The Education (Assisted Places) (Incidental Expenses) (Amendment) (Wales) Regulations 2000

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by section 3(3), (4), (5) and (9) of the Education (Schools) Act 1997(1) and now vested in the National Assembly for Wales(2).

Citation, commencement and application

1.—(1) These Regulations may be cited as the Education (Assisted Places) (Incidental Expenses) (Amendment) (Wales) Regulations 2000 and shall come into force on 1st September 2000.

(2) These Regulations apply to Wales only.

(3) These Regulations apply in relation to any school year beginning on or after 1st September 2000.

Amendment of the Education (Assisted Places) (Incidental Expenses) Regulations 1997

2.—(1) The Education (Assisted Places) (Incidental Expenses) Regulations 1997(3) shall be amended as follows.

(2) In regulation 2(2), for “£11,466” there shall be substituted “£11,718”.

(3) For regulation 2(3)(a) and (b) there shall be substituted —

(a)£71 where the relevant income does not exceed £10,901; and

(b)£37 where that income exceeds £10,901 but does not exceed £11,718..

(4) In regulation 4 —

(a)in paragraph (3), for “£10,683” there shall be substituted “£10,914”; and

(b)in paragraph (4) –

(i)for “£10,683” there shall be substituted “£10,914”, and

(ii)for “£10,504” there shall be substituted “£10,735”.

Explanatory Note

(This note does not form part of the Regulations)

These Regulations amend the Education (Assisted Places) (Incidental Expenses) Regulations 1997 (“the 1997 Regulations”) in respect of a school year beginning on or after 1st September 2000. The 1997 Regulations provide for the payment of grants as regards incidental expenses, and for the remission of incidental expenses, in respect of pupils eligible to continue to hold assisted places at independent schools by virtue of section 2 of the Education (Schools) Act 1997, notwithstanding the abolition of the assisted places scheme by section 1 of that Act.

These Regulations relax the means test (set out in regulation 2 of the 1997 Regulations) and increase the amount of grant payable for uniform grant in respect of clothing expenditure incurred in relation to the 2000/2001 and subsequent school years.

These Regulations also relax the means test (set out in regulation 4 of the 1997 Regulations) for travel grant and increase the amount of grant payable.
