The Local Government (Best Value) (Exemption) (Wales) Order 2000

The National Assembly for Wales makes the following Order in exercise of the powers given to it by sections 2(5) and 29(1) of the Local Government Act 19991:

Citation, commencement and application1.

(1)

This Order may be cited as the Local Government (Best Value) (Exemption) (Wales) Order 2000 and shall come into force on 1st April 2000.

(2)

This Order applies to Wales only.

Exemption from the duties in Part I of the Local Government Act 19992.

Community councils whose budgeted gross revenue expenditure for either of the financial years commencing on 1st April 1998 or 1st April 1999 did not exceed £1,000,000 shall not be subject, in relation to any of their functions, to the duties imposed by sections 3 to 6 of the Local Government Act 1999.

Part I of the Local Government Act 1999 imposes duties on local and other authorities to make arrangements to secure continuous improvements in the way in which their functions are exercised (best value), to conduct best value reviews of their functions and to prepare a best value performance plan for each financial year.

Sections 2(5) and 29(1) of the Act enable the National Assembly for Wales, in relation to Wales, to exempt specified authorities, or specified descriptions of authority, from those duties in relation to specified functions.

This Order exempts community councils whose budgeted gross revenue expenditure for either of the financial years commencing on 1st April 1998 or 1st April 1999 did not exceed £1,000,000.
