><Para><Text>This Order, which applies to Wales, specifies ships and aircraft and purposes for which they are  “premises” in and under the Food Safety Act 1990.</Text></Para></BlockText></P><P><BlockText><Para><Text>The Order —</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>replaces provisions formerly made by section 59(3) of and Schedule 4 paragraph 1 to the 1990 Act for home-going ships and for import cargo inspections of ships and aircraft (article 3 and Schedule paragraphs 1 and 2(a));</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text><CommentaryRef Ref="c5185441"/><CommentaryRef Ref="c5185451"/>in further implementation of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1993/0043" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1993" Number="43">93/43/EEC</Citation> on the hygiene of foodstuffs  and Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1989/0397" id="c00002" Class="EuropeanEconomicCommunityDirective" Year="1989" Number="397">89/397/EEC</Citation> on the official control of foodstuffs , specifies certain other ships and aircraft for the purpose of applying provisions of the Food Safety (General Food Hygiene) Regulations 1995 and the Food Safety (Temperature Control) Regulations 1995 and for certain related sections of the Act (article 3 and Schedule paragraph 2(b) and (c)).</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>provides that references to  “premises” in sections 2, 3, 29, 32 and 50 of the Food Safety Act 1990 shall include those other ships and aircraft for the purposes specified in paragraph 2(a), (b) and (c) of the Schedule and of sections 8 to 10 of the 1990 Act (Schedule paragraph 2).</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>A Regulatory Appraisal for these Regulations has been prepared pursuant to section 65 of the Government of Wales Act 1998 and placed in the Library of the National Assembly for Wales together with a Transposition Note setting out how the main elements of the European Community legislation referred to above are transposed in this Order.
