National Assembly for Wales, in exercise of the powers conferred on it by sections 6(1) and 20(1) of the Sea Fish (Conservation) Act 1967<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1967/84">1967 c. 84</ref>. Section 1 was substituted by the Fisheries Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1981/29">1981 (c. 29)</ref> section 19(1), and was amended by paragraph 38(a) of Schedule 13 to the Merchant Shipping Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1995/21">1995 (c. 21)</ref> and paragraph 43(2) and (3) of Schedule 2 to the Scotland Act 1998 (Consequential Modifications) (No.2) Order 1999 (<ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1999/1820">S.I. 1999/1820</ref>).</p><p>Section 6 was modified in its effect by section 33(1) of the 1981 Act and amended by <ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/1999/1820">S.I. 1999/1820</ref>, Schedule 2, paragraph 43(6).</p><p>By virtue of article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>) the functions exercisable under section 6(1) of the 1967 Act were transferred to the National Assembly in so far as exercisable in relation to Wales (defined in section 155(1) of the Government of Wales Act <ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1998/38">1998 (c. 38)</ref> as including “the sea adjacent to Wales out as far as the seaward boundary of the territorial sea”); in respect of waters beyond Wales these functions remain exercisable by the Ministers.</p><p>See section 22(2) of the 1967 Act for definitions of “the Ministers” for the purposes of sections 1 and 15(3). Section 22(2) was amended by the Fisheries Act 1981, sections 19(2)(d) and 45(b) and (c) and by <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/1999/1820">S.I. 1999/1820</ref>, paragraph 43(12) of Schedule 2</p></authorialNote>, and of all other powers enabling it in that behalf, hereby makes the following Order:</p></formula></preamble><body><article eId="article-1"><heading>Name and commencement</heading><num>1.</num><content><p>This Order is named the Crab Claws (Prohibition of Landing) (Revocation) (Wales) Order 2001 and shall come into force on 1st June 2001.</p></content></article><article eId="article-2"><heading>Revocation</heading><num>2.</num><content><p>The Crab Claws (Prohibition of Landing) Order 1986<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00011" href="http://www.legislation.gov.uk/id/uksi/1986/496">S.I. 1986/496</ref>. The Order was revoked by <ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/2000/1235">S.I. 2000/1235</ref> except in so far as it formed part of the Law of Scotland or had effect in relation to Wales. It also made related provision for enforcement.</p></blockContainer><blockContainer ukl:Name="P"><p>Provisions relating to the retention on board and the landing of edible crabs and detached claws can now be found in Article 18.4 of Council Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/1998/0850">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 850/98</ref> (<abbr class="acronym" title="Official Journal">OJ</abbr> <abbr title="Number">No.</abbr> L125, 27.04.98, p.1) for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms.</p></blockContainer><blockContainer ukl:Name="P"><p>Provisions for the enforcement of restrictions and obligations contained in that Regulation have been made in the <ref eId="c00002" href="http://www.legislation.gov.uk/id/wsi/2000/2230">Sea Fishing (Enforcement of Community Conservation Measures) (Wales) Order 2000 (2000 No.2230 (W.148)</ref>) which came into force on 11th September 2000.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
