Safety Act 1990 <noteRef href="#c5185391" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> having had regard in accordance with section 48(4A) of that Act to relevant advice given by the Food Standards Agency and after consultation in accordance with section 48(4) and (4B) of that Act, makes the following Order:</p></formula></preamble><body eId="body"><article eId="article-1"><heading>Title, commencement and application</heading><num>1.</num><content><p>This Order which may be cited as the Food Safety (Ships and Aircraft) (Wales) Order 2003; shall come into force on 31st July 2003 and applies to Wales only.</p></content></article><article eId="article-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>In this Order —</p></content></paragraph><hcontainer name="definition"><content><p>“<term refersTo="#term-the-act" eId="term-the-act">the Act</term>” (“<term refersTo="#term-y-ddeddf" eId="term-y-ddeddf"><i>y Ddeddf</i></term>”) means the Food Safety Act 1990;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-exempt-ship-or-aircraft" eId="term-exempt-ship-or-aircraft">exempt ship or aircraft</term>” (“<term refersTo="#term-llong-neu-awyren-esempt" eId="term-llong-neu-awyren-esempt"><i>llong neu awyren esempt</i></term>”) means any sovereign immune ship or aircraft or any ship of a State other than the United Kingdom which is exercising the right of innocent passage through that part of the territorial sea within to Wales;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-home-going-ship" eId="term-home-going-ship">home-going ship</term>” (“<term refersTo="#term-llong-syn-mynd-tuag-adref" eId="term-llong-syn-mynd-tuag-adref"><i>llong sy'n mynd tuag adref</i></term>”) means a ship which is engaged exclusively in —</p></intro><level class="para1"><num>(a)</num><content><p>plying in internal waters, or</p></content></level><level class="para1"><num>(b)</num><content><p>excursions which last not more than one day, start and end in Great Britain and do not involve calling at any place outside Great Britain;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-innocent-passage" eId="term-innocent-passage">innocent passage</term>” (“<term refersTo="#term-tramwyon-ddiniwed" eId="term-tramwyon-ddiniwed"><i>tramwyo'n ddiniwed</i></term>”) has the same meaning as it has for the purposes of Part II Section 3A of the United Nations Convention on the Law of the Sea;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-internal-waters" eId="term-internal-waters">internal waters</term>” (“<term refersTo="#term-dyfroedd-mewnol" eId="term-dyfroedd-mewnol"><i>dyfroedd mewnol</i></term>”) has the same meaning as it has for the purposes of Article 8(1) of the United Nations Convention on the Law of the Sea;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-the-principal-hygiene-and-temperature-control-provisions" eId="term-the-principal-hygiene-and-temperature-control-provisions">the principal Hygiene and Temperature Control provisions</term>” (“<term refersTo="#term-y-prif-ddarpariaeth-rheoli-hylendid-a-thymheredd" eId="term-y-prif-ddarpariaeth-rheoli-hylendid-a-thymheredd"><i>y prif ddarpariaeth Rheoli Hylendid a Thymheredd</i></term>”) means —</p></intro><level class="para1"><num>(a)</num><content><p><noteRef href="#key-20c47e50b4f32207319ac8e6bcc26765" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></level><level class="para1"><num>(b)</num><content><p>the Food Safety (Temperature Control) Regulations 1995 <noteRef href="#c5185411" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> except regulations 4 — 9 and 12 and Part III of those Regulations.</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-sovereign-immune-ship-or-aircraft" eId="term-sovereign-immune-ship-or-aircraft">sovereign immune ship or aircraft</term>” (“<term refersTo="#term-llong-neu-awyren-freintrydd-sofran" eId="term-llong-neu-awyren-freintrydd-sofran"><i>llong neu awyren freintrydd sofran</i></term>”) means a ship or aircraft belonging to a State other than the United Kingdom and which is not in use for commercial purposes;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-territorial-sea" eId="term-territorial-sea">territorial sea</term>” (“<term refersTo="#term-môr-tiriogaethol" eId="term-môr-tiriogaethol"><i>môr tiriogaethol</i></term>”) has the same meaning as it has for the purposes of the Territorial Sea Act 1987 <noteRef href="#c5185421" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-wales" eId="term-wales">Wales</term>” (“<term refersTo="#term-cymru" eId="term-cymru">Cymru</term>”) has the same meaning as provided by section 155 of the Government of Wales Act 1998 <noteRef href="#c5185431" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>.</p></content></hcontainer></article><article eId="article-3"><heading>Ships and aircraft as premises for specified purposes</heading><num>3.</num><content><p>“Premises” shall include any ship or aircraft of a description specified in the Schedule to this Order for any purpose specified in relation to that ship or purposes</b></heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1.</num><content><p>Any home-going ship for the purpose of applying the Act and any regulations made under it.</p></content></paragraph><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2.</num><intro><p>Any other ship or any aircraft, which is not an exempt ship or aircraft —</p></intro><level class="para1" eId="schedule-paragraph-2-a"><num>(a)</num><content><p>for the purpose of ascertaining whether there is in the ship or aircraft any food imported as part of the cargo in contravention of the provisions of regulations made under Part II of the Act;</p></content></level><level class="para1" eId="schedule-paragraph-2-b"><num>(b)</num><content><p><noteRef href="#key-2c1b6049438066f6dac232e1868d95b4" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>... and</p></content></level><level class="para1" eId="schedule-paragraph-2-c"><num>(c)</num><content><p>for the purpose of applying sections 11 and 12 of the Act:</p></content></level><wrapUp><p>and references to  “premises” in sections 2, 3, 29, 32 and 50 of the Act shall include any ship or aircraft of a description specified in this paragraph both in relation to any purposes specified in this paragraph and in relation to sections 8 to 10 of for home-going ships and for import cargo inspections of ships and aircraft (article 3 and Schedule paragraphs 1 and 2(a));</p></item><item><num>(b)</num><p><noteRef href="#c5185441" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/><noteRef href="#c5185451" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>in further implementation of Council Directive <ref eId="c00001" href="http://www.legislation.gov.uk/european/directive/1993/0043">93/43/EEC</ref> on the hygiene of foodstuffs  and Council Directive <ref eId="c00002" href="http://www.legislation.gov.uk/european/directive/1989/0397">89/397/EEC</ref> on the official control of foodstuffs , specifies certain other ships and aircraft for the purpose of applying provisions of the Food Safety (General Food Hygiene) Regulations 1995 and the Food Safety (Temperature Control) Regulations 1995 and for certain related sections of the Act (article 3 and Schedule paragraph 2(b) and (c)).</p></item><item><num>(c)</num><p>provides that references to  “premises” in sections 2, 3, 29, 32 and 50 of the Food Safety Act 1990 shall include those other ships and aircraft for the purposes specified in paragraph 2(a), (b) and (c) of the Schedule and of sections 8 to 10 of the 1990 Act (Schedule paragraph
