The National Assembly for Wales makes this Order in exercise of powers conferred by sections 10, 12, 41 and 106 of the Highways Act 1980(1), and of all other enabling powers:

1.  The new highways which the National Assembly proposes to construct —E+W

(a)along the routes described in Schedule 1 to this Order (the highways along the routes being in this Order referred to as “the main new trunk road”); and

(b)along the routes described in Schedule 2 to this Order which connect the main new trunk road with other highways at the places stated in that Schedule (the highways along these routes being in the Order referred to as “the slip roads”); and

(c)along the routes described in Schedule 3 to this Order which connect the main new highway and the slip roads with other trunk roads stated in that Schedule (the highways along these routes being in the Order referred to as “the new connecting trunk roads”)

shall become trunk roads as from the date when this Order comes into force.

3.  The National Assembly directs as respects any part of a highway which crosses the route of any of the new trunk roads that —E+W

(a)where the highway is maintainable at public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the National Assembly shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the National Assembly to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

4.  The lengths of trunk road described in Schedule 4 to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk roads and shall be classified as shown in that Schedule as from the date on which the National Assembly notifies the County Councils of Rhondda Cynon Taff and Blaenau Gwent that the new trunk roads are open for through traffic.E+W

5.  The National Assembly is authorised to construct the bridge specified in Schedule 5 to this Order as part of the main new trunk road over the navigable watercourse specified in that Schedule.E+W

(ii)“the main new trunk road” and “the slip roads” have the meanings given in article 1 of this Order all forming part of the Neath to Abergavenny Trunk Road (A465);

(iii)“the new connecting trunk roads” means the connecting trunk roads mentioned in article 1 of this Order and “a new connecting trunk road” means one of those highways: The East of Abercynon to East of Dowlais Trunk Road (A4060); The Neath to Abergavenny Trunk Road (A465); and The Cardiff to Glan Conwy Trunk Road (A470);

(iv)“the trunk roads” means the new highways mentioned in article 1 of this Order;

(v)“classified road” as a classification for a highway, means that the highway is not a principal road for the purpose of enactments and instruments which refer to highway classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the National Assembly and which does not specifically refer to their classification as principal roads;

(vi)“the trunk road” means the Neath to Abergavenny Trunk Road (A465).

7.  This Order shall come into force on the 8th of October 1999 and may be cited as the Neath to Abergavenny Trunk Road (A465) (Abergavenny to Hirwaun Dualling and Slip Roads) and East of Abercynon to East of Dowlais Trunk Road (A4060), Cardiff to Glan Conwy Trunk Road (A470) (Connecting Roads) Order 1999.E+W

SCHEDULE 1E+WROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road is a route situated between Abergavenny and Hirwaun in the County and County Boroughs of Monmouthshire, Blaenau Gwent, Caerphilly, Merthyr Tydfil, and Rhondda Cynon Taff and is a route about 40.6 kilometres in length starting at a point on the Trunk Road (marked “A” on the deposited plan at key plan No. 1), some 40 metres west of the centrepoint of the Hardwick Roundabout at Abergavenny and going in a general south westerly direction to a point on the Trunk Road (marked “B” on the deposited plan at key plan No. 2), some 800 metres north west of the centrepoint of the Rhigos Roundabout at Hirwaun Ponds.

SCHEDULE 2E+WROUTES OF THE SLIP ROADS

The routes of the slip roads are the following:

1.  Grade separated junction with the realigned Merthyr Road (B4246). (Site Plan No.1).U.K.

Two routes to connect the westbound carriageway of the main new trunk road with a roundabout to be constructed as part of the highway east of the Council Depot at Llanfoist (the new trunk roads along these routes being respectively given the reference numbers 1 and 2 on the deposited plan at site plan No. 1).

2.  Two routes to connect the eastbound carriageway of the main new trunk road with the A4143 south east of the cemetery at Llanfoist (the new trunk roads along this route being given the numbers 3 and 4 on the deposited plan at site plan No. 1).U.K.

3.  Grade separated junction with the realigned B4246 and Abergavenny Road (A4077). (Site Plan No. 2).U.K.

Four routes to connect the eastbound and the westbound carriageways of the main new trunk road with two roundabouts to be constructed as part of the highway to be provided for in associated side roads Orders, west of Glanbaiden Farm north west of King George’s Field, Govilon and southeast of Cross Roads, Gilwern (the new trunk roads along these routes being respectively given the reference numbers 5, 6, 7 and 8 on the deposited plan at site plan No. 2).

