see article 2 of, and the entries relating to the <abbr title="Control of Pollution Act 1974 c. 40">1974 Act</abbr> and the Environmental Protection Act in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>) and section 53 of the Scotland Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and now vested in it<authorialNote class="footnote" eId="f00002" marker="2"><p>The powers of the Secretary of State in so far as exercisable in relation to Wales have been transferred to the National Assembly for Wales: see Article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>).</p></authorialNote>, hereby makes the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement, interpretation and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Special Waste (Amendment) (Wales) Regulations 2001.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><intro><p>These Regulations shall come into force—</p></intro><level class="para1" eId="regulation-1-2-a"><num>(a)</num><content><p>in the case of all provisions other than regulations 10 and 11, on 1 November 2001;</p></content></level><level class="para1" eId="regulation-1-2-b"><num>(b)</num><content><p>in the case of regulation 10, on 1 December 2001; and</p></content></level><level class="para1" eId="regulation-1-2-c"><num>(c)</num><content><p>in the case of regulation 11, on 1 May 2002.</p></content></level></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>These Regulations apply to Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Special Waste Regulations 1996</heading><num>2.</num><content><p>The Special Waste Regulations 1996<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1996/972">S.I. 1996/972</ref> as amended by <ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/1996/2019">S.I. 1996/2019</ref> and <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/1997/251">1997/251</ref>.</p></authorialNote> are amended as follows.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Updated approved classification and labelling guide and approved supply list</heading><num>3.</num><intro><p>In regulation 1(4) (interpretation)—</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>in the definition of “the approved classification and labelling guide”, for “(Second edition)” substitute “(Fourth edition)”, and for “18th October 1994” substitute “12th October 1999”; and</p></content></level><level class="para1" eId="regulation-6-b"><num>(b)</num><content><p>in paragraph (2)(a)(ii), omit “motor vehicle”.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Consignment notes: duty of consignee not accepting delivery of a consignment</heading><num>7.</num><content><p>In regulation 10 (consignment notes <abbr title="et cetera" xml:lang="la">etc.</abbr>: duty of consignee not accepting delivery of a consignment) in paragraph (3)(c), after “regulation 8,” insert “(annotated to show which consignment is not accepted)”.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Consignment notes: rejected consignments</heading><num>8.</num><content><p><mod>After Regulation 10 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><article><heading>Consignment notes: requirement for a new consignment note</heading><num>10A:</num><paragraph><num>(1)</num><content><p>This regulation applies where, in accordance with regulation 10(6)(c), a consignor proposes that a consignment be delivered to other specified premises in respect of which there is held any waste management licence necessary to authorise receipt of the waste.</p></content></paragraph><paragraph><num>(2)</num><intro><p>Before the consignment is delivered to those premises —</p></intro><level class="para1"><num>(a)</num><intro><p>four copies of a new consignment note shall be prepared and</p></intro><level class="para2"><num>(i)</num><content><p>on each copy Parts A and B shall be completed and the relevant code entered, including the previous code;</p></content></level><level class="para2"><num>(ii)</num><content><p>to each copy shall be attached a copy of any relevant previous carrier’s schedule, annotated to show which consignment was not accepted;</p></content></level></level><level class="para1"><num>(b)</num><content><p>the carrier shall complete Part C on each of those copies;</p></content></level><level class="para1"><num>(c)</num><intro><p>the consignor, subject to paragraph (3) below—</p></intro><level class="para2"><num>(i)</num><content><p>shall complete Part D on each of those copies</p></content></level><level class="para2"><num>(ii)</num><content><p>shall retain one copy (on which Parts A to D have been completed and the relevant codes entered); and</p></content></level><level class="para2"><num>(iii)</num><content><p>shall give the three remaining copies (on which Parts A to D have been completed and the relevant codes entered) to the carrier.</p></content></level></level></paragraph><paragraph><num>(3)</num><content><p>The carrier may, where he has received written instructions from the consignor to that effect, complete Part D of each of the copies of the consignment note on behalf of the consignor, and where he does so he shall send to the consignor the consignor’s copy (on which Parts A to D have been completed and the relevant codes entered).</p></content></paragraph><paragraph><num>(4)</num><intro><p>The carrier shall ensure that the three copies of the consignment note which he has received (or, if paragraph (3) applies, retained) —</p></intro><level class="para1"><num>(a)</num><content><p>travel with the consignment; and</p></content></level><level class="para1"><num>(b)</num><content><p>are given to the consignee on delivery of the consignment.