Mae'r Gorchymyn hwn yn gwneud darpariaeth ar gyfer gorfodi yng Nghymru a'r môr tiriogaethol cyfagos at Gymru gyfyngiadau Cymunedol gorfodadwy penodol a rhwymedigaethau eraill sy'n berthnasol i bysgota môr gan gychod Cymunedol a chychod trydydd gwledydd a nodir yn Rheoliad y Cyngor (CE) Rhif 2742/1999 (OJ Rhif L341, 31.12.99, t.1) (“Rheoliad y Cyngor”).
Mae Rheoliad y Cyngor yn sefydlu cyfanswm yr haldiadau a ganiateir a chwotâu yr Aelod-wladwriaethau ar gyfer 2000 ac yn pennu amodau penodol ynglŷn â sut y gellir eu dal.
Mae hefyd yn awdurdodi pysgota gan gychod Norwy ac Ynysoedd Ffaröe am ddisgrifiadau penodedig o bysgod o fewn ardaloedd penodedig y tu mewn i derfynau pysgodfeydd yr Aelod-wladwriaethau yn 2000 ac yn gosod gofynion ynghylch cwotâu pysgota a pharthau a awdurdodwyd, dulliau pysgota, dal trwyddedau a chadw at amodau trwyddedau, cadw coflyfrau, gwneud adroddiadau a materion cyffelyb.
Mae erthygl 3 o'r Gorchymyn yn creu tramgwyddau mewn perthynas â thorri darpariaethau Rheoliad y Cyngor y cyfeirir atynt yng ngholofn 1 (ac a ddisgrifir yn gryno yng ngholofn 2) o Atodlenni 1 (ar gyfer cychod y Gymuned) a 2 (ar gyfer cychod trydydd gwledydd) i'r Gorchymyn. Pennir cosbau ar gyfer tramgwyddau o'r fath (erthygl 4). Ar hyn o bryd £5,000 yw'r uchafswm statudol y cyfeirir ato yn yr Atodlenni. Gwneir darpariaeth ar gyfer casglu dirwyon (erthygl 5).
Mae'r Gorchymyn yn rhoi pwerau gorfodi i swyddogion pysgodfeydd môr Prydeinig mewn perthynas â chychod pysgota penodol o fewn y môr tiriogaethol cyfagos at Gymru ac ar dir yng Nghymru mewn perthynas â chipio pysgod ac offer pysgota (erthyglau 6, 7 ac 8). Gwneir darpariaeth ar gyfer cosbi unrhyw un a geir yn euog o ymosod ar swyddog, neu ei rwystro (erthygl 10).
Mae'r Gorchymyn yn diddymu Gorchymyn Pysgodfeydd Môr (Gorfodi Mesurau Cwota'r Gymuned) 1999 (O.S. 1999/424) a Gorchymyn Pysgota Trydydd Gwledydd (Gorfodi) 1999 (O.S. 1999/425) i'r graddau y maent yn gymwys i Gymru.