[F24.   tA route some 60 metres in length to connect the westbound carriageway of the main new trunk road (A465) with Station Road (to be realigned as provided for in the associated Side Roads Order), commencing at a point 120 metres south west of the junction between the existing trunk road (A465) and Station Road west of Saleyard in a south easterly direction to a point 145 metres north west of the junction between the National Cycle Route 46 and Brunant Road (the new trunk road along this route being given the reference number 9 on the deposited plan at Site Plan number 2A (as amended)). 2).U.K.

5.  The route of the new trunk road along this route being given the reference number 10 on the deposited plan at Site Plan number 2 of the Principal Order is omitted. U.K.

6.  Grade separated junction to include four routes to connect the eastbound and westbound carriageways of the main new trunk road (A465) with the existing roundabout at Brynmawr, and new connecting roads to include a new roundabout at Old Abergavenny Road described in Schedule 3, south east of the Brynmawr Foundation School (the new trunk roads along these routes being respectively given the reference numbers 11, 12, 13 and 14 on the deposited plan at Site Plan number 3A (as amended) and 4B (as amended) and described individually as follows:- U.K.

A route some 0.30 kilometres in length to connect the westbound carriageway of the main new trunk road (A465) with Brynmawr Roundabout, commencing at a point 210 metres south of the south eastern corner of the Brynmawr Foundation School Sports pitch where it connects with the existing trunk road (A465), in a generally westerly direction, to its junction with the north east quadrant of Brynmawr Roundabout (the new trunk road along this route being given the reference number 11 on the deposited plan at Site Plan number 3A (as amended) and 4B (as amended)). A route some 0.26 kilometres in length to connect the westbound carriageway of the main new trunk road (A465) with Brynmawr Roundabout, commencing at a point 40 metres north west of the bridge of Intermediate Road over the existing trunk road (A465), in a south easterly direction, to its junction with the north west quadrant of Brynmawr Roundabout (the new trunk road along this route being given the reference number 12 on the deposited plan at Site Plan number 3A (as amended) and 4B (as amended)). A route some 0.31 kilometres in length to connect the eastbound carriageway of the main new trunk road (A465) with a new connecting road (described in Schedule 3 and given the reference G to H), commencing at a point 190 metres south of the south eastern corner of the Brynmawr Foundation School Sports pitch and 10 metres south of Old Abergavenny Road in a westerly, then northerly, then easterly direction, to a point 60 metres south east of the south eastern corner of the Brynmawr Foundation School Sports pitch and 10 metres south of the road leading to Hafod (the new trunk road along this route being given the reference number 13 on the deposited plan at Site Plan number 3A (as amended) and 4B (as amended)). A route some 0.44 kilometres in length to connect the eastbound carriageway of the main new trunk road (A465) with a new roundabout (being part of the new connecting road described in Schedule 3 and given the reference G to H), commencing at a point 30 metres east of the bridge of Intermediate Road over the existing trunk road (A465), in a south easterly direction, to a point 180 metres south east of the south eastern corner of the Brynmawr Foundation School Sports pitch and 10 metres north of Old Abergavenny Road (the new trunk road along this route being given the reference number 14 on the deposited plan at Site Plan number 3A (as amended) and 4B (as amended)).]

[F37.  A route some 0.89 kilometres in length, starting at a point on the northern side of the existing trunk road (A465) about 570 metres west of the agricultural underpass at Waun Rhydd, Garn Lydan and running in a generally north easterly then easterly direction to meet the eastbound carriageway of the main new trunk road 290 metres east of the agricultural underpass at Waun Rydd, Garn Lydan (the new trunk road along this route being given the reference number 15 on the deposited plan at Site Plan number 4A (as amended)). U.K.

8.  A route some 0.6 kilometres in length, starting at a point on the southern side of the existing trunk road (A465) about 570 metres west of the agricultural underpass at Waun Rhydd, Garn Lydan and running in a generally north easterly direction to meet the westbound carriageway of the main new trunk road 50 metres east of the agricultural underpass at Waun Rydd, Garn Lydan (the new trunk road along this route being given the reference number 16 on the deposited plan at Site Plan number 4A (as amended)). U.K.

9.  An at-grade junction with the Rassau Industrial Estate internal road at about the mid- point of Rassau Industrial Estate. (Site Plan number 5A (as amended)). Two east facing routes some 0.27 kilometres and 0.12 kilometres in length to connect the westbound and eastbound carriageways respectively of the main new trunk road, the first with a roundabout to be constructed as part of the highway to be provided for in the associated Side Roads Order, within the Rassau Industrial Estate and north of Herrington Farm, Rassau, the other with the existing internal Rassau Industrial Estate road to be improved under the associated Side Roads Order (the new trunk roads 4 along this route being respectively given the reference numbers 17 and 18 on the deposited plan at Site Plan number 5A (as amended)).U.K.