</p></content></level></paragraph><paragraph><num>(5)</num><intro><p>Subject to regulation 10, on receiving the consignment the consignee shall—</p></intro><level class="para1"><num>(a)</num><content><p>complete Part E on all copies of the consignment note given to him;</p></content></level><level class="para1"><num>(b)</num><content><p>retain one copy;</p></content></level><level class="para1"><num>(c)</num><content><p>give one copy to the carrier; and</p></content></level><level class="para1"><num>(d)</num><content><p>forthwith furnish one copy to the Agency for the place to which the consignment has been transported.</p></content></level></paragraph><paragraph><num>(6)</num><content><p>The carrier shall retain the copy of the consignment note given to him by the consignee.</p></content></paragraph></article></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Fees</heading><num>9.</num><intro><p>In regulation 14 (fees)—</p></intro><level class="para1" eId="regulation-9-a"><num>(a)</num><content><p><mod>in paragraph (1), for the words after “fee”, substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>prescribed for the purposes by a charging scheme under section 41 of the Environment Act 1995<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00012" href="http://www.legislation.gov.uk/id/ukpga/1995/25">1995 c. 25</ref>.</p></authorialNote></p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-9-b"><num>(b)</num><content><p>omit paragraph (2)(a)(i); and</p></content></level><level class="para1" eId="regulation-9-c"><num>(c)</num><content><p>in paragraph (2)(a)(iii), after “each round” insert “in the succession”.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Form of consignment note</heading><num>10.</num><intro><p>In Schedule 1, Part I (form of consignment note)—</p></intro><level class="para1" eId="regulation-10-a"><num>(a)</num><content><p>in section 6 of Part B, for “that make the waste special” substitute “of the waste”;</p></content></level><level class="para1" eId="regulation-10-b"><num>(b)</num><content><p>in Part C, for “(name &amp; The 1994 Regulations have most recently been amended by the Chemicals (Hazard Information and Packaging for Supply) (Amendment) Regulations 2000 [<ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/2000/2381">S.I. 2000/2381</ref>] and copies of the new (Fourth) edition of the approved labelling guide and of the new (Sixth) edition of the approved supply list may be obtained from <abbr class="acronym" title="Health and Safety Executive">HSE</abbr> Books, <abbr class="acronym" title="Post Office">PO</abbr> Box 1999, Sudbury, Suffolk CO10 2WA.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 amends regulation 6(1) of the Principal Regulations by removing the “motor vehicle” battery limitation in respect of loads of lead acid batteries for which pre-notification is not required.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 amends regulation 7 of the Principal Regulations so that for a second and subsequent consignment in a succession of consignments of special waste the code identifying the first consignment in that succession must be entered on the consignment note in addition to the relevant code for the consignment in question.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 6(a) amends regulation 8(1)(d) of the Principal Regulations by extending from 24 hours to 72 hours the time in which a carrier’s round must be completed. Regulation 6(b) removes the “motor vehicle” battery limitation from the lead acid battery loads exception in regulation 8(2)(ii) of the Principal Regulations requiring the carrier to provide the Agency, for the place of delivery, with a copy of the consignment note before the removal of the first waste on the round.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 7 amends regulation 10(3)(c) of the Principal Regulations so as to require that, where a consignee rejecting a delivery has received a consignment note, the copy of any carrier’s schedule which he forwards to the Environment Agency (“the Agency”) for the new destination is annotated to indicate which loads were not accepted.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 8 inserts a new regulation 10A. Regulation 10A provides that a new consignment note must be prepared where a load is rejected by the consignee and is redirected to premises other than those from which it was collected or where it was produced and sets out the procedure to be followed for the new consignment note. It also allows a carrier to sign Part D of the consignment note where they have the written authority of the consignor.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 9(a) amends regulation 14(1) of the Principal Regulations so that fees are set by the Agency in a charging scheme under section 41 of the Environment Act 1995, rather than by the Secretary of State. Regulation 9(b) amends regulation 14(2)(a) by removing the first condition for a second or subsequent carrier’s round in a succession of rounds to be exempted from payment of a fee for the assignment of a code (that the carrier is also the consignee in relation to every consignment in all the rounds). Regulation 9(c) amends the conditions in regulation 14(2)(a)(iii) of the Principal Regulations by making it clear that the total weight limit of 400kg applies to each round in the succession.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 10 makes minor amendments to the prescribed form of consignment note in Schedule 1 to the Principal Regulations.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 11 substitutes a new prescribed form of carrier’s schedule in Schedule 1 to the Principal Regulations. Additional information required is the postcode of the address of origin, the time of the carrier’s signature, and a description of waste removed.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
