The powers of the Secretary of State, insofar as exercisable in relation to Wales, have been transferred to the National Assembly for Wales; see Article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).

, after consultation in accordance with section 93(2) of that Act, and having regard to the matters specified in section 93(6) of that Act as required by section 93(5) of that Act, hereby makes the following Regulations:

Citation commencement and application1.(1)

These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) (Wales) Regulations 2002 and come into force on 22nd March 2002.

These Regulations apply to Wales.

The Producer Responsibility Obligations (Packaging Waste) Regulations 1997 (“the Principal Regulations”) impose on producers obligations to recover and recycle packaging waste, and related obligations.

These Regulations amend the recovery and recycling targets in Schedule 2 to the Principal Regulations for 2002 onwards. These targets are used to calculate recovery and recycling obligations. Regulation 2(2) increases the target for recovery from 56% to 59% and regulation 2(3) increases the target for recycling from 18% to 19%.
