href="http://www.legislation.gov.uk/id/uksi/1996/672">1996/672</ref>).</p></authorialNote> and all other powers enabling it in that behalf, makes the following Regulations —</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Artificial Insemination of Cattle (Emergency Licences) (Wales) Regulations 2001 and shall come into force on 25th April 2001.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations shall apply to Wales only.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations, unless the context otherwise requires —</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr>” means the Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/1985/1861">1985/1861</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“emergency licence” means an emergency licence issued under regulation 3(1);</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="the National Assembly for Wales">National Assembly</abbr>” means the National Assembly for Wales; and</p></content></hcontainer><hcontainer name="definition"><content><p>“outbreak of foot-and-mouth disease” means a period during which one or more areas within Great Britain are declared to be infected or controlled areas for the purposes of the Foot-and-Mouth Disease Order 1983<authorialNote class="footnote" eId="f00003" marker="3"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/1983/1950">1983/1950</ref>, as amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1993/3119">1993/3119</ref>, <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1995/2922">1995/2922</ref>, <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00007" href="http://www.legislation.gov.uk/id/wsi/2001/572">2001/572 (W.26)</ref>; <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/wsi/2001/658">2001/658 (W.33)</ref>, <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00009" href="http://www.legislation.gov.uk/id/wsi/2001/968">2001/968 (W.46)</ref>, <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00010" href="http://www.legislation.gov.uk/id/wsi/2001/133">2001/133 (W.47)</ref> which was itself amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00011" href="http://www.legislation.gov.uk/id/wsi/2001/1234">2001/1234 (W.67)</ref>; and <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00012" href="http://www.legislation.gov.uk/id/wsi/2001/1406">2001/1406 (W.93)</ref></p></authorialNote>.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>Any reference in these Regulations to a numbered regulation shall be construed as a reference to the regulation so numbered in these Regulations.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Power to issue emergency licences during outbreaks of foot-and-mouth disease</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>During an outbreak of foot-and-mouth disease, the <abbr title="the National Assembly for Wales">National Assembly</abbr> may issue emergency licences for the purposes of these Regulations.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>An emergency licence</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>may be general or specific; and</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p>may be made subject to such conditions and exclusions as the <abbr title="the National Assembly for Wales">National Assembly</abbr> may think fit.</p></content></level></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>The <abbr title="the National Assembly for Wales">National Assembly</abbr> may modify, suspend or revoke any emergency licence at any time either —</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><content><p>in the case of a general licence, by giving notice in such manner as it may think fit; or</p></content></level><level class="para1" eId="regulation-3-3-b"><num>(b)</num><content><p>in the case of a specific licence, by giving notice in writing to the holder of the licence.</p></content></level></paragraph><paragraph eId="regulation-3-4"><num>(4)</num><content><p>An emergency licence shall automatically expire 2 months after the end of the outbreak of foot-and-mouth disease during which it is issued.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Effect of an emergency licence</heading><num>4.</num><content><p>An emergency licence may authorise the licensee to do anything specified in the licence that would otherwise be prohibited by any provision of the <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr>, subject to any conditions and exclusions as specified in the licence.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Provision of information <abbr title="Et cetera" xml:lang="la">etc</abbr></heading><num>5.</num><content><p>No person shall make any statement or provide any information for the purpose of obtaining an emergency licence unless he reasonably believes the information or statement to be true.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Amendment to the Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>The <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr> shall be amended in so far as they apply to Wales in accordance with the following paragraph.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p><mod>In regulation 4 (application of regulations), immediately following paragraph (3), there shall be inserted the following paragraph —<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="wsi" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><paragraph><num>(3A)</num><content><p>These regulations shall not apply to anything done in accordance with an emergency licence issued under the Artificial Insemination of Cattle (Emergency Licences) (Wales) Regulations 2001<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/wsi/2001/1539">S.I. 2001/(1539(W.107)</ref>.</p></authorialNote>.</p></content></paragraph></quotedStructure><inline Regulations)</subheading><blockContainer ukl:Name="P"><p>Regulation 3 of these Regulations empowers the National Assembly for Wales to issue emergency licences during outbreaks of foot-and-mouth disease (as defined in regulation 2).</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 of these Regulations provides that an emergency licence may authorise the licensee to do things that would normally be prohibited by the Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (“the <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr>”), which controls a range of activities related to the artificial insemination of cattle.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 provides that anyone making a statement or providing information for the purpose of obtaining an emergency licence must reasonably believe that the statement or the information is true.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 6 of these Regulations amends regulation 4 of the <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr> to provide that the <abbr title="Artificial Insemination of Cattle (Animal Health) (England and Wales) Regulations 1985 (S.I. 1985/1861)">1985 Regulations</abbr> shall not apply in relation to anything done in accordance with an emergency licence issued under regulation 3 of these Regulations.</p></blockContainer><blockContainer ukl:Name="P"><p>Failure to comply with the conditions of an emergency licence or with regulation 5 of these Regulations is an offence against section 10(6) of the Animal Health and Welfare Act 1984, for which the maximum penalty is three months imprisonment and/or a fine at level 3 on the standard scale (currently, £1,000).</p></blockContainer><blockContainer ukl:Name="P"><p>A Regulatory Appraisal has not been prepared in respect of these