10.  Grade separated junction between the properties known as Hirgan Farm and The Wells Farm, Beaufort Wells to the south-west of Rassau Industrial Estate. (Site Plan number 5A (as amended)). U.K.

11.  Two west facing routes some 0.26 kilometres and 0.47 kilometres in length to connect the westbound and eastbound carriageways of the main new trunk road with the roundabout to be constructed as part of the highway to be provided for in the associated Side Roads Order, south-west of the property known as The Wells Farm and north of the property known as Hirgan Farm, Beaufort Wells (the new trunk roads along this route being respectively given the reference numbers 19 and 20 on the deposited plan at Site Plan number 5A (as amended )). The route, reference number 19, starting at a point at a new roundabout 100 metres north of farmhouse at Hirgan Farm, terminating at a point where it meets the westbound carriageway of the main new trunk road 200 metres south-west of the farmhouse. U.K.

The route, reference number 20, starting at a point at a new roundabout 140 metres north of the farmhouse at Hirgan Farm, terminating at a point where it meets the eastbound carriageway of the main new trunk road 350 metres south-west of the farmhouse.

12.  Grade separated junction with the unclassified road leading northwards and the A4048 leading southwards from the existing Nant-y-Bwch roundabout. (Site Plans numbered 5 and 6 on the deposited plan numbered HA/10/2 – WO131 of the 1999 Order). U.K.

Four routes to connect the westbound and eastbound carriageways of the main new trunk road with a roundabout to be constructed as part of the highway to be provided for in the associated Side Roads Order, in the vicinity of the existing Nant-y-Bwch roundabout. The new trunk roads along these routes being respectively given the reference numbers 21 and 22 on the deposited plan at Site Plan number 5A (as amended) and 23 and 24 on deposited plan at Site Plan number 6 which remain unchanged as shown on the deposited plan numbered HA/10/2 – WO131 of the 1999 Order and which have been constructed under that Order. The route, reference number 21, some 0.26 kilometres in length starting at a point on south-eastern side of Nant-y-Bwch roundabout terminating where it meets the westbound carriageway of the main new trunk road 260 metres east of the roundabout. The route, reference number 22, some 0.32 kilometres in length starting at a point on the north-eastern side of Nant-y-Bwch roundabout terminating where it meets the eastbound carriageway of the main new trunk road 320 metres east of the roundabout.]

13.  Grade separated junction with the A469 leading to Rhymney. (Site Plan No. 6).U.K.

Four routes to connect the eastbound and westbound carriageways of the main new trunk road with two roundabouts to be constructed as part of the highway to be provided for in associated side roads Orders (the new trunk roads along the routes being respectively given the reference numbers 25, 26, 27 and 28 on the deposited plan at site No. 6).

14.  A route some 1.0 kilometres in length starting at a point on the south eastern side of the roundabout to be constructed as part of the main new trunk road at Dowlais Top (described in Schedule 3) and running in a generally south easterly direction including the new roundabout which joins the new trunk road (A4060) at a point approximately 320 metres north east of the junction of the A4060 and Blaen Dowlais Street (marked D on the deposited plan at site plan No. 7) and then at a point on the eastern side of the new roundabout running in a generally north easterly direction to meet the westbound carriageway of the main new trunk road east of Roadside Pond Reservoir, (the new trunk road along this route being given the number 29 on the deposited plan at site plan No.7).U.K.

15.  Grade separated junction with the unclassified road leading northwards to Merthyr Common. (Site Plan No. 7).U.K.

Three routes to connect the eastbound and westbound carriageways of the main new trunk road with a roundabout to be constructed as part of the main new trunk road (described in Schedule 3) which connects High Street and the unclassified road leading northwards to the retail park at Dowlais Top and onwards to Merthyr Common (the new trunk roads along these routes being respectively given the reference numbers 30, 31 and 32 on the deposited plan to site plan No. 7).

16.  A route some 0.3 kilometres in length starting at a point on the eastern side of Rocky Road 170 metres east of the new grade separated junction to be provided for in associated side roads Orders at Galon Uchaf, south of the trunk road and running in a generally easterly direction to meet the westbound carriageway of the main new trunk road south of the Pant Industrial Estate (the new trunk road along this route being given the number 33 on the deposited plan at site plan No. 8).U.K.

17.  A route to connect the eastbound carriageway of the main new trunk road with a roundabout to be constructed as part of the highway to be provided for in associated side roads Orders, south of Pant Industrial Estate (the new trunk road along this route being given the reference number 34 on the deposited plan at site plan No. 8).U.K.

18.  Grade separated junction with the unclassified road leading south to the Gurnos Estate and the private access road to Gurnos Farm. (Site Plan No.8).Two routes to connect the eastbound and westbound carriageways of the main new trunk road with two roundabouts to be constructed as part of the highway to be provided for in associated side roads Orders, north of the Gurnos Estate and east of Taf Fechan (the new trunk roads along these routes being respectively given the numbers 35 and 36 on the deposited plan at site plan No. 8).U.K.

19.  Grade separated junction with the Cardiff to Glan Conwy Trunk Road (A470) leading northwards to Brecon and southwards to Gellideg. (Site Plan No. 9).Four routes to connect the eastbound and westbound carriageways of the main new trunk road with a dumb-bell shaped roundabout to be constructed as part of the Cardiff to Glan Conwy Trunk Road (A470) (described in Schedule 3) to this Order at Cefn-Coed-y-Cymmer (the new trunk roads along these routes being respectively given the numbers 37, 38, 39 and 40 on the deposited plan at site plan No. 9).U.K.

20.  Grade separated junction at Baverstock. (Site Plan No. 10).Four routes to connect the eastbound and westbound carriageways of the main new trunk road with two roundabouts to be constructed as part of the highway to be provided for in associated side roads Orders, at Baverstock south west of the Baverstock Hotel and north east of Llwydcoed Crematorium (the new trunk roads along these routes being given the numbers 41, 42, 43 and 44 on the deposited plan at site plan No.10).U.K.

21.  Grade separated junction at Hirwaun Ponds. (Site Plan No. 11).U.K.

Four routes to connect the eastbound and westbound carriageways of the main new trunk road with a roundabout to be constructed as part of the highway to be provided for in associated side roads Orders, in the vicinity of the existing roundabout at Hirwaun Ponds (the new trunk roads along these routes being given the numbers 45, 46, 47 and 48 on the deposited plan at site plan 11).

[F422.  A route some 40 metres in length to connect the eastbound carriageway of the main new trunk road (A465) with Main Road, Gilwern commencing at a point on the main new trunk road (A465) 170 metres south west of the junction between School Lane and Main Road, Gilwern in a north easterly direction, to a point 130 metres south west of the 6 aforementioned junction (the new trunk road along this route being given the reference number 49 on the deposited plan at Site Plan number 2A as amended))]U.K.

SCHEDULE 3E+WROUTE OF THE NEW CONNECTING TRUNK ROADS

The route of the new East of Abercynon to East of Dowlais Trunk Road (A4060) is a route about 700 metres in length starting at a point some 45 metres north west of a point on the centreline of the existing trunk road (A4060) about 390 metres south west of the south eastern limit of Blaen Dowlais Street (marked C on the deposited plan at site plan No.7) running in a generally north easterly direction to a point some 320 metres north east of the southeastern limit of Blaen Dowlais Street (marked D on the deposited plan at site plan No.7) where it meets the new A465 slip road roundabout.

The route of the new Cardiff to Glan Conwy Trunk Road (A470) is a route about 460 metres in length forming a dumb-bell shaped grade separated junction centred on a point some 520 metres east of the property known as Ffrwd-ganol-fawr (marked F on the deposited plan at site plan No. 9).

The route of the new Neath to Abergavenny Trunk Road (A465) comprising a grade separated roundabout about 400 metres in length, centred on a point about 500 metres east of the south eastern edge of the Lower Reservoir, Dowlais Top (this route being given the reference letter E on the deposited plan at site plan No. 7) to connect with the slip roads.

[F5“The route of the Neath to Abergavenny Trunk Road (A465), comprising a grade separated link road and roundabout, to connect with Brynmawr Roundabout; two new slip roads; Old Abergavenny Road and the road leading to Hafod and the road leading to Brynmawr Foundation School (all to be realigned in the associated Side Roads Order); is a route about 680 metres in length (marked G to H on the deposited plan at site plan Nos. 3A and 4B) as follows:-

starting at a point on the south eastern side of the existing roundabout at Brynmawr (marked G on the deposited plan at site plan Nos. 3A and 4B) then in a south easterly direction for 200 metres, then in a north easterly direction for 220 metres over the main new trunk road (A465), to meet the southern side of a new connecting roundabout (to be constructed with a centre point 210 metres south east of the south eastern corner of Brynmawr Foundation School Sports Pitch and with a circumference of 140 metres), and to connect with a new slip road (described in Schedule 2 and being given the number 14 on the deposited plan at site plan Nos. 3A and 4B), and then continuing from the north western side of the new roundabout in a north westerly direction for 120 metres to connect with a new slip road (described in Schedule 2 and being given the number 13 on the deposited plan at site plan Nos. 3A and 4B) at a point 60 metres south of the south eastern corner of Brynmawr Foundation School Sports Pitch and 10 metres south of the road leading to Hafod (marked H on the deposited plan at site plan Nos. 3A and 4B)]
